Usually, the people who have the legal right to use and benefit from a private road share its reasonable maintenance costs—but the controlling answer is in the recorded easement, deed, covenants, road-maintenance agreement, or association rules. If those documents do not settle the issue, state law may assign costs by equal shares, proportionate use, benefit received, or rateable contribution. There is no single nationwide formula.
Before paying or sending a bill, identify the road’s ownership, the users’ legal rights, the exact work proposed, and the law in the state where the road is located. The state examples below illustrate how different the default rules can be; they are not a determination of any particular owner’s obligation.

Why the answer starts with the property documents
A private road can be owned by one person, jointly by several owners, or by an association while neighboring parcels hold easements or rights-of-way over it. Ownership and the right to travel across the road are not the same thing, and neither automatically answers who must pay for grading, drainage, snow removal, or reconstruction.

- Recorded easement or right-of-way. Look for language requiring an easement holder, dominant-estate owner, or road owner to repair, maintain, or contribute to expenses.
- Deeds and title records. A deed may incorporate an earlier declaration, reference a road association, or limit the use of the easement.
- Covenants, declarations, and subdivision documents. These may create a common-maintenance duty, an assessment procedure, or a formula based on parcels, frontage, use, or another measure.
- Written maintenance agreements. A later agreement can explain who arranges work, how estimates are approved, when invoices are due, and how disputes are handled.
- Road-association or homeowners’ association rules. Bylaws and recorded rules may authorize assessments, meetings, votes, reserve funds, and collection procedures.
Check the recording information and the current versions of every document. An informal promise between neighbors may help explain past practice, but it may not override a recorded restriction or satisfy a statute’s requirements for an enforceable agreement.
What to look for in the wording
Terms such as “reasonable and necessary repairs,” “maintenance,” “improvements,” “common benefit,” “pro rata,” “rateable,” “frontage,” “primary access,” and “user” can produce different results. A clause that grants access may say nothing about costs. Another clause may impose a duty on the road owner but permit recovery from users. Do not infer a formula from the fact that neighbors have historically paid equal amounts.
Maintenance, repair, and improvement are different bills
The classification of the work can decide whether a contribution is owed. Routine maintenance generally preserves an existing road: grading gravel, filling potholes, clearing snow, repairing ordinary washouts, cleaning culverts, and maintaining drainage. A repair restores a failed or damaged feature. An improvement adds capacity or changes the road, such as widening it, paving a gravel surface, relocating the route, installing a new bridge, or building a new drainage system.

Ventura County Public Works Agency’s explanation of California Civil Code § 845 says that, absent an agreement, costs for an easement serving parcels under different ownership are generally proportionate to use, while users generally cannot be compelled to pay for improvements beyond keeping the easement in good repair. See the county’s Private Property/Roads Frequently Asked Questions.
Maine’s private-road association statute also distinguishes repairs and maintenance from paving. Its framework includes limited exceptions for paving approved under the statute’s specified voting standard or shown to be cost-effective for erosion control or repair of existing pavement. It separately addresses drainage infrastructure located under an easement. Those provisions apply to Maine associations and should not be transplanted to another state. The statute is available at 23 M.R.S. § 3101.

Questions to ask before dividing a bill
- What condition or hazard makes the work necessary?
- Does the proposal restore an existing feature or add a new one?
- Which parcels or users receive a practical benefit?
- Does a recorded document authorize the work and the proposed assessment?
- Is notice, a meeting, a vote, or a supermajority required?
- Are permits, engineering plans, or drainage approvals needed?
Obtain a written scope, at least one itemized estimate, and the proposed allocation before work begins. Keep photographs, inspection notes, bids, invoices, meeting notices, minutes, votes, and payment records.

