If court-ordered maintenance is missed, do not replace the order with an informal deal or wait indefinitely. Confirm which court or government service administers the order, create a dated arrears record, and ask that body to start the correct enforcement process. The available remedy depends on whether the order is for child or spousal maintenance, where it was made, where the payer lives, and whether payments run through a collection service.
Start by identifying the order and the enforcement authority
“Maintenance” can mean child support, spousal support or another family-court payment. The document may be a family-court order, an administrative assessment, or an order registered with a government collection service. Those distinctions determine who can enforce it and which forms, fees and deadlines apply.

- Issuing jurisdiction: Identify the country, state, province or territory named on the order and the court that made it.
- Order type: Check whether it covers child maintenance, spousal maintenance, or both; whether it is final or temporary; and whether it has been varied.
- Payment route: Note whether payments are made directly to you, through a statutory collection service, through the court, or by payroll deduction.
- Payer’s location: Enforcement can change if the payer now lives in another country or legal region.
- Current terms: Record the exact amount, currency, due date, start date, and any provision for indexation or arrears.
Read every page of the order, including schedules and later variation orders. A missed instalment is normally an arrears issue, but a payment dispute, an alleged overpayment or a claim that the order was changed can require a different application.

| Column | What to record |
|---|---|
| Due date | The date specified by the order or collection service |
| Amount due | The instalment required, including any separately ordered sums |
| Amount received | Money actually cleared, not merely promised or sent |
| Date received | When the payment reached you or the collection account |
| Running balance | Previous balance plus the new shortfall |
| Evidence reference | Bank statement, receipt, transfer confirmation or message showing the payment |
Save the order, every variation, bank statements, transfer records, receipts and relevant messages in date order. Keep copies in a secure location. If the payer made a partial payment, credit it to the correct instalment and state how you allocated it. Do not inflate the balance with interest or fees unless the order or applicable law authorises them.
Contact the named agency or court promptly
Use the contact details on the order or the official correspondence from the collection service. Ask four precise questions:
- Is the case currently eligible for administrative enforcement, or must I file a court application?
- What form, referral or notice starts enforcement?
- What evidence, statement of arrears and fee are required?
- How will the authority notify me of payments, objections, hearings or a change in the balance?
Keep a log of calls, dates, reference numbers and documents sent. A private debt collector cannot normally substitute for the family-court or statutory process. Do not sign a waiver or accept a reduced settlement without understanding whether it changes the order or releases future arrears.
England and Wales: child maintenance handled by the Child Maintenance Service
Direct Pay and Collect and Pay are different
For child maintenance administered by the Child Maintenance Service (CMS), GOV.UK guidance states that Direct Pay does not allow the service to take enforcement action while the case remains on that method. A recipient can ask the CMS to move the case to Collect and Pay. On Collect and Pay, the CMS collects the payment and says it will act when an instalment is not made in full and on time.
Ask the CMS how to request the change and provide your arrears schedule. Moving to collection does not erase earlier arrears; the service will explain which balances it recognises and what evidence is needed for payments made outside its system.

Measures the CMS may use
Depending on the case, Collect and Pay can seek deductions from wages, a pension or benefits; take money directly from a bank account; and apply to court for a liability order. Once a liability order is obtained, further action such as seizure of property may be possible under the applicable procedure. The authority decides which step is available and proportionate; a recipient should not promise a particular outcome.
What a payer should do
GOV.UK tells a paying parent who cannot pay in full or on time, or who has missed a payment, to contact the CMS and report changes in income or circumstances. Stopping payments without reporting a change leaves the existing assessment in place and can increase arrears. A payer who believes the amount is unaffordable should ask for a formal review or variation rather than privately rewriting the order with the other parent.

Effect of a liability order
The Department for Work and Pensions describes a liability order as legal recognition that a specified amount of child maintenance was unpaid for a specified period. It enables additional legal action. The amount may also be registered in the Register of Judgments, Orders and Fines, which can affect access to credit. The order does not turn an unverified estimate into a debt: the authority must identify the period and amount covered.
England and Wales: enforcing a Family Court maintenance order
A Family Court maintenance order is different from a CMS assessment. The EX327 enforcement leaflet says a creditor may apply for a specific enforcement measure or for another measure the court considers appropriate when the debtor is resident in England or Wales. The application should identify the order, the unpaid instalments, payments received and the remedy requested.
If the debtor is abroad, reciprocal enforcement may be available where the other country has arrangements with the UK. The correct route depends on both jurisdictions, the type of order and where the debtor or assets are located. Cross-border enforcement often requires certified copies, translations or transmission through a designated authority, so specialist advice can prevent a rejected application.

