Some Indian income-tax penalties can be waived, reduced or replaced by statutory immunity, but there is no blanket waiver. The correct route depends on the tax year, whether the Income-tax Act, 1961 or Income-tax Act, 2025 governs the proceeding, the type of penalty, payment of tax and interest, and whether an appeal has already been filed. For tax years beginning before 1 April 2026, proceedings generally continue under the 1961 Act. Newer-year cases may involve the Dispute Resolution Committee (DRC) under section 379 or an Assessing Officer immunity application under section 440, using the currently revised Form 161 where applicable.
Start with the tax year and the governing Act
The first question is not “Can my penalty be waived?” but “Which law governs this proceeding?” The Income Tax Department’s transition guidance states that a proceeding relating to a tax year beginning before 1 April 2026 continues under the Income-tax Act, 1961, even when the proceeding starts after the Income-tax Act, 2025 comes into force. A tax year beginning on or after 1 April 2026 is dealt with under the 2025 Act framework.

Read the assessment, reassessment or penalty order and record the tax year, the section cited, the date the order was served, the demand raised, and whether an appeal or revision is pending. Do not transfer a form, deadline or section number from one Act to the other. In particular, do not assume that an older immunity provision or the former section 270AA conditions automatically apply to section 440 of the 2025 Act.
What kinds of relief are actually available?
“Waiver” can describe several legally different outcomes. A competent authority may cancel a penalty, reduce it, grant immunity from prosecution, or allow a taxpayer to avoid a penalty by satisfying statutory conditions. An appeal against the underlying addition or penalty is a separate remedy. A request for relief does not automatically extend an appeal deadline or replace an appeal unless the relevant scheme expressly makes that choice.

Dispute Resolution Committee: when it can help
What the DRC can decide
The Income Tax Department’s Form 34BC FAQ says the DRC may modify or vary a specified order, waive or reduce a penalty, grant immunity from prosecution under the applicable rule, or decline to modify the order. Relief is not automatic: the committee first decides whether the case is eligible and whether the statutory and procedural requirements have been met.
Eligibility is narrow
For the 2025 Act framework, the Department’s Appeals and Revisions FAQ describes the DRC as available where the variation is below Rs 10 lakh and the returned income is below Rs 50 lakh, subject to the other conditions. Those figures are statutory thresholds, not a guarantee that a penalty will be waived. The Income-tax Rules, 2026 describe exclusions involving specified searches, surveys and information received under an agreement. The rules also allow granted relief to be withdrawn if its conditions are breached.
The equivalent 1961 Act framework and the 2025 Act framework should be checked separately. Although section 379 substantially reenacts section 245MA and retains the material eligibility criteria, monetary thresholds and excluded-person categories described by the Department, the order and tax year still determine which provision applies.

How the DRC process works
- Identify the order and tax year. Confirm that the order is one the DRC is permitted to consider and that the relevant threshold and exclusion tests are satisfied.
- Prepare the Form 34BC application. Use the current official form and provide the order, computation, grounds, demand details and supporting records requested by the form.
- Disclose payment and appeal information. The committee’s procedure and the order may require payment of the demand where applicable, together with proof. State accurately whether any appeal, revision or other proceeding is pending.
- Respond to the committee. Explain the factual error, reasonable explanation or circumstances supporting modification, penalty reduction or immunity. Do not omit adverse facts; the committee can decline relief.
- Pay the amount required by the resolution. The FAQ describes payment of demand and submission of proof before the DRC issues a written order granting prosecution immunity and penalty waiver or reduction where applicable.
- Obtain the consequential order. The Jurisdictional Assessing Officer gives effect to the DRC resolution. Keep the resolution, payment challans and the consequential order together.
Timing and appeal consequences
The Form 34BC FAQ says the DRC should pass an order within six months from the end of the month in which the application is admitted. That is an administrative time frame, not a promise of approval or a reason to ignore a separate appeal deadline.
Acceptance has a major strategic consequence: the Department says an applicant cannot return to the Commissioner (Appeals) once the DRC application is accepted. It also says that no appeal or revision lies against the Assessing Officer’s order giving effect to the DRC resolution. Obtain professional advice before accepting the DRC route if you may want ordinary appellate review of the addition or penalty.

