A delayed inherited-home transfer usually has one of two bottlenecks: the personal representative is still waiting for legal authority to administer the estate, or the authority exists but the land registry has not completed (or cannot complete) the title application. Before chasing anyone, confirm the property’s jurisdiction, how it was owned, and which of those two stages is outstanding. The correct documents, deadlines and escalation options depend on the location; England and Wales, New South Wales and Singapore follow different procedures.
Start with three checks
- Where is the property? Land registration is controlled by the jurisdiction where the land sits, not necessarily where the deceased lived or where probate was obtained.
- How was it owned? A sole owner, joint tenants, tenants in common and other forms of co-ownership can produce different outcomes.
- Which stage is delayed? Ask whether the grant of probate or administration is still pending, has been issued, or has already been used to lodge a land-registration application.
Ask the executor or administrator for the title or ownership record, the will or intestacy information, the grant status, any land-registry application or reference number, and copies of notices requesting more information. Those details turn “the transfer is delayed” into a specific issue that the responsible court, registry or adviser can address.

Separate an authority delay from a registration delay
Probate (or an equivalent grant) gives a personal representative authority to deal with the deceased’s estate. Registration is the later process of changing the public title record or recording a transfer. A beneficiary may be entitled under a will or intestacy before the legal title has been registered in that beneficiary’s name, so an inheritance can be validly agreed while the register still shows the deceased or the personal representative.

|---|---|---|
| Grant of probate or administration | Court application status, missing-information request, oath or statement requirements, and the applicant’s reference | The executor or administrator, with the probate court or a local lawyer where needed |
| Land-registration application after a grant | Lodgement date, application number, requisition or defect notice, documents already supplied, and the deadline for a reply | The person who lodged the application, often the personal representative or conveyancer, with the land registry |
| Unclear entitlement or competing claims | The will, later codicils, intestacy information, notices of dispute and any court orders | A qualified estates lawyer in the property’s jurisdiction |
Do not assume that a registry application exists simply because probate was granted. Conversely, do not treat a registry delay as a probate problem if the application has already been lodged and the registry is waiting for evidence.

Check ownership before assuming the estate must transfer the title
Sole ownership
If the deceased was the sole registered owner, the personal representative generally needs the relevant grant before dealing with the legal estate. The representative then uses the jurisdiction’s transfer or assent procedure to put the beneficiary on the register, or to sell the property and distribute the proceeds.
Joint tenancy
In England and Wales, a home held as joint tenants normally passes automatically to the surviving owner or owners. That can mean the property does not follow the will in the same way as a solely owned asset. The surviving owner may still need to provide a death certificate and make a register update, but the personal representative’s probate process is not the same as a sole-owner transfer.
Other co-ownership
Tenants in common and comparable forms of co-ownership can leave the deceased’s share in the estate. The will or intestacy rules then determine who is entitled to that share, and the representative may need a grant and a registration application. The wording on the title and the governing law matter more than informal descriptions such as “the family home.”

England and Wales: work out which step is holding things up
When probate is still pending
GOV.UK describes probate as the legal right to deal with the deceased’s estate. Until the grant is obtained, the executor may not be able to complete the legal transfer of a sole-owned home. GOV.UK also cautions: “You should not make any financial plans or put property on the market until you’ve got probate.” That warning is about authority and risk; it is not a promise of a standard processing period.
Ask the applicant whether the probate service has issued a request for information, whether inheritance-tax or other tax steps are outstanding, and whether the application is being made in the correct name and capacity. A beneficiary who is not the executor usually cannot fix an incomplete application directly, but can press the representative for the reference and a clear explanation of what remains.
When probate has been granted but the register has not changed
HM Land Registry’s guidance explains that a will or intestacy can create a beneficiary’s equitable interest, but “the legal estate does not vest in a beneficiary until a grant of representation is obtained and the land is conveyed to the beneficiary.” In practical terms, the grant is not the same thing as a completed title change. The representative must still carry out the conveyance and registration steps.

