Who Is Affected by Canada’s Foreign Buyer Ban? Exceptions, Property Rules and 2026 Expiry

Canada’s federal foreign-buyer ban generally prevents a “non-Canadian” from directly or indirectly buying covered residential property. The rule is narrower than a blanket ban on all foreign real estate purchases: buyer status, corporate control, the property’s location and building type, and specific exceptions all matter.

As of the September 2026 federal consolidations, the temporary prohibition is scheduled to expire on January 1, 2027. That date could be amended, so anyone planning a purchase should verify the live law and obtain transaction-specific legal advice.

What the federal ban prohibits

The Prohibition on the Purchase of Residential Property by Non-Canadians Act prohibits a non-Canadian from purchasing residential property in Canada, either directly or indirectly, unless an exception applies or the property and transaction fall outside the Act’s scope.

“Indirectly” matters. A buyer cannot necessarily avoid the prohibition by using a corporation, trust, partnership or another arrangement. The Regulations contain detailed control and ownership tests for entities. It is therefore inaccurate to say that every company with a foreign shareholder is automatically prohibited, but it is equally unsafe to assume that incorporating removes the restriction.

The federal rule is only one part of a purchase analysis. Provincial or territorial taxes, municipal rules, immigration conditions, financing requirements and ordinary conveyancing obligations can still apply even when the federal prohibition does not.

Who is a non-Canadian?

Individuals without Canadian citizenship or permanent residence

An individual is generally a non-Canadian if they are neither a Canadian citizen nor a permanent resident. A temporary resident’s visa, study permit or work permit does not by itself create the same status as permanent residence. Temporary residents must fit one of the specific regulatory exceptions described below.

Corporations and other entities controlled by non-Canadians

The Act also reaches certain corporations and other entities controlled by non-Canadians. Control is determined under the legislation and Regulations, not by a simple rule such as “foreign shareholders equal a ban.” Ownership percentages, voting rights and other structural facts can change the result.

Because the entity provisions are technical, a proposed purchase through a corporation, partnership, trust or nominee should be reviewed before an offer is signed. Changing the ownership structure after a transaction is negotiated may not cure a prohibited purchase and can create additional tax or liability issues.

Which properties are covered?

Residential property within the statutory definition

The federal definition generally includes a building containing three dwelling units or fewer. It also includes separately owned residential units, such as a semi-detached house, a rowhouse unit or a residential condominium unit.

The definition is about the property and its legal characteristics, not just the buyer’s intention. A home intended as a rental can still be covered, and a property described casually as a “multi-unit” building may need a precise unit count and title review.

Larger multi-unit buildings

Larger multi-unit buildings are outside the federal prohibition’s residential-property definition. The parliamentary explanation of the Act distinguishes these buildings from properties with three dwelling units or fewer. A buyer should confirm the building’s unit count and legal classification rather than relying on a listing headline.

Geographic limit: census metropolitan areas and census agglomerations

The prohibition does not cover residential property outside a census metropolitan area (CMA) or census agglomeration (CA), using Statistics Canada’s Standard Geographical Classification 2021. This means the answer can differ between a property near a major city and one outside the relevant CMA or CA boundary.

“Outside Toronto” or “outside Vancouver” is not a legal test by itself. A municipality’s name, postal address or distance from a city centre does not establish whether the parcel is inside a designated CMA or CA. The property’s location must be checked against the applicable statistical geography.

Vacant land and development acquisitions

Vacant land is excluded from the prohibition under the current framework. The Regulations also provide an exception for certain acquisitions made for development. These provisions are not a general permission to buy a home and later describe it as an investment project; the transaction must satisfy the applicable regulatory requirements.

Federal exceptions by buyer status

Protected persons

The Act exempts a protected person within the meaning of the Immigration and Refugee Protection Act. The exemption depends on the buyer’s legally recognized protected-person status, not simply on having made a refugee claim or facing a difficult immigration situation.