The explanation states that the changes take effect from 1 April 2026 for tax year 2026–27 and later years. The Department’s latest-news listing records CBDT Notification No. 134/2026 dated 8 October 2026, which notified a revised Form 161 for applications under section 440(2).
Why the final law and form must be checked
The Finance Bill material is explanatory, while the notification confirms issuance of the revised form but does not, by itself, set out every field and operative condition. Before relying on section 440, obtain the final amended statutory text, the notified rules and the complete current Form 161. Confirm the exact categories of misreporting or income covered, the payment calculation, the application deadline, required documents and the effect of any pending appeal.
Do not copy section 270AA conditions from the earlier regime into section 440. Similar terminology does not prove that the eligibility tests, tax-year coverage, additional-tax amount or deadline are identical.

Practical sequence for a section 440 application
- Verify coverage. Confirm that the tax year begins on or after 1 April 2026 and that the penalty or prosecution issue falls within the current section 440 wording.
- Check appeal status. The Finance Bill explanation includes a no-appeal condition. Determine whether an appeal has been filed, and obtain advice before withdrawing or foregoing one.
- Calculate statutory payments. Reconcile assessed tax and interest and calculate any additional income-tax payment required in lieu of penalty under the operative law.
- Use the revised Form 161. Complete the version notified on 8 October 2026 and attach the documents the form and rules require.
- File through the prescribed channel and retain proof. Keep the acknowledgement, payment records, order, correspondence and evidence supporting the application.
- Monitor the Assessing Officer’s decision. Immunity exists only if the statutory conditions are met and the competent authority grants it. A rejected application does not itself decide the merits of an underlying appeal.
Proceedings under the Income-tax Act, 1961
A pre-1 April 2026 tax-year proceeding remains under the 1961 Act. That Act contains different mechanisms, including provisions historically associated with discretionary waiver, reasonable-cause protection and conditional immunity. The available official material does not establish an exhaustive, current list of every legacy penalty that can be waived under sections such as 273A, 273B or 270AA.
Accordingly, identify the exact penalty section and verify its current text, rules, circulars and case-specific conditions. A reasonable-cause provision may defend against a penalty without being a discretionary “waiver”; a prosecution-immunity provision may not cancel the underlying tax; and a discretionary power may require a separate application to a specified authority. Treat those as different remedies rather than interchangeable labels.
Waiver request or appeal: keep the remedies separate
An appeal challenges the legal or factual basis of the assessment or penalty. A waiver or immunity application accepts that a statutory route may resolve the consequence if its conditions are met. Filing one does not automatically preserve the other.

- Section cited, date of service and current outstanding demand.
- Tax and interest payment challans and any demand-adjustment record.

- Current official form, notified rules and the authority’s jurisdiction.
Common mistakes that lead to rejection or lost rights
Using the wrong Act
A section number from the 2025 Act may not govern an earlier tax year. Start with the transition rule and the tax year printed on the order.
Assuming payment alone creates immunity
Payment of tax, interest or an additional amount is only one condition where the statute says so. The authority must still find that the case and application satisfy every requirement.
Ignoring excluded cases
Specified searches, surveys and information received under an agreement can exclude a case from the DRC framework. Check the 2026 Rules rather than relying on a general description of DRC relief.
Filing DRC without understanding finality
Once accepted, the DRC application prevents a return to the Commissioner (Appeals), and the Assessing Officer’s implementation order is not appealable or revisable according to the Department FAQ.
Calling every favourable outcome a “waiver”
Reduction, cancellation, prosecution immunity, reasonable-cause protection and settlement under a special scheme have different legal effects. Use the exact relief stated in the order.
A sensible next step
Make a one-page case summary showing the tax year, governing Act, penalty section, order date, demand, payments, appeal status and the relief sought. Compare that summary with the current Form 34BC or Form 161 instructions, as applicable. Because choosing DRC or a section 440 application can affect appeal rights, have a qualified Indian tax professional review the live order and deadlines before filing, withdrawing an appeal or accepting a resolution.