For the specific case of a registered property formerly owned solely by one person and transferred to a beneficiary, the GOV.UK checklist identifies:
- form AP1, “Change the register”;
- form AS1, “Whole of registered title: assent”;
- the original or an official copy of the UK grant of probate or letters of administration;
- identity evidence for the relevant parties;
- any applicable Stamp Duty Land Tax or Land Transaction Tax certificate or filing; and
- the applicable registration fee.
That list is scenario-specific. A sale, part transfer, unregistered land, restriction on the title or a different ownership structure can require other forms or evidence. Check the current official checklist and fee calculator rather than copying a form list from an older matter.
Read a requisition or defect notice carefully
If HM Land Registry sends a requisition, the application is not necessarily rejected. It means the registry needs a correction, clarification or additional document. Ask the person who lodged the application:

- What is the exact wording and response deadline?
- Which document or signature is missing or inconsistent?
- Who is responsible for replying?
- Has a reply been submitted, and can you see the confirmation?
A missed requisition deadline or an answer that does not address every point can cause the application to be cancelled or require a fresh application.
When the grant was issued overseas
For the England and Wales process described by HM Land Registry, an overseas grant must be resealed or the representative must obtain a UK grant before dealing with the land. Ask a local estates professional whether resealing is available for that grant and whether the title, will and identities match the documents submitted. Do not assume that a foreign probate order automatically gives authority over land in England and Wales.

New South Wales: expedition is case-specific

- real estate already sold with settlement due;
- litigation with a listed hearing;
- hardship affecting a sole entitled spouse or a minor child; or
- a deceased person who was the sole operator of a business.
The court also states that it will not expedite replies to requisitions and imposes additional conditions on an expedition application. These are NSW rules only and can change. If the property is in NSW, check the live Supreme Court guidance, identify the evidence supporting the urgency, and ask whether the application concerns the initial probate filing or a later requisition. A NSW example cannot be used to predict an England and Wales or Singapore timetable.
Singapore: identify whether the case fits the online pathway
Singapore’s Family Justice Courts describe probate and administration as the process for appointing someone to manage the deceased’s assets and liabilities. Their online guidance covers specified uncontested cases, such as a valid will naming the executor or a no-will application by an entitled beneficiary. A dispute, uncertainty about entitlement, unusual asset structure or another non-standard fact may fall outside that self-service route.
If a Singapore application does not fit the specified uncontested categories, ask the court or a Singapore-qualified lawyer what alternative filing is required. Do not substitute an England and Wales form or assume that an executor’s authority transfers across jurisdictions.
A practical follow-up sequence
- Write down the property address and jurisdiction. Include the state, territory or country where the land is registered.
- Obtain the title or ownership record. Note the registered owners, co-ownership wording, restrictions, charges and any survivorship notation.
- Confirm the estate authority. Record whether a grant is not yet filed, filed and pending, issued, resealed or replaced by a local grant.
- Request the registration details. If a grant exists, ask who lodged the application, the lodgement date, the reference number and the current status.
- Look for a formal request. Obtain every requisition, defect notice or request for further evidence, including its deadline.
- Match the documents to the transaction. Use the current checklist for an assent, sale, part transfer, unregistered title or other transaction; do not rely on a checklist for a different case.
- Ask about a status check or expedition route. The responsible court or registry may offer one, but the evidence and eligibility are local.
- Create a written response plan. Name the person who will answer each request and set a date to confirm that the answer was lodged.
When professional advice is worth the cost
Local legal or conveyancing help is especially important when there is a will contest, disagreement among beneficiaries, an unclear executor, a foreign grant, a restriction on the title, unregistered land, a missing original document or a registry requisition that the representative does not understand. A conveyancer can review whether the land application matches the title; an estates lawyer can advise on authority and entitlement. Their role is to resolve a defined complication, not to guarantee a faster result.
Common mistakes that prolong a transfer
- Using the deceased’s home address as the jurisdiction. The land’s location controls registration.
- Treating probate as title registration. A grant authorises administration; it does not, by itself, change the register.
- Assuming every home passes under the will. Joint-tenancy survivorship can operate separately from the will in England and Wales.
- Sending the wrong form set. AP1 and AS1 apply to the specified England and Wales assent scenario, not every transfer.
- Ignoring a requisition. A request for evidence needs a complete, timely reply from the person responsible for the application.
- Relying on a foreign grant without checking local recognition. Resealing or a local grant may be required.
- Quoting a generic processing time. Court and registry workloads, missing information and local expedition rules make universal promises unreliable.
The fastest useful next step is therefore not a guess at how many weeks remain. It is a documented answer to three questions: where the property is, how it was owned, and whether the grant or the registration application is the current bottleneck.
