If this is an Indian Central Goods and Services Tax (CGST) case, an earlier appeal does not automatically stop every GST refund. First establish whether you have a formal withholding order in Part A of FORM GST RFD-07, a refund application that is still being processed, or a FORM GST RFD-06 rejection that is under appeal. Each situation has a different remedy.

The steps below apply to India’s CGST framework. GST refund and appeal rules in other countries, and even rules for different Indian orders or refund categories, can differ. Check the applicable tax authority’s current instructions and obtain advice from a qualified local GST professional before relying on a deadline or filing strategy.

Identify what has happened to the refund

Do not treat the words “refund on hold” as a legal conclusion. Match the GST Portal record and the documents you received to one of these three situations.

Situation Evidence to look for What it means in the India CGST context Likely next move
Formal withholding Part A of FORM GST RFD-07, with reasons and reference to an appeal or other proceeding Section 54(11) may allow withholding only when the statutory conditions are met; a pending appeal by itself is not enough. Read the order against section 54(11), check the hearing opportunity and stated revenue risk, and challenge or clarify the order on the facts if necessary.
Refund application still pending Application reference number (ARN), portal status, notices or requests for documents, but no RFD-07 withholding order or RFD-06 rejection identified This may be an ordinary processing or documentation delay rather than a section 54(11) withholding. Answer outstanding requests, confirm that the proper officer has the complete record, and obtain a status explanation. There is no single remedy established for every pending status.
Refund rejection under appeal FORM GST RFD-06 rejecting the claim and an appeal record The rejection and the appeal are separate from a formal withholding order. If the appeal or other authority later grants relief, use the fresh RFD-01 process described in CBIC Circular 111/30/2019-GST.
Favorable order already received Appellate or other order, its communication date, and the earlier RFD-06 order The original rejected claim does not simply revive in the portal; the circular describes a new refund application route. File a fresh RFD-01 in the appeal/other-order category with the required order details and attachments, then track sanction and payment.

When can the department withhold a refund under section 54(11)?

Section 54(11) concerns a refund that arises from an order which is under appeal or further proceedings, or another proceeding under the CGST Act. It does not create a blanket rule that any refund must wait whenever the taxpayer has an unresolved appeal.

The provision requires the Commissioner to form an opinion that paying the refund is likely to adversely affect revenue in the appeal or other proceeding because of malfeasance or fraud. The taxpayer must also receive an opportunity to be heard before the refund is withheld. Rule 92 and FORM GST RFD-07 provide the procedural framework and form reference.

“Where an order giving rise to a refund is the subject matter of an appeal or further proceedings or where any other proceedings under this Act is pending and the Commissioner is of the opinion that grant of such refund is likely to adversely affect the revenue in the said appeal or other proceedings on account of malfeasance or fraud committed, he may, after giving the taxable person an opportunity of being heard, withhold the refund till such time as he may determine.”

This wording contains several conditions. The order should identify the relevant appeal or proceeding, explain the expected adverse effect on revenue, connect that risk to alleged malfeasance or fraud, and record that you had an opportunity to be heard. If an RFD-07 is vague, ask the issuing office in writing to identify the exact statutory basis, the proceeding relied on, and the facts or documents supporting the conclusion. Keep proof of the request and any response.

Collect the complete record before responding

Download and preserve a time-stamped copy of every item below. A clear chronology often reveals whether the issue is withholding, routine processing, or rejection.

  • The original refund application, ARN, filing date and portal status history.
  • FORM GST RFD-06 sanction or rejection order, if one was issued.
  • Part A of FORM GST RFD-07 and any notice or hearing communication connected with it.
  • The appeal memorandum, acknowledgement, appellate order or other proceeding order, and the current status of that matter.
  • Requests for documents, deficiency memos, replies, written submissions and hearing records.
  • Proof of when each order was communicated, including portal downloads and email or other delivery records.
  • Electronic credit-ledger entries showing any debit made for the original refund application.

For a new claim after a favorable appeal, the record should also show the order type, order number, date, issuing authority, the appellate or other order, the original RFD-06 rejection order and related supporting documents.

A practical sequence for getting the matter moving

1. Verify the portal status and the order actually issued

Sign in to the GST Portal, open the refund application using its ARN, and download the status history and every available notice or order. Search your records for RFD-07 and RFD-06. Do not infer a withholding merely from a status such as “pending” or “under process.” If no order is available, record that fact and ask the jurisdictional office whether a document has been issued but not uploaded.

2. Test an RFD-07 against section 54(11)

Read the Part A order line by line. Identify the appeal or other proceeding, the alleged malfeasance or fraud, the stated effect on revenue and the period for which payment is withheld. Check whether you were given a meaningful opportunity to be heard before the order. If any element is missing or unclear, send a written clarification request rather than relying on a telephone assurance. A disputed withholding may require case-specific representation or legal challenge; the documents and facts determine the appropriate forum.