| Maine | For qualifying residential properties sharing a common benefit, owners share equally when the private road is the primary means of access and no agreement or other statutory method controls. | The rule concerns reasonable and necessary repairs and maintenance, includes notice and due-process requirements, and applies only within the scope of 23 M.R.S. § 3121. |
| Rhode Island | Owners of multiple benefited residential properties share costs in proportion to the benefit each receives. | Market or assessed value is not the measure of benefit. An owner who directly or indirectly damages part of the easement bears restoration costs under R.I. Gen. Laws § 34-9.1-2. |
| Vermont | Each person enjoying a common benefit contributes rateably to maintenance. | 19 V.S.A. Chapter 27 addresses maintenance in the absence of an express agreement or requirement and allows a civil action to enforce the contribution duty. |
| California guidance | Ventura County summarizes Civil Code § 845 as allocating costs according to the owners’ agreement or, without one, proportionate to use. | The county says users generally cannot be forced to fund improvements without an agreement, apart from keeping the easement in good repair. Confirm current state law and the documents for the property. |
Maine: equal shares only after the statutory conditions are met
Maine’s statute first looks for an agreement, deed restriction, covenant, declaration, road association, or elected statutory method. If none controls, qualifying residential owners who share a common benefit generally divide reasonable and necessary repair and maintenance costs equally when the private road is the primary means of access. “Equal” does not mean every person in a household; it refers to the owners or properties covered by the statute. The statute also requires reasonable notice and due process before the default contribution is enforced.
Maine provides a path to recover an unpaid share after written demand. A demand should identify the work, amount claimed, allocation method, supporting invoices, and deadline, while complying with the statute and any governing agreement.
Rhode Island: benefit, not assessed value
Rhode Island’s default focuses on the benefit each residential property receives from a private easement or right-of-way. A property that uses the route for its only access may receive a different benefit from a parcel with an alternative route, but the statute’s application depends on the facts and the legal definitions. The statute expressly says market or assessed value is not used to calculate benefit.

Damage is treated separately. If one owner’s driving, construction, or other conduct damages a portion of the easement, that owner can be responsible for restoring the damaged portion rather than shifting the cost to every beneficiary.
Vermont: rateable contribution and a civil action
Vermont’s statute states: “In the absence of an express agreement or requirement governing maintenance of a private road, when more than one person enjoys a common benefit from a private road each person shall contribute rateably to the cost of maintaining the private road and shall have the right to bring a civil action to enforce the requirement of this section.” That language comes from the Vermont Legislature’s 19 V.S.A. § 2702.
“Rateably” is not automatically the same as equal shares. Determine how the statute and Vermont cases apply to the number of users, the nature of their benefit, and the work at issue. An agreement can replace the statutory default if it is enforceable and covers the dispute.
California: follow the agreement or proportionate use
Ventura County’s public-works FAQ explains the county’s understanding of California Civil Code § 845 for private easements. Where multiple owners use an easement, the agreement controls; absent an agreement, costs generally follow proportionate use. The county’s guidance also cautions that an improvement is not the same as keeping the easement in good repair. Because the FAQ is county guidance rather than a ruling in a particular dispute, verify the current statute, relevant cases, and recorded documents.

