You generally start claiming pre-construction home-loan interest in the previous year (financial year) in which the property is acquired or construction is completed—not when the loan is sanctioned or when each interest payment is made. The qualifying interest for the earlier period is divided into five equal annual installments: one in that acquisition or construction year and one in each of the next four previous years.

The amount you can actually deduct depends on the property being self-occupied or let out, the tax regime selected, statutory completion conditions and the applicable annual ceiling. Keep the lender’s interest certificate and loan records because the higher deduction requires supporting certification.

The rule in one minute

Section 24(b) of the Income-tax Act, 1961 covers interest on borrowed capital used for a house property. Interest relating to the period before the previous year in which the property is acquired or constructed is called pre-construction (or pre-acquisition) interest. After reducing any part already allowed under another provision, the balance is spread equally over five years.

The Income Tax Department’s statutory text states that the amount “shall be deducted under this clause in equal instalments for the said previous year and for each of the four immediately succeeding previous years.” In practical terms, you claim one-fifth in the trigger year and one-fifth in each of the following four years, subject to the rules and limits that apply to your property and tax regime.

Find the correct year to begin claiming

Use the acquisition or construction year

First establish the previous year in which you legally acquired the property or in which construction was completed, then identify the assessment year in which that previous year is reported. The statute uses that acquisition or construction event as the starting point. Loan sanction, first disbursement, the date of an individual interest debit or an assumed possession date does not automatically determine the first installment.

For a purchased property, review the documents that establish when acquisition occurred. For a self-built or builder-construction property, establish when construction was completed under the applicable facts and legal documents. Possession may coincide with the relevant event, but it should not be used as a shortcut without checking the governing wording and your records.

Previous year and assessment year are different

India’s tax terminology can make the five-year sequence look confusing. The previous year is the financial year in which income is earned and the acquisition or construction event occurs; the assessment year follows it. If the trigger event falls in financial year 2025–26, the first installment is reported in the return for assessment year 2026–27, followed by returns for assessment years 2027–28, 2028–29 and 2029–30.

Item What it means
Loan period before the trigger year Interest may form the pre-construction amount, after required reductions.
Trigger previous year The financial year in which acquisition or construction occurs; first one-fifth installment is claimed here.
Next four previous years One equal installment is claimed in each year, if otherwise allowable.
Assessment year The return year used to report the corresponding previous year.

Calculate the five equal installments

  1. Collect the interest total for the prior period. Obtain an interest certificate or detailed statement from the lender covering the period before the trigger previous year. Include interest on qualifying borrowed capital, not principal repayments.
  2. Remove amounts already deducted elsewhere. Section 24(b) requires the pre-period amount to be reduced by any part that has already been allowed as a deduction under another provision. Do not divide the unreduced figure if it would duplicate a deduction.
  3. Divide the balance by five. The result is the nominal annual pre-period installment.
  4. Start in the trigger year. Claim one installment in the previous year of acquisition or completed construction and continue for the four immediately succeeding previous years.
  5. Apply the year’s other limits. Add the installment to otherwise allowable current-year interest only to the extent permitted for the property type, tax regime and statutory ceiling.

Arithmetic illustration: If qualifying prior-period interest, after all required reductions, is ₹5,00,000, the five installments are ₹1,00,000 each. This demonstrates the division-by-five formula only; it does not guarantee that ₹1,00,000, or the full amount of the five installments, will be deductible in every taxpayer’s return.

Self-occupied property: the ceiling and its conditions

Old-regime guidance for AY 2025–26

The Income Tax Department’s guide for assessment year 2025–26 lists ₹2,00,000 as the maximum section 24(b) interest deduction for a qualifying self-occupied property under the old tax regime. The ceiling applies to the relevant aggregate deduction; it is not an automatic additional ₹2,00,000 on top of every other interest amount.

The section 24(b) provisos attach conditions to the higher ₹2,00,000 limit. Among them, the loan must have been borrowed on or after 1 April 1999, and acquisition or construction must be completed within five years from the end of the financial year in which the capital was borrowed. A certificate from the person to whom the interest is payable is also required. Apply the precise statutory wording to each borrowing and completion timeline rather than assuming that every under-construction loan qualifies.

Do not confuse two different five-year rules

There are two separate periods. The five equal installments rule tells you how long qualifying pre-construction interest is spread. The five-year completion condition is a requirement connected with the higher self-occupied deduction limit. Satisfying one does not by itself prove that the other is satisfied.

New tax regime treatment

The department’s ITR 3 validation rules for assessment year 2026–27 state that interest on borrowed capital cannot be claimed for a self-occupied house when the new tax regime is selected. That is a year-specific filing rule and should be read together with the regime selected and the return form applicable to you. Do not carry the AY 2025–26 old-regime ₹2,00,000 figure into a new-regime self-occupied return.

