An approved I-140 does not, by itself, let you move an employment-based green card case to a new employer. Most applicants use AC21 portability only after the properly filed I-485 has been pending for at least 180 calendar days, the I-140 is approved (or ultimately approved), the case is in EB-1, EB-2 or EB-3, and the new offer is permanent and in the same or a similar occupational classification. The 180-day clock starts with the I-485 receipt date—not the I-140 approval date. Portability is normally requested with Form I-485 Supplement J while the I-485 remains unadjudicated.
What an approved I-140 does—and does not—allow
Form I-140 approval establishes that the employment-based immigrant petition met the petition requirements when USCIS approved it. It does not automatically transfer that petition to another employer, and it does not by itself make a new job acceptable for your pending adjustment application.

Changing employers without filing a new adjustment case generally depends on section 204(j) of the Immigration and Nationality Act, commonly called AC21 portability. USCIS describes portability as using a qualifying new permanent job offer for an eligible pending Form I-485. The new employer does not simply take over the old I-140. Instead, you ask USCIS to accept the new offer for the pending adjustment case.

- Your employment-based category is EB-1, EB-2 or EB-3.
- You are the beneficiary of an approved I-140, or a pending I-140 that USCIS ultimately approves.
- Your properly filed I-485 has been pending for at least 180 calendar days when USCIS receives the portability request.
- The I-485 is still pending and has not already been adjudicated.
- The new offer is permanent and in the same or a similar occupational classification as the job described in the underlying petition.
- You request portability, normally by filing Form I-485 Supplement J.
If one of these requirements is missing, an approved I-140 or retained priority date may not be enough to finish the green card case through the new job.
The three protections people often confuse
Immigration cases involve three related but different protections. Treating them as interchangeable is a common reason people believe a job change is safe when it is not.
| Question | AC21 portability for a pending I-485 | Retention of an approved I-140 | Priority-date retention |
|---|---|---|---|
| What it preserves | The ability to rely on a qualifying new permanent job offer for an eligible pending adjustment case | The approved petition’s continuing validity after certain withdrawals or business-termination events | The earlier priority date for use with a later qualifying employment-based petition |
| Main timing rule | I-485 pending at least 180 days when USCIS receives the portability request | Generally, 180 days after I-140 approval or at least 180 days of associated I-485 pendency, depending on the withdrawal circumstances | Usually follows from a petition that remains eligible for date retention; it is not itself a portability request |
| New-job requirement | Yes. The offer must be permanent and in the same or a similar occupational classification | No. Petition validity does not create a new qualifying job | No. A retained date does not supply an employment offer |
| Typical filing or action | Form I-485 Supplement J | No portability form; the issue arises when USCIS evaluates withdrawal, termination or revocation | A later employment-based petition may use the retained date |
| Important limit | The I-140 must be approved or ultimately approved, and other adjustment requirements still apply | USCIS can still revoke for substantive grounds | Date retention does not guarantee adjustment approval or permit adjustment through any employer |
The Department of Homeland Security’s November 18, 2016 final rule discusses these protections separately. A retained date is not the same thing as a portable job offer.

For AC21 portability, count from the date USCIS properly received the I-485, not from the I-140 approval date, the priority date, the labor-certification date or the date you started working.
USCIS states in Volume 7, Part E, Chapter 5 of its Policy Manual: “For portability purposes, counting the number of days the adjustment application has been pending begins on the day the applicant properly filed the adjustment application with USCIS and includes every subsequent calendar day until USCIS receives the applicant’s request to port (so long as the application remains unadjudicated).”

