Run a controlled comparison before assuming an online store personalized your price. Match the exact item, seller, options, location, account status and purchase conditions; check the price and the complete amount due before payment in separate browser profiles or devices; then repeat the check. A difference is a clue to investigate, not proof that personal data set your price.
What “personalized price” means
Personalized pricing is a price set with personal information about a shopper and an estimate of what that individual is willing to pay. The Federal Trade Commission (FTC) used that definition in a policy statement proposed for public comment in August 2026. The proposal distinguishes an individualized price from a market-wide change that affects people buying in the same market.

The distinction matters because several pricing practices can look identical on a single screen. A retailer may adjust prices as inventory falls, offer a local price based on your delivery area, show a member coupon, or add taxes and shipping at checkout. None of those observations, by itself, establishes that a system profiled you.

The FTC’s proposed 2026 statement was not a final rule or a categorical ban. The release set September 18, 2026 as the public-comment deadline. Nothing in the cited material establishes a final legal outcome, a universal consumer test or a finding about any particular retailer.

What information can be used to tailor an offer?
In initial staff findings released by the FTC in January 2025, the agency described materials from six intermediary respondents. Those materials identified possible inputs such as precise location, browsing history, demographic information, mouse movements and items left in a shopping cart. The examples were hypothetical and show that the mechanism is plausible; they do not show that a specific store uses each signal or that a particular price difference came from profiling.
Websites and apps can collect signals through cookies, pixels, device fingerprinting, app advertising identifiers and cross-device tracking. A site might recognize a signed-in account directly, infer a returning device, or combine activity across devices through an advertising or analytics system. You usually cannot see which signal, if any, affected a price.
There is no reliable prevalence number in the cited material. The 2025 FTC release said the six intermediaries it examined worked with at least 250 clients. That is a count of clients served by those intermediaries, not a count or percentage of retailers confirmed to personalize prices.

A useful test changes as few variables as possible. Write down the conditions first so that a lower number is not simply a different offer.
- Exact listing: use the same product URL, seller, model, size, color, quantity, condition and selected options.
- Timing: compare at approximately the same time. Prices and stock can change while you move between devices.
- Delivery details: use the same destination or ZIP code, currency, shipping method and delivery speed.
- Account state: record whether each browser is signed in, enrolled in a rewards program, using a membership benefit or eligible for a coupon.
- Browser and device state: note the browser, device, operating system and whether the session has stored cookies or a prior cart.
- Purchase conditions: keep quantity, payment method, subscription choice, protection plan and other add-ons the same.
Do not ask another person to compare an approximate substitute. A different seller, package size or delivery address can fully explain the result you see.

How to run the comparison step by step
- Open the exact listing. Copy the product URL and verify the seller and every selectable option. Take a screenshot showing those details.
- Set the same destination. Enter the same ZIP code or delivery address, select the same currency and choose the same shipping speed. If the site uses a location selector, record its setting.
- Record the first price. Capture the displayed listing price and any visible discount. Note the time to the minute, stock message and whether a coupon or membership label appears.
- Build the cart without paying. Add the same quantity and options. Keep shipping, taxes, mandatory charges, optional add-ons and discounts visible rather than relying on the headline price.
- Record the pre-payment total. Stop at the last screen before payment and save the full amount and each component. Do not place duplicate orders merely to test a price.
- Repeat in an independent session. Use a separate browser profile or another device. A private window can reduce some saved local data, but it does not make you invisible to the site during the session.
- Match account conditions deliberately. Either keep both sessions signed out or sign both into equivalent accounts. Record rewards enrollment, membership, coupon codes and cart history instead of assuming they match.
- Switch the order of the test. If possible, check the second session first on a later run. This helps reveal a simple time-based change that follows the clock rather than the browser.
- Repeat later. Re-run the same comparison after the discrepancy matters to you. A pattern that survives repeated, matched observations is more informative than one snapshot, but it still does not identify the cause by itself.
Keep an evidence record that another person could audit
A dated record makes it easier to spot an ordinary market or checkout explanation and gives a retailer clear information if you ask for clarification. Preserve the following for each session:

Store only the information you need. Screenshots can contain addresses, account names or order numbers; redact those before sharing them publicly.

Use the sequence below rather than labeling a result immediately.
First, verify that the products are truly identical
Marketplace pages may switch sellers, warehouses or fulfillment terms without making the difference prominent. Compare the seller name, condition, package size, quantity, color, storage or service tier and stock status. A different variant is a different offer.
Next, reconcile the transaction total
Compare the amount due before payment, not only the large number at the top of a product page. Shipping, taxes, mandatory ancillary charges and optional add-ons can appear later. The FTC’s fee guidance says the final amount must be disclosed before payment and explains when mandatory ancillary charges belong in that total.

Then check market and location explanations
Demand and inventory can move a price between two visits. Regional pricing can reflect delivery costs, local taxes, regulations or a different inventory pool. The FTC has said businesses may use demand- or inventory-based dynamic pricing when the information shown to shoppers is not misleading.

Finally, compare eligibility and history
A rewards account, membership, targeted coupon, first-order offer or abandoned-cart promotion can change the offer without changing the public price. Record whether each session has the same eligibility before treating the result as unexplained.

