Hire a locally licensed or registered boundary surveyor as soon as a neighbour disputes the property line, existing surveys conflict, boundary monuments are missing, or you plan work close enough to the line that an error could cause an encroachment. A surveyor can investigate records and conditions on the ground and mark the boundary under local rules. The survey does not automatically decide ownership or force a neighbour to accept the result. If disagreement continues, use the land authority, mediation or court process available where the property is located, and obtain property-law advice when legal rights are at stake.
What a boundary surveyor actually does
A boundary surveyor examines the legal description, recorded plans, prior evidence and physical features of the land, then performs field work to locate or re-establish the line. Depending on local law and the agreed scope, the surveyor may recover existing monuments, place or reference markers, mark the line and provide a plan or written report.

South Australian government guidance puts the legal point plainly: “A property boundary defines legal ownership of land and its position can only be determined by a licensed surveyor.” The exact credential differs by jurisdiction. Some places use “licensed surveyor,” others “registered surveyor” or a cadastral-survey authorization. Confirm the terminology and authority that apply to the property, not the surveyor’s home state or the location of an old report.

A fence, hedge, wall, driveway or other visible feature is evidence of occupation, not automatic proof of the legal line. South Australia specifically warns that many existing fences are not on the property boundary. A structure can therefore be inside the wrong parcel even when it has stood there for years.

Situations that justify hiring one
Your neighbour disputes the line
Commission professional boundary work when the neighbour says your fence, wall, driveway, building or other improvement is over the line, or when you make the same allegation about theirs. A licensed surveyor can physically mark the disputed boundary and explain the evidence used.
A project will be close to the boundary
Arrange the survey before construction, excavation or relocation of a fence if the work could approach the line. South Australian guidance treats an encroachment as a structure intruding across the legal boundary and lists buildings, driveways, eaves and balconies as examples. Establishing the line before work is cheaper and safer than discovering an encroachment after concrete is poured.
Monuments or markers are missing or disturbed
Old pins, posts and other monuments can be removed, buried or moved. If you cannot identify reliable boundary evidence, have a qualified surveyor investigate rather than placing replacement stakes yourself.

Documents and ground conditions disagree
Hire a surveyor when a title plan, deed description, earlier survey, fence location and occupation history do not line up. The surveyor can assess which records and monuments carry weight under local surveying rules and document the basis for the result.
Several surveys conflict
An adjoining owner’s survey may not answer your question. New York consumer guidance tells owners to check whether a survey was prepared for them or for a former owner. A survey commissioned for another transaction may have a different purpose, date, scope or assumptions. When two surveys conflict, ask the surveyors to compare their records and explain the discrepancy.

| Relevant experience | Have they handled contested boundaries, missing monuments and conflicts between earlier surveys? |
| Scope | Does the fee include record research, field work, monument recovery or placement, boundary marking and a written plan or report? |
| Communication | Will the surveyor explain the evidence to both owners or communicate directly with the adjoining owner’s surveyor? |
| Timing and logistics | What is the expected schedule, travel or access requirement, fee structure and process for a follow-up visit? |
| Dispute support | Is an additional meeting, mediation support or expert-witness service available at a separate charge? |
Ask for the deliverable in writing before authorizing work. Requirements differ: one matter may need marked corners and a plan, while another may require a detailed report explaining conflicting evidence. The sources do not establish a universal product, format or price, so do not assume that a document called a “survey” will meet your intended filing, construction or litigation purpose.

Good records help the surveyor define the issue and reduce avoidable site visits.
- Your deed, title description and any recorded subdivision or survey plan.
- Every prior survey, including the date, commissioning party and stated purpose.
- Photographs of fences, walls, buildings, driveways, eaves, balconies, markers and other relevant features, with dates and locations.
- A short, dated account of what you and the neighbour disagree about and when the disagreement began.
- Any written notices, proposed construction drawings or correspondence that identifies a measurement or location.
Tell the surveyor whether the immediate goal is construction clearance, a fence location, a negotiated agreement, an authority determination or possible litigation. Ask whether the proposed work is suitable for that purpose and whether a later legal or expert report would be separate.

