Who Can Submit Form 121 for EPF Withdrawal? Eligibility Rules and Filing Timing

Form 121 is a tax declaration for requesting no tax deducted at source (TDS) on an eligible payment when your estimated tax liability for the relevant tax year is nil. It is not the application that withdraws your Employees’ Provident Fund (EPF) balance. EPFO’s April 13, 2026 guidance identifies Form 121 as the consolidated replacement for Forms 15G and 15H for TDS-exempted incomes.

The current official summary describes eligible resident individuals and specified eligible entities as potential declarants, while excluding companies, firms and non-residents. Your declaration must accurately state that your estimated tax liability is nil, and it should reach the payer before the income is credited or paid.

What Form 121 does in an EPF withdrawal

Form 121 deals only with the tax treatment of a payment. It asks the payer or deductor not to deduct TDS because the declarant expects no income-tax liability for the relevant tax year. Submitting it does not approve an EPF claim, release your provident-fund balance or replace the EPFO withdrawal forms and identity checks used for the claim itself.

The Income Tax Department’s Form 121 manual describes it this way: “Form No.121 is a statutory declaration prescribed under the Income Tax Rules, 2026, through which a taxpayer declares that tax liability on its estimated total income for the relevant tax year is nil.” That wording makes the central test a tax-liability test, not simply an EPF-membership test.

For an EPF member, the practical sequence is therefore two separate decisions:

  • Whether you are allowed to submit the tax declaration under the current Form 121 rules.
  • Whether you meet EPFO’s current rules for making the particular withdrawal or settlement claim.

A person can satisfy one of those tests and fail the other. Form 121 cannot cure an ineligible EPF claim, and an otherwise valid EPF claim does not automatically justify a nil-tax declaration.

Who may submit Form 121

Resident individuals

EPFO’s April 2026 circular summary identifies eligible residents as users of the consolidated Form 121. A resident individual may therefore be within the intended category, provided the declaration is truthful and the person’s estimated tax liability for the relevant tax year is nil.

Residence status and tax liability are separate questions. Being resident does not by itself establish eligibility; you still have to calculate your estimated total income under the applicable tax rules and determine whether the resulting liability is nil.

Specified eligible entities

The same EPFO summary refers to “specified eligible entities.” It does not, in the accessible summary, provide a complete list of every entity type or all conditions attached to those entities. Treat that category as limited to entities expressly covered by the current Form 121 instructions rather than assuming that every non-individual taxpayer can file.

Categories expressly excluded in the EPFO summary

EPFO’s April 13, 2026 circular summary says that companies, firms and non-residents may not furnish Form 121. A company or firm should not submit the form merely because the payment is connected with an EPF account, and a non-resident should not rely on the resident-individual route.

Where an organisation’s legal status is unclear, confirm the category in the current official form instructions before sending a declaration. Do not alter the entity’s status to fit the form.

Eligibility tests to apply before you sign

1. Check your taxpayer category

Start by identifying whether you are a resident individual or another category specifically allowed by the current instructions. The 2026 EPFO summary excludes companies, firms and non-residents. The summary does not establish a universal rule for every other entity, so an entity should use Form 121 only when the official instructions clearly include it.

2. Calculate estimated total income for the tax year

Form 121 concerns estimated total income for the relevant tax year, not just the EPF amount. Prepare a reasonable projection of all income that belongs in your tax calculation for that year. Include the EPF-related payment and any other taxable income that the applicable tax rules require you to consider.

Use the tax year named in the current form and filing instructions. A declaration made for one year cannot be carried forward automatically to a later year if your income, residence, or tax rules change.

3. Confirm that estimated tax liability is nil

The declaration is appropriate only when your estimated tax liability is nil. “No TDS” and “no tax liability” are not interchangeable concepts: TDS is a collection mechanism, while tax liability is the amount ultimately due under the tax rules. Form 121 is a statement about the latter.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If your projection produces any tax liability, do not submit a nil-liability declaration. Recalculate using current rules or obtain qualified tax advice before choosing a different withholding treatment.

4. Verify that the payment is covered

Form 121 applies to specified payments for which the relevant rules permit a declaration. The EPFO circular index identifies the 2026 transition to Form 121 for TDS-exempted incomes, but the accessible summary does not set out every EPF payment type or every claim-screen condition.

Before filing, check the current EPFO claim interface and the Income Tax Department’s instructions for the exact payment and tax year. Do not assume that every withdrawal, transfer, advance or final settlement is treated identically.

5. Keep the declaration accurate

A nil-liability declaration is a statutory statement. Enter your legal name, taxpayer details, residence status and estimated figures exactly as required by the current form. Keep the calculations and supporting records that led you to the nil-liability conclusion. If circumstances change before payment, reassess whether the declaration remains correct.

How the 2026 change relates to Forms 15G and 15H

Older EPF guidance used two separate declarations. EPFO’s 2025 newsletter described Form 15G for resident individuals below age 60 and Hindu Undivided Families, and Form 15H for resident individuals aged 60 or older, in connection with TDS exemption on EPF withdrawals.

That age-based split is historical context, not a substitute for the current process. EPFO’s April 13, 2026 circular identifies Form 121 as the consolidated successor for TDS-exempted incomes. Use the form and version specified in the current EPFO and Income Tax Department instructions for the year of your payment.

Issue Earlier framework described by EPFO 2026 position identified by EPFO
Declaration forms Form 15G and Form 15H Consolidated Form 121
Form 15G category Resident individuals below age 60 and HUFs Historical description only
Form 15H category Resident individuals aged 60 or older Historical description only
Core tax condition Apply the rules in force at that time Estimated tax liability for the relevant tax year is nil
EPF-specific withdrawal threshold and claim-screen rules Not stated in the cited 2025 newsletter Not stated in the accessible 2026 EPFO summary or Income Tax Department manual

The table does not mean every former Form 15G or 15H user automatically qualifies for Form 121. Category, residence, estimated income, tax liability, payment type and the current year’s instructions all still matter.

