Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteFor most goods and services covered by the 56th GST Council’s rate revision, the new rates apply from 22 September 2025. The date is not universal: cigarettes, zarda and other chewing tobacco, unmanufactured tobacco, and beedi remained on their existing GST rates and compensation cess until a later date was notified. For every invoice, test the product classification and the three relevant events—supply, invoice and payment—under section 14 of the Central Goods and Services Tax Act, 2017.
Buying goods before a rate change does not preserve the old rate. GST is levied on supply, so stock supplied on or after the effective date generally uses the revised rate. A rate change also does not automatically turn every later document into a “revised invoice”; the correction document, return treatment and deadline depend on the exact facts and applicable notification.

Key dates and rules at a glance
| Question | Rule to apply |
|---|---|
| When did most 56th Council rate changes start? | 22 September 2025, for the goods and services included in the notified revision. |
| Were all products covered on that date? | No. Cigarettes, chewing tobacco products such as zarda, unmanufactured tobacco and beedi kept their existing GST rates and compensation cess pending a later notified date. |
| Which rate applies to old inventory? | The rate in force when the outward supply occurs. The purchase or stocking date alone does not decide the rate. |
| How are cross-date transactions tested? | Use CGST Act section 14, comparing the supply date with invoice issue and receipt-of-payment dates. |
| Must an e-way bill be replaced solely because the rate changed? | No. An existing e-way bill remains valid for its original validity period. |
| Does every post-change invoice count as a revised invoice? | No. The revised-invoice rule cited in the CBIC invoice provisions has a specific retrospective-registration context; a rate change by itself is not a blanket trigger. |
The Ministry of Finance FAQ on the 56th GST Council decisions, posted 3 September 2025, supplies the broad effective date and transition answers. The actual rate for an invoice still depends on the relevant rate notification and the precise classification of the supply.
When the revised GST rates took effect
For the ordinary categories covered by the 56th Council’s rate decisions, the effective date was 22 September 2025. “Effective” means the date from which the notified rate applies to the relevant taxable supply; it does not mean that every item a business owns is revalued on that day.

The official FAQ expressly separated specified tobacco products from the general implementation date. Cigarettes, chewing tobacco products including zarda, unmanufactured tobacco and beedi continued at their existing GST rates and compensation cess until a later date was notified. A business dealing in one of those products should not apply 22 September 2025 merely because it is the headline date for other sectors.
Check the product or service before using the date
- Identify the exact HSN or SAC classification used on the invoice.
- Read the rate notification that covers that classification, including any conditions, exemption wording or separate commencement date.
- Check whether the supply is a tobacco exception or another category with its own implementation provision.
- Retain the notification and classification analysis with the transaction file so an auditor can see why the rate was selected.
The 57th GST Council meeting on 8 October 2026 made recommendations on process and clarification matters. The PIB release states that those recommendations take effect only through the relevant circular, notification or amendment. A council recommendation, without that legal instrument, is not a substitute for the rate notification in force on the invoice date.
Old stock: the rate follows the supply
The Ministry of Finance FAQ answers the common question, “If I already have stock on the date when rate changes come into effect, should I apply the revised rate?” with the principle that GST is levied on supply. Goods bought or manufactured under the former rate do not retain that rate indefinitely. If the taxable outward supply occurs on or after the revised rate’s effective date, the revised rate generally applies, even when the inventory was purchased or held earlier.

What to do in your inventory system
- Freeze a cut-off report showing quantities and locations at the change date. This is an audit trail, not a reason to preserve the old rate.
- Map each stock-keeping unit to its current HSN and the applicable notification.
- Configure the sales-tax code by supply date and classification, rather than by purchase batch alone.
- For sales straddling the date, record the dispatch, delivery or other legally relevant supply evidence used to establish when the supply occurred.
- Review customer price lists and contracts separately. A commercial price agreed before the change may require a tax-inclusive recalculation even though the tax rate is determined under GST law.
Do not reduce output tax merely because the input invoice for the inventory shows the former rate. Input tax credit is considered by reference to the inward supply and statutory conditions, while output tax is determined for the later outward supply.
Cross-date transactions: apply section 14, not a single-date shortcut
Section 14 of the CGST Act governs a change in the rate of tax for goods or services. It tests whether the supply took place before or after the change and then compares the invoice date with the date payment was received. The result is a statutory time-of-supply date; it is not always the invoice date.
| Supply timing | Invoice and payment timing | Time-of-supply date under section 14 |
|---|---|---|
| Before the rate change | Invoice and payment both after the change | Earlier of payment receipt or invoice issue |
| Before the rate change | Invoice before the change; payment after | Invoice issue date |
| Before the rate change | Payment before the change; invoice after | Payment receipt date |
| After the rate change | Invoice before the change; payment after | Payment receipt date |
| After the rate change | Invoice and payment both before the change | Earlier of payment receipt or invoice issue |
| After the rate change | Invoice after the change; payment before | Invoice issue date |
How to determine the payment date
For section 14, receipt of payment is the earlier of the date the amount is entered in the supplier’s books or the date it is credited to the supplier’s bank account. A proviso substitutes the bank-credit date where that credit occurs more than four working days after the rate-change date. Keep the bank statement, ledger posting and remittance advice together; a vague “customer paid around the cut-off” description is not enough.

