If both people signed the mortgage note as co-borrowers, each generally remains responsible to the lender for the entire payment and, in many loan agreements, the full outstanding balance. A private agreement to split the bill, a move-out, a deed transfer, or a divorce decree usually does not change that obligation unless the lender formally releases a borrower, the loan is refinanced or assumed under approved terms, or the mortgage is paid off. If one borrower misses a contribution, the other may need to cover the shortage to prevent delinquency, credit damage and possible foreclosure.
This is general U.S. consumer information. The signed promissory note, mortgage or deed of trust, loan program, account status and state law control the result in a specific case.

The lender follows the loan documents, not the household’s payment arrangement
A co-borrower is not merely someone who helps with a monthly bill. The Consumer Financial Protection Bureau (CFPB) defines a co-signer or co-borrower as someone who agrees to take full responsibility to repay a mortgage loan with the other borrower. That means the lender can generally seek the entire contractual payment from either borrower when the other does not pay.

Suppose two borrowers agree that one will pay 60% and the other 40%. If the 40% contribution never arrives, the lender can still treat the account as short unless the full required payment is received. The lender is not bound by the borrowers’ private split. The borrower who advances the missing amount may have a separate claim for reimbursement under a written agreement or applicable state law, but that private dispute does not excuse an incomplete mortgage payment.

Joint liability can extend beyond the monthly installment
Mortgage notes commonly make each signer responsible for the debt. If the loan is accelerated after a serious default, that responsibility can include the unpaid principal, interest, fees and other amounts allowed by the contract and law. The exact language matters, so read the note rather than relying on labels such as “co-borrower,” “co-signer” or “secondary borrower.”
Ownership and debt are different
A deed identifies ownership interests in the property; it does not by itself prove who is personally liable on the promissory note. Conversely, a co-signer may owe the debt without receiving an ownership interest, depending on the loan documents and program. Review the note and the mortgage or deed of trust to determine who promised to pay and what property rights were granted as security.
What a missed contribution does to the mortgage account
The practical issue is whether the servicer received the full amount due by the contractual deadline and how the account is coded under the loan terms. A payment that is short, late or not received can place the loan into delinquency. Both borrowers can be affected even when only one person stopped sending money.

CFPB guidance explains that when co-borrowers agree to divide payments and one fails to contribute, the payment may remain incomplete and both borrowers’ credit can suffer. The effect depends on the account history, what the servicer reports and applicable credit-reporting rules; no reliable score-point loss can be predicted without those facts.

Foreclosure information generally remains on a credit report for seven years, according to CFPB consumer guidance published in 2024. That is a general reporting statement, not a guarantee that every foreclosure record will appear for exactly that period or that other negative information will follow the same timetable.
The home is collateral for the debt
The mortgage or deed of trust gives the lender foreclosure rights if the contractual requirements are not met. A delinquency notice should identify the amount needed to bring the loan current and describe potential consequences, including foreclosure where applicable. Receiving a notice does not mean foreclosure is inevitable, but ignoring notices removes time that could be used to correct the account or seek an alternative.
What to do as soon as one borrower misses a payment
- Check who signed and what was promised. Obtain the executed promissory note and mortgage or deed of trust. Confirm every borrower, the payment terms, grace provisions, late charges and notice addresses. Do not infer liability solely from a deed or from who normally makes the payment.
- Contact the mortgage servicer. Ask for the current status, a transaction history, the exact amount required to bring the loan current and copies of any delinquency notices. Request the answer in writing or through the servicer’s secure message system, and record the date, representative and reference number for every call.
- Protect the account while sorting out the private dispute. If possible, make the full contractual payment rather than sending only the portion assigned in a household agreement. Ask how a partial payment will be handled; some servicers may return it, hold it or apply it under specific rules. Keep proof of every payment.
- Ask about loss mitigation. If the household cannot make the full payment, ask the servicer what payment assistance, repayment, modification or other loss-mitigation options are available. A HUD-approved housing counselor can help organize the documents and communicate with the servicer.
- Escalate a servicing error in writing. If a payment was made but not credited, or the transaction history is wrong, use the servicer’s designated notice-of-error or request-for-information process. Follow the address and content instructions in the periodic statement or the servicer’s website, send copies rather than originals, and retain delivery evidence.
CFPB guidance describes a 60-day protection against furnishing negative information about a payment that is the subject of a properly reported servicing error. This does not create a blanket pause on all credit reporting, eliminate the amount owed or stop foreclosure deadlines. Continue working with the servicer while the error is investigated.

Private payment agreements
An agreement between co-borrowers can allocate costs between them, but it generally cannot amend the lender’s contract. Put the arrangement in writing, state who pays what and by when, and specify how a shortfall will be funded. Even a detailed agreement usually gives the nonpaying borrower a reimbursement obligation rather than releasing either person from the mortgage.

