What to Do When a Tenant Stays After a Rental Agreement Expires (2026 Guide)

Do not change the locks or remove a tenant yourself when a rental agreement expires. First determine the property’s jurisdiction, lease terms, and whether you consented to continued occupancy or accepted rent. Then serve the locally required written notice, wait the complete statutory period, and file the correct possession or holdover case if the tenant still will not leave. Notice periods, forms, service rules, and court procedures differ sharply by state and city.

What expiration of the agreement actually means

An end date in a lease does not create one nationwide procedure for removing an occupant. The result depends on the agreement, what happened after the end date, and the law where the property sits. A tenant who remains may be a holdover occupant, a tenant whose tenancy became periodic, or someone staying with the landlord’s permission. Those classifications affect the notice and case you may use.

Read the entire agreement before sending anything. Look for automatic-renewal language, holdover clauses, notice deadlines, options to extend, rent-acceptance terms, and instructions about how notices must be delivered. Also identify whether the unit is residential, commercial, subsidized, rent-regulated, a manufactured-home space, or another special housing type. Local rules can add protections that do not appear in a standard lease.

Three common post-expiration situations

  • Agreed extension: You and the tenant expressly agreed to a new term or to continue month to month. Ending that arrangement requires the notice and procedure for the new tenancy.
  • Implied or periodic tenancy: Your conduct, including accepting rent, may create a recurring tenancy under local law. New York is a specific example: Real Property Law § 232-c generally treats acceptance of rent for a period after a term ends as creating a month-to-month tenancy unless an express or implied agreement provides otherwise.
  • Holdover without consent: The tenant remains after the term and you did not agree to a continuation. You still normally must give the legally required notice and obtain a court order before possession can be enforced.

Do not assume that a tenant’s failure to sign a renewal automatically makes the occupancy illegal. The lease, payment history, communications, and local statutes must be considered together.

Why the property’s location controls the timeline

There is no single notice period that applies across the United States. The following official rules illustrate the differences; they are not interchangeable and should not be used for a property in another state or city.

Jurisdiction Official example What to verify before acting
Texas Texas Property Code § 24.005 generally requires at least three days’ written notice to vacate before a forcible-detainer suit against a tenant holding over, unless a written lease or agreement sets a different period. Check the current statutory text (an amendment was noted as effective January 1, 2026), the lease’s notice clause, and any applicable exceptions.
Delaware Delaware Courts says residential termination notice generally should be given or sent at least 60 days before the rental term ends unless the rental agreement provides otherwise. Confirm whether the unit is subsidized, a manufactured-home arrangement, or commercial. Commercial notice is generally controlled by the agreement.
New York New York court guidance gives examples of 30-, 60-, and 90-day periods based on occupancy and tenancy circumstances and distinguishes among several notice types. Check rent-regulation, good-cause, local, and lease requirements, as well as the current court instructions for the county where the property is located.

These examples show why a notice copied from another state can invalidate a case. The correct period may depend on how long the tenant has occupied the unit, whether the lease expired naturally, whether rent was accepted, and whether a special protection applies.

Step-by-step: a lawful path to regain possession

1. Establish the facts and preserve records

Create a dated file containing the signed agreement and amendments, payment ledger, inspection reports, messages, emails, renewal discussions, and proof of every notice. Record the contractual end date and each payment received afterward. Keep communications factual and avoid language that could be read as granting a new term unless that is your intention.

2. Decide whether continued occupancy was accepted

Ask whether you invited the tenant to stay, negotiated a renewal, allowed a move-out extension, or accepted rent covering a period after expiration. A payment may have legal consequences even if you intended it only as compensation for use. New York’s statute and court guidance specifically warn that accepting rent after a termination date can restart the tenancy or lead to dismissal of a case. Other jurisdictions may apply different rules, so obtain local advice before demanding possession while retaining post-expiration rent.

3. Identify the exact notice required

Determine whether the case calls for a notice to quit, notice of termination, notice to cure, or another locally prescribed form. The document may need the property address, tenancy facts, termination date, amount of any claimed rent, and instructions about surrender. Use the current form and language required by the court or statute where the property is located; do not rely on a generic internet template.

4. Calculate the deadline precisely

Count the period using the local rule, including rules about weekends, holidays, the day of service, and whether the deadline must fall at the end of a rental period. A notice that gives one day too little can require starting over. If the lease promises more time than the statute, the longer contractual period may control. For subsidized housing, federal requirements can override conflicting state notice provisions.

5. Serve the notice using the permitted method

Delivery rules can be as important as the wording. Permitted methods may include personal delivery, delivery to a suitable person followed by mailing, posting and mailing, certified mail, or another method specified by statute. New York court guidance states that the notice in most holdover cases must be served correctly and that the server should be an adult who is not a party to the case. Keep an affidavit, certificate, mailing receipt, photographs, or other proof required in your jurisdiction.

6. Wait until the full notice period expires

Do not file early, accept payments inconsistently, or promise a different deadline after service without understanding the legal effect. If the tenant leaves, document the surrender, conduct the inspection required by local law, and handle the security deposit under the applicable deadline. If the tenant remains, move to the court process rather than attempting physical removal.

