You can usually amend or revoke a revocable living trust, but the trust’s amendment clause and state law control exactly how. An irrevocable trust is more difficult to change and may require a statutory, court, beneficiary-consent, or other jurisdiction-specific procedure.
Changing one document does not automatically change the others. Retirement-account and insurance beneficiaries, powers of attorney, and health-care directives operate under separate rules. The correct answer depends on your governing state, the document’s language, your capacity, and the assets involved.

Which estate-planning documents are generally changeable?
The table below shows the practical distinction. “Changeable” does not mean informal edits are effective; every document has a legally recognized method for amendment, revocation, or replacement.
| Document | Who normally can make a change? | What controls the process? | Where assets or authority operate |
|---|---|---|---|
| Will | The person who made the will, while legally capable | Execution rules in the governing state; the form of codicil or replacement will | Assets governed by the will, usually through probate |
| Revocable living trust | The creator (often called the grantor or settlor), while the retained power exists | The trust’s amendment and revocation clauses plus state law | Property properly transferred to the trust; trust administration generally avoids probate for those assets |
| Irrevocable trust | Usually not unilaterally by the creator | Trust language, state statutes, court procedures, beneficiary rights, and specialized doctrines such as decanting | Property held under the irrevocable trust |
| Financial power of attorney | The principal, while capable, can generally revoke or replace it | State power-of-attorney law and the document’s terms | Authority for an agent to act during the principal’s life; it does not itself distribute an estate |
| Advance health-care directive or health-care proxy | The person who signed it, subject to state rules | State health-care-document law and the directive’s revocation method | Medical decisions and stated treatment wishes during life |
| Beneficiary designation | The account or policy owner, if the contract and law permit a change | The financial institution’s form, account or policy terms, and applicable law | Life insurance, retirement accounts, payable-on-death accounts, and similar assets that commonly pass outside a will |
A will and a trust are therefore not interchangeable checklists. Each controls only the property and authority assigned to it.

Can you change a will?
Usually, yes. A will-maker can generally amend or revoke a will during life while legally capable. The new instrument must satisfy the law that governs the will. States differ on signing, witnessing, notarization, self-proving affidavits, electronic execution, and the treatment of handwritten documents. There is no single nationwide witness rule that safely applies everywhere.
Codicil or complete replacement
A codicil is an amendment that leaves the original will in place except for specified provisions. A complete replacement will can be clearer when there are many changes. The choice is a drafting and risk decision: a poorly coordinated codicil can create inconsistencies with unchanged clauses, while a replacement must correctly revoke or supersede the earlier will.
Formalities matter
Do not cross out a paragraph, write a note in the margin, or sign a new page and assume the change will be honored. Depending on the state, an informal alteration may be ignored, create a contest, or revoke more than intended. Use the execution method required by the governing state and keep the final original where the personal representative can find it.
Moving to another state
A move is a review trigger because the new state may use different execution and revocation rules. A will validly signed in one state may still be recognized elsewhere, but relying on that assumption can leave witnesses, self-proving language, or substantive provisions mismatched with current law. Have the document reviewed under the law that will govern administration in the new state.

Can you amend or revoke a revocable living trust?
Generally, yes, while the creator retains capacity and the power to amend or revoke. The American Bar Association defines it as “A revocable living trust is a trust that is created and funded during your lifetime that you retain the power to amend or revoke.” That retained power is the key difference from an irrevocable trust.
Read the amendment clause first
A trust is a contract-like document with its own procedure. It may require a signed writing, acknowledgment before a notary, delivery to a trustee or co-trustee, a particular document title, or another specified step. State law may supply a default rule, but a stricter requirement in the trust can still control.
Why a technically defective amendment can fail
American Bar Association case summaries describe disputes in which courts considered substantial compliance yet found an attempted amendment ineffective because a trust-specific requirement was missed. Examples included failure to use a required title and failure to deliver the amendment to a co-trustee. Those outcomes are state-specific illustrations, not a universal test. Follow every instruction in the trust rather than relying on a general form.
Amendment is different from funding
Changing beneficiaries or trustees in the document does not transfer newly acquired property into the trust. Real estate, bank accounts, business interests, and other assets must be titled or assigned as the trust requires. An asset that never entered the trust may still pass under a beneficiary designation, a joint-ownership arrangement, or a will.

What happens if the creator becomes incapacitated?
Incapacity can change who has authority to act, but it does not automatically give a power-of-attorney agent the right to rewrite the trust. The agent’s authority depends on the power of attorney, the trust, and applicable state law. The American Bar Association has summarized 2024 decisions invalidating agent-made trust amendments in particular circumstances. Before incapacity occurs, the trust should state whether and how an agent or successor trustee may amend administrative provisions, and those provisions should be coordinated with the power of attorney.
Can an irrevocable trust be changed?
Usually not by the creator alone. “Irrevocable” means the trust does not give the creator the same unilateral amendment or revocation power available under a revocable trust. The restriction may protect tax, asset-protection, public-benefit, or other planning objectives, so an informal letter or new will cannot override it.
Possible modification routes
Depending on the jurisdiction and facts, a change may be possible through:

- A court-approved modification or reformation when the trust’s purpose, administration, or circumstances meet the state’s standard.
- Consent or agreement involving beneficiaries, trustees, a trust protector, or other parties identified in the document.
- A provision in the trust itself allowing a limited amendment, replacement of a trustee, or administrative update.
These routes are not interchangeable, and an available route in one state may not exist in another. In 2025, Arkansas and the District of Columbia adopted the Uniform Trust Decanting Act, illustrating that legislative options are changing. Whether decanting applies still depends on the trust language, jurisdiction, beneficiaries, trustee powers, and the proposed change.

