Changing employers can be possible while a U.S. employment-based green card application is pending, but only when the case fits the AC21 portability rules. In the usual adjustment-of-status scenario, your Form I-485 must have been pending for at least 180 days, and the new, bona fide full-time permanent job must be in the same or a similar occupational classification as the job tied to the immigrant petition. Category, petition, visa-availability, work-authorization and case-history details can change the result.
What “changing employers” means in a pending green-card case
This article addresses employment-based adjustment of status in the United States, where the applicant has filed Form I-485. It does not treat every employment-based category or every job move alike. The relevant protection is commonly called AC21 job portability, under section 204(j) of the Immigration and Nationality Act.

Under qualifying circumstances, the approved employment-based immigrant petition can remain usable for adjustment purposes even after the applicant moves to another employer. USCIS says an applicant seeking AC21 portability generally does not need to ask the agency to transfer the pending I-485 to a new petition or basis. The new position still must satisfy the same-or-similar occupational-classification requirement and the offer must be genuine and prospective.

The first test: has the I-485 been pending 180 days?
The 180-day requirement concerns the period that a properly filed Form I-485 has been pending. It is a legal threshold, not a statistic about approval rates or how long applicants usually wait.

- Confirm that the I-485 was properly filed and remains pending.
- Do not assume that filing an I-140, receiving an employment-authorization document, or working for the sponsoring employer for 180 days automatically satisfies the rule.
- Because case events can affect the calculation, verify the filing and receipt history before relying on portability.
USCIS describes the 180-day condition in its Policy Manual chapter on transfer of an underlying basis. The Form I-485 Supplement J instructions retrieved for the December 23, 2022 edition state the same minimum pendency period; check USCIS for the current edition before preparing a filing.
The second test: is the new job in the same or a similar occupational classification?
AC21 does not require the new employer or job title to be identical. USCIS frames the inquiry around occupational classification. A matching title by itself is not enough, and a different title does not automatically disqualify a move.
Compare the actual original and proposed positions. Assemble evidence showing what each job entails and how the two occupations relate. The record should allow USCIS to evaluate the positions rather than relying on a bare statement that they are “similar.” A material change in duties or occupational field can create a problem even when the employer uses familiar words in the title.
Do these 3 things before closing this tab:

Which employment-based cases can use AC21 portability?
USCIS identifies certain adjustment applicants in the EB-1, EB-2 and EB-3 employment-based categories as potentially eligible. The category label alone is not a guarantee; the petition, adjustment filing and job offer must also meet the applicable requirements.
The AC21 portability mechanism described here does not apply in the same way to petitions based on extraordinary ability or to national-interest-waiver cases. Those classifications have different job-offer structures. Do not treat an extraordinary-ability or national-interest-waiver case as if it were an ordinary employer-sponsored portability case.
If you are unsure which subcategory your case uses, check the approved I-140 and the basis listed for the I-485. A case that has changed categories or petitions may require a separate analysis.

These two procedures are often confused but have different purposes and timing.
| Issue | AC21 job portability | Transfer of the underlying basis |
|---|---|---|
| What the applicant is asking for | Use the existing employment-based petition for adjustment while moving to a qualifying same-or-similar job. | Have USCIS adjudicate the pending I-485 using another petition or immigrant category. |
| Is a new basis-transfer request required? | USCIS says an eligible portability applicant does not need to request transfer of the I-485 to a new petition or basis. | The applicant asks USCIS to transfer the adjustment application and supplies evidence for the new basis. |
| Timing | The I-485 generally must have been pending at least 180 days. | Continuing eligibility, evidence, visa availability where applicable and other requirements apply; timing is not the same as ordinary job portability. |
| Agency decision | The request is evaluated under the portability rules and the job-match evidence. | USCIS states that the decision to grant or deny a transfer request is always discretionary. |
| Different employment-based category | Changing employers alone does not create a new immigrant category. | If the applicant requests a transfer to a different employment-based category based on a new I-140, USCIS says portability cannot be used until at least 180 days after making that transfer request, if portability otherwise applies. |
The distinction is set out in USCIS’s Chapter 8, Transfer of Underlying Basis. The 180-day rule tied to a category-transfer request is not a universal reset triggered by every employer change.

What kind of offer is required?
The new position must be a bona fide, full-time, permanent job offer that the applicant intends to accept when adjustment of status is approved. This is a prospective offer; it is not merely proof that the applicant is currently working somewhere.
USCIS uses Form I-485 Supplement J to confirm a bona fide job offer or request portability under INA section 204(j). The instructions identify a properly filed I-485 pending at least 180 days and an underlying I-140 naming the applicant as the principal beneficiary as conditions for requesting portability.
The retrieved Supplement J instructions are dated December 23, 2022. USCIS may update forms and instructions, so use the current edition and filing directions shown on the agency’s website. The instructions also explain that Supplement J addresses the prospective offer and does not determine whether the applicant currently has work authorization with the prospective employer.
Do not infer from a portability filing that you may immediately work for the new employer. Work authorization, nonimmigrant status and any employment restrictions are separate questions.