International students

Student status alone is not enough. A temporary resident relying on the student exception must satisfy the full set of prescribed conditions:

  • Be enrolled in an authorized program at a designated learning institution.
  • Have filed Canadian income tax returns for each of the five taxation years before the purchase.
  • Have been physically present in Canada for at least 244 days in each of the five calendar years before the purchase.
  • Purchase the property for no more than $500,000.
  • Not have previously purchased more than one residential property.

Every condition is cumulative. For example, a student who has been in Canada for five years but missed the 244-day presence threshold in one of those calendar years may not qualify. The price ceiling is also a maximum purchase price for this exception, not a general statement that all students can buy property below that amount.

People with work permits or work authorization

A temporary resident with a qualifying work permit, or authorization to work under the referenced immigration regulations, may qualify if all prescribed conditions are met. On the purchase date, the person must have at least 183 days remaining on the qualifying authorization and must not have previously purchased more than one residential property.

The remaining-validity test is measured on the purchase date. A permit that expires soon after closing may still qualify if it has the required 183 days remaining when the purchase occurs; a permit with less time remaining does not satisfy this exception merely because renewal is expected.

Diplomatic, consular and specified official statuses

The Regulations prescribe exceptions for foreign nationals holding specified diplomatic, consular, official or special-representative acceptances. The wording is status-specific. Employment by a foreign government or an international organization does not automatically establish eligibility unless the person holds the status identified in the Regulations.

Specified safe-haven public-policy categories

Certain temporary residents whose status followed a specified public-policy safe-haven exemption may also fall within a regulatory exception. This is not a broad exception for anyone who entered Canada for humanitarian reasons; the immigration category and the relevant public policy must match the prescribed rule.

Buying with a Canadian spouse or common-law partner

A non-Canadian may purchase with a spouse or common-law partner who is one of the following:

  • A Canadian citizen.
  • A person registered under the Indian Act.
  • A permanent resident.
  • A temporary resident who meets one of the qualifying temporary-resident exceptions.
  • A protected person covered by the Act’s exemption.

The relationship and the partner’s legal status must be established at the time of the transaction. Simply adding a Canadian friend, business associate or informal co-buyer does not create this exception. Couples should also consider how title, beneficial ownership, financing and provincial land-transfer rules interact with the federal analysis.

Four tests to apply before making an offer

A practical eligibility review follows four separate axes. Passing one does not compensate for failing another.

  1. Buyer or entity status: Determine whether each buyer is a Canadian citizen, permanent resident, protected person, qualifying temporary resident or non-Canadian. For an entity, document ownership, voting rights and control.
  2. Location: Confirm whether the parcel is inside a CMA or CA under the 2021 Standard Geographical Classification. Do not rely only on the municipality’s common name.
  3. Property type: Verify whether the property is a covered building of three dwelling units or fewer, a separately owned unit, a larger multi-unit building, vacant land or another category.
  4. Exception conditions and purchase history: If relying on a student, work-permit, partner, diplomatic, protected-person or development exception, collect proof of every condition and check whether the buyer has previously purchased residential property.

Quick comparison of common situations

Situation Federal result What must still be verified
Foreign national buying a condominium in a CMA Generally prohibited unless an exception applies. Buyer status, any applicable exception and prior purchases.
International student buying a home for $500,000 or less Potentially allowed only if every student condition is met. Five tax returns, 244 days of physical presence in each of five calendar years, DLI enrollment and purchase history.
Work-permit holder with 183 or more days remaining Potentially allowed under the work-authorization exception. Qualifying authorization, exact remaining validity on purchase date and prior purchases.
Non-Canadian buying with a Canadian spouse Potentially allowed if the spouse has a listed status and the relationship qualifies. Marriage or common-law evidence, partner’s status, title and beneficial ownership.
Non-Canadian buying vacant land Outside the prohibition under the current framework. Whether the parcel is legally vacant land and whether other federal, provincial or municipal rules apply.
Non-Canadian buying a qualifying development site Potentially exempt under the development provisions. Whether the acquisition and intended use meet the Regulations’ requirements.
Non-Canadian buying a building with more than three dwelling units Outside the Act’s residential-property definition as described in the federal explanation. Unit count, title classification and local rules.
Non-Canadian buying property outside a CMA or CA Outside the federal prohibition’s geographic scope. Official statistical geography for the specific parcel.