Worked examples
- Supply before 22 September, invoice on 24 September, payment on 30 September: because both invoice and payment follow the change, section 14 uses whichever of those two events occurs first.
- Supply before 22 September, invoice on 20 September, payment on 5 October: the invoice date controls this combination.
- Supply after 22 September, invoice on 20 September, payment on 25 September: the payment date controls this combination.
- Supply after 22 September, payment on 20 September, invoice on 25 September: the invoice date controls this combination.
These examples illustrate the matrix; they do not override a product-specific notification, place-of-supply rule or a different statutory fact pattern.
Advances paid before or after the change
An advance does not create a universal “old rate” or “new rate” rule. The official FAQ directs taxpayers to the time-of-supply provisions in section 14 where the supply is incomplete or the invoice has not been issued. Establish the supply status, invoice date and receipt-of-payment date, then apply the corresponding statutory combination.
Advance review checklist
- Was the amount actually credited to the supplier’s bank account, and when was it entered in the books?
- Had the goods or services been supplied, in whole or in part, before the rate changed?
- Was a tax invoice issued, and does it meet the applicable invoice requirements?
- Does a special rule apply to the particular service, continuous supply or category?
Document the conclusion with the contract, delivery or completion evidence, receipt record and invoice. Avoid using the payment date in isolation.

Invoices after a rate change: when is a document actually “revised”?
Tax invoices must show the applicable rate and tax amount, along with the other particulars required by the CGST invoice rules. The rules also contain particulars for revised invoices and for credit and debit notes. However, the revised-invoice provision identified in the CBIC text concerns supplies made during the period between the retrospective effectiveness of a supplier’s registration and the issue of the registration certificate. That is a specific registration situation, not a general rate-change instruction.
Therefore, an invoice issued after 22 September 2025 is not automatically a revised invoice. First determine the correct time of supply under section 14 and the rate notification. If an invoice already issued contains the wrong rate, the appropriate correction document, return adjustment and deadline must be checked against the facts and the applicable notification and correction provisions. The materials do not support one universal document or deadline for every rate-change error.

Controls for issuing or correcting an invoice
- Record the classification, supply date, invoice date and payment-receipt evidence.
- Recalculate the tax using the rate legally applicable to that time of supply.
- Compare the draft document with the mandatory invoice fields, including rate and tax amount.
- If a prior document is wrong, identify whether the law calls for a credit note, debit note, another adjustment or no replacement document.
- Check the relevant return period and statutory time limit before posting the adjustment.
Do not label a document “revised invoice” merely to explain a price change. The legal document type should match the provision authorising it.

Input tax credit when rates change
The FAQ states that a registered person may claim input tax charged at the rate in force at the time of the inward supply, subject to the normal statutory conditions and restrictions. A supplier’s earlier purchase of stock does not, by itself, invalidate the tax shown on the supplier’s later purchase invoice.
Credit properly availed in the electronic credit ledger can be used against output tax liability under section 49(4). A later reduction in the output rate does not automatically erase eligible credit. The important exception is a change that makes the outward supply exempt: for supplies from the exemption date, input tax credit may have to be reversed as required by the Act.
ITC review questions
- Was there a valid tax invoice and a genuine inward supply?
- Was the credit taken at the rate applicable when that inward supply occurred?
- Were the statutory possession, receipt, payment and return conditions met?
- Is the related outward supply still taxable, or did it become exempt from the change date?
- Can the ledger, purchase register and reversal calculation be reconciled to the return?
E-way bills for goods already in transit
A rate change alone does not require mandatory cancellation and fresh generation of an e-way bill. The existing e-way bill remains valid for its original validity period, according to the official FAQ. Transport records should still match the actual consignment, invoice and vehicle details. Generate a replacement only when another legal or factual change independently requires one, not simply because the tax rate changed.

- Identify the legal date: start with 22 September 2025 for covered categories, then verify exceptions and later notifications.
- Build a transaction triad: capture supply completion or dispatch evidence, invoice issue timestamp and payment receipt evidence.
- Run the section 14 matrix: classify the transaction by before/after supply and invoice/payment combinations.
- Validate the code: confirm HSN or SAC, rate, exemption status and any product-specific condition.
- Reconcile stock and sales: ensure old purchase batches are not forcing an obsolete output rate.
- Check ITC: preserve eligible inward credit and calculate any reversal for newly exempt outward supplies.
- Review documents: verify invoice fields, correction-document authority and return deadlines before altering an issued document.
- Retain evidence: store notifications, contracts, delivery records, bank credits, ledgers, invoices and e-way bills together.
Common mistakes and how to avoid them
- Using the purchase date for old stock: replace it with the outward supply analysis.
- Assuming the invoice date always wins: section 14 uses different combinations of supply, invoice and payment dates.
- Treating an advance as decisive by itself: apply the statutory time-of-supply facts, including payment-receipt definition.
- Applying 22 September to every tobacco product: verify the exception and later notified date.
- Calling every correction a revised invoice: identify the legally applicable document and deadline.
- Reissuing e-way bills automatically: the rate change alone does not invalidate an existing bill.
- Reversing all ITC after an output-rate reduction: distinguish a lower taxable rate from a newly exempt outward supply.
- Implementing a Council recommendation before notification: wait for the circular, notification or legislative amendment that gives it legal force.
What to verify before filing or advising a customer
Because section 14 outcomes can change with a single date or classification, a reviewer should be able to reproduce the result from the file. Confirm the exact notification, the tax period, the supplier and recipient status, the nature of the supply, and whether a special rule applies. For an already-issued invoice, obtain professional advice or a written tax position before choosing a correction mechanism; the legally correct treatment is fact-specific and cannot be inferred from the words “rate change” alone.
