Why the U.S.–India Trade Deal Is Stalled in October 2026

The U.S.–India trade negotiations have plateaued because the two governments still disagree over farm-market access, the tariff consequences of India’s Russian-oil purchases, and the outcome of an unfinished U.S. Section 301 industrial-capacity investigation.

The three disputes keeping the agreement from closing

India’s Finance Minister Nirmala Sitharaman said on October 5, 2026, that further concessions would be difficult. U.S. Trade Representative Jamieson Greer likewise said an agreement was not imminent. Their comments describe negotiations that have moved beyond the initial framework but have not produced a finished, comprehensive treaty.

Agriculture and protection for farmers

Washington wants substantially better access for U.S. agricultural exports. India is trying to protect politically sensitive farm and dairy sectors, where tariff changes can affect domestic prices, rural incomes and the livelihoods of large numbers of farmers.

The February 2026 framework identified possible Indian tariff reductions for products including dried distillers’ grains, red sorghum, tree nuts, fruit, soybean oil, wine and spirits. Indian officials have continued to distinguish those products from sensitive staples and dairy, which they want to keep protected. That gap matters because a package that opens selected product lines without addressing the most politically sensitive categories may not satisfy U.S. negotiators, while broader concessions could face substantial domestic resistance in India.

Russian oil, tariff leverage and the snapback risk

U.S. trade pressure is linked to India’s purchases of Russian crude. A U.S. executive order allows officials to recommend reinstating an additional 25% duty if India resumes importing Russian oil, either directly or indirectly. The provision creates a conditional tariff risk rather than an automatic surcharge: the possible duty depends on the policy trigger and a subsequent recommendation.

India therefore faces a choice with costs on both sides. Reducing Russian-oil purchases could increase fuel costs or put additional pressure on government finances. Continuing those purchases could expose Indian exports to higher U.S. duties. Until the two governments settle how the oil condition will operate, it is difficult to treat the tariff concessions in a broader trade package as stable.

The unfinished Section 301 investigation

Washington has not completed a Section 301 investigation into alleged excess industrial capacity. Section 301 is the U.S. trade-law process used to examine foreign practices that the United States considers unreasonable or discriminatory and to determine whether a response is warranted.

For India, the unresolved investigation creates uncertainty about its eventual tariff treatment. Even if negotiators agree on agriculture and energy, India cannot know the full exposure of its exports until the investigation produces a result. That uncertainty makes it harder to sign a larger agreement with clear, durable market-access terms.

What the February 2026 framework actually established

The February 2026 White House joint statement specified that the United States “will apply a reciprocal tariff rate of 18 percent” to originating goods of India. It also described a route toward removing reciprocal tariffs on a wide range of goods if an interim agreement were successfully concluded.

The accompanying fact sheet said India would eliminate or reduce tariffs on U.S. industrial goods and on a wide range of agricultural products. Those documents set out negotiating commitments and a path forward; they did not constitute the completed text of a comprehensive, legally final treaty. The October plateau means the parties have not yet converted those broad commitments into a settled package covering the disputed exceptions, conditions and implementation details.

What tariff will Indian goods face in the United States?

The clearest published figure is the 18% reciprocal rate specified in the February 2026 joint statement for originating Indian goods. The same statement described possible removal of reciprocal tariffs for a wide range of goods if an interim agreement succeeded. Because the Section 301 investigation remains unfinished and the Russian-oil condition can create an additional 25% duty risk, the final treatment of every Indian product cannot be determined from the framework alone.

In practical terms, businesses need to distinguish three things: the 18% framework rate, any product-specific exemptions or reductions negotiated in an interim agreement, and the separate possibility of an additional duty tied to Russian-oil purchases. The framework is not a guarantee that every product will receive the same rate after the outstanding issues are resolved.

Why the delay matters to both economies

The dispute affects a large and growing trade relationship. Reuters reported that Indian goods exports to the United States reached $42.79 billion from April through August 2026, compared with $40.39 billion in the same period a year earlier. Reuters also reported that India recorded a goods-trade surplus with the United States of nearly $34 billion in fiscal year 2025/26.

For India, access to the U.S. market supports exporters while energy decisions affect domestic costs. For the United States, the negotiations are a way to seek more access for farm and industrial products and to use tariff policy in response to concerns about Russian-oil purchases and industrial capacity. The size of the trade flows raises the cost of leaving the rules unsettled, but it also gives both sides reasons to hold firm on issues they consider strategically important.

What would have to change before a deal can move

  1. Agricultural terms: India and the United States would need a product-by-product agreement that identifies which farm and food tariffs fall, which sensitive staples and dairy protections remain, and how those exceptions are administered.
  2. Russian-oil conditions: The parties would need a workable understanding of how direct or indirect purchases are assessed and when the possible additional 25% duty could be recommended.
  3. Section 301 outcome: Washington would need to complete the industrial-capacity investigation so India can evaluate its final tariff exposure rather than negotiate against an unresolved contingency.
  4. Legal form and implementation: The framework’s broad promises would have to become detailed, enforceable commitments, with product coverage, exemptions and effective dates set out in the final instrument.

Until those elements are settled, the February framework remains a negotiating foundation rather than a completed comprehensive agreement. The October statements from both governments indicate that further concessions, particularly on politically sensitive agriculture and the linked energy-and-tariff questions, are the immediate obstacles to turning that foundation into a deal.
