Your Medicare switching deadline depends on how the insurer leaves. Medicare distinguishes among a contract terminated by the Centers for Medicare & Medicaid Services (CMS), a contract ended by the plan or by mutual agreement with Medicare, and a contract that is not renewed. Each event has a different Special Enrollment Period (SEP).
Read the insurer’s notice for the event type and contract end date before choosing a replacement. If your Medicare Advantage plan ends and you have not enrolled in another Medicare Advantage plan by the old plan’s end date, Medicare says you will be enrolled in Original Medicare.

Which deadline applies when a Medicare plan exits?
Use the category stated in your official notice. The dates below are the general Medicare.gov windows for affected members; your notice and Medicare should control if wording or timing is unclear.
| Exit event | When the switching opportunity starts | When it ends | Plans you may generally choose |
|---|---|---|---|
| CMS terminates the contract | One month before the contract ends | Two full months after the contract ends | Another Medicare Advantage plan or a Medicare drug plan |
| The plan ends its contract, or the plan and Medicare agree to end it | Two months before the contract ends | One full month after the contract ends | Another Medicare Advantage plan or a Medicare drug plan |
| The contract is not renewed | December 8 | The last day of February in the following year | Another Medicare Advantage plan, Medicare drug plan, or Medicare Cost Plan |
“Termination” and “nonrenewal” are not interchangeable. A termination ends a contract under one of the first two rules. A nonrenewal means the contract will not continue into the next contract year and uses the December-to-February window.

CMS terminates the contract
If CMS terminates the contract, the SEP begins one month before the contract end date and continues through two full months after that date. During that period, you may switch to another Medicare Advantage plan or enroll in a Medicare drug plan, subject to the plan’s service area and eligibility rules.
This window can overlap the date your old coverage ends. Do not wait for the final month if you already know which replacement meets your medical and prescription needs; submitting earlier gives the new plan more time to confirm enrollment and its effective date.
The plan ends the contract or mutually agrees to end it
When the plan ends its contract, or the plan and Medicare agree to end it, the SEP starts two months before the contract ends and lasts through one full month afterward. The available changes described by Medicare include joining another Medicare Advantage plan or a Medicare drug plan.

The contract is not renewed
For a nonrenewal, Medicare.gov states that the switching period runs from December 8 through the last day of February of the following year. Members can move from their Medicare Advantage, Medicare drug, or Medicare Cost Plan to another plan during this period.
The nonrenewal period is tied to the calendar dates in the rule, not simply to “two months before and one month after” the date on your letter. Keep the notice because it identifies the plan year and the date your existing coverage will stop.
What happens if you do nothing?
If your Medicare Advantage plan ends and you have not joined another Medicare Advantage plan before the old plan ends, Medicare says you will be enrolled in Original Medicare. That is not the same as being automatically placed in a new Medicare Advantage plan. You will need to evaluate whether to add Part D prescription coverage and whether a Medicare Supplement policy is available and appropriate for your situation.

How to identify your event and calculate the window
- Find the controlling notice. Look for the words “terminated,” “contract ending,” “mutually agreed,” or “nonrenewal.” Also locate the contract end date and the date your current coverage stops.
- Match the wording to the correct rule. Do not use the CMS-termination dates for a plan-initiated termination, and do not use either termination formula for a nonrenewal.
- Mark both ends of the SEP. Write down the first eligible date and the final eligible date. “Two full months after” and “one full month after” refer to complete calendar months following the contract end, so ask Medicare to confirm the final day if the end date falls midmonth.
- Check whether the notice describes a consolidation. CMS’s Calendar Year 2026 guidance says affected members of plan consolidations are not eligible for the termination/nonrenewal SEP described there because a consolidation is not itself a termination or nonrenewal.
- Call if the notice is ambiguous. Contact 1-800-MEDICARE (1-800-633-4227) or the plan and ask which SEP applies to your contract and what date an enrollment request must be received.
Immediate or midmonth CMS termination
CMS’s Calendar Year 2026 guidance notes that CMS may terminate a contract immediately, including in the middle of a month. That situation may not fit a simple “last day of the month” assumption. Use the specific termination date in the notice and ask Medicare how the SEP is calculated for your case.
How to choose a replacement plan
Only compare plans available in your ZIP code. A plan that appears suitable in general may not serve your county, accept your clinicians, or cover your prescriptions. Medicare’s plan-joining process provides the enrollment context; the plan’s current materials confirm the details that apply to you.
Check doctors, hospitals, and access rules
- Verify that your primary-care clinician, specialists, preferred hospitals, and important outpatient facilities are in network if you are considering a network-based Medicare Advantage plan.
- Ask whether referrals, prior authorization, or a designated primary-care provider are required for the services you use.
- Confirm the plan’s service area, especially if you live in more than one location or travel for extended periods.
Check every prescription, not just the premium
- Search the new plan’s formulary for each medication, including the exact strength and dosage form.
- Record the formulary tier, copayment or coinsurance, quantity limits, prior-authorization requirements, and preferred pharmacies.
- Check the effective date of the new drug coverage so the old coverage does not end before the replacement begins.
Estimate total cost sharing
Compare the monthly premium with the costs you are likely to incur for primary care, specialists, hospital services, durable medical equipment, laboratory work, and prescriptions. Also compare the annual out-of-pocket maximum for covered Medicare Advantage services. A lower premium can still produce higher total spending if the network or cost-sharing structure does not fit your care.
Confirm the start date before relying on the change
Ask the plan when coverage will begin and request confirmation of the enrollment submission. Do not cancel appointments, prescriptions, or other coverage based only on an application screen. Keep the notice, confirmation number, and effective-date information together until the transition is complete.