What about powers of attorney and health-care directives?
A financial power of attorney appoints an agent to act within the authority granted by the principal. The principal can generally revoke or replace it while capable, following state requirements. Review the appointment after marriage, divorce, a move, or a loss of trust in the named agent. The American Bar Association specifically cautions that state law differs and highlights the need to review an appointment naming an ex-spouse after divorce.
An advance health-care directive or health-care proxy addresses medical wishes or appoints a decision-maker. It is separate from both a will and a trust. A new will does not replace a health-care proxy, and a trust amendment does not change hospital records. Ask the relevant health system or state registry how a replacement directive must be delivered so clinicians can locate the current version.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Do beneficiary designations change when you update a will or trust?
No. Life-insurance policies, retirement accounts, payable-on-death accounts, and similar assets generally pass under the beneficiary designation on file, subject to the account or policy terms and applicable law. Updating a will or revocable trust alone can therefore leave an outdated beneficiary in place.

Coordinate the designation with the plan
After changing an estate document, inventory every account and policy with a designation. Obtain the institution’s current form, name primary and contingent beneficiaries, and confirm that the institution accepted the change. Keep confirmation with the estate records. Divorce can have a special effect: the legal consequences of a former-spouse designation vary by state and by asset type, so do not assume a divorce automatically solves the problem.

A practical process for updating an estate plan
- Identify the governing law. Note your residence, where property is located, the trust’s governing-law clause, and any recent move. State-specific rules determine execution and amendment validity.
- Collect the complete documents. Locate the signed will, every trust amendment, powers of attorney, health-care directives, deeds, account statements, and beneficiary confirmations. A summary or unsigned draft is not the operative instrument.
- Write down the intended changes. Separate dispositive wishes (who receives property) from administrative changes (trustee, executor, or agent) and from health-care instructions. This prevents a will change from being mistaken for a beneficiary or medical-document change.
- Check capacity and conflicts. The person making the change must meet the governing capacity standard and act voluntarily. Look for conflicting amendments, revoked documents, divorce provisions, or gifts that no longer match the plan.
- Follow the document’s method. For a will, use the state-required signing and witnessing process. For a trust, follow every amendment-clause detail, including any acknowledgment, delivery, title, or co-trustee requirement. For an irrevocable trust, determine whether a statutory or court route is needed.
- Execute and preserve the final version. Sign the correct version, complete required notarization or witness steps, and store the original securely. Tell the executor, trustee, or another trusted person where it is located without distributing conflicting drafts.
- Update assets separately. Retitle property or complete assignments needed to fund a trust. Submit new beneficiary forms for insurance and retirement accounts and verify acceptance.
- Replace agents and medical documents. Deliver revoked and replacement powers of attorney and health-care directives to the people and institutions expected to rely on them.
- Schedule a future review. Recheck the plan after a major life event and periodically under the advice appropriate for your state.
Life events that should trigger a review
The event itself does not amend anything; it signals that the documents may no longer express your wishes. Review the entire plan after:
- Birth or adoption of a child: confirm guardianship language, inheritances, and beneficiary designations.
- Marriage: coordinate a new spouse’s rights with existing children, trusts, retirement accounts, and insurance.
- Divorce or separation: review the former spouse’s status as beneficiary, executor, trustee, financial agent, and health-care decision-maker. State law may treat each role differently.
- Death or incapacity of a loved one: replace a deceased or unavailable executor, trustee, guardian, agent, or beneficiary.
- Move to another state: recheck execution formalities, homestead or community-property issues, and health-care-document recognition.
- Changed finances: reassess business ownership, real estate, debt, insurance, tax objectives, charitable gifts, and whether a trust is funded as intended.
Common mistakes and how to correct them
- Editing only the will: Make a coordinated checklist for the trust, designations, powers of attorney, and health-care documents.
- Using a generic trust amendment: Compare the form against the trust’s own clause and governing law; obtain state-specific advice when the procedure is unclear.
- Assuming a power-of-attorney agent can amend a trust: Verify express authority in both instruments and the applicable statute before any amendment is attempted.
- Leaving a trust unfunded: Complete the deeds, assignments, or account registrations needed for the trust to control the intended property.
- Keeping multiple “final” originals: Destroy or clearly mark revoked versions according to local practice, and make sure the custodian can identify the operative document.
- Relying on an online signing rule from another state: Electronic-estate-planning laws are not uniform. In 2025, Missouri and North Dakota enacted the Uniform Electronic Estate Planning Documents Act; that example does not establish the rule in any other state.
Why state law and current legislation matter
The American Bar Association reported that state legislatures enacted 13 uniform trust and estate acts in 2025. That count is a legislative update, not a measure of how often people revise documents. It demonstrates why a form or explanation written for another state can become unreliable. Electronic execution, witnessing, trust modification, and the effect of divorce on designations all depend on the jurisdiction and the asset.
For an individual answer, gather the governing state, the exact document language, the person’s capacity, and the assets involved before signing anything. A state-licensed estate-planning attorney can determine whether a codicil, replacement will, trust amendment, decanting, court petition, beneficiary form, or new agent appointment is the legally effective route.