How to apply the rule to your case
- Find the I-485 receipt notice and identify the date USCIS accepted a properly filed application.
- Count every calendar day from that filing date. The threshold is 180 days, not 180 business days.
- Confirm that the I-485 remains pending. A case that has already been approved cannot be ported through Supplement J.
- Make sure USCIS receives the portability request after the threshold has been reached. Filing or delivery problems can create a timing dispute, so retain proof of delivery.
An I-140 approval issued six months after the I-485 was filed does not reset or replace the I-485 clock. Conversely, an I-140 approved long ago does not let you port immediately if the I-485 has been pending for fewer than 180 days.
What the new job must look like
The replacement position must be a new, permanent job offer in the same or a similar occupational classification as the job in the underlying petition. The test concerns the occupational classification, not merely whether the job title is identical. A different title can still be similar; an identical title with materially different work may raise questions.
Information to compare before you move
- The core duties and level of responsibility in the old and new positions.
- The occupational classification used for the original petition and the classification that best describes the new role.
- The required education, experience and specialized skills.
- Whether the new position is permanent rather than temporary or contingent.
- Whether the offer is full-time in the sense required for the employment-based category and petition.
Keep the original job description, the I-140 filing materials available to you, the new employer’s detailed offer letter and a written explanation of why the occupations are the same or similar. USCIS makes a case-specific determination; no single job-title match guarantees approval.
The new offer may be with the original petitioner, a different employer or, as described in the USCIS Policy Manual, self-employment. The employer change itself is not the legal test. The permanent offer and occupational similarity are.
How to request portability with Supplement J
USCIS requires Form I-485 Supplement J for portability requests made on or after January 17, 2017. Use the current form edition and filing instructions in effect when you file; USCIS editions, addresses and supporting-document requirements can change.

- Confirm the case category. Verify that the underlying petition is EB-1, EB-2 or EB-3 and identify the I-140 receipt number, approval status and priority date.
- Verify the I-485 timeline. Use the I-485 receipt notice to establish the proper filing date and confirm that at least 180 calendar days will have elapsed when USCIS receives Supplement J.
- Check that the I-485 is still pending. Review USCIS case notices and any transfer, interview or request-for-evidence history. Portability is for an unadjudicated adjustment application.
- Obtain a qualifying offer. The new employer, or you where self-employment is involved, must provide a permanent offer in the same or a similar occupational classification.
- Complete Supplement J accurately. Match names, receipt numbers, job information and employer details to the underlying case and the new offer. The employer generally signs the required certification for an employee position.
- Assemble evidence. Include the new offer and supporting job details, the I-485 receipt information, the I-140 approval information when available, and any explanation needed to show occupational similarity.
- File using the current USCIS instructions. Confirm the filing address and whether the form is being submitted with another filing or separately. Keep a complete copy and delivery confirmation.
- Respond to USCIS follow-up. A request for evidence, notice of intent or interview question about the job, petition or adjustment eligibility must be answered by the stated deadline.
Supplement J is a request for portability; filing it before the 180-day requirement is met does not create eligibility. If the I-140 is still pending, portability can depend on USCIS ultimately approving that petition.
What happens if the original employer withdraws the I-140?
Withdrawal timing affects whether the approved I-140 remains valid, but it is a separate analysis from whether you can port to the new job.
Withdrawal before the relevant protection period
When the petitioner withdraws an approved I-140 before 180 days have elapsed since approval, and the associated I-485 has either been pending for fewer than 180 days or has not been filed, USCIS generally automatically revokes the I-140 approval. In that situation, an approved petition may not remain available for portability or priority-date purposes.
Withdrawal after 180 days
If the withdrawal occurs 180 or more days after I-140 approval, or the associated I-485 has been pending for at least 180 days, the petition generally remains valid for priority-date retention. That does not eliminate the requirements for portability. You still need the 180-day I-485 period, a qualifying same-or-similar permanent job and an approved or ultimately approved petition. USCIS may also revoke an I-140 for substantive grounds, such as a finding that it was not approvable when filed or involved fraud or willful misrepresentation.
Business closure or termination can raise similar questions. Continued petition validity, priority-date retention and portability must each be evaluated under their own rules.

Priority-date retention does not let you use any new job
A priority date is a place in the visa-availability line. If an approved petition qualifies for retention, you may be able to use that earlier date with a later qualifying employment-based petition. The date does not independently authorize adjustment of status through a new employer.
For example, a person whose former employer withdraws an I-140 after the applicable protection period may retain the earlier priority date but still need a new employment-based petition if the person is not eligible to port the pending I-485. The later petition must qualify on its own, and the person must still satisfy adjustment requirements when a visa is available.