What to do when surveys conflict
- Give both surveyors the complete record. Provide deeds, plans, field notes or reports rather than only the page that appears to support your position.
- Ask for a professional comparison. New York consumer guidance recommends that your surveyor contact the adjoining property’s surveyor when surveys conflict. Request an explanation of differing evidence, coordinate systems, monuments, measurements and legal descriptions.
- Do not move markers or alter structures. Keep the site unchanged while the line is unresolved. Moving a stake, removing a fence or continuing construction can destroy evidence and intensify the dispute.
- Request a clear written explanation. Ask what line is being marked, which records and monuments support it, what uncertainties remain and what the plan depicts.
- Decide whether a legal step is needed. If the disagreement concerns ownership, adverse possession, easements, a written boundary agreement, removal of construction or litigation, consult a property lawyer in the relevant jurisdiction.
A technical survey finding is not automatically a court judgment or a binding agreement between owners. Georgia’s Professional Engineers and Land Surveyors Board expressly says its board does not adjudicate boundary disputes and identifies them as civil matters. A survey supplies technical evidence; a legal process may still be required to establish enforceable rights.

Try a documented agreement
Owners may be able to agree on the line or on a practical resolution after reviewing the survey. Put any agreement into the form required locally. New York guidance notes that even an agreed common boundary may require legal work to formalize it, so do not rely on an informal conversation or an unrecorded sketch when title rights are affected.
Use mediation or another dispute-resolution process
Mediation can help when both sides are willing to consider the survey evidence but need a structured settlement. Ask the local land authority, court service or lawyer which process is recognized and whether an agreement must be recorded.

Ask a land authority to determine the boundary
Some jurisdictions provide an administrative determination route. NSW, for example, describes applying for a Registrar General’s determination in certain boundary cases. Eligibility, notice requirements and the effect of a determination are specific to NSW and cannot be assumed elsewhere.
Bring a court action when necessary
If no agreement or administrative route resolves the issue, litigation may be available. Oregon law provides for a court action to determine a disputed boundary. A court case can involve pleadings, evidence, expert testimony and orders affecting structures or title, so obtain local legal advice before filing or responding.
Jurisdiction changes the rules
Boundary practice is not uniform. South Australia and Queensland use licensed or registered surveyor terminology; Georgia describes land surveying as licensed practice. NSW has a boundary-notice process for certain fencing work with specified response periods and possible cost sharing. Those deadlines must not be transplanted to another state or country.
New York’s consumer information emphasizes checking who commissioned an earlier survey and obtaining attorney advice to formalize an agreed boundary. Oregon Revised Statutes, Chapter 105, illustrates that a court determination route may exist. Washington Revised Code, Chapter 58.04, is another reason to check the current statute where the land lies. Confirm current credentials, notice periods, filing routes, recording requirements and legal effect with the relevant authority or a local lawyer.
What a survey cannot settle by itself
- Ownership claims: locating a line does not by itself decide whether title has changed through a deed, adverse possession or another legal doctrine.
- Easements and access: a boundary line does not answer whether someone has a recorded or implied right to cross or use land.
- Construction remedies: the survey may show an encroachment, but removal, compensation or permission generally requires agreement or legal authority.
- Neighbour acceptance: a neighbour can challenge the result; the surveyor cannot compel acceptance.
- Deadlines and notice: statutory time limits and cost-sharing rules depend on the jurisdiction and type of dispute.
Why consumer measuring tools are not a substitute
GPS receivers, phone mapping apps, tape measures and purchased boundary stakes can help you document conditions, but they do not establish a legal property line. Consumer equipment may use different reference systems, have limited precision under ordinary conditions or locate an approximate position rather than a legally defensible boundary. Do not place stakes or move a fence on the assumption that a device has settled the dispute. Use your observations as information for the surveyor, not as a replacement for licensed work.
A practical decision checklist
- Has anyone expressly disputed the line or alleged an encroachment?
- Will a planned fence, building, driveway, eave, balcony or excavation be close to the boundary?
- Are monuments missing, disturbed or inconsistent with the title plan?
- Do prior surveys have different lines, dates, purposes or commissioning owners?
- Have you gathered the deed, recorded plans, surveys, photographs and dated correspondence?
- Have you verified the surveyor’s current local authority for cadastral or boundary work?
- Does the proposal state the field work, marking, records examined and written deliverable?
- Have you asked whether communication with the other surveyor or a follow-up meeting costs extra?
- Will you keep the site unchanged while the dispute is investigated?
- Do ownership, adverse possession, easement, agreement, removal or litigation issues require a property lawyer?
Bottom line
Hire a locally authorized boundary surveyor at the first credible sign that the line is disputed, uncertain or important to a nearby project. Provide complete records, insist on a clearly defined scope and keep the physical situation unchanged while the survey is prepared. If the neighbour rejects the result, treat surveying and dispute resolution as separate steps: use the procedure available in the property’s jurisdiction and obtain legal advice where enforceable rights or court action are involved.
