What to Know About State Taxes Before Moving in Retirement

A retirement move can change how your income is taxed, but there is no universally “tax-friendly” state. The result depends on your former and new state, your domicile, the date you move, the tax year, your filing status, and whether each dollar comes from Social Security, a pension, military retirement, an IRA, investments, rent, or work. Build a two-state comparison using current revenue-department instructions before estimating any savings.

Start with the question that actually determines your bill

Before comparing state income-tax rates, identify the exact move you are considering. Write down your current state, destination state, planned move date, filing status, tax year, and every type of income you receive. Also note whether you will keep a house, spend substantial time, work, vote, maintain a driver license, or retain other ties in the former state.

State rules can differ even for two taxpayers with the same federal adjusted gross income. A state may exempt one type of pension but tax another, follow federal Social Security taxability with a subtraction, or impose a different rule on military retirement. A midyear move can create two resident periods and a separate nonresident allocation. Do not use a general state ranking as a substitute for this fact pattern.

What domicile means when you keep more than one home

The IRS describes domicile as “a permanent legal home that you intend to use for an indefinite or unlimited period, and to which, when absent, you intend to return.” Read the full explanation in IRS Publication 555.

You can own or rent more than one home while having only one domicile for this purpose. Intent is evaluated through actions and circumstances rather than a single form. The IRS identifies factors such as where you pay state income tax, where you vote, and where property is located. Those are evidence of intent, not a universal checklist that guarantees the result; each state can apply its own statutory residency tests.

Evidence to organize before the move

  • The date you sell, rent out, or stop using the former home as your permanent home.
  • Where you actually live during each part of the year and how many days you spend in each state.
  • Your address on tax returns, voter registration, driver license, vehicle registration, estate documents, and financial accounts.
  • Where your spouse or dependents live, where you receive mail, and where utilities and insurance are maintained.
  • Any continuing business, employment, rental property, or other state connection in the former state.

Keeping the old house does not automatically preserve the old domicile, and buying a new house does not automatically establish a new one. If the facts are close, read both states’ residency guidance and keep contemporaneous records explaining when and why your permanent home changed.

Federal tax treatment is only the starting point

Federal rules help you determine what enters the federal return, but they do not decide the state result. The IRS explains that qualified employer pension and annuity payments can be fully or partly taxable federally; the taxable portion may be calculated under the general rule or simplified method. See IRS Topic 410 and the IRS Seniors & Retirees resources.

A destination state may start with federal income, add or subtract particular benefits, or use its own definition of taxable income. Therefore, “not taxable federally” does not automatically mean “not taxable by the state,” and federal taxability does not prove that a state will tax the same amount.

Do you have to file a part-year state return when you move?

Often, yes. A move during the tax year can require a part-year resident return, a nonresident return, or both, depending on the states and the income involved. The return generally divides the year into resident and nonresident periods and allocates income under that state’s instructions.

How the official examples differ

  • Arizona: The Arizona Department of Revenue says part-year residents are taxed on income earned while Arizona residents, including retirement income from another state, and on Arizona-source income earned before moving to or after leaving Arizona. Use the current individual guidance at Arizona Department of Revenue for the applicable form and year.
  • Oregon: Oregon says a part-year resident calculates tax as a nonresident for the nonresident period and as a full-year resident for the resident period. Its guidance also says pension income and other income from any source are taxable when a taxpayer changes permanent residence to Oregon, while Oregon does not tax Social Security or Railroad Retirement Board benefits. See Oregon personal income tax guidance.

These are state-specific examples, not a national formula. Your filing software or preparer must use the exact allocation worksheets, sourcing rules, and deadlines for the states involved.

Move-year filing checklist

  1. Record the exact date your permanent home changed and the days you lived in each state.
  2. Download each state’s current part-year resident and nonresident instructions for the tax year.
  3. Separate income received during each residency period from income sourced to a state regardless of residence.
  4. Keep Forms 1099, pension statements, distribution records, closing documents, and withholding records that support the allocation.
  5. Check whether estimated payments or withholding need to change after the move.

Compare every retirement-income category separately

Do not put all retirement income in one “pension” line. Create a worksheet with the following categories and apply both states’ current rules to each one.

Income category Questions for the former and destination states Illustrative official guidance
Social Security Does the state tax the federally taxable portion, provide a subtraction, or exclude benefits entirely? Minnesota says it taxes the same amount federally taxable, with a possible state subtraction. Oregon says it does not tax Social Security benefits.
Employer pensions and annuities Is the payment taxable to residents? Is a state or federal pension subtraction available? Does the state use federal taxable income? Minnesota says pensions, including federal pensions, received while a person is a Minnesota resident are taxable regardless of where earned. Arizona describes a subtraction for certain Arizona and U.S. government pensions.
Military retirement Is military retirement treated like an ordinary pension or given a separate exclusion or subtraction? Minnesota says military retirement pay is not taxable in Minnesota.
IRA and workplace-plan withdrawals Does the state follow federal taxable income, and are any age, contribution, or public-pension adjustments available? Federal rules determine the federal taxable portion, but the state return must be checked separately; IRS Topic 410 is not a state exemption.
Investment income Are interest, dividends, and capital gains included in the resident base, and how are gains allocated in a part-year move? Apply each state’s resident-period and nonresident-period instructions; no universal allocation rule applies.
Rental income Where is the property located, and does that state tax the rent even after you become a nonresident? Real-property income is a key state-source category to review in the former state and destination state instructions.
Wages, consulting, or business income Where were services performed, and did the business remain connected to the former state? State-source earnings can remain taxable after a domicile change; check sourcing rules and nonresident filing requirements.

