Ilya Lichtenstein was sentenced on November 14, 2024, to 60 months—five years—in federal prison for conspiracy to commit money laundering arising from the 2016 theft of approximately 120,000 bitcoin from cryptocurrency exchange Bitfinex. He was also ordered to serve three years of supervised release.
The legal distinction matters: Lichtenstein pleaded guilty to a money-laundering conspiracy under 18 U.S.C. § 1956(h), rather than to a standalone charge described simply as “hacking.” The Justice Department said the stolen bitcoin was moved through thousands of transactions and that investigators later seized more than 94,000 bitcoin that remained in the original wallet.

What happened to the Bitfinex hacker?
Lichtenstein, identified by the Justice Department as a New York City resident, pleaded guilty on August 3, 2023. Prosecutors said he used advanced tools and techniques to access Bitfinex’s systems in August 2016 and carried out more than 2,000 unauthorized transactions.

Those transactions transferred 119,754 bitcoin to a wallet controlled by Lichtenstein. Afterward, prosecutors said he deleted access credentials and log files from Bitfinex’s network to cover his tracks.

His wife, Heather Rhiannon Morgan, also pleaded guilty in the case. Prosecutors said Morgan helped launder some of the proceeds. Her prosecution and sentence were separate from Lichtenstein’s, so the couple should not be treated as having received the same punishment.
The Justice Department’s sentencing announcement describes Lichtenstein as the person who carried out the unauthorized access and Morgan as assisting with laundering activity.
Why was the sentence five years instead of 20?
The money-laundering conspiracy charge carried a statutory maximum of 20 years in prison. That maximum was not an automatic sentence or a required minimum. The court determined the actual punishment after considering the charge of conviction, Lichtenstein’s guilty plea, federal sentencing rules, the government’s position, his criminal history and other case-specific factors.

The public DOJ sentencing release confirms the final sentence but does not, by itself, provide a complete calculation explaining every month of the judge’s decision. It is therefore inaccurate to assume that the five-year term was imposed as a direct mathematical penalty for each stolen bitcoin.

It is also unsafe to infer a precise release date from the five-year sentence alone. Pretrial detention credit, federal good-conduct credit, prison designation, later sentence reductions and subsequent court orders can affect time served. A current custody or release claim should be checked against an official Bureau of Prisons record or later court filing.
How the 2016 Bitfinex theft happened
The breach took place in August 2016. According to the government’s account, Lichtenstein gained unauthorized access to Bitfinex’s network and directed more than 2,000 transactions into a bitcoin wallet he controlled.
The available DOJ releases establish the unauthorized transfers and the efforts to delete credentials and logs. They do not establish every technical detail of the exploit, so the incident should not be described using a specific vulnerability unless that claim is supported by the underlying indictment, plea agreement or sentencing filings.

How the stolen bitcoin was laundered
Bitcoin transactions are recorded on a public blockchain, but tracing a transaction does not automatically identify the person controlling an address. The government said Lichtenstein and Morgan used a combination of on-chain and off-chain methods to make the proceeds harder to follow or connect to their identities.
According to the DOJ, the methods included:
- Creating fictitious identities and online accounts.
- Using automated transactions to move funds.
- Transferring cryptocurrency through exchanges and darknet markets.
- Chain hopping—converting bitcoin into other cryptocurrencies.
- Using mixing services, including Bitcoin Fog, Helix and ChipMixer.
- Moving funds through U.S. business accounts to make banking activity appear legitimate.
- Converting part of the proceeds into gold coins, which prosecutors said Morgan concealed by burying them.
The case materials indicate that approximately 25,000 bitcoin moved out of the original wallet through laundering activity, while more than 94,000 bitcoin remained there and were later seized. The figures are approximate in this summary because DOJ announcements refer to the seizure as both more than 94,000 bitcoin and approximately 95,000 bitcoin.
How investigators recovered the bitcoin
Investigators did not reverse transactions on the Bitcoin blockchain or “crack” Bitcoin. The key breakthrough was finding information that gave them control of the wallet.
After Lichtenstein and Morgan were arrested in February 2022, agents obtained court-authorized search warrants for online accounts they controlled. Investigators found files containing wallet addresses and the private keys associated with the wallet holding the stolen bitcoin.

A private key functions as the cryptographic credential needed to authorize transactions from a cryptocurrency wallet. Blockchain records can show where coins moved, but control of the corresponding private key is what allows someone to transfer the assets. Once investigators obtained the relevant keys through the seized account data and followed the legal process, they could take custody of the bitcoin remaining in the wallet.
The Justice Department said it seized more than 94,000 bitcoin in February 2022 and described the action as the largest cryptocurrency seizure by U.S. law enforcement at that time and the largest single financial seizure in the department’s history. Its earlier arrest announcement valued the seized cryptocurrency at approximately $3.6 billion at the time of the seizure and discussed approximately $4.5 billion in cryptocurrency in the context of the February 2022 arrests. Those are historical valuations, not current bitcoin prices.

The words seized, forfeited and repaid describe different legal stages:
| Term | Meaning in this case |
|---|---|
| Seizure | The government took custody or control of assets under legal authority. |
| Forfeiture | The government seeks or obtains legal ownership of property connected to criminal conduct. |
| Restitution | A court-ordered payment or transfer intended to compensate legally recognized victims. |
| Distribution | The later process of transferring forfeited property or proceeds to eligible claimants. |
The DOJ established a public Bitfinex-hack case page with information about seized and forfeited property and the claims process. It also issued a notice concerning potentially affected persons.

That notice said that, for purposes of the offenses of conviction, the government’s position was that there were no “victims” under the Crime Victims’ Rights Act, while still providing notice out of caution. The existence of a seizure or forfeiture process does not by itself prove that all recovered bitcoin had already been returned to Bitfinex customers.
Accordingly, “the government recovered the money” is too broad if it implies that every affected customer had already been repaid. The supported description is that the government seized more than 94,000 bitcoin that remained in the original wallet and created a process for claims involving seized and forfeited property.
What this case shows about cryptocurrency crime
The Bitfinex case illustrates why cryptocurrency investigations often depend on both blockchain analysis and traditional evidence. Public transaction records helped investigators follow the movement of funds, but online-account files, identity information, exchange records, business accounts and private-key data were also decisive.

Criminal proceedings, forfeiture, ownership claims and any eventual distribution are separate legal questions.
The most precise summary is therefore: Lichtenstein was sentenced to five years in federal prison for his role in a money-laundering conspiracy arising from the theft of 119,754 bitcoin from Bitfinex in 2016. More than 94,000 bitcoin that remained in the original wallet were seized in 2022, but seizure should not automatically be described as restitution or final distribution.