Form 121 versus an EPF withdrawal claim

These documents serve different purposes and may involve different parties.

Question Form 121 EPF withdrawal claim
Primary purpose Request no TDS on a specified payment when estimated tax liability is nil Request payment, settlement or another permitted transaction from the EPF account
Decision being made Whether tax should be deducted at source Whether the member meets EPFO’s withdrawal or settlement rules
Key eligibility focus Taxpayer category and nil estimated tax liability Current EPFO claim conditions, account data and applicable withdrawal rules
Result of approval The payer may apply the permitted TDS treatment EPFO processes the underlying claim if all claim requirements are met

Because the forms answer different questions, an EPF member may need to complete the withdrawal claim even after making Form 121, and the payer may still require information or verification before processing the payment.

When to submit Form 121

The Income Tax Department manual says the declaration should ideally reach the payer before the income is credited or paid, preferably at the start of the tax year. Filing after the payment has already been credited may not produce the intended TDS result for that payment.

In practical terms, prepare the declaration as soon as you know a covered payment is expected and before the payer’s withholding event. If your EPF claim is already in progress, check whether the current claim channel presents a Form 121 option and whether it specifies a submission deadline.

What the official filing workflow says

The manual describes a payer or deductor-side process rather than a universal member-side EPF workflow. A deductor signs in to the income-tax e-filing portal using TAN credentials, selects the Form 121 filing option, enters payer and declarant details, uploads the prescribed data, completes verification and retains the acknowledgement.

  1. Confirm the responsible filer. Determine whether the payer, trustee or another deductor submits the declaration through its TAN account, or whether the current EPF channel asks you to provide the declaration directly.
  2. Use the current form option. Select Form 121 for the relevant tax year and payment type. Do not use an old Form 15G or 15H workflow unless the current official instructions expressly direct you to do so.
  3. Enter matching details. Ensure the declarant’s identity and tax information match the records used for the EPF claim and the payer’s TDS file.
  4. Submit before credit or payment. Observe the timing recommended by the Income Tax Department, ideally at the beginning of the tax year.
  5. Complete verification and save proof. Retain the acknowledgement or confirmation supplied by the filing channel, along with your calculation of estimated tax liability.

The TAN-based steps belong to the deductor workflow described in the manual. They should not be read as an instruction that every EPF member must personally log in with TAN credentials.

EPF-specific details that still need confirmation

The accessible official materials do not establish every EPF withdrawal threshold, service-period condition, claim-screen question or current member workflow associated with Form 121. Those details can affect whether TDS is relevant to your transaction, even when your tax estimate is nil.

Before submitting anything, use the current EPFO claim flow and current Income Tax Department guidance to verify:

  • The exact withdrawal or settlement type you are selecting.
  • Whether the payment is one for which Form 121 is accepted.
  • Any threshold, service-period or account-status condition displayed for that claim.
  • Whether the form is submitted by you, EPFO, a trustee or another payer.
  • The tax year and declaration version shown on the filing screen.

If the online claim screen and a prior article give different instructions, follow the current official screen and obtain clarification from EPFO or a qualified tax professional rather than filing an inaccurate declaration.

Common mistakes and how to avoid them

Confusing “no TDS” with “no tax”

Form 121 requires a nil estimated tax liability, not merely a preference to receive the full payment. Rework your estimate if any taxable income creates a liability.

Using the old age-based forms automatically

Forms 15G and 15H belong to the earlier framework described in EPFO’s 2025 newsletter. The 2026 circular identifies Form 121 as the consolidated successor, so check the current year’s instructions first.

Assuming resident status is enough

Resident status addresses only one eligibility dimension. You must also fit an allowed taxpayer category, have a covered payment and meet the nil-liability condition.

Submitting after payment

A declaration sent after the income is credited or paid may be too late for that withholding event. Submit before the payment whenever the current process permits.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Treating the declaration as withdrawal approval

Form 121 does not establish that EPFO must release funds. Complete the separate EPF claim and satisfy its current rules.

A practical pre-submission checklist

  • You are a resident individual or another category expressly allowed by the current Form 121 instructions.
  • You are not a company, firm or non-resident excluded by EPFO’s April 2026 summary.
  • You have estimated your total income for the correct tax year.
  • Your resulting estimated tax liability is nil.
  • The payment and EPF claim type are covered by the current instructions.
  • You are submitting before the income is credited or paid.
  • Your declaration details match your EPF and tax records.
  • You have saved the acknowledgement and your calculation records.
  • You have checked the current EPFO claim screen for any withdrawal-specific conditions that are not stated in the Form 121 manual.

When professional advice is sensible

Consider qualified Indian tax advice if you have several income sources, uncertain residence status, an entity account, changing income during the year or a tax projection that is close to producing a liability. Advice is also useful when the EPFO claim screen, the payer’s instructions and the tax form appear to conflict. The declaration should reflect your actual position; it should not be filed simply to avoid an immediate deduction.

Bottom line on Form 121 eligibility

Form 121 may be submitted by eligible resident individuals and specified eligible entities covered by the 2026 EPFO guidance, but not by companies, firms or non-residents listed as excluded. The decisive tax condition is nil estimated liability for the relevant year, and the declaration should reach the payer before credit or payment. Because Form 121 is only a TDS declaration, separately confirm the current EPF withdrawal rules, threshold and claim workflow before filing.
