BitMEX faces reported UK High Court claim for about $27m in bitcoin over alleged unlicensed derivatives

BitMEX is facing a reported £20 million (about $27 million) claim in England’s High Court from UK software engineer Lewis Barber. Barber says the crypto exchange sold derivative contracts to him without the Financial Conduct Authority (FCA) authorisation required under UK law and seeks the return of bitcoin he says he lost between 2018 and 2022, or equivalent damages.

The case was reported on 13 October 2026 but had not yet been served on HDR Global Trading Limited, BitMEX’s owner and operator. No court has ruled that BitMEX breached UK law, and the claim is not a decided class action.

What the UK lawsuit alleges

Barber’s statement of claim says BitMEX offered crypto-derivative products to UK customers while lacking FCA authorisation. His pleaded case relies on the Financial Services and Markets Act 2000 (FSMA). He argues that contracts made in breach of the UK’s regulated-activities rules are void and that he should receive restitution of the bitcoin lost on those trades, or damages representing its value.

The reported amount is £20 million. The assignment’s dollar figure of approximately $27 million is a conversion of that sterling claim, not a separate valuation announced by the court. Barber says the relevant trading losses arose from transactions between 2018 and 2022.

Promotion that allegedly reached Britain

The claim alleges that BitMEX promoted its services worldwide without excluding the UK. It cites, among other material, an advertisement in The Times dated 3 January 2019. Barber also points to an FCA warning dated 3 March 2020 that BitMEX might have been conducting regulated investment activity in the UK without authorisation.

Those allegations remain to be tested. A BitMEX spokesperson told The Guardian: “No such claim has been served on HDR Global Trading Limited.” Gareth Keillor, the Seladore Legal partner representing Barber, said the case is that BitMEX entered the transactions without the authorisation required by UK law and that FSMA therefore allows recovery of the bitcoin lost, or equivalent damages.

Has BitMEX been served or found liable?

As reported on 13 October 2026, the proceedings had been filed but not served on HDR Global Trading Limited. Filing starts a court process; it is not a finding that the allegations are true. The defendant will normally have an opportunity to acknowledge service, respond to the particulars of claim and challenge jurisdiction, liability, causation or the proposed remedy.

There is no reported merits judgment, settlement or order declaring BitMEX contracts void. The case therefore cannot yet establish that every BitMEX derivative traded by a UK resident was unlawful or that losses are automatically recoverable.

What products are at issue?

BitMEX operated a peer-to-peer platform for cryptocurrency derivatives rather than a simple spot-buying service. The US Commodity Futures Trading Commission (CFTC) described the platform in a 5 May 2022 consent order as offering derivatives on bitcoin, ether and litecoin. It recorded the launch of BitMEX’s first perpetual bitcoin–US dollar leveraged swap on 13 May 2016; the product was designed to trade in a way similar to a traditional futures contract.

A CFTC complaint filed on 1 October 2020 described the mechanics relevant to potential losses:

  • Customers deposited bitcoin as margin.
  • Positions used leverage, so a relatively small price move could consume the margin.
  • When a margin balance fell below the maintenance-margin level, BitMEX took over and liquidated the position.
  • The complaint said the customer’s maintenance margin was lost on liquidation.

The CFTC complaint alleged that BitMEX operated futures, options and swaps without the registrations it said were required under US law. Those US allegations are background about how the products worked; they do not decide Barber’s separate UK FSMA theory.

Can UK BitMEX traders get their bitcoin back?

Not automatically. Keillor said other UK-based people may have entered similar contracts, but stressed that whether an individual has a claim depends on that person’s facts and trading history. A potential claimant would need to examine at least:

  • Where they lived and traded when each contract was entered.
  • The exact BitMEX product—such as a perpetual swap, future, option or another instrument.
  • Trading dates, deposits, withdrawals, liquidations, fees and realized losses.
  • The contractual entity and terms that applied to the account at the time.
  • Whether limitation periods, arbitration clauses, causation issues or other defences affect the case.

The requested remedy is also fact-sensitive. Barber seeks the bitcoin he says was lost, or equivalent damages. The value of a bitcoin-denominated claim can change sharply depending on the valuation date and the court’s approach to restitution, damages and any gains or losses after the trades.

Records that may matter

Anyone considering advice should preserve account statements, trade exports, wallet addresses, deposit and withdrawal records, liquidation notices, fee histories, emails, advertising seen in the UK and identity or address evidence for the relevant period. Do not alter or delete original files. A solicitor can then assess whether the records support a UK claim and whether action is still in time.

What the FCA warning means for old losses

The March 2020 FCA warning is an allegation-supporting fact cited by Barber, not a ruling that his individual contracts are void. A warning can show that the regulator publicly raised an authorisation concern, but a court would still need to decide issues such as whether the specific activity was regulated, whether the relevant contracts fell within FSMA’s restrictions, and what remedy follows.

The dates also matter. Barber’s trades span 2018 to 2022, while the warning was issued in 2020. A warning issued during a trading period does not by itself resolve contracts entered before or after it. The court may examine the product, marketing, customer location and legal terms for each transaction.

Why the case could matter beyond one trader

If Barber succeeds, the judgment could clarify how UK authorisation rules apply to offshore crypto-derivative platforms, how FSMA remedies work for bitcoin-denominated losses and what evidence a claimant must provide. It could also influence similar claims, but it would not necessarily create a blanket entitlement for every UK customer. The comparison points would include the regulator and jurisdiction, product type, defendant’s authorisation status, trading dates and records, remedy sought and procedural stage.

What is established—and what is not

  • Established by the reporting: a £20 million claim was reported as filed in the High Court; Barber is the named claimant; the alleged losses concern BitMEX derivatives traded in 2018–2022; and service had not been reported.
  • Still allegations: that BitMEX carried on regulated activity in the UK without authorisation, that the contracts are void, and that Barber is entitled to restitution or damages.
  • Not established: that all UK BitMEX traders can recover losses, that every perpetual swap was illegal in Britain, or that the claim will proceed to a liability judgment.

For now, the practical answer is to treat the case as an individual, unadjudicated test of a legal theory. UK traders with comparable histories may wish to obtain independent financial-services legal advice, but no recovery is guaranteed until a court determines the relevant facts and law.