| Issue | AC21 portability | Priority-date or petition retention |
|---|---|---|
| Purpose | Use a new permanent job for a pending I-485 | Preserve the earlier petition’s approval or priority date for future use |
| Timing | I-485 pending at least 180 days when USCIS receives the request | Generally tied to 180 days after I-140 approval or 180 days of I-485 pendency, depending on the event |
| Job test | Same or similar occupational classification is required | No job offer is created by retention |
| Form | Supplement J | A later petition may be required; no Supplement J substitute exists for a new petition |
| Outcome | The pending adjustment case may continue with the new offer if all requirements are met | The date or petition may remain usable, but adjustment is not guaranteed |
Practical timing scenarios
I-140 approved, I-485 pending 90 days
You generally cannot rely on AC21 portability yet. The I-140 approval does not start the 180-day portability period. Leaving the sponsoring job before the threshold can create risk, particularly if the employer withdraws the petition or USCIS questions the original job offer.
I-140 approved, I-485 pending 180 days or more
You may be eligible to port if the case is EB-1, EB-2 or EB-3, the I-485 remains pending, the new offer is permanent and same or similar, and Supplement J is properly filed. Eligibility is not automatic; the petition and adjustment must still satisfy all other requirements.
Do these 3 things before closing this tab:

Petition or priority-date retention may still be possible, but the unrelated job does not satisfy the same-or-similar requirement for portability. If you need adjustment through that employer, a new employment-based petition may be required.

The I-485 is approved before the job change
There is no pending I-485 to port. The consequences of leaving the job can involve other immigration rules and facts not addressed by AC21 portability; obtain case-specific advice before changing employment.
Ability-to-pay guidance for certain pending-I-140 portability cases
In January 2024, USCIS announced prospective guidance for described cases in which a beneficiary moves under AC21 while the I-140 is pending. USCIS said its ability-to-pay review looks at facts from the priority date through the I-140 filing date. The announcement applies to petitions filed on or after publication of that guidance.
This is a narrow rule about evaluating the underlying petition. It does not mean the new employer automatically inherits the former employer’s petition obligations, and it does not remove the requirement that the I-140 be ultimately approved before portability can succeed.

- Counting from I-140 approval. Use the I-485 receipt date for the AC21 clock.
- Assuming 180 days means six months exactly. USCIS describes the period as 180 calendar days; count the actual dates and allow time for USCIS receipt.
- Changing jobs before the I-485 threshold. An approved I-140 alone does not provide the portability protection.
- Filing Supplement J too early. The form cannot create eligibility before the I-485 has been pending for 180 days.
- Relying on a similar-sounding title. Compare duties and occupational classification, not just the title.
- Confusing a retained priority date with a portable case. A date can be preserved while a new petition is still required.
- Ignoring petition withdrawal or revocation history. Timing and the reason for withdrawal matter, and substantive revocation grounds remain possible.
- Using an outdated form or address. Check the current USCIS edition, instructions and filing location before sending anything.
- Failing to document delivery. Keep a copy of every filing and evidence that USCIS received the request.
Pre-filing checklist
- I-140 category is EB-1, EB-2 or EB-3.
- I-140 is approved, or you understand that it must ultimately be approved if still pending.
- I-485 was properly filed and the receipt date is documented.
- At least 180 calendar days will have elapsed before USCIS receives the portability request.
- I-485 remains pending and unadjudicated.
- New offer is permanent and clearly describes the position.
- Old and new roles can be explained as the same or similar occupational classification.
- Supplement J is the current edition and all signatures and receipt numbers are accurate.
- You have considered any withdrawal, termination, revocation or business-closure event involving the original petition.
- You have checked current USCIS instructions and considered obtaining individualized immigration advice.
What this rule cannot answer by itself
No general checklist can determine whether a particular job is similar enough, whether a petition remains approvable, or whether an adjustment application has another eligibility problem. The result can depend on the I-140 category and status, the exact I-485 receipt and adjudication history, the duties and classification of both jobs, and any withdrawal or revocation facts.
USCIS Policy Manual Volume 7, Part E, Chapter 5 is the primary policy reference for portability. The DHS final rule published November 18, 2016 supplies the regulatory background, and the January 2024 USCIS announcement addresses the limited ability-to-pay point described above. Verify the current form edition, filing address and case-specific requirements before filing.
