Then verify that entity in the relevant regulator’s register, confirm the specific activities it is allowed to perform, read how your assets are held, and identify the complaint or compensation routes that actually apply. “Regulated” can mean only anti-money-laundering registration or a narrow permission; it does not mean your crypto is insured or guaranteed.
Why a “regulated” label is not enough
Crypto exchanges often serve customers through several companies. A single brand may use one entity for customers in the United States, another for the United Kingdom and separate entities for European Union countries. Those companies can have different licences, custody arrangements, terms and complaint procedures.

Regulatory status is also activity-specific. A firm may be permitted to provide a particular trading service but not lending, staking, brokerage, securities dealing or custody. In some regimes, registration primarily confirms anti-money-laundering and counter-terrorist-financing controls. It is not an endorsement of the business, the tokens it lists or the safety of customer assets.

Crypto holdings generally do not receive the same automatic protections as money in an insured bank account or securities in a protected brokerage account. Step 1: identify your jurisdiction and the contracting entity
Before comparing fees, find out which company will legally contract with you. Your country, state or territory can determine the entity, available products and applicable law.
Find the legal name
- Open the exchange’s account terms, privacy notice or legal disclosures.
- Record the complete company name, incorporation country and registered address. Note any company number or licence number.
- Check the onboarding screen and account-opening agreement for a statement identifying the entity serving your country.
- Confirm that the name on the agreement matches the name in the regulator’s official register. A brand name, domain name or group parent is not a substitute.
If the terms do not clearly identify the contracting company, treat that as a material information gap. Do not assume the best-regulated company in the group holds your account.
Match the entity to the service you need
List what you intend to do: spot trading, derivatives, brokerage, transfers, custody, staking, lending or securities transactions. Verify each activity separately. A registration that covers wallet transfers may not cover a lending product, and permission to arrange trades may not authorize the firm to hold client assets.

Use the regulator’s own register rather than a badge, press release or list on the exchange’s website. Search the exact legal entity and inspect the status, permissions, conditions and effective dates.
Check the status details
- Active or current: A historical approval, withdrawn registration or expired transitional status is not current authorization.
- Permission scope: Read the activities and products named in the record. “Registered” without a service description is incomplete.
- Restrictions: Look for limitations on customers, geography, assets, custody, marketing or transaction size.
- Legal entity: Confirm that the register entry is the same company named in your contract.
- Warnings: Search the regulator’s warning, enforcement and consumer-alert pages for the entity and its trading names.
Save a dated copy or screenshot of the entry when you open an account. Regulatory records and permissions can change, and the status on the day you deposit funds is the relevant one.
What the main regimes mean in practice
United States: verify the asset and the service
U.S. protections depend on whether a transaction involves a security, commodity, money transmission or another regulated activity. On March 17, 2026, the Securities and Exchange Commission and Commodity Futures Trading Commission issued a joint interpretation addressing crypto-asset classification and transactions under federal securities laws. SEC Chairman Paul S. Atkins described the action by saying, “This is what regulatory agencies are supposed to do: draw clear lines in clear terms.” That statement concerns the interpretive action; it is not a declaration that every crypto asset or exchange is a registered securities exchange.
The SEC’s Investor.gov alert explains that registration obligations can apply to particular securities offerings and intermediaries. It also warns about platforms that combine exchange, broker-dealer and custody functions. Check the particular service and asset instead of relying on a general “U.S. regulated” statement. A money-services registration, for example, does not by itself establish securities-exchange status.

