Discord’s Arbitration Clause: What It Does—and How to Opt Out

By TheFinanceBase Team 10 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: Discord’s current Terms of Service generally require people who reside in the United States or Canada to resolve most covered disputes through individual, binding arbitration instead of a conventional court case—unless they qualify for an exception or timely opt out. The current opt-out window is generally 30 days after September 29, 2025, or 30 days after first registering the account, whichever is later.

That does not mean Discord has eliminated every possible lawsuit. The Terms preserve certain small-claims and intellectual-property disputes, and opting out of arbitration does not automatically cancel the separate class-action waiver or every other litigation restriction.

What Discord’s current arbitration clause means

Discord’s current Terms of Service are effective September 29, 2025, and were last updated on August 29, 2025. For residents of the United States and Canada, the dispute-resolution section contains an “Agreement to Arbitrate.”

The clause is written broadly. It covers many disputes arising from the relationship between a user and Discord, the Terms, or use of Discord’s services. The language reaches claims based on contract, tort, statutes, fraud, and misrepresentation, among other theories.

Unless an exception applies or the user successfully opts out, the agreement generally means:

  • the dispute must first go through Discord’s required informal-resolution process;
  • if that process fails, the dispute may proceed to individual binding arbitration rather than a traditional court case;
  • the user generally cannot pursue the claim as part of a class or representative proceeding; and
  • the arbitrator, rather than a judge, generally decides covered disputes and may have authority to decide whether the arbitration agreement applies.

“Discord is voiding your right to sue” is therefore an understandable headline, but it is not a precise description. The clause changes the forum and generally limits collective litigation; it does not eliminate every individual remedy or every possible court proceeding.

Arbitration is not the same as having no legal remedy

In arbitration, an arbitrator—not a judge or jury—resolves the dispute in a private proceeding. Discord’s Terms say the arbitrator may award the relief that would otherwise be available in court under applicable law or equity. The important difference is usually the process, location, publicity, review rights, and ability to combine claims with other users—not necessarily the complete disappearance of an individual claim.

Federal law generally favors enforcement of written arbitration agreements, including under the Federal Arbitration Act. That does not make every clause automatically enforceable. Ordinary contract defenses, statutory protections, the type of claim, procedural requirements, and the user’s location can all matter. The Terms themselves are Discord’s contractual position; a court ultimately determines enforceability when a dispute is litigated.

What you must do before suing or starting arbitration

Discord’s Terms require a written informal-dispute notice before a user starts a lawsuit or arbitration. The notice must be sent to [email protected].

According to the current Terms, the notice should include:

  • your name;
  • the email address or phone number associated with your Discord account;
  • a detailed description of the problem; and
  • the resolution you want.

The user and their counsel must also be personally available for a telephone or videoconference about the dispute unless Discord waives that requirement in writing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the dispute is not resolved within 60 days after Discord receives the written notice, the parties may move to the formal dispute-resolution provisions. The Terms state that this informal process is a prerequisite to a formal proceeding. They also state that applicable limitation periods, filing fees, and other deadlines are tolled while the informal process is underway.

Do not confuse the two email addresses. An opt-out notice goes to [email protected]. A notice about an existing dispute goes to [email protected]. Sending one does not automatically accomplish the purpose of the other.

What happens if you do not opt out

For covered disputes involving U.S. and Canadian residents, the Terms say that after the informal process fails, either party may initiate binding arbitration as the sole means of resolving the dispute.

The current agreement also attempts to apply broadly to certain claims that arose before the agreement existed and to claims arising after the agreement or the user’s relationship with Discord ends. It gives the arbitrator broad authority to decide questions about the agreement’s interpretation, applicability, enforceability, or formation, subject to the exceptions written into the Terms.

Individual claims generally replace class or representative claims

The Terms separately restrict collective litigation. For U.S. residents, the class-arbitration and collective-relief language generally says that claims may be brought only in an individual capacity—not as a plaintiff or class member in a class or representative proceeding.

There is an important distinction here: opting out of arbitration is not the same as opting out of the class-action waiver. The current Terms say that a person who opts out of arbitration is not opting out of any other provision. As a result, the class-action waiver, one-year deadline for bringing an action, governing-law provision, and venue provisions may still matter after an arbitration opt-out, subject to applicable law.