A practical decision process before accepting a new job
- Identify the adjustment basis. Review the I-140 approval and I-485 receipt to determine the employment-based category and whether the case is employer-sponsored, extraordinary ability or national interest waiver based.
- Confirm the I-485 timeline. Locate the I-485 receipt date and verify that the application has been properly filed and pending for at least 180 days. If a basis-transfer request is involved, identify the date of that request separately.
- Compare the occupations. Obtain the original petition’s job description and the proposed employer’s detailed, signed description. Compare actual duties and occupational classifications, not titles alone.
- Check the offer terms. Confirm that the new offer is full-time, permanent, bona fide and intended to be accepted once adjustment is approved.
- Prepare the evidence. Keep the offer letter, job descriptions, organizational or employment records and documents that explain the occupational relationship. The evidence should address the positions actually being compared.
- Decide whether Supplement J is appropriate. Use the current USCIS form edition and instructions, and follow the filing method applicable to your case.
- Review independent case issues. Check petition validity, priority-date and visa availability, nonimmigrant status, employment authorization, travel plans and derivative applications before resigning or starting work.
- Get case-specific advice when facts are close. A move across occupations, a category change, a questionable petition history or a pending transfer request can make a general portability explanation unreliable for your record.
Illustrative situations
Move after the 180-day threshold
An applicant in a potentially covered employer-sponsored category has a properly filed I-485 pending for more than 180 days and receives a permanent, full-time offer whose duties fall in the same or a similar occupational classification. That fact pattern may support AC21 portability, subject to the petition and evidence requirements.
Move before 180 days
An applicant changes jobs while the I-485 has been pending only 120 days. The ordinary portability threshold has not yet been reached. The applicant should not treat the future 180-day date as retroactive permission or assume the case is protected simply because the eventual date will pass.
Extraordinary-ability or national-interest-waiver case
An applicant’s I-140 is based on extraordinary ability or a national interest waiver. The employer-sponsored AC21 mechanism described in this article is not the correct framework for treating that case as portable. The applicant needs an analysis based on the classification’s own requirements.
Transfer to a different employment-based category
An applicant asks USCIS to move the pending I-485 to a new I-140 and a different employment-based category. That request has its own evidence, continuing-eligibility, visa-availability and discretionary considerations. USCIS states that, when portability otherwise applies, the applicant cannot use portability until at least 180 days after making that transfer request.
Employment authorization, travel and status remain separate
AC21 portability does not answer every practical question created by a job change. The ability to work for the proposed employer depends on the applicant’s current work-authorizing basis and the conditions attached to it. A Supplement J filing is not itself an employment-authorization document.
Travel plans, maintenance of nonimmigrant status, dependents’ filings and employment-authorization renewals can affect the case independently of whether the new job appears same or similar. Do not quit, begin the new job, travel internationally or rely on a particular document solely because the 180-day date has passed.

Petition validity and visa availability also matter. A portability analysis cannot establish from the general rule whether a particular I-140 remains valid, whether a priority date is available or how a derivative applicant’s case will be handled.
Common mistakes that can put a case at risk
- Counting the wrong 180 days: using time employed, I-140 processing time or work-authorization time instead of I-485 pendency.
- Relying on a title match: assuming identical titles prove occupational similarity without comparing duties and evidence.
- Treating every category alike: applying the employer-sponsored portability rule to extraordinary-ability or national-interest-waiver cases.
- Confusing portability with a basis transfer: filing or discussing a new I-140 as though it were only an employer change.
- Using an outdated form: submitting Supplement J without checking the current USCIS edition and instructions.
- Assuming portability grants work permission: overlooking separate employment-authorization and status requirements.
- Ignoring case-specific history: failing to examine petition validity, visa availability, travel, derivatives or prior requests.
Official guidance to check before filing or changing jobs
USCIS’s Policy Manual, Volume 7, Part A, Chapter 8 explains transfers of an underlying basis, AC21 portability, the 180-day condition and category limits. USCIS’s November 17, 2020 policy alert, Job Portability after Filing Application to Adjust Status, describes the consolidated policy guidance on evaluating same-or-similar occupations and portability requests. The retrieved Form I-485 Supplement J instructions are dated December 23, 2022; verify the current form and instructions on USCIS before use.
Bottom line
A pending employment-based green-card application may survive an employer change through AC21 portability when the case is in a covered category, the properly filed I-485 has been pending at least 180 days, and the new offer is bona fide, full-time, permanent and in the same or a similar occupational classification. Portability is not the same as transferring the I-485 to a new basis, and neither procedure by itself resolves work authorization, travel, visa availability or petition-validity questions. Treat the 180-day date as the beginning of a case-specific review, not as automatic permission to change jobs.