3. Decide whether the appeal concerns the refund rejection

An appeal against FORM GST RFD-06 is different from an appeal against a demand, assessment or another order that may indirectly affect a refund. If the pending appeal is not about the refund rejection itself, do not assume that either the fresh RFD-01 route or section 54(11) applies automatically. Map the exact order under appeal, the refund category and the statutory provision cited in each document.

4. Answer outstanding processing requests

If the application is simply pending, provide every document requested by the proper officer in one indexed submission and retain the acknowledgement. Ask for confirmation that the submission is linked to the ARN and request the next procedural step or a reasoned status update. The available rules do not establish one universal escalation route for every pending status, so avoid filing an unrelated appeal or grievance merely because processing is slow.

5. File a fresh claim after a favorable appeal

When an appellate or other authority overturns the refund rejection, submit a new FORM GST RFD-01 under the category “Refund on account of assessment/provisional assessment/appeal/any other order.” Enter the order type, number, date and issuing authority exactly as shown on the order. Upload the appellate or other order, the earlier RFD-06 rejection order and related documents. Explain the calculation and identify the portion allowed by the appellate authority.

CBIC Circular 111/30/2019-GST states that an amount already debited from the electronic credit ledger for the earlier claim need not be debited again in this fresh application. Do not make a second debit simply because the portal presents a new ARN; retain the ledger evidence and refer to the circular in your covering submission.

6. Track the decision and payment separately

The proper officer considers the amount allowed by the appellate or other authority and issues the relevant refund order and payment order. Monitor the new ARN, respond promptly to any deficiency or clarification, and compare the sanctioned amount with the appellate relief. A favorable order may leave a separate portion rejected or disputed; treat that portion as a distinct issue rather than assuming the entire original claim is payable.

Release of a formally withheld refund and possible interest

The GST Council’s refund guidance states that when the reasons for withholding no longer exist, a refund withheld under section 54(11) may be released through an order in Part B of FORM GST RFD-07. The release order is different from the earlier Part A withholding order, so keep both in your file and verify that the amount and tax head match the entitlement.

Section 54(12) provides for interest when the taxpayer becomes entitled to a refund that was withheld and the entitlement arises from the appeal or further proceedings. The cited statutory text sets a ceiling of up to 6%; the applicable notified rate, start date, end date and eligibility must be checked against the current notification and the facts of the case. Do not calculate or promise a particular amount from the ceiling alone.

Protect the appeal deadline without overgeneralizing it

The GST Portal FAQ for an appeal against a demand order states a normal filing period of three months from communication of the order, with up to one additional month potentially condoned for sufficient cause. It also states that a minimum pre-deposit of 10% of the disputed tax is ordinarily required for that demand-order appeal.

Those figures are not a universal deadline or deposit rule for every refund dispute. Confirm the appealable order, forum, limitation period, condonation standard and deposit requirement from the applicable provisions and the order you received. Keep evidence of the communication date; a portal download date, email date and other delivery evidence can affect the limitation analysis.

Common mistakes that prolong a refund dispute

  • Assuming that a pending appeal automatically blocks every GST refund.
  • Calling a portal delay a section 54(11) withholding without locating Part A RFD-07.
  • Filing a fresh RFD-01 before confirming that the appeal actually overturned an RFD-06 rejection.
  • Leaving the order number, date or issuing authority blank or inconsistent with the appellate order.
  • Debiting the electronic credit ledger a second time when the earlier debit is already documented.
  • Ignoring a hearing notice and then arguing that no opportunity to be heard was provided.
  • Using the demand-order appeal deadline or 10% pre-deposit figure for a different type of proceeding.
  • Calculating interest at 6% without checking the notified rate and the dates that govern entitlement.

When professional help is warranted

Consider a qualified Indian GST professional or tax lawyer when the RFD-07 alleges fraud or malfeasance, the refund involves several tax periods or tax heads, the appeal deadline is close, the appellate order grants only partial relief, or the department refuses to explain the statutory basis for withholding. Provide the adviser with the complete chronology, portal downloads, orders, ledger records and communication proofs. Professional assistance can help interpret the documents, but no adviser can guarantee release of the refund.

If the claim is outside India

“GST refund” is used in many jurisdictions, but forms, appeal rights, withholding powers and interest rules are not interchangeable. The RFD-07, RFD-06, RFD-01 and sections 54(11)–(12) discussed here are India CGST references. If your registration or refund belongs to another country, use that tax authority’s rules and forms instead of adapting this procedure.

Decision checklist

  • Have you located an RFD-07 withholding order, an RFD-06 rejection, or only a pending ARN?
  • Does the alleged withholding identify the proceeding, revenue risk, malfeasance or fraud, and hearing opportunity?
  • Does the appeal concern the refund rejection itself or a different order?
  • If relief was granted, have you filed RFD-01 under the appeal/other-order category with all required order details?
  • Have you preserved proof of communication dates, ledger debits and every submission?
  • Have you checked the current appeal limitation, pre-deposit and interest notification for your exact proceeding?