- Identify the legal users. List every parcel, easement holder, road owner, association, and tenant whose rights are relevant. A tenant’s use may be counted through the owner’s parcel, depending on the documents and law.
- Define the project. Separate snow removal, grading, drainage repair, emergency work, reconstruction, paving, widening, and other items. A single contractor proposal may contain both maintenance and improvement work.
- Find the controlling rule. Quote the exact paragraph in the easement, declaration, agreement, or bylaws. If the documents are silent, identify the current state statute and any controlling decisions.
- Choose the legally relevant measure. The applicable measure may be equal shares, use, benefit, rateable contribution, frontage, vehicle intensity, or another formula. Use only a measure authorized by the governing instrument or law.
- Check approval and notice. Confirm who may call a meeting, approve an assessment, sign a contract, and issue a demand. Emergency authority may differ from authority for elective improvements.
- Document the arithmetic. Show the total contract price, credits, reserves, contingency, each parcel’s factor, and each resulting share. State whether the amount is a one-time assessment or recurring charge.
- Collect and account. Send an itemized invoice with payment instructions and a deadline. Deposit funds in the account required by the association or agreement and retain proof of payment.
- Handle objections in writing. Ask an objecting owner to identify the document, factual assumption, or calculation being challenged. Do not begin litigation or withhold an undisputed amount without checking local requirements.
Illustrative arithmetic, not a legal formula
Suppose three parcels receive the same access benefit and an enforceable rule requires equal shares for a $12,000 repair. The arithmetic would be $4,000 per parcel. If a valid use-based rule assigned factors of 1, 2, and 3, the six total factors would produce shares of $2,000, $4,000, and $6,000. These examples only demonstrate how a stated formula works; they do not establish which formula your state or documents require.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Road associations and shared decisions
An association can make recurring maintenance easier by setting a calendar, reserve policy, bidding process, and emergency procedure. Its governing documents should state who votes, what notice is required, how quorum is calculated, whether owners may vote by proxy, and how assessments become liens or personal obligations.
Maine’s road-association framework addresses meetings, maintenance, repairs, and control of certain drainage infrastructure. It illustrates why an association should record notices, attendance, votes, contracts, and allocation schedules rather than rely on informal group messages. A rule adopted without the required meeting or vote may be challenged even if the work itself is sensible.
Emergency work
A washout blocking the only access route may require immediate stabilization. Before authorizing it, check whether the documents permit emergency spending and whether state law allows later recovery. Notify every affected owner as soon as practical, describe the danger, preserve before-and-after photographs, and obtain a written contractor explanation of why delay would increase damage or risk.
When one owner causes the damage
Shared maintenance does not necessarily mean shared responsibility for avoidable damage. Heavy trucks, excavation, inadequate drainage changes, or construction traffic may damage only a segment of the road. Rhode Island’s statute expressly assigns restoration costs to an owner who directly or indirectly damages part of an easement. Other states may use negligence, nuisance, contract, or easement principles instead.

Document the date, vehicle or activity, weather, location, photographs, witness accounts, and repair estimate. Avoid accusing an owner without evidence. If the road also needs ordinary maintenance, separate the damage claim from the general assessment so that each amount has a defensible basis.
What to do when someone will not pay
Start with a written demand that cites the governing clause or statute, attaches the approved scope and invoice, explains the allocation calculation, and gives the required response period. Confirm whether the agreement requires mediation, arbitration, a meeting, or a second notice.
Enforcement varies. Maine permits a residential owner or owners sharing the common benefit to pursue an unpaid share after written demand under its statute. Vermont provides a civil action to enforce its default contribution requirement. Ventura County explains that a maintenance obligation under the California law it summarizes may be enforced through civil action. These remedies are jurisdiction-specific and do not guarantee recovery in every factual situation.

Document checklist for owners
- Recorded easement, right-of-way, and plats
- Current deeds and title commitments for every benefited parcel
- Covenants, declarations, subdivision restrictions, and HOA rules
- Road-association articles, bylaws, assessment schedules, and prior minutes
- Written maintenance agreements and amendments
- Contractor scopes, bids, permits, invoices, warranties, and proof of payment
- Photographs, drainage reports, inspection notes, and incident records
- Meeting notices, ballots, proxies, quorum records, and vote results
- Written demands, objections, payment plans, and settlement communications
Keep the records with the property file, not only in one neighbor’s email account. Future owners, lenders, and contractors may need to understand why an assessment was made and whether a reserve or continuing obligation exists.
Bottom line for a private-road bill
The person who owns the road is not automatically the only person who pays, and the person who uses it is not automatically liable for every project. The enforceable easement, deed, covenant, maintenance agreement, or association rule comes first. If those sources are silent, apply the law of the road’s state—carefully distinguishing equal shares, benefit, rateable contribution, and proportionate use—and classify the work as maintenance, repair, or improvement before sending or accepting a bill.