What the ban does not decide

Federal eligibility is not a complete affordability or closing analysis. A purchase may still trigger provincial or territorial non-resident taxes, municipal requirements, zoning restrictions, financing conditions, insurance rules and immigration consequences. Conversely, a provincial rule cannot be treated as proof that the federal Act applies to a property.

The federal materials do not provide a complete survey of every local rule. Buyers should ask a Canadian real-estate lawyer and, where relevant, an immigration professional to review the exact buyer, entity, property, title structure and jurisdiction before signing.

Expiry date and enforcement

The Department of Finance announced a two-year extension that sets the ban’s scheduled end at January 1, 2027, while retaining the existing exceptions. The announcement establishes the scheduled expiry, not what Parliament or the government may do afterward. Confirm the current consolidated Act, Regulations and any extension immediately before relying on the date.

The federal parliamentary explanation states that a person convicted of violating the Act may face a fine of up to $10,000. A court may order the non-Canadian to sell the property. A person who knowingly assists a prohibited purchase can also face liability. These consequences make a written eligibility assessment worthwhile when any fact is uncertain.

Why the policy exists—and what the official statement does not prove

When the extension was announced in 2024, Deputy Prime Minister and Minister of Finance Chrystia Freeland said: “By extending the foreign buyer ban, we will ensure houses are used as homes for Canadian families to live in and do not become a speculative financial asset class. The government is intent on using all possible tools to make housing more affordable for Canadians across the country.”

That quotation describes policy intent. It is not evidence, by itself, that the ban changed home prices, reduced speculation or improved affordability. No central statistic establishing those outcomes is included in the governing explanations summarized here.

Documents to assemble for a real transaction

  • Passport and immigration documents for every individual buyer.
  • Proof of citizenship, permanent residence, protected-person status or the specific temporary-resident category being claimed.
  • For students, designated-learning-institution enrollment records, five years of Canadian tax filings and evidence of physical presence for each required year.
  • For work-permit holders, the permit or work authorization showing at least 183 days remaining on the purchase date.
  • Evidence of marriage or common-law status and the partner’s qualifying legal status, if relying on the partner exception.
  • Corporate, trust or partnership records showing ownership, voting rights and control.
  • The parcel’s legal description, unit count, title information and evidence of CMA or CA location.
  • Development plans and supporting documents if relying on the development exception.

Have counsel review these documents before the offer becomes binding. A real-estate agent’s description, a lender’s pre-approval or a seller’s assurance is not a legal determination that the Act does not apply.

Bottom line for common reader questions

Can a foreigner buy a house in Canada?

Usually not if the buyer is a non-Canadian and the house is covered residential property inside a CMA or CA, unless a statutory or regulatory exception applies. Properties outside the geographic scope, vacant land, certain development acquisitions and larger multi-unit buildings can produce a different result.

Can an international student buy a home?

Only if the student meets every prescribed condition, including the five-year tax-filing and physical-presence requirements, the $500,000 price limit and the one-property limit.

Can someone on a work permit buy?

Possibly, but the person needs qualifying work authorization with at least 183 days remaining on the purchase date and must not have purchased more than one residential property.

Does the ban apply outside Toronto or Vancouver?

It applies based on CMA or CA geography, not a city’s reputation or distance from downtown. A property outside a designated CMA or CA is outside the federal prohibition, subject to confirmation of the parcel’s official location.

Can a non-Canadian buy with a Canadian spouse?

Yes, potentially, when the spouse or common-law partner has one of the listed qualifying statuses and the relationship and ownership structure satisfy the applicable rules.
