Who Can Access Your Health Data? Questions to Ask a Clinic or Health App

Who can see your medical records depends on where the information is stored, who operates the service, how the data arrived there, and which laws apply. A doctor’s office, hospital, insurer, or a vendor working for one is usually subject to HIPAA. An independently chosen fitness, fertility, medication, wellness, or record-aggregation app may not be, even if you imported information from a clinic.

Before you connect an account or authorize a release, map the data flow: what is collected, who receives it, why it is shared, how it is protected, and what you can access, correct, export, disconnect, or delete. The questions below are designed for U.S. consumers and are practical prompts, not guarantees that every organization must answer in the same way.

Start with the clinic-versus-app distinction

HIPAA is a federal privacy and security framework for covered entities and their business associates. Qualifying doctors’ offices, hospitals, pharmacies, health plans, and other providers are generally covered entities. A technology or billing company handling protected health information for one of those organizations can be a business associate and have HIPAA obligations for that work.

HIPAA does not automatically follow health information wherever it goes. If you independently download an app and type in symptoms, upload a medical record, or connect a patient portal, the app is not protected by HIPAA merely because the information originated with a clinic. The key questions are whether the app is offered by or on behalf of a covered entity, whether it is acting as that entity’s business associate, what data it handles, and how it obtains and shares the data.

An app can still face other legal requirements. The Federal Trade Commission (FTC) Act prohibits unfair or deceptive privacy and security practices. The FTC’s Health Breach Notification Rule (HBNR) can apply to certain personal health record vendors, related entities, and service providers outside HIPAA. Coverage is fact-specific, and an unauthorized disclosure—not only a hacker intrusion—can qualify as a breach under the rule.

As FTC Bureau of Consumer Protection Director Samuel Levine put it in April 2024, “Protecting consumers’ sensitive health data is a high priority for the FTC.” That enforcement priority is not a promise that a particular app is HIPAA-covered or secure.

Who may access information held by a clinic?

People inside the practice

Access is normally assigned by job role and need. Clinicians may view records for treatment; billing and coding staff may need information for payment; and administrators, information-technology staff, or quality teams may access portions for permitted health-care operations. Ask which roles can see your full chart, which can see only billing or scheduling data, and how access is logged and reviewed.

Outside organizations

A clinic may use laboratories, transcription services, cloud-hosting companies, electronic-record vendors, claims processors, patient-portal providers, analytics tools, or collection agencies. When a vendor acts for the clinic and handles protected health information, a business-associate relationship and contract may apply. Other disclosures can be allowed by HIPAA or by your authorization. Request the clinic’s Notice of Privacy Practices and ask which categories of vendors receive or maintain your information.

Permitted disclosures are not the same as public access

HIPAA permits certain uses and disclosures without a separate authorization, including treatment, payment, and health-care operations, plus specific legal, public-health, and safety situations. Your record is not therefore “secret from everyone,” and a clinic may retain information required by law or professional rules. Ask what uses are automatic, which require your written authorization, and how to revoke an authorization. Revocation generally cannot undo disclosures already made, and some uses may continue when another legal basis applies.

Who may access data in an independent health app?

For an app you selected yourself, read the app’s current privacy notice and settings rather than relying on a “HIPAA compliant” label. That phrase may describe one product or integration and does not guarantee that every feature, advertising partner, analytics tool, or future use is governed by HIPAA.

Depending on the app, data may be visible to its employees and contractors, cloud and customer-support providers, analytics or advertising partners, connected wearable or device platforms, social-login providers, or other services you authorize. The app may collect information you enter, data imported from a portal or device, identifiers such as email and device IDs, location or usage information, and inferences generated from those inputs. Ask specifically about identifiable and sensitive data, not only the app’s headline feature.

If an app is offered by a clinic, insurer, or another covered entity—or is performing a service for one—it may fall within HIPAA for that relationship. The same company can have different obligations for different products or data flows, so ask about the exact account and connection you are using.