Moving out
Leaving the home does not remove a signer from the note. The departing borrower can remain liable while the remaining borrower occupies the property. Moving out may also create practical issues involving insurance, maintenance and access, but those issues do not change the lender’s rights.
Transferring title
Signing a deed to another owner changes an ownership interest; it does not automatically remove the transferor from the mortgage debt. A title transfer without a lender-approved change can leave the former owner liable while no longer holding the property. Ask the servicer whether the loan permits an assumption or release and what underwriting is required.
Divorce and separation: what changes and what does not
A divorce decree can assign responsibility between former spouses. For example, it may order one spouse to make every mortgage payment or require the home to be sold. That order governs the spouses’ relationship, but the original lender generally retains the rights granted by the loan until it releases a borrower or the debt is otherwise changed or paid.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsCFPB divorce guidance identifies two common ways to remove a former spouse from ongoing mortgage exposure: the remaining spouse may refinance into a new loan, or the home may be sold and the existing mortgage paid from the proceeds. Whether an assumption, novation or release is available is contract- and program-specific. Obtain the servicer’s written requirements instead of assuming a decree, quitclaim deed or informal promise is sufficient.

If a decree says the other spouse must pay
Continue monitoring the loan even if the decree assigns payment responsibility elsewhere. Request statements and delinquency notices, and act promptly if the ordered payer misses a payment. A court may provide remedies between former spouses, but only the lender or a valid loan transaction can change the creditor’s collection rights.
Resolution routes when one borrower wants to keep the home
| Route | What it can accomplish | Questions to resolve |
|---|---|---|
| Cover the shortfall temporarily | Keeps the existing loan current while the borrowers address reimbursement or another long-term plan. | Can the paying borrower afford the full payment, and is there a written repayment plan? |
| Repayment or settlement between borrowers | Documents how an advance will be repaid; it does not itself release anyone from the mortgage. | What security, deadlines and enforcement rights apply under state law? |
| Refinance into one borrower’s name | Can replace the joint loan and remove the departing borrower if the new lender approves the application. | Does the remaining borrower qualify alone, and do income, credit, equity, rates and closing costs make the payment affordable? |
| Lender-approved assumption or release | May transfer the loan or release a borrower without a standard refinance when the contract and lender program permit it. | Does this specific loan allow assumption or release, and what approval and underwriting are required? |
| Sell the property | Uses sale proceeds to pay the mortgage and can end both borrowers’ ongoing loan exposure if the debt is fully paid. | Will the sale price cover principal, interest, fees and selling costs? What happens if proceeds are insufficient? |
CFPB identifies refinancing or sale as common paths when co-borrowers part ways. The right route depends on lender approval, affordability, available equity and the urgency of the delinquency. Do not delay a sale or refinance application while foreclosure notices are advancing; ask the servicer how the application affects deadlines.

Co-borrower or co-signer
Both roles can involve responsibility for repayment, but the documents determine the scope. A co-borrower may also receive ownership rights, while a co-signer can have no ownership interest. Examine the note, riders and closing documents for each person’s signature and obligations.

A spouse is not automatically a co-borrower on every mortgage. CFPB explains that a spouse may not have to sign an individual mortgage application if the applicant qualifies alone, although a joint-credit application or state-law requirements concerning marital property or collateral can require another signature. Marriage alone therefore does not answer who owes the debt.

Person listed only on the deed
Being on title can provide ownership rights without creating personal liability on the note. Removing someone from title also does not prove that the lender released that person from the debt. Verify both documents separately.
When to involve a counselor or attorney
Get individualized help promptly when the account is delinquent, a foreclosure notice has arrived, the borrowers are divorcing, the payment history is disputed, or the property may sell for less than the debt. A HUD-approved housing counselor can help evaluate loss mitigation. A qualified local attorney can explain state-specific rules on deficiency liability, divorce orders, deed transfers, reimbursement claims, foreclosure procedure and bankruptcy. The CFPB advises checking state law and the original agreement because those details can change the analysis.
Questions to ask the servicer
- What is the loan’s exact delinquency status and the total amount needed to bring it current?
- How were the last payments applied, and can you provide the complete transaction history?
- What loss-mitigation programs are available, and what documents and deadlines apply?
- Does this loan permit an assumption, borrower release or other approved transfer?
- What is the deadline for responding to the latest notice, and how will a pending application affect that deadline?
- Where must a notice of error or request for information be sent?
Illustrative examples
One borrower stops paying after moving out
Both borrowers signed the note, and the departing borrower stops sending half the payment. The remaining borrower must generally pay the full amount or risk delinquency. The departing borrower’s move-out does not end liability. The borrowers can document reimbursement, seek a refinance or approved release, or sell the home.
A divorce decree assigns the mortgage to one spouse
The decree orders Spouse A to pay, but both names remain on the original loan. If Spouse A misses payments, the servicer can generally pursue either named borrower under the note. Spouse B should monitor the account and seek a refinance, approved release or sale rather than relying solely on the decree.
A payment was made but not credited
The borrower sends proof of payment, requests the transaction history and submits a written notice of error through the servicer’s designated process. The borrower keeps copies and delivery records, continues responding to notices and does not assume the dispute automatically suspends all reporting or foreclosure activity.
Bottom line for a missed co-borrower payment
When two people signed the mortgage loan, the lender generally can require either one to cover the full contractual payment. Covering a shortfall may protect the account, but it does not settle the underlying dispute or release the nonpaying borrower. Confirm liability from the note and security instrument, obtain the servicer’s account figures, challenge errors in writing and pursue an approved refinance, assumption, release or sale when the borrowers will no longer share the loan. For foreclosure, divorce or state-law questions, use a HUD-approved counselor or qualified local attorney without waiting for the situation to worsen.