Protect your Part D coverage during the transition
Medicare.gov says your old drug coverage ends when your new drug coverage begins. Avoid an unintended gap. Going 63 days or longer without Part D or other creditable prescription drug coverage may expose you to a Part D late-enrollment penalty later.
“Creditable” means coverage expected to pay, on average, at least as much as standard Medicare prescription drug coverage. Ask the plan or another coverage provider for confirmation if you are unsure whether your existing prescription coverage is creditable. Keep proof of coverage in case Medicare later asks you to document it.

“My Medicare Advantage plan is ending at the end of the year.”
Read the letter to determine whether it says the contract is not renewed or uses termination language. If it is a nonrenewal, the stated SEP is December 8 through the last day of February of the following year. You still should compare and submit an enrollment request promptly so you know when replacement coverage starts.
“The insurer is leaving my county.”
Leaving an area may be described in a notice as a nonrenewal, a contract termination, or another transaction. The insurer’s ordinary explanation is not enough to determine your SEP. Match the legal event in the notice to the three categories above and confirm with Medicare if the language is unclear.

“The plan says it is merging with another plan.”
CMS’s Calendar Year 2026 guidance says a consolidation is not a termination or nonrenewal for purposes of the termination/nonrenewal SEP described there. Do not assume that a consolidation gives you the same window as a contract exit. Ask the plan or 1-800-MEDICARE what election rights apply and whether your coverage continues under the consolidated contract.
“I missed the first part of my SEP.”
You may still be inside the applicable window, depending on the event. CMS termination allows changes through two full months after contract end; plan-initiated or mutual termination allows changes through one full month after; nonrenewal runs through the last day of February. Confirm the final date before submitting and ask what coverage applies while the request is processed.
A practical transition checklist
- Save the termination, nonrenewal, or consolidation notice, including all pages and enclosures.
- Write down the event type, contract end date, coverage end date, SEP start date, and SEP final date.
- List your doctors, hospitals, medications, pharmacies, preferred facilities, and upcoming appointments.
- Compare only plans serving your ZIP code.
- Verify provider networks, formulary status, utilization rules, premiums, cost sharing, service area, and effective date.
- Submit the enrollment request before the applicable SEP closes and retain the confirmation.
- Check that prescription coverage begins when the old coverage ends; investigate any possible 63-day gap.
- After enrollment, confirm the new member ID, drug benefits, provider access, and first premium or payment instructions.
- Call 1-800-MEDICARE if the event type, deadline, or automatic transition is not clear.
Questions to ask Medicare or the plan
- Is this event a CMS termination, a plan-initiated or mutual termination, a nonrenewal, or a consolidation?
- What is the official contract end date and the last date of my current coverage?
- What is the first and final day of my SEP?
- If I do not choose another Medicare Advantage plan, when will Original Medicare begin?
- When will Part D coverage end and when will the replacement drug coverage begin?
- Will my doctors, hospitals, prescriptions, and pharmacies be covered under the replacement plan?
- What enrollment effective date should I expect, and how will I receive confirmation?
Bottom line
There is no single “insurer exits” deadline. A CMS termination generally allows switching from one month before contract end through two full months afterward. A plan-initiated or mutually agreed termination generally allows switching from two months before through one full month afterward. A nonrenewal uses the stated December 8-through-the-last-day-of-February window. Consolidations and immediate midmonth terminations may require separate confirmation. Use the exact notice, protect against a Part D gap of 63 days or more, and call 1-800-MEDICARE when the event or date is uncertain.