Common court enforcement tools
For a money judgment generally, HM Courts and Tribunals Service states: “The court will not enforce the judgment unless you ask it to.” Its EX321 guide lists several possible mechanisms. Availability, procedure and cost depend on the judgment and the debtor’s circumstances.
| Remedy | How it works | Useful when | Important limits |
|---|---|---|---|
| Warrant of control | Enforcement agents seek payment or control and sale of qualifying goods | The debtor has identifiable goods of value | Some goods are protected; recovery is not guaranteed |
| Attachment of earnings | A regular amount is deducted from wages through the employer | The debtor is employed and income is traceable | Amounts are constrained by protected-income rules and employment changes |
| Third-party debt order | A third party, often a bank, is ordered to pay money held for the debtor | A specific account or debt is likely to contain funds | The account may be empty or funds may be legally protected |
| Charging order | The debt is secured against qualifying property or an asset | The debtor owns property with usable equity | It may secure the debt without producing immediate cash |
HMCTS warns that an application fee may be payable, that the fee is added to the debt, and that the court cannot guarantee recovery. Check the current fee and form before filing; a fee exemption or reduction may be available to an eligible applicant.
Child maintenance, spousal maintenance and private agreements
Child maintenance
Child-support systems often give a government agency powers that an individual does not have, such as payroll deductions or benefit deductions. Use that agency where the case is already registered, and ask how it treats payments made directly between parents.
Spousal maintenance
Spousal support is commonly enforced as a court judgment rather than through the child-maintenance service. The order may permit enforcement against income, bank funds or property, but the application route can differ from child support. Check whether the order includes a specific enforcement clause and whether arrears must be calculated through a court statement.
Voluntary arrangements
An agreement that was never made an order may require a civil claim or a fresh application rather than enforcement of a court order. Ireland’s Courts Service, for example, advises legal advice where the arrangement was voluntary rather than court-ordered. Do not describe a private promise as a court debt unless a court has made or adopted an order.

Examples of different systems outside England and Wales
Ireland
Ireland’s Courts Service describes an enforcement-order summons for wage deductions. The debtor attends a hearing and must explain why maintenance was not paid. The summons process, hearing requirements and available orders are specific to Ireland; they should not be copied into another country’s case.
Ontario, Canada
Ontario states that court-ordered child or spousal support is automatically filed with the Family Responsibility Office. The office can enforce collection and send a support deduction notice to an income source such as an employer. Confirm registration and the balance with the office rather than assuming that a private payment ledger alone activates enforcement.
Singapore
Singapore Judiciary guidance lists an enforcement order for attachment of a debt and a show-payment order requiring the respondent to explain arrears or payment obligations. The forms, service rules and hearing process are local to Singapore.
When the payer says the amount is unaffordable or the order is wrong
Affordability does not automatically suspend an order. The payer should report changed income, unemployment, illness or other relevant circumstances to the responsible agency or apply for a formal variation. Until the order is changed, the stated instalments generally remain due.

Cross-border cases and hard-to-locate payers
Collect the payer’s last known address, employer, bank or property information, tax or social-insurance identifiers where lawfully available, and copies of any foreign order. Do not attempt to access private accounts or obtain information unlawfully. Ask the issuing court or agency whether reciprocal enforcement is available in the country where the payer or assets are located. Translation, authentication and transmission requirements can add delay and cost.
International cases merit qualified local advice before filing. A domestic warrant or deduction order may have no effect abroad unless the destination jurisdiction recognises and enforces it.
Fees, legal help and safety
Enforcement fees vary by jurisdiction and remedy. Some systems add an application fee to the debt; others deduct collection charges or require payment before filing. Confirm the current amount with the responsible court or agency and ask whether a fee waiver or reduction applies.

HMCTS says: “You may be able to get free legal advice from a law centre, Citizens Advice, or a consumer advice centre.” Seek qualified advice promptly if arrears are large, the payer is selling or transferring assets, a hearing is scheduled, the order involves another country, or there is domestic abuse or a risk to personal safety. Use a safe address and communication method where necessary, and tell the court or agency about safeguarding concerns.
A practical sequence for the next seven days
- Read the order and mark every missed or partial instalment.
- Build the ledger and attach bank evidence.
- Identify the named agency or court and confirm its current contact channel.
- Ask whether the case is on a collection service, whether a transfer is needed, and what enforcement application applies.
- Submit the requested form and evidence, keeping proof of delivery.
- Calendar follow-up dates and report any new payment immediately.
- Obtain local advice before accepting a settlement, filing across borders or responding to a disputed variation.
Enforcement is an application-driven process: the authority cannot choose a remedy it has not been asked to consider, and no procedure guarantees recovery. A complete order, an accurate ledger and prompt contact with the correct authority give the case the best chance of moving forward.
