Wildfire Insurance: State FAIR Plans vs. Private Coverage

By TheFinanceBase Team 12 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When private homeowners insurance is available, it is usually the more complete single-policy solution for wildfire-prone property. A state FAIR Plan is a last-resort insurance facility for owners who cannot obtain required coverage in the regular market, but it is not a standardized national product. Limits, covered perils, deductibles, eligibility rules and claim settlement terms vary by state.

A FAIR Plan can keep a property insured against specified fire losses, yet it may omit liability, theft, water damage, contents, replacement-cost features or additional living expenses. In California, for example, the basic plan covers fire or lightning, internal explosion and smoke; Oregon’s plan uses named-peril dwelling coverage and does not offer a homeowners package combining liability and property insurance. Compare the complete package—private policy, FAIR Plan alone, or FAIR Plan plus a separate Differences in Conditions (DIC) policy—rather than comparing only the dwelling premium.

What private homeowners insurance and a FAIR Plan actually are

Private homeowners coverage

A private homeowners policy is an insurer’s contract for a defined property, set of covered causes of loss, liability protection and optional endorsements. A policy may cover the dwelling, detached structures, personal property and loss of use, subject to limits, exclusions, deductibles and settlement language. Availability depends on the address, construction, wildfire exposure, prior losses, protection features and the insurer’s underwriting rules. Even when a carrier is willing to quote, two policies can differ materially in wildfire, smoke, water, theft, liability, evacuation and rebuilding provisions.

State FAIR Plans

FAIR means Fair Access to Insurance Requirements. A state creates or authorizes the plan as a safety net for applicants who cannot secure coverage in the regular market or who cannot obtain a particular peril, such as fire. The plan’s governing statute, underwriting rules and policy forms are state-specific. A FAIR Plan is therefore not automatically equivalent to a standard homeowners policy, and the label does not tell you whether the policy pays replacement cost, actual cash value, contents, liability or additional living expenses.

Some FAIR Plans are limited fire policies; others provide a dwelling form with named perils and separate options. Eligibility can also change if regular-market coverage becomes available. Read the plan’s current application rules and policy form for the property’s state rather than relying on another state’s description.

Why the state changes the answer

The official California and Oregon materials illustrate how different a FAIR Plan can be. The following comparison uses current plan information available in 2026; it is not a national template.

Issue California FAIR Plan Oregon FAIR Plan
Basic structure Limited residential fire policy Dwelling policy; no homeowners package combining liability and property coverage
Basic covered causes of loss Fire or lightning, internal explosion and smoke Named-peril terms on the basic dwelling form
Optional or omitted protection Specified extended-coverage perils and vandalism or malicious mischief may be added for an additional premium; traditional homeowners protections such as theft and liability are not included in the basic plan Liability and theft are unavailable through the Oregon FAIR Plan
Maximum dwelling or residential limit $3 million maximum across all residential coverages combined, according to California Department of Insurance guidance $600,000 maximum across coverage parts absent special facultative reinsurance, according to the current Oregon FAIR Plan dwelling page
Loss settlement noted by official materials Check the policy form and endorsements for the applicable settlement basis Actual-cash-value settlement on the basic dwelling form
Eligibility example For people unable to find an insurer that will sell needed homeowners or renters coverage If regular-market coverage is available, the property owner is not eligible

Limits and forms can be amended. Confirm the current application, declarations page and complete policy wording before binding coverage.

What a private policy, FAIR Plan and DIC combination cover

Coverage question Private homeowners policy FAIR Plan alone FAIR Plan plus DIC
Wildfire and fire damage Depends on the policy’s covered-peril wording and exclusions Usually the plan’s specified fire perils; California’s basic plan includes fire or lightning, internal explosion and smoke FAIR Plan fire protection remains, while the DIC may address selected gaps under its own form
Smoke Check whether smoke is covered and whether limits or exclusions apply Included in California’s basic plan; not a universal rule for every state Determined by both forms
Personal liability Often part of a homeowners package, with a stated limit May be absent; Oregon’s plan does not provide it May be available through the DIC or another separate liability policy, subject to underwriting
Theft and contents Often included, but limits and exclusions vary May be excluded; Oregon’s plan makes theft coverage unavailable Only covered if the DIC or another policy expressly provides it
Additional living expenses or loss of use Check the limit, waiting period and covered triggers Do not assume it is included Check the DIC and FAIR Plan together; neither should be presumed to fill the other’s omissions
Settlement basis Replacement cost, actual cash value or a mixture, as the form states State-specific; Oregon’s basic dwelling form uses actual cash value Each policy applies its own valuation and exclusions

A DIC policy is not a universal upgrade. It is a separate contract intended to address specified gaps, and its exclusions, deductibles, limits and insurer requirements matter as much as the FAIR Plan’s terms.

California FAIR Plan: what the official guidance says

Basic covered perils

The California Department of Insurance describes the basic FAIR Plan as covering losses caused by fire or lightning, internal explosion and smoke. For an additional premium, the policy may add specified extended-coverage perils and vandalism or malicious mischief. Those additions do not turn the plan into a full homeowners package.

