A viable challenge depends on the exact query, how much movement information it assembled, the officers’ stated legal authority and investigative purpose, and what the agency’s logs show about access, sharing, retention, and use.
Ask a licensed lawyer in the relevant state and court to preserve and obtain the records, then evaluate a suppression motion or another remedy. Courts have reached different results: a Norfolk trial judge required a warrant but was later reversed by the Virginia Court of Appeals; a Northern District of Ohio judge denied suppression on the record before that court; and a separate constitutional case involving Norfolk remained on appeal in the American Civil Liberties Union’s April 20, 2026 update. None of those decisions creates a nationwide rule.

What a Flock-data challenge is really about
Flock cameras photograph passing vehicles and record information such as a plate image, time, location, and vehicle characteristics. An agency can later search its database. The constitutional issue is usually not the existence of one photograph by itself, but what officers acquired and how they used it.

The second type of search may support a stronger argument that police obtained a detailed record of movements. The Northern District of Ohio emphasized that its ruling addressed only the facts and record presented, not every possible ALPR search.

Police access can also matter even when the underlying camera captured a vehicle in public. Your lawyer should determine whether officers:
- searched one plate, a vehicle description, a “hot list,” or another identifier;
- set a date range, radius, route, or number of cameras that produced a prolonged movement history;
- combined Flock results with other databases, cellphone information, toll records, or investigative files;
- shared the results with another department or jurisdiction; and
- used the result to obtain a stop, warrant, interview, arrest, or other investigative step.
Those details can affect whether the acquisition or use is treated as a Fourth Amendment search, whether a warrant or exception was required, and whether later evidence should be suppressed.
First steps after learning police used Flock data
- Contact local counsel promptly. Suppression procedures and filing deadlines vary with the state, court, charge, and stage of the case. The available authorities do not establish a deadline that can safely be applied nationwide.
- Preserve every document you already have. Keep the citation, arrest paperwork, search-warrant materials, discovery, reports, body-camera references, and messages that mention a plate, vehicle fingerprint, Flock, or ALPR. Do not alter metadata or delete messages.
- Tell counsel exactly what you know. Record when you learned of the search, which agency was involved, the alleged offense, the vehicle or plate involved, and any date or location mentioned by an officer.
- Ask for a preservation request. An attorney can ask the agency, prosecutor, and any participating department to preserve query logs, returned images, audit records, sharing records, and related evidence before routine retention settings remove them.
- Do not try to access an agency account. Unauthorized access can create separate legal problems and will not substitute for formal discovery, a subpoena, or a public-records request.
How to build the Fourth Amendment argument
Identify the government action
Separate the camera’s initial observation from the later police search. Counsel should identify who operated the camera, who queried the database, what interface or account was used, and whether a private operator retained or processed the information for the government. The relevant government acquisition may be the query, the export of results, or the use of a compiled movement record rather than the instant a camera photographed a plate.

Measure the scope of the query
Document the date range, geographic area, cameras included, number of sightings, and whether the results were organized into a route or timeline. A request that returns one observation may be materially different from one that maps repeated appearances throughout a city. The record should show the actual settings and results, not merely an investigator’s later description.
Test the asserted legal basis
Ask whether officers relied on a warrant, consent, an emergency theory, a statutory authorization, agency policy, or an exception to the warrant requirement. Obtain the warrant application and affidavit if a warrant was issued. Compare what the affidavit said with what the Flock log shows: the dates searched, cameras selected, identifiers entered, and results returned.
If there was no warrant, counsel can assess whether the government’s theory fits the particular facts. A court may consider the public nature of a plate observation, the amount of historical data assembled, the sensitivity of the location record, and the practical ability to reconstruct a person’s movements. Do not treat any one factor as automatically decisive.

Connect the search to the evidence
A suppression motion generally needs a link between the challenged acquisition and evidence the prosecution wants to use. Counsel may ask whether Flock results led to a traffic stop, a vehicle search, an identification, a warrant, an interview, or another investigative act. If the government claims an independent source, inevitable discovery, or good-faith reliance, the timing and content of the records become important.

What the current cases actually decided
The decisions below involve different courts, records, and procedural postures. They should be compared rather than treated as conflicting nationwide rules.
| Case or proceeding | Court and date | Issue and result | What it does not establish |
|---|---|---|---|
| Commonwealth v. Church (trial ruling) | Norfolk Circuit Court; later reversed | The trial court reasoned that Flock’s collection and storage of license-plate and location information constituted a Fourth Amendment search requiring a warrant. | It is not the current controlling Virginia result because the suppression ruling was reversed. |
| Commonwealth v. Church (appellate result) | Virginia Court of Appeals; October 14, 2025 ruling as quoted in Flock Safety’s account | The appellate court reversed, reasoning that the system photographed the plate and vehicle as they traveled on public thoroughfares and that a warrant was not required on those facts. | The quoted reasoning does not approve every possible query or prolonged movement-history search. Verify the official opinion when relying on the quotation. |
| United States v. No. 1:22-cr-00615-JPC | U.S. District Court for the Northern District of Ohio; June 9, 2025 | Judge J. Philip Calabrese denied the defendant’s suppression motion. | The opinion expressly limited its analysis to the facts and record before the court; it is not a categorical approval of all Flock searches. |
| Schmidt v. City of Norfolk | U.S. District Court for the Eastern District of Virginia; discovery opinion filed August 15, 2025 | The opinion recited allegations about cameras, vehicle fingerprints, a centralized database, and the ability to link sightings into movement records while deciding a discovery motion. | It was not a final merits finding that Norfolk violated the Constitution. |
| Schmidt v. Norfolk status update | ACLU update dated April 20, 2026 | The ACLU reported that the broader challenge to Norfolk’s ALPR tracking was before the Fourth Circuit and concerned tracking drivers’ movements. | The update does not establish the appeal’s status as of October 2026. |
| Massachusetts public-records proceeding | Suffolk Superior Court; decision reported September 2, 2026 | A public-records order required disclosure of camera locations and redacted audit records. | It concerns transparency access, not a criminal defendant’s automatic entitlement to the same records in discovery. |
The Norfolk trial opinion included this statement: “Here, the Court finds the collection and storage of license plate and location information by the FLOCK system constitutes a search within the meaning of the Fourth Amendment and should require a warrant.” Because the later appellate ruling reversed that result, the quotation is best used to explain one trial-level rationale, not to state current Virginia law.

