What “covered” means under the 8th Pay Commission
The controlling document is the Ministry of Finance, Department of Expenditure resolution published in the Gazette of India on 3 November 2025. It directs the Commission to examine and recommend desirable and feasible changes to pay, allowances, facilities and other benefits for named categories of employees.
Being listed in the terms of reference (ToR) means that a group falls within the Commission’s subject matter. It does not mean that every member will receive the same increase, that a fitment factor has been fixed, or that an individual benefit exists before recommendations are accepted and implemented.

The resolution gives the Commission 18 months from its constitution to submit recommendations. The Prime Minister’s Office said the effect of recommendations would normally be expected from 1 January 2026, following the usual ten-year pattern. That wording describes an expectation, not a final implementation order.
The nine employee categories named in the Gazette
The Gazette’s employee list is broader than staff working in Central Government ministries alone. Each category below is expressly identified for examination of pay, allowances and related benefits.
1. Central Government industrial and non-industrial employees
This is the principal category and covers both industrial and non-industrial employees of the Central Government. The ToR do not limit consideration to a particular ministry, department or pay level; the Commission is asked to examine the category as a whole while taking account of rationalisation, functional requirements and specialised departmental needs.

2. All India Services personnel
Personnel belonging to the All India Services are separately named. Their inclusion means the Commission may consider their emoluments and associated benefits within the framework set by the resolution.
3. Defence Forces personnel
Defence Forces personnel are expressly included. Therefore, the answer to “Will Defence employees get the 8th CPC?” is that Defence personnel are within the Commission’s mandate. The listing itself does not establish a particular military pay revision, allowance treatment or implementation date.

4. Union Territory personnel
Personnel of the Union Territories are directly listed. The resolution also identifies two Union Territory-linked judicial groups separately: High Court employees whose expenditure is borne by Union Territories and judicial officers of subordinate courts in Union Territories.
5. Indian Audit and Accounts Department officers and employees
Officers and employees of the Indian Audit and Accounts Department are expressly included, rather than being left to implication through the general Central Government category.

Members of regulatory bodies created under Acts of Parliament are named in the ToR. The Reserve Bank of India is expressly excluded from this category. The exception matters: a body’s regulatory function alone is not enough; the listed statutory basis and the RBI exclusion must be applied as written.
7. Supreme Court officers and employees
Officers and employees of the Supreme Court are included as a named group.
8. Certain High Court officers and employees
The inclusion is limited to High Court officers and employees whose expenditure is borne by Union Territories. It is not a blanket statement covering every High Court employee in India.

9. Subordinate-court judicial officers in Union Territories
Judicial officers of subordinate courts in Union Territories are separately covered. For judicial officers, the resolution requires attention to the Supreme Court’s 24 August 1993 principle that judicial service conditions should not be tied to those of the administrative executive and must reflect the judiciary’s special needs.

Are pensioners covered under the 8th Pay Commission?
Pension issues are assigned to the Commission, but the wording does not answer every past-pensioner question. The Gazette frames its pension duties around employees and the pension arrangements that apply to them; it does not expressly identify retirement-date cohorts or state that every person who retired before a specified date will receive a revised pension.
Employees covered by NPS or the Unified Pension Scheme
The Commission must review death-cum-retirement gratuity for employees covered by the National Pension System, including the Unified Pension Scheme. This is a specific gratuity-review assignment. It should not be expanded into an assurance of a particular pension formula or an automatic increase for all NPS or UPS participants.
Employees outside NPS or UPS
For employees not covered by NPS or UPS, the ToR direct a review of death-cum-retirement gratuity and pensions. The Commission is also asked to take account of the stated unfunded cost of non-contributory pension schemes. The resolution therefore puts pension design and cost considerations on the Commission’s agenda without prescribing the eventual rate, formula or payment date.
People who retired before 2026
The official text does not say that all pre-2026 retirees will receive a revised pension. Whether a particular past-pensioner group is included, and on what basis, will require the Commission’s recommendations followed by Government action. A media estimate, association demand or stakeholder submission is not the same as an official entitlement.

Pensioners as consultation participants
The Commission’s official consultation page invited “pensioners” to submit representations along with the named employee categories. The submission period ran from 5 March through 15 June 2026 and is closed. Participation in that consultation establishes an opportunity to present views; it does not create a separate benefit guarantee.
Are State Government employees included?
State Government employees are not named in the Gazette’s list of employee categories. The resolution refers to State Governments because they often adopt Central Pay Commission recommendations, sometimes with modifications, and because the Commission should consider likely fiscal effects on them.
That reference is not a direction that State Government employees are directly covered by this Commission. A state may later decide to adopt recommendations, alter them or decline to adopt them. The decision belongs to the relevant State Government and should not be confused with direct inclusion in the 8th CPC ToR.

The published employee list does not automatically extend to every public-sector company, government-owned corporation, autonomous institution or state-funded organisation. The clearest named regulatory-body category is limited to members of bodies created under Acts of Parliament, with the Reserve Bank of India excluded. Where an organisation is not in one of the listed categories, its treatment cannot be inferred from the fact that it performs a public function.

There are several separate stages between being named in the ToR and receiving money or a revised pension:

- Scope: The Gazette identifies the category as one the Commission may examine.
- Evidence and deliberation: The Commission considers representations, service conditions, functional needs, affordability and the pension or gratuity framework relevant to the group.
- Recommendations: The Commission submits its proposals within the 18-month period allowed from constitution.
- Government decision: The Union Government decides whether and how to accept, modify or implement recommendations, including any effective date and transitional rules.
- Individual application: Departments, payroll authorities and pension-disbursing authorities apply the final rules to each employee or pensioner’s service record.
A person can therefore be in a covered category while the amount, formula, arrears, eligibility conditions and payment timetable remain undecided.

Practical answers to common reader questions
Who may be covered?
Employees in the nine categories expressly listed in the Gazette are within the Commission’s pay-and-benefits mandate. “May be covered” is the accurate phrase because the final result depends on recommendations and Government decisions.
Will Defence employees get the 8th CPC?
Defence Forces personnel are expressly named, so they are within the ToR. The resolution does not state the size or structure of any eventual revision.

Are State Government employees included?
They are not in the listed employee categories. States may later adopt Central recommendations, with or without modifications, but that is a separate state-level decision.
Will every pensioner receive a revised pension?
No such universal assurance appears in the published ToR. Pension and gratuity matters are assigned for review, while treatment of particular retirement cohorts remains to be decided.
What remains unknown
- No official fitment factor, salary table, pension percentage or beneficiary total is established by the cited Gazette and consultation material.
- The ToR do not provide a pension formula for NPS, UPS or non-NPS/UPS retirees.
- The documents do not settle arrears, minimum increases, family-pension treatment or the exact implementation mechanics for each group.
- Final coverage for any borderline organisation or individual will depend on the applicable Government orders and the person’s service or pension records.
The safest reading is therefore precise: the named employee groups are eligible for consideration by the 8th Central Pay Commission; pension and gratuity questions are part of its assignment; and neither fact, by itself, guarantees a particular payment to an individual.