How to opt out of Discord arbitration

The current Terms say a user may decline the Agreement to Arbitrate—but not the other provisions of the Terms—by emailing an opt-out notice to:

[email protected]

The notice must be sent within:

  • 30 days after September 29, 2025; or
  • 30 days after you first register your Discord account;

whichever date is later.

For a new account created after September 29, 2025, the practical deadline is generally 30 days after the account’s first registration. For an account created on or before September 29, 2025, the effective-date window generally ended 30 days after September 29, 2025. Continued use of Discord does not, by itself, create a new general opt-out period under the current Terms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Suggested opt-out email

The current Terms do not prescribe a specific form or template. A clear written notice that identifies your account and rejects the arbitration agreement is the safer practical approach. For example:

Subject: Discord Agreement to Arbitrate Opt-Out
I am opting out of Discord’s Agreement to Arbitrate in the Terms of Service. My name is [full name]. The email address associated with my Discord account is [account email], and my Discord username or user ID is [optional identifier].

Do not add language purporting to reject the entire Terms unless that is genuinely what you intend and you have obtained appropriate legal advice. Discord’s clause specifically says the opt-out applies to the Agreement to Arbitrate and not to the other provisions.

Preserve proof

Keep a copy of the exact email you sent, the timestamp, the sending address, the account-associated email address, any Discord username or user ID included, and any delivery confirmation or response. Save the applicable version of the Terms as well.

Evidence matters because a disagreement may later arise about whether the notice was timely, whether it identified the correct account, or whether it was actually sent and received. A sent-email record is useful, but it is not a guarantee that a court will accept the opt-out or that every future claim can proceed in court.

Which disputes can still go to court?

Discord’s Terms preserve several categories of possible court proceedings.

Small claims

The Terms include a small-claims exception for qualifying disputes that fall within the relevant court’s jurisdiction. Whether a particular case qualifies depends on the applicable small-claims court’s rules, monetary limits, subject-matter jurisdiction, and other requirements.

Intellectual-property disputes

The Terms state that disputes involving certain intellectual-property rights are not subject to arbitration. The listed categories include patents, copyrights, moral rights, trademarks, trade secrets, and claims of piracy or unauthorized use of Discord’s services.

Other court proceedings

For disputes that are not arbitrable, the current Terms designate courts in New Castle County, Delaware, including for specified arbitration-related litigation. The Terms also select U.S. and California law except where applicable law prohibits that choice.

These provisions do not necessarily control every user. Mandatory consumer protections may apply in some jurisdictions, including protections for European Union consumers expressly preserved by the Terms. The Agreement to Arbitrate described here expressly addresses residents of the United States and Canada; readers elsewhere should not assume the same dispute provisions apply.

What opting out does—and does not—do

Opting out generally does Opting out does not necessarily do
Reject Discord’s Agreement to Arbitrate for the user who sends a timely notice. Cancel the rest of Discord’s Terms of Service.
Preserve the possibility of a judge or jury trial where applicable law permits one. Guarantee that every dispute can be brought in court.
Prevent Discord from being bound by the arbitration agreement as well, according to the opt-out language. Automatically restore class-action or representative-proceeding rights.
Remove the current and prior arbitration provisions between the user and Discord, according to the clause. Eliminate filing deadlines, venue rules, governing-law provisions, or other contractual restrictions.

A practical decision checklist

  1. Identify your location. Confirm whether you reside in the United States or Canada, because the current Agreement to Arbitrate expressly applies to those residents.
  2. Find the relevant Terms. Confirm that the version you are reviewing is the current Terms effective September 29, 2025, or identify the version that governed when the relevant event occurred.
  3. Determine when the account was first registered. The opt-out deadline is tied to both the current effective date and first registration, with the later date controlling.
  4. Calculate the 30-day window. If the later triggering date has already passed, the current Terms do not appear to provide a new general opt-out period simply because you continue using Discord.
  5. Send the opt-out to the correct address. Use [email protected], not the dispute-notice address.
  6. Identify the account clearly. Include your name and the account email address or phone number. Adding a username or user ID can reduce ambiguity.
  7. Save proof. Retain the email, timestamp, account information, Terms version, and any response or delivery record.
  8. Handle an existing dispute separately. If you already have a dispute, review the informal-resolution requirements and send the required written notice to [email protected].
  9. Check all remaining restrictions. Even after opting out, review the class-action waiver, one-year claim deadline, venue, governing-law, small-claims, and intellectual-property provisions.