Records that can make the challenge concrete
Ask counsel to seek records tailored to the actual investigation. A broad request for “everything about Flock” may be resisted or produce irrelevant material. Useful categories can include:
- Query and audit logs: the account, officer, date and time, search terms, filters, selected cameras, date range, geographic radius, and reason or case code.
- Results returned: the images, vehicle fingerprints, confidence information, exports, screenshots, and notes created from the search.
- Access and sharing history: every officer, agency, fusion center, or outside jurisdiction that viewed, downloaded, or forwarded the result.
- Retention and preservation information: the applicable policy, contract, account setting, evidence hold, deletion event, and any explanation for missing records.
- Investigative use: reports, warrant affidavits, stop documentation, interview notes, and communications showing how the result influenced the next step.
- System and policy documents: the department’s ALPR policy, training materials, search-reason requirements, and rules governing cross-jurisdiction access.
These are issue-spotting categories, not a promise that every item is discoverable in every court. Discovery rights, privilege claims, protective orders, and authentication requirements depend on local law and the procedural posture of the case.
How to find out when your plate was searched
Criminal case discovery
Have counsel request the query and audit records through the ordinary criminal-discovery process and, when necessary, seek a court order. Ask for the original electronic records and a custodian or analyst who can explain the fields. A report that says an officer “ran the plate” may not reveal whether the search covered one camera or a citywide historical period.

Subpoenas and third-party records
If a vendor, neighboring department, or regional system holds relevant logs, counsel can evaluate a subpoena or other process authorized by the court. The correct recipient and procedure vary; a private request does not compel production.
Public-records requests
Residents, journalists, and advocates may use state public-records laws to seek policies, camera locations, contracts, and redacted audit material. The September 2, 2026 Massachusetts disclosure account illustrates that route. It does not decide what a prosecutor must disclose to a criminal defendant, and exemptions, fees, response times, and appeal rights are state-specific.
Retention, sharing, and the seven-day announcement
Retention rules can determine whether a useful log still exists. In an August 2026 response, the ACLU described Flock’s announced change from a standard 30-day retention period to seven days and raised questions about how “Evidence Mode” handles queried data, search reasons, and audit assistance. Those statements are an account of the announcement, not proof of the settings in a particular department’s account.
An agency may have different contractual terms, statutory limits, evidence holds, or local policies. Ask for the governing agreement and the account-specific retention history. If a department says records were deleted, counsel can examine the deletion policy, whether a litigation or evidence hold should have stopped deletion, and whether copies remain in reports, exports, backups, or another agency’s system.
Common mistakes that weaken a challenge
- Claiming a blanket rule: neither “Flock always requires a warrant” nor “public plates are never protected” accurately describes the authorities summarized above.
- Relying on a headline instead of the record: the number of cameras, observations, dates, and filters used in your case matter more than a generic description of the vendor.
- Confusing litigation types: a discovery ruling, a public-records order, a civil-rights case, and a criminal suppression decision answer different questions.
- Ignoring appellate posture: the Norfolk trial ruling was reversed, and the separate Norfolk constitutional case had a dated appellate-status update rather than a final result in the materials available here.
- Waiting for records to disappear: short retention settings make a prompt preservation request important.
- Filing without checking local procedure: the motion title, evidentiary hearing process, service rules, and deadline depend on the forum and charges.
A practical decision framework for counsel
| Question | Why it matters | Evidence to locate |
|---|---|---|
| What exactly was searched? | Distinguishes a single observation from aggregated tracking. | Query filters, date range, radius, camera list, search terms, returned results. |
| Who searched and under what authority? | Tests warrant, exception, policy, and attribution. | Account identity, warrant or affidavit, policy, training record, reason code. |
| How long and how broadly was movement reconstructed? | Shows the privacy impact of the acquisition. | Timeline, number and distribution of sightings, route map, exports. |
| What happened afterward? | Connects the search to suppressible evidence. | Stop report, warrant application, arrest records, interviews, investigative notes. |
| Who else received the data? | May reveal additional searches, witnesses, or preservation locations. | Sharing and access logs, interagency messages, download history. |
| Does a remedy remain available? | Procedure and timing can control even a strong factual argument. | Charging documents, docket entries, local rules, appeal posture, counsel’s deadline analysis. |
If the judge denies suppression
Ask counsel to identify the precise ruling: whether the court found no search, found a search but an exception, rejected a factual foundation, or applied a remedy limitation. A clear record may matter for reconsideration, an interlocutory request where allowed, or an appeal after final judgment. The available authorities do not establish which route or deadline applies in your court.
A separate civil-rights or public-records strategy may exist, but it has different standing, immunity, exhaustion, pleading, and remedy requirements. Do not assume that a public-records win produces suppression or that a suppression ruling automatically produces damages.