Clinic portal or independent app: a practical comparison

Question Clinic or covered-entity portal Independent consumer app
Does HIPAA generally apply? Usually, when the provider or plan is a covered entity; vendors working for it may be business associates. Not automatically. An app chosen independently may fall outside HIPAA even when you enter information copied from a medical record.
Who controls the account? The clinic, hospital, plan, or its contracted portal provider, subject to its notices and contracts. The app company and the terms and privacy settings you accept.
Typical data sources Records created or received by the provider, claims, messages, orders, and test results. User-entered data plus optional connections to portals, wearables, devices, platforms, or other apps.
Access and copying rights HIPAA generally gives you rights to inspect and obtain copies, including directing an electronic copy from an electronic health record to a person or app you choose. Rights depend on the app’s policy and other applicable law; do not assume a clinic’s HIPAA rights transfer to the app.
Breach and complaint routes Ask the organization’s privacy contact and use the federal HIPAA complaint process when appropriate. The FTC Act or HBNR may apply in some cases; state law may add remedies. Coverage is fact-specific.

Questions to ask your clinic before sharing or connecting records

Use these prompts with the privacy officer, medical-records department, or portal support team. Ask for written answers when the decision involves a large or sensitive record.

Questions to ask a health app before granting access

Coverage and responsibility

  • Is the app offered by or on behalf of a clinic, insurer, or other HIPAA-covered entity?
  • For this connection, is the company acting as a HIPAA business associate, or am I using an independent consumer service?
  • Which privacy laws and complaint channels does the company identify for this product?

Collection and inference

  • What health or behavioral inferences do you create from my inputs, and are those inferences stored with my identity?
  • Which sources can connect: a clinic portal, wearable, home device, operating-system health platform, pharmacy, or another app?

Sharing and commercial use

  • Which companies or service providers receive my data, including cloud, support, analytics, advertising, or social-media services?

Control, security, and closure

  • How do I view, export, correct, delete, or disconnect my data and connected accounts?
  • What happens to data already copied by another service after I disconnect an integration?
  • When I close my account, how long are production records and backups retained, and what must be kept for legal or fraud-prevention reasons?

  • How and when will you notify me if information is exposed or disclosed without authorization?

How to send clinic records to an app more safely

  1. Identify the destination. Confirm the exact app developer, account, website, and connected service. Avoid uploading a record to a similarly named or unverified destination.
  2. Read the current privacy notice and permissions screen. Note each data category, purpose, recipient, retention period, advertising choice, and deletion process. Save a copy because policies and integrations can change.
  3. Ask the clinic how the transfer works. A patient portal may use an authorization screen or an application programming interface (API). Ask whether the transfer is one-time or ongoing and how to stop future syncs.
  4. Limit the scope. Choose selected records, date ranges, or data types when the portal allows it. Do not grant continuous access when a one-time export answers your need.
  5. Use strong account protection. Enable multifactor authentication, use a unique password, review active sessions, and avoid sharing portal credentials directly with an app when an official authorization flow is available.
  6. Verify the result. Check what arrived in the app, whether identifiers are correct, and whether the app immediately shared data with other connected services.
  7. Disconnect and document. Revoke the portal connection when finished, then use the app’s export or deletion controls. Ask both organizations what copies, logs, and backups remain; deleting the app from your phone does not necessarily delete remote records.

What breach notifications can—and cannot—tell you

For a qualifying breach covered by the FTC Health Breach Notification Rule, affected individuals generally must be notified without unreasonable delay and within 60 calendar days after discovery. If at least 500 residents of a state or territory are affected, media notice may also be required; FTC notice timing differs depending on whether 500 or more people are involved. These are legal thresholds, not estimates of how often breaches occur.

The HBNR can cover certain personal health record vendors and related entities that have the technical capacity to draw identifiable health information from multiple sources and are managed, shared, and controlled by or primarily for the individual. Not every health app meets that definition. An unauthorized disclosure to an advertising or other recipient can matter even when no attacker “hacked” the system.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a notice arrives, identify what data was involved, the dates, recipients, and steps offered. Change reused passwords, revoke unnecessary connections, monitor affected accounts, and ask whether the company has deleted or recovered improperly disclosed data. A notice does not establish that every past or future use was unlawful; it describes a particular incident under the sender’s stated obligations.

State protections and limits of federal rules

This framework is U.S.-focused. State medical-record, consumer-privacy, breach-notice, and health-data laws can provide additional rights or impose different timelines. Rules also vary for minors, reproductive-health information, genetic data, substance-use treatment records, and employers or schools. If the stakes are high, ask the organization which state law governs your account and consult a qualified privacy or health-law professional.

For a clinic, request the Notice of Privacy Practices and your access and authorization options. For an independent app, treat the privacy notice, permissions, connection settings, and deletion terms as the controlling practical documents. The most reliable answer to “Who can see my medical records?” is a documented list of every system and recipient your data reaches—not a logo, label, or single word such as “HIPAA.”