Common mistakes to avoid

  • Using the wrong email address: an opt-out belongs at [email protected]; an informal dispute notice belongs at [email protected].
  • Relying on an old deadline: Discord’s 2018 explanation mentioned a 90-day opt-out period, but that historical statement is not the current rule. The current Terms state 30 days.
  • Using the April 2024 deadline: Discord’s April 2024 Terms also used a 30-day rule tied to April 15, 2024 or account registration. That language is historical and superseded by the current Terms.
  • Assuming the opt-out is retroactive in every situation: The current clause addresses current and prior arbitration provisions, but how it affects a specific already-accrued claim can depend on timing, contract formation, and applicable law.
  • Assuming opting out restores class rights: The Terms expressly say the opt-out is limited to arbitration and does not reject other provisions.
  • Waiting until a dispute becomes urgent: A missed contractual deadline or separate one-year limitation provision can materially affect a claim. Preserve documents and get advice promptly.
  • Calling the opt-out a guaranteed lawsuit: It preserves the possibility of a court trial only as permitted by applicable law; it does not guarantee a favorable forum, jurisdiction, or result.

Historical context: why older articles may be misleading

Discord has used arbitration and class-action language before the current Terms. In an October 16, 2018 explanation, Discord said it had added an arbitration and class-action waiver clause, limited the clause to U.S. users, and extended the then-applicable opt-out period from 30 to 90 days.

That explanation should not be used to calculate the current deadline. Discord’s April 2024 Terms used a different 30-day trigger tied to April 15, 2024 or account registration. The current Terms now use September 29, 2025 and first registration, whichever is later.

When researching a contract dispute, always match the notice deadline to the version of the agreement and the account or event date involved. Search results often preserve superseded terms long after a company changes them.

When to get legal help

General information cannot determine whether a particular claim is covered, whether Discord properly formed an agreement with you, whether an exception applies, or whether a limitation period has expired. Consider speaking with a licensed attorney if you have an existing dispute, a significant payment or privacy claim, a possible class action, an intellectual-property issue, a jurisdiction question, or uncertainty about the opt-out deadline.

For general education only, readers can also review consumer rights legal information about arbitration clauses. Educational material is not individualized legal advice, and an attorney or qualified legal-aid organization must evaluate the facts and location of a specific dispute.

Frequently Asked Questions

Can Discord users still sue Discord?

Sometimes. For U.S. and Canadian residents, the current Terms generally direct covered disputes into individual binding arbitration unless the user timely opts out. Small-claims and certain intellectual-property disputes are expressly excluded from arbitration, and other legal exceptions may apply.

What is Discord’s arbitration opt-out email address?

The current Terms identify [email protected]. An opt-out email is different from the informal dispute notice, which goes to [email protected].

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How long do I have to opt out of Discord arbitration?

The current Terms state that the notice must be sent within 30 days after September 29, 2025, or within 30 days after first registering the account, whichever is later.

Does opting out of arbitration restore class-action rights?

Not necessarily. Discord’s current Terms say the opt-out applies to the Agreement to Arbitrate and not to other provisions. The separate class-action waiver may therefore remain relevant, subject to applicable law.

Does the 2018 90-day opt-out period still apply?

No. The 90-day period described in Discord’s 2018 explanation was historical. The current Terms use a 30-day period with the September 29, 2025 or first-registration trigger.

The Bottom Line

Bottom line: Discord’s current U.S. and Canadian Terms attempt to require individual binding arbitration for most covered disputes, but they provide a limited opt-out route. If the applicable 30-day window is still open, email a clear notice to [email protected], identify the account, and preserve proof. If you already have a dispute, separately follow the informal-resolution process at [email protected]. Opting out does not automatically remove Discord’s class-action waiver, deadlines, venue rules, or other Terms.