7. File the correct possession or holdover case

A notice is not an eviction order. New York’s Unified Court System guide states: “Before you can start a holdover eviction case you must ask your tenant in writing to vacate the property (move out).” That sentence is guidance for New York proceedings, not a universal rule. In New York, file in the court where the property is located and use the proceeding and petition required for the tenancy. Delaware directs a landlord seeking possession to file in the Justice of the Peace Court closest to the rental. Texas generally uses a forcible-detainer action in the appropriate justice court.

8. Serve the court papers and attend every hearing

After filing, the summons and petition must be served under the court’s rules. Bring the agreement, notices, service proof, payment ledger, photographs, and communications to the hearing. The tenant may raise defenses involving defective notice, retaliation, discrimination, habitability, payment, renewal rights, or protected status. A judge—not the landlord—decides possession.

9. Use only the authorized enforcement process

If the court awards possession, follow the local waiting period and request the authorized writ or enforcement document. Texas State Law Library guidance describes a sequence that can include suit, hearing, judgment, appeal rights, and a writ of possession. The sheriff or other authorized officer, not the landlord, carries out the physical removal. Do not treat a favorable judgment as permission to act outside the enforcement procedure.

Rent accepted after expiration: why payment handling matters

Post-expiration rent is one of the most consequential facts in a holdover dispute. A receipt, deposit, or ledger entry can be evidence that you recognized a continuing tenancy. New York Real Property Law § 232-c provides a concrete example: accepting rent for a period after a lease term ends generally creates a month-to-month tenancy unless an express or implied agreement says otherwise. New York court guidance also cautions that accepting rent after a stated termination date may restart the tenancy and cause a holdover case to be dismissed.

That New York result should not be generalized to every jurisdiction. Before depositing a payment, determine whether local law permits acceptance “for use and occupancy,” requires a reservation of rights, or treats the payment as rent. Ask a landlord-tenant lawyer or the local court’s help center how to handle an unsolicited payment while preserving your position. Keep a written record of any payment returned, held, or accepted and the communication sent with it.

Common notice and filing mistakes

  • Using the wrong notice: A notice to cure, termination notice, and notice to quit serve different purposes in some jurisdictions.
  • Borrowing another state’s deadline: Three days in Texas, 60 days in a Delaware residential example, and 30-, 60-, or 90-day New York examples cannot be substituted for one another.
  • Ignoring the lease: A contractual notice period or renewal option may change the analysis.
  • Serving it yourself when prohibited: New York guidance requires an adult server who is not a party; other places have their own restrictions.
  • Counting from the wrong date: Service date, mailing rules, weekends, holidays, and end-of-term requirements can change the deadline.
  • Filing in the wrong venue: Courts generally require filing where the property is located, with Delaware specifically directing landlords to the nearest Justice of the Peace Court.
  • Accepting rent without a plan: Payment can alter tenancy status or undermine the case, especially after a termination date.

Situations requiring additional legal checks

Regulated or subsidized housing

Rent regulation, local good-cause rules, federal subsidy programs, and public-housing procedures can require a qualifying reason, a particular notice, or additional agency steps. Delaware Courts notes that federal requirements control if they conflict with its general notice provisions for federally subsidized units. Confirm the program and current rules before serving a notice.

Manufactured-home arrangements

A manufactured-home space may have separate statutory protections and notice periods. Do not assume the rules for an apartment or single-family rental apply to the land-lease relationship.

Commercial property

Commercial notice is often driven primarily by the negotiated agreement, with different remedies and court forms from residential cases. Read default, holdover-rent, and attorney-fee clauses and obtain commercial counsel before acting.

Possible discrimination or retaliation issues

Keep the decision tied to lawful lease and occupancy facts. A tenant may assert retaliation for reporting conditions or discrimination based on a protected characteristic. Because these defenses can affect both timing and liability, obtain local advice if such facts are present.

What not to do

Do not change the locks, block entry, shut off utilities, remove belongings, threaten the tenant, or hire someone to force the tenant out unless a lawful officer is executing a court order. Delaware Courts gives changing locks without a court order as an example of wrongfully keeping a party out of a unit. The exact prohibition and remedies vary by jurisdiction, so verify local law, but a self-help lockout can expose you to damages and weaken a possession case.

A practical decision checklist

  1. Write down the property’s country, state or province, city, and county.
  2. Classify the occupancy: residential, commercial, subsidized, rent-regulated, or manufactured-home.
  3. Read expiration, renewal, holdover, notice, and rent-acceptance clauses.
  4. Record every post-expiration payment and communication.
  5. Check the current local court instructions and statute for notice type, content, timing, service, venue, and filing fees.
  6. Serve the notice exactly as required and preserve proof.
  7. Wait through the entire deadline without self-help action.
  8. File the authorized possession or holdover case if the tenant remains.
  9. Attend the hearing, comply with the judgment, and use only the official enforcement process.

For a regulated, subsidized, commercial, or disputed tenancy—or whenever post-expiration rent was accepted—consult a lawyer licensed where the property is located. A local court’s current self-help materials can identify forms and filing locations, but they cannot substitute for advice about your specific facts.
