TSMC has not been reported as having received a final $1 billion U.S. fine. In April 2025, Reuters-based reports said the company could face a penalty of $1 billion or more in an export-control investigation into chips it made for Chinese designer Sophgo. The concern is that a TSMC-made chip ordered by Sophgo reportedly matched one found in Huawei’s Ascend 910B AI processor—not that TSMC was shown to have sold directly to Huawei.
Why is TSMC reportedly under investigation?
The U.S. Commerce Department was reported to be examining TSMC’s work for Sophgo, a Chinese chip designer. The reported concern is that a chip made by TSMC for Sophgo matched a chip found inside Huawei’s Ascend 910B AI processor. That raised questions about whether the chip reached Huawei in violation of U.S. export controls.

The reported chain is therefore indirect: TSMC fabricated a chip ordered by Sophgo, and a matching chip was later found in a Huawei product. The reporting does not establish that Huawei placed the order with TSMC, or that TSMC knowingly supplied Huawei.

Huawei is on the U.S. Commerce Department’s Entity List. U.S. Bureau of Industry and Security rules include a Foreign Direct Product Rule that can restrict certain foreign-produced items made using U.S. technology from being supplied to Huawei without authorization. Those rules help explain why a chip fabricated outside the United States could still raise U.S. export-control questions.

Whether a particular chip is covered depends on the applicable rule and the facts of its production and transfer. The available reporting does not establish a final agency finding about how those requirements applied to TSMC’s work for Sophgo.
What is known—and not known—about the chip match?
Reuters-based coverage reported that a TSMC-made chip ordered by Sophgo matched one found in Huawei’s Ascend 910B. The match is central to the reported inquiry, but the public account does not establish all the technical evidence behind it or independently document each step by which the chip reached Huawei.

A RAND expert, Lennart Heim, estimated in 2025 reporting that nearly 3 million chips had been involved in recent years. That is an expert estimate cited in news coverage, not a government-disclosed or audited shipment total.

Why was a $1 billion penalty mentioned?
April 2025 reporting described a possible penalty of $1 billion or more, potentially in connection with a settlement. It was not a final assessment. The reports tied that figure to export-control penalties that can reach as much as twice the value of violating transactions; the available information does not provide an established transaction value or a final calculation for TSMC.

The distinction matters: a maximum penalty framework does not mean the government has determined that a violation occurred, calculated a fine, or imposed the maximum amount. The reported figure was a potential outcome of an investigation, not a bill or settled liability.
Was this a direct sale to Huawei or a downstream transfer?
| Question | What the reporting says | What it does not establish |
|---|---|---|
| Who placed the reported order? | Sophgo reportedly ordered the TSMC-made chip. | That Huawei ordered it from TSMC. |
| Where did a matching chip appear? | A chip reportedly matched one found in Huawei’s Ascend 910B. | The complete route by which it reached Huawei or all technical details of the match. |
| Why might U.S. rules apply? | Huawei is on the Entity List, and certain foreign-produced items made with U.S. technology can be restricted under the Foreign Direct Product Rule. | A final determination that this chip was covered or that TSMC violated the rules. |
| What is the enforcement status? | TSMC was reportedly under investigation, and a potential penalty was discussed. | A final fine, completed settlement, charging document, or announced closing date. |
Has the United States already fined TSMC?
No final U.S. fine or completed settlement was identified in the reporting available from April 2025. Taiwan Economy Minister Kuo Jyh-huei said his ministry had not received notification of a possible fine and described TSMC as “a company that respects laws and regulations.” A TSMC spokesperson was reported as saying the company was in a quiet period and did not comment further.

Those statements do not resolve the investigation. Until an authoritative enforcement announcement establishes an outcome, the accurate description is that TSMC could face a potential penalty and was reportedly under investigation—not that it has been found liable or fined.