Let-out property is not the same calculation

Department guidance treats let-out property differently from self-occupied property. The five-year allocation of qualifying pre-period interest still needs to be calculated, but the way the resulting interest is used in the house-property computation is different. Do not apply the self-occupied ₹2,00,000 ceiling as a universal rule to a let-out property.

After calculating rental income under the applicable house-property provisions, interest deductions and any resulting loss are subject to separate set-off and carry-forward rules. Whether a loss can reduce salary or other income, and how much can be carried forward, depends on the current law and the facts of the return. Verify those rules for the relevant assessment year instead of assuming that the five installments can always be used against any income.

Documents to keep before filing

  • Lender interest certificate: Obtain a certificate identifying the lender, the borrower, the property loan and interest for the relevant period. Section 24(b) calls for certification for the higher deduction.
  • Loan records: Retain the sanction letter, disbursement statements, account statements and annual interest certificates. Record the date and amount of each borrowing if there are multiple tranches.
  • Acquisition or construction evidence: Keep the sale or acquisition documents, builder agreements, completion evidence and dates used to identify the trigger previous year.
  • Prior deduction reconciliation: Note any portion of the same interest already claimed under another provision so it is removed before the five-way division.
  • Return particulars: Department filing guidance asks for lender and loan details. Enter them consistently with the certificate and retain calculations supporting each installment.

A practical timeline example

Assume a loan is drawn during financial years 2022–23 and 2023–24, and the property is acquired or construction is completed in financial year 2025–26. Interest attributable to the period before financial year 2025–26 is the candidate pre-period amount. If the qualifying balance is ₹5,00,000, the nominal installment is ₹1,00,000. The five nominal claims fall in financial years 2025–26 through 2029–30, reported in assessment years 2026–27 through 2030–31.

That timeline does not decide the final deduction. You must still test the self-occupied or let-out status, old or new regime, completion conditions, annual ceiling and documentation. If acquisition legally occurred earlier than completion, the relevant trigger may also be earlier; establish the event from the documents and applicable law.

Common mistakes and how to correct them

Mistake Why it is wrong Correction
Starting the five installments when the loan is sanctioned The statute ties the start to the previous year of acquisition or construction. Identify and document the legally relevant acquisition or construction year.
Using the possession date automatically Possession is not stated as the universal trigger in section 24(b). Check acquisition and construction facts and the governing wording before choosing the year.
Dividing the gross interest without adjustments Any amount already allowed under another provision must be reduced first. Reconcile prior claims, then divide the remaining qualifying amount by five.
Claiming all five installments in full regardless of limits Property type, regime, completion timing and annual ceilings can restrict the deduction. Recompute the allowable amount for each return year.
Applying the old-regime ₹2,00,000 figure to the new regime AY 2026–27 ITR 3 validation rules disallow self-occupied section 24(b) interest under the new regime. Check the regime and assessment-year instructions before filing.
Confusing the installment period with the completion condition They are separate five-year rules serving different purposes. Test both independently.
Filing without lender certification The higher self-occupied deduction requires a certificate and return particulars. Obtain the certificate and retain the underlying loan records.

What changes under the Income-tax Act, 2025?

The official Income-tax Act, 2025 uses section 22 for the corresponding house-property deduction and also describes five equal installments beginning in the tax year of acquisition or construction and continuing for the next four tax years. Statutory numbering and tax-year terminology can change, and the available text does not resolve every commencement or transition issue for an individual return.

For a return affected by the 2025 Act or a transition between Acts, confirm which law governs that tax year, the commencement notification and any transitional provisions. Do not substitute section 22 or its terminology for section 24(b) without checking the applicable year.

Decision checklist before you claim

  • Have you identified the previous year in which acquisition occurred or construction was completed?
  • Have you mapped that previous year to the correct assessment year?
  • Have you calculated interest for the earlier period and removed any amount already deducted elsewhere?
  • Have you divided the remaining amount into five equal installments?
  • Is the property self-occupied or let out for the year of claim?
  • Which tax regime and assessment-year instructions apply?
  • If claiming the self-occupied higher limit, do the loan-date and five-year completion conditions apply to your facts?
  • Do you have the lender’s certificate, loan particulars and acquisition or completion evidence?
  • Have you checked the current-year rules for any house-property loss set-off or carry-forward?

The safe sequence is therefore: establish the acquisition or construction year, calculate and reduce the pre-period interest, divide the balance by five, then apply the property-specific and year-specific limits before entering the claim.