Important omissions

The department identifies theft and liability as examples of traditional homeowners protections that the basic FAIR Plan does not include. A homeowner also must verify contents, detached structures, loss-of-use, water damage, deductible and settlement provisions in the issued form. The regulator advises considering a separate Differences in Conditions policy for some perils missing from the FAIR Plan.

Residential limit

Current California Department of Insurance consumer guidance lists a maximum $3 million residential limit across all coverages combined. That is a combined ceiling, not $3 million automatically available for the dwelling, contents and every other coverage separately. Your rebuild estimate and the plan’s underwriting rules determine how much of the limit can be assigned to each coverage.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Mitigation and plan changes

The department’s FAIR Plan overview says discounts on the wildfire portion of premiums may be available for property hardening. Ask the plan or an agent what documentation and qualifying work are required; a discount is not automatic merely because a project was completed. The department has described a broader residential policy as an improvement being sought, so do not assume that a broader package is already available without checking current plan documents.

Oregon FAIR Plan: a different structure

Dwelling-only, named-peril approach

The Oregon FAIR Plan Association states that it does not offer a homeowners package policy combining liability and property coverage. Its basic dwelling form is a named-peril policy, meaning a loss must result from a peril listed in the form rather than from any cause that is not excluded. The basic form uses actual-cash-value loss settlement, which deducts depreciation; that can produce a lower claim payment than replacement-cost coverage for an older roof, siding or other component.

Limits and eligibility

The current Oregon FAIR Plan dwelling page lists a $600,000 maximum across coverage parts absent special facultative reinsurance. The Oregon FAIR Plan FAQ says an owner is not eligible when regular-market coverage is available. It also says liability and theft coverage are unavailable through the plan. A private policy becoming available can therefore affect both eligibility and the need to move coverage.

Historical limit change

In 2023, the Oregon regulator reported that the FAIR Plan increased residential limits from $400,000 to $600,000 and commercial property limits from $700,000 to $1 million. The 2023 announcement is historical; use the plan’s current coverage page and written quote for today’s applicable limit.

How to determine whether you qualify for a FAIR Plan

  1. Shop the regular market first. Obtain written declinations or quotes from licensed insurers or an independent agent. Some plans require proof that coverage was unavailable or unaffordable under their rules.
  2. Ask what requirement the plan is solving. Clarify whether you need fire-only protection, a dwelling policy, a renters policy or another form. Eligibility for one coverage does not guarantee eligibility for every option.
  3. Submit complete property information. Provide year built, square footage, roof age and material, electrical and plumbing updates, heating system, outbuildings, occupancy, mortgage information, prior losses and wildfire-mitigation features.
  4. Confirm state-specific limits before applying. A plan may cap the combined residential amount or require special reinsurance for a higher limit. Compare the cap with a current contractor-based rebuild estimate.
  5. Review the issued declarations and full form. Do not rely on an agent’s summary. Verify covered perils, exclusions, deductibles, valuation, sublimits, conditions, cancellation and renewal terms.
  6. Recheck eligibility at renewal. If a regular-market carrier is willing to insure the property, the state plan may require replacement or may no longer be available.

How to compare the real cost

A FAIR Plan premium is only one part of the price of protection. A meaningful comparison uses the same dwelling replacement estimate and adds every policy needed to obtain the protections you want.

Cost item Questions to put in writing
Primary premium What is the annual premium for the private policy or FAIR Plan at this address?
Supplemental policy If the FAIR Plan omits liability, contents, water or additional living expenses, what does a DIC or other policy cost?
Deductible Is there a flat deductible, a percentage wildfire deductible or separate deductibles for different perils?
Fees and payment terms Are inspection, policy, installment, broker or financing fees charged, and when is payment due?
Limits and sublimits Are detached structures, contents, debris removal, ordinance-and-law work and temporary housing adequate for this home?
Settlement basis Will a claim pay replacement cost, actual cash value or a combination, and what conditions must be met before replacement-cost benefits are released?
Renewal exposure Can the premium, deductible or eligibility change after a loss or when regular-market coverage becomes available?

Official California and Oregon materials do not establish an apples-to-apples statewide price ranking. A FAIR Plan is not proven to be always cheaper or always more expensive. Compare current written quotes and complete forms for the specific address with a licensed agent.

Replacement cost versus actual cash value

Replacement-cost coverage is designed to pay the cost to repair or replace damaged property with like kind and quality, subject to the policy’s conditions and limit. Actual cash value subtracts depreciation for age and condition. The distinction matters after a wildfire because older roofs, siding, windows and mechanical systems can have substantial depreciation.

Ask the insurer to show an example claim calculation for the dwelling, personal property and any roof-specific rule. Confirm whether you must first complete repairs, whether an initial payment is actual cash value, how long you have to claim replacement-cost holdback, and whether code-upgrade costs require an ordinance-and-law endorsement.