Federal and state requirements may both matter. A platform may use different entities or licenses for money transmission, commodities, securities or custody. The absence of a securities registration may be lawful for a service that does not involve securities, but it should be clear from the terms what legal framework applies.
United Kingdom: what FCA registration means
The Financial Conduct Authority requires businesses within the existing Money Laundering Regulations cryptoasset regime to register before operating in scope. The FCA states that this registration is an anti-money-laundering and counter-terrorist-financing requirement, not an endorsement. It does not itself give customers Financial Ombudsman Service or Financial Services Compensation Scheme protection.
The FCA’s broader Financial Services and Markets Act cryptoasset regime was passed in 2026. Its activity-specific rules and guidance were published on June 30, 2026, with the broader regime expected to apply from October 25, 2027. Until that start date, an FCA cryptoasset registration should not be described as full authorization for every future regulated activity. Check the firm’s current entry, any transitional provisions and the particular product you want to use.
Direct cryptoasset investments are not FSCS-protected, according to the FCA’s consumer warning. The absence of FSCS cover is distinct from whether a firm is registered for AML purposes or will be subject to wider conduct and custody rules in the future regime.
European Union: perform a MiCA scope check
The European Supervisory Authorities’ consumer factsheet, updated in October 2025, distinguishes services covered by the Markets in Crypto-Assets Regulation or other EU financial-services legislation from services outside those frameworks. Services outside the relevant framework may involve significant risks and limited or no consumer protection.
Check the European Securities and Markets Authority register and the information published by the national authority in your country. A platform being accessible from Europe does not prove that every entity, service or country is authorized. Confirm whether the permission covers the service you are selecting and whether the entity is operating under a valid transition or full authorization.
Does MiCA protect my crypto?
MiCA can establish conduct, disclosure and authorization requirements for covered crypto-asset services, but it is not a blanket guarantee against losses. First determine whether your exchange, entity and product fall within MiCA or another EU financial-services regime. If they do not, the ESAs warn that protections may be limited or absent.

MiCA scope also does not answer the insolvency question by itself. Read the custody and client-asset provisions in the exchange’s terms, find out who controls the keys, and establish what claim you would have if the operator failed. Keep the authorization check and the asset-recovery check separate.

Step 2: understand custody, ownership and insolvency risk
Regulatory status cannot tell you who can move your coins. Ask how the exchange holds them and what legal rights you retain.
Questions to answer before depositing
- Who controls the private keys? In a custodial account, the exchange or its custodian generally controls the keys and records your contractual interest. In a self-custody arrangement, you control the keys and also bear the loss risk if they are destroyed or stolen.
- Are customer assets segregated? Determine whether customer assets are kept separately from the firm’s own assets and whether segregation applies on-chain, in bank accounts, or only in internal records.
- What does “ownership” mean? Terms may describe customers as having a beneficial, contractual or proprietary interest. Read the insolvency section for the process of returning assets and the treatment of any shortfall.
- Can the firm rehypothecate or lend assets? Staking, lending, margin and yield features can change how assets are used and the priority of your claim.
- Where are assets held? A third-party custodian, omnibus wallet or overseas affiliate may introduce additional legal and operational risks.
- How do withdrawals work? Check limits, review periods, identity checks, supported networks, suspension rights and whether the firm can pause withdrawals during an investigation or insolvency event.
The SEC warns that customers of crypto-asset entities may lose access to accounts or be unable to retrieve assets during platform distress. A permission to operate does not eliminate that operational risk.
Is my crypto insured if an exchange goes bankrupt?
Usually, you should assume no automatic insurance unless the exchange and the relevant scheme expressly confirm otherwise for your exact asset and account. The SEC says accounts at crypto-asset entities do not receive the same protections it describes for FDIC-insured bank deposits or SIPC-covered securities. The FCA says direct cryptoasset investments are not FSCS protected.
Insurance, investor compensation and a claim in insolvency are different concepts:
Recommended Free Tools
| Protection question | What it would cover | What you must verify |
|---|---|---|
| Deposit insurance | Certain eligible bank deposits up to scheme limits | Whether your balance is a qualifying bank deposit, not a crypto balance or exchange IOU |
| Investor compensation | Eligible investments when a covered firm cannot return them, subject to rules and limits | Whether the asset, entity and service are within the scheme; crypto is often excluded |
| Private insurance | A policy may cover specified theft, operational loss or custody events | Policy holder, exclusions, limits, deductibles and whether customers are insured beneficiaries |
| Insolvency claim | Your contractual or proprietary claim against the failed firm or segregated assets | Priority, segregation, governing law, set-off rights and recovery procedure in the terms |
Do not treat a statement that the company is “insured” as proof that your individual holdings are protected. Ask for the named policy, covered assets, event definitions and claim process.
Step 3: compare exchanges on the protections that matter
When two or more exchanges remain after the legal-status check, compare them on the same criteria. Counting regulator logos rewards marketing rather than protection.