Does incognito mode change online prices?
A private browsing session may start without some cookies and local history and may delete local records when it closes. It does not prevent a website from seeing activity during the session. The FTC has identified cookies, pixels, device fingerprinting, app advertising identifiers and cross-device tracking as possible tracking methods.
Use a private window only as one controlled condition in your comparison. Keep the normal session as a separate condition and record both. Do not treat a lower number in a private window as proof that the site penalized your regular browser; the change could result from a missing coupon, a new cart, a different test bucket or a normal price update.
What privacy controls can and cannot tell you
Browser settings and site permissions
Review cookie controls, location permissions and the site’s privacy notice. Blocking some third-party cookies or denying location access can reduce certain signals, but the site may still use account information, first-party activity, device characteristics or information supplied by other services. A changed price under these settings does not identify which signal mattered.

Extensions and ad blockers
Some privacy extensions or ad blockers limit known trackers. FTC guidance cautions that they may not block every tracking technique. Test with the extension enabled and disabled only if you can keep all other conditions identical, and record the setting in your log.
Clearing cookies, changing devices or using a VPN
These actions can alter location, identity or stored-session signals, so they may be useful as optional comparison conditions. They are not guaranteed ways to obtain a lower price or reveal personalization. A VPN can change the apparent network location while leaving account, device or checkout information unchanged; it can also trigger fraud checks or a different regional catalog.

A listing-price comparison can miss charges added in the cart. For each session, separate:
- the advertised item price;
- discounts and coupon deductions;
- shipping and delivery fees;
- taxes or duties;
- mandatory service or ancillary charges; and
- optional protection, subscription or expedited-delivery add-ons.
Leave optional products unchecked when the comparison is supposed to cover the same purchase. If a fee is mandatory, record where it first appears and whether it is included in the amount shown before payment. A difference in tax or delivery cost is a difference in the transaction, not evidence that the base product price was individualized.

The cited FTC materials do not establish a trustworthy percentage or store count. The 2025 staff findings covered materials from six intermediaries and said those intermediaries worked with at least 250 clients, but that does not mean 250 retailers were confirmed to personalize prices. Without a defined population and a consistent test, a number would overstate what is known.

The same limitation applies to claims that a particular retailer is charging you a personalized price. The material supports investigating whether personal-data pricing is technically possible, not attributing an individual observation to a named company.
What the FTC materials say about enforcement
The FTC’s August 2026 release described a proposed policy statement and quoted Chairman Andrew Ferguson: “The FTC does not have the legal authority to ban personalized pricing in all circumstances, but businesses that fail to tell consumers how their personal data is being used to set a price may be in violation of the FTC Act and other laws we enforce.” The statement was proposed for comment, with September 18, 2026 given as the comment deadline in the release. Treat that context as part of the quote; it is not an enacted ban or a ruling on your purchase.
An earlier FTC release in January 2025 quoted Chair Lina M. Khan saying: “Initial staff findings show that retailers frequently use people’s personal information to set targeted, tailored prices for goods and services—from a person’s location and demographics, down to their mouse movements on a webpage,” The release described initial findings and hypothetical examples, not a determination that a specific shopper’s price was set this way.
What to do when a discrepancy persists
- Finish the controlled log. Add the repeated observations, session order and every matched condition.
- Ask the retailer a precise question. Include the product URL, seller, time, destination, displayed price, final pre-payment total and screenshots. Ask what explains the difference and which fees or promotion terms applied.
- Keep the response with your record. Save the date, channel and wording. Do not edit screenshots in a way that removes the conditions needed to understand them.
- Consider a complaint if you believe information was misleading. Describe observable facts and attach the record. Avoid claiming that profiling or unlawful conduct has been proved when the evidence shows only a price difference.
Do not place duplicate orders, create accounts with false information or evade fraud controls to gather evidence. Those actions can create new pricing and security variables and may violate a site’s terms.
Common testing mistakes and fixes
- Comparing different products: copy the URL and verify every option instead of relying on a product title.
- Testing hours apart: run sessions close together and reverse their order on a repeat run.
- Ignoring the delivery address: use the same ZIP code and shipping method; regional inventory can change both price and availability.
- Mixing account states: sign both sessions in or keep both signed out, and record rewards status.
- Stopping at the listing page: continue to the final pre-payment screen so taxes, shipping and mandatory fees are visible.
- Assuming private browsing is anonymous: treat it as a different test condition, not a shield from tracking.
- Drawing a conclusion from one observation: repeat the comparison and check demand, inventory, seller and promotion explanations first.
- Publishing personal data in screenshots: redact addresses, payment details, account identifiers and order numbers before sharing.
A compact repeatable checklist
- Same URL, seller, model, variant, quantity and condition.
- Same time window, destination, currency and shipping method.
- Same account, rewards, coupon and membership conditions.
- Separate browser profiles or devices with their states recorded.
- Screenshot the listing price and every checkout component.
- Capture the complete amount due before payment.
- Repeat later and reverse which session you check first.
- Rule out inventory, demand, region, seller, promotion, tax, shipping and fee differences.
- Describe a persistent gap as an observation and preserve the record; do not present it as proof without additional evidence.
Bottom line
The strongest practical approach is a controlled, repeated comparison of identical offers under identical conditions, with both the advertised price and the final pre-payment total recorded. Privacy settings can change some signals but cannot certify that a store did or did not personalize a price. The FTC materials show why personal-data pricing is plausible while leaving the cause of any individual price difference unresolved.