When a DIC policy may be useful

A DIC policy is a separate contract that can address selected perils or protections omitted by a FAIR Plan. The California Department of Insurance specifically points consumers toward DIC coverage for some gaps. The DIC does not automatically provide every feature of a standard homeowners policy, and it may have its own exclusions, limits, waiting periods and deductibles.

Before buying, request a side-by-side schedule showing which policy responds first to fire, smoke, water, theft, vandalism, liability, contents and loss of use. Ask whether the DIC requires a FAIR Plan, whether both policies must be kept in force, how overlapping insurance is coordinated and whether the DIC pays replacement cost or actual cash value.

What to do when private coverage is declined

Get the reason in writing

A declination may relate to roof age, brush clearance, construction, prior claims, distance to fire protection, a protection-class rule or the insurer’s current geographic appetite. Correcting an underwriting issue can open more options than immediately accepting a limited policy.

Improve insurability

  • Document roof, siding, vents, windows, defensible-space work and other mitigation with dated invoices and photographs.
  • Ask whether the carrier accepts a wildfire risk inspection or a third-party mitigation certificate.
  • Update electrical, plumbing, heating and roof records so an agent can submit complete information.
  • Use a licensed independent agent who can approach multiple admitted insurers and explain state-plan eligibility.

Protect the mortgage requirement

Most lenders require evidence of property insurance, but a lender’s minimum requirement is not the same as adequate protection for your finances. Tell the lender if a private policy is replaced by a FAIR Plan and ask what supplemental coverage documentation it requires. Never let a policy lapse while a replacement is still pending.

How to compare policy forms before binding

  1. Match the dwelling limit to a current rebuild estimate, not the home’s sale price or tax assessment.
  2. List every covered peril and exclusion, with special attention to wildfire, smoke, water, theft and vandalism.
  3. Record separate limits for the dwelling, other structures, contents and additional living expenses.
  4. Write down each deductible, including any wildfire percentage deductible and minimum dollar amount.
  5. Identify replacement-cost, extended-replacement-cost and actual-cash-value language.
  6. Check liability limits, medical-payments coverage and exclusions if a private or supplemental policy is intended to protect against lawsuits.
  7. Confirm mortgagee wording, inspection requirements, vacancy rules, cancellation rights and renewal conditions.
  8. Ask how a claim involving both policies is reported and which insurer appoints the adjuster.

Claims and recovery questions to settle in advance

Wildfire claims can involve a total loss, smoke contamination, debris removal, code upgrades and temporary housing. Before a loss, ask the insurer where to report a claim, what proof of loss is required, how personal property is documented and whether emergency repairs are authorized. Keep an off-site inventory with photographs, serial numbers, receipts and estimated replacement prices. Store policy declarations, endorsements, mortgage information and agent contacts in a secure cloud account or other location outside the home.

After a loss, notify every potentially responsive insurer promptly, prevent further damage when safe, keep receipts and do not discard damaged property until the adjuster or insurer gives instructions. A FAIR Plan and a DIC insurer may have different notice requirements; missing one can complicate coordination.

Wildfire risk context for California homeowners

The California Department of Insurance’s 2025 release, citing Cal FIRE, reported 15 major fires since 2015, with 174 fatalities and 55,528 buildings destroyed. Those are historical California figures, not a prediction of future losses and not a national statistic. They help explain why availability, deductibles, mitigation documentation and accurate limits should be reviewed at every renewal.

A practical decision framework

Choose private coverage when it is available and adequate

Prefer a private homeowners policy when its covered perils, liability, contents, loss-of-use, valuation and limits meet the property’s needs at a sustainable total cost. Check the wildfire deductible and exclusions rather than assuming a broad policy covers every fire-related expense.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use a FAIR Plan as the required safety net

Use the state plan when regular-market insurers will not write the property or when the plan is the only available way to satisfy a fire-insurance need. Treat it as a defined set of protections, not as a substitute for a package policy. Determine which gaps must be filled separately.

Pair the plan with supplemental coverage when gaps matter

Consider a DIC or other separate policy when you need protections the FAIR Plan omits, such as liability, theft, broader contents or additional living expenses. Buy only after checking the two forms together for overlaps, exclusions and adequate limits.

Re-shop after mitigation or market changes

Improved roof condition, defensible space, wildfire-hardening documentation or a change in insurer appetite can alter eligibility and price. Recheck private options before each renewal, while maintaining continuous coverage.

Common mistakes to avoid

  • Assuming every state FAIR Plan has the same perils, limits or eligibility test.
  • Comparing only the dwelling premium and ignoring the cost of DIC, liability or contents coverage.
  • Using a market-value estimate instead of a rebuild-cost estimate.
  • Assuming a $3 million California limit means $3 million is available separately for every coverage.
  • Overlooking Oregon’s actual-cash-value settlement on the basic dwelling form.
  • Believing a FAIR Plan automatically includes theft, liability, water damage or temporary housing.
  • Failing to ask what happens if regular-market coverage becomes available.
  • Letting a private policy lapse before a FAIR Plan or supplemental policy is active.