| Criterion | Comparison questions | Evidence to record |
|---|---|---|
| Jurisdiction and entity | Which company contracts with a resident of your country? | Legal name, address, company number and governing law |
| Regulator and activity | Which authority supervises the exact service? | Register entry, permission wording, conditions and status date |
| Regime | Is the service covered by securities, commodities, AML, MiCA, FSMA or another framework? | Applicable law and any transition or territorial limitation |
| Custody | Who controls keys and may use or lend assets? | Custody policy, segregation language and insolvency treatment |
| Complaints | Can you use an ombudsman, compensation scheme or only the firm’s process? | Eligibility, exclusions, deadlines and escalation route |
| Access and withdrawals | Can you withdraw promptly and independently? | Limits, holds, network support, suspension clauses and recovery steps |
A provider with fewer listed regulators may offer clearer custody and complaint terms than a provider displaying many registrations. Compare the substance of each permission, not the number of jurisdictions in a footer.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How do I check a crypto exchange’s licence?
- Write down your location. Use the country where you are resident and, where relevant, your state or province. Availability from an IP address is not the same as authorization for residents.
- Capture the contracting entity. Copy the full legal name from the account agreement and note the services you plan to use.
- Search the official register. Use the regulator’s register, not a search advertisement or a third-party directory.
- Read the permission description. Confirm that it covers trading, brokerage, custody, lending, staking or securities dealing as applicable.
- Check status and conditions. Look for active, restricted, transitional, suspended or withdrawn status and read attached conditions.
- Search warnings and enforcement. Check the regulator’s consumer warnings, disciplinary notices and restrictions using both the legal name and trading names.
- Reconcile the documents. The register, exchange terms and privacy notice should identify the same entity. Investigate any mismatch before depositing.
- Document the result. Save the register entry and key terms with the date, then set a reminder to recheck them if you keep a long-term balance.
Complaint routes and exclusions
Find the complaint path before you need it. The exchange should state how to submit a complaint, the response timetable, escalation contact and governing law. Then determine whether an independent ombudsman or compensation scheme can review your case.
Read exclusions carefully. A scheme may cover a regulated investment service but exclude direct cryptoasset holdings, unregulated lending, staking rewards, transactions through an overseas affiliate or losses caused by market movements. “Complaints accepted” does not mean compensation is available.
Keep transaction IDs, wallet addresses, account statements, identity-verification correspondence and withdrawal requests. These records can establish what happened and which entity handled the transaction.
Warning signs that should stop a comparison
- The site says “fully regulated” but does not name the legal entity or regulator.
- The register entry exists, but its permission does not cover the product being advertised.
- The exchange asks you to rely on a parent company’s licence while your contract is with an affiliate.
- Custody terms allow broad reuse, lending or rehypothecation without explaining your claim if assets are missing.
- Withdrawal rights are discretionary, indefinitely suspendable or unclear about supported networks.
- The firm promises insurance without naming the insurer, policy, limits and beneficiary status.
- Marketing emphasizes regulator count but omits warnings, restrictions, transition status or complaint exclusions.
- You cannot identify an official register entry for the exact entity after searching legal and trading names.
Practical decisions for common situations
You only want occasional spot purchases
Choose an entity with a verifiable permission for the service in your jurisdiction, transparent custody terms and workable withdrawals. Do not pay extra for a “regulated” label if the permission is only an AML registration and the account has no applicable compensation protection; understand the limitation instead.
You plan to stake, lend or use margin
Re-run the authorization check for each feature. These products can involve a different entity, separate terms, counterparty exposure and different asset treatment from ordinary spot trading. A spot-trading permission is not evidence that lending or staking is authorized.
You are comparing a U.S. platform with an EU or UK platform
Do not compare jurisdictions as if one offers universal protection. Compare the entity, asset classification, custody model, complaint route and exclusions for your own residence. A U.S. securities interpretation, a UK AML registration and an EU MiCA authorization answer different legal questions.
The exchange’s status changed after you opened the account
Save the notice, read the revised terms and identify whether the change affects your entity, products or withdrawal rights. Consider withdrawing assets you do not need to keep in custody while you verify the new status. Do not assume that a brand-wide announcement applies to your account.
A concise pre-deposit checklist
- My country and the account’s contracting entity are identified.
- The entity appears in the relevant official register.
- The permission covers the exact service and asset I intend to use.
- The status is active, and I understand any restriction or transition date.
- I know who controls the keys and whether assets are segregated.
- I have read the insolvency, lending, staking and withdrawal clauses.
- I know whether an ombudsman or compensation scheme applies and what it excludes.
- I have checked regulator warnings and enforcement notices.
- I understand that crypto is not automatically covered by bank deposit insurance or investor compensation.
- I can withdraw and retain records if the platform becomes unavailable.
The result of this process is not a guarantee that an exchange will be safe or profitable. It is a documented judgment about which legal entity, permissions and customer-asset arrangements fit your circumstances, with the remaining risks made explicit.