Minnesota shows why labels matter

Minnesota’s senior guidance treats ordinary pensions, Social Security, and military retirement differently: pensions received while resident are taxable regardless of where earned; the state taxes the federally taxable Social Security amount but may allow a subtraction; and military retirement pay is not taxable. This combination is why a comparison based only on “retirement income” can produce the wrong answer. Read the current guidance at Minnesota Department of Revenue.

Arizona illustrates subtraction limits

Arizona says residents are taxed on income reported for federal purposes and describes a subtraction for certain Arizona and U.S. government pensions. Its part-year guidance also discusses a limited pension subtraction. Because eligibility and amounts depend on the current form and tax year, verify the exact subtraction before using it in a projection.

Will your former state still tax a pension after you move?

Sometimes a former state cannot tax a qualifying pension paid to a nonresident because of federal limits, but that protection is not a blanket exemption for every retirement payment. The payment must meet the applicable definition, and other facts can affect sourcing.

New York’s 2025 nonresident and part-year instructions explain federal limits involving certain qualified pension plans and qualifying deferred-compensation plans. They also discuss situations in which pension income connected to services performed in New York is allocated. Review the complete instructions at New York Form IT-203 instructions. Do not assume that changing your address eliminates every former-state filing obligation.

A practical two-state comparison method

  1. Define the fact pattern. Enter origin, destination, move date, filing status, tax year, homes retained, and days in each state.
  2. Inventory gross sources. List Social Security, each employer or government pension, military retirement, IRA withdrawals, workplace-plan distributions, interest, dividends, gains, wages, consulting, rents, and other state-source income.
  3. Check domicile and statutory residency. Read both revenue departments’ definitions, day-count rules, and presumption provisions.
  4. Map the move year. Identify part-year returns, nonresident returns, allocation schedules, withholding, and estimated-payment changes.
  5. Apply category rules. For every income source, record resident treatment, nonresident treatment, subtractions, exemptions, and sourcing rules.
  6. Check continuing former-state income. Rental property, work performed there, business activity, and services tied to that state may require a return after the move.
  7. Use current-year forms. Thresholds and subtraction amounts can change. Do not carry a prior-year rule into a new tax year without checking.
  8. Model the complete cash flow. Include withholding, estimated payments, filing costs, and any relevant local or non-income taxes before calling a move a “tax saving.”

Taxes beyond state income tax

A move can affect property, sales, inheritance, estate, and local taxes as well as income tax. The material here establishes the income-tax comparison framework, not state-specific dollar comparisons for those other taxes. For a serious relocation decision, obtain the destination locality’s current official guidance and include recurring housing and local-tax costs in the budget.

Common mistakes that create surprise bills

  • Assuming the state that did not tax a benefit will remain responsible after the move, or assuming the former state can never tax a payment.
  • Using federal taxability as the state answer without checking additions, subtractions, and state definitions.
  • Filing as a full-year resident in one state when the facts support a part-year or nonresident return.
  • Ignoring rental, work, consulting, or business income sourced to the former state.
  • Applying a state example, such as Oregon’s Social Security treatment or Minnesota’s military-retirement treatment, to another state without authority.
  • Relying on a tax-year threshold or exemption from an old form.

When professional help is worthwhile

A tax preparer experienced with multi-state and part-year returns can help when the move occurs midyear, you retain a former-state property, or you have several pension and investment sources. A retirement-focused financial planner can model the broader cash-flow effect, but neither professional replaces the need to verify the states’ current instructions. Bring your income inventory, move-date records, residency evidence, and prior returns to the consultation.

Final pre-move checklist

  • Confirm where you will actually live and the date your permanent home changes.
  • Document any former-state home, rental, work, business, or other continuing connection.
  • List every income source and keep the payment statements.
  • Read both states’ current resident, part-year, and nonresident instructions.
  • Check Social Security, each pension, military retirement, IRA, workplace-plan, investment, rental, and work-income rules separately.
  • Plan withholding, estimated payments, and filing deadlines for the move year.
  • Review relevant local and non-income taxes before making a relocation decision.

The most defensible answer to “Which state is best?” is therefore a completed comparison for your origin, destination, move date, income mix, filing status, and tax year—not a national ranking or a generic savings estimate.
