What to do when a lender says your loan is written off but still wants payment

A loan marked “written off” or “charged off” is not automatically forgiven. The label usually describes an accounting status, not a promise that you owe nothing. Before paying, ignoring the demand, or agreeing to a new plan, identify who is contacting you, obtain the balance and ownership details in writing, compare them with your records, and use the debt-validation and credit-report dispute processes that apply to your situation.

The right response depends on the loan type, the dates, your state’s law, and whether the sender is the original lender, a servicer, a third-party debt collector, or a debt buyer. Mortgage liens and foreclosure rights can involve issues separate from ordinary collection of a balance.

What “written off” means—and what it does not mean

A charge-off or write-off generally records that the creditor considers an account seriously delinquent for accounting purposes. It does not, by itself, prove that the debt was canceled, settled, discharged in bankruptcy, or legally unenforceable. A creditor may continue to assert a balance, transfer the account, or refer it for collection, subject to the documents and law governing the account.

Ask whether a separate event changed the obligation. A signed settlement agreement, forgiveness letter, bankruptcy discharge, court order, or other written release may matter more than the charge-off notation. If none exists, the notation alone does not establish forgiveness. CFPB mortgage guidance tells consumers who thought a debt was satisfied or written off to verify the account rather than assume the balance disappeared.

The label also does not answer whether the amount is correct, who currently owns the account, whether a lawsuit is still timely, or whether a mortgage lien or foreclosure remedy remains. Those questions require the loan agreement, payment history, transfer records, dates, and applicable state law.

First identify who is demanding payment

Collection rules and your next step can change depending on the sender. Check the letter, email, statement, caller’s name, and any account number. Ask the sender to state its legal name, role, mailing address, and the name of the current creditor.

Sender What it may be doing Why the distinction matters
Original lender Still asserting the balance or handling an account internally Federal debt-collector validation rules do not automatically apply to every original lender interaction.
Loan servicer Managing billing or payments for the lender or owner Servicing, mortgage, and consumer-credit rules may apply differently from third-party collection rules.
Third-party debt collector Collecting for another creditor A timely written dispute under applicable federal rules can require a collection pause until verification is provided.
Debt buyer Claiming it purchased the account You need ownership and account-history evidence, not merely a new company name.

Do not assume a caller is entitled to payment merely because the caller has your personal information. Use a statement or letter—not an unverified phone number—to send requests and preserve a record.

Request the account details in writing

Send a written request for enough information to determine whether the claim is yours and how the amount was calculated. A validation notice from a covered debt collector generally identifies the creditor, the amount claimed, and your dispute rights. Read the notice’s deadline carefully; CFPB guidance describes up to 30 days after receiving validation information as the general period for a written dispute that triggers the federal collection pause, but the actual notice controls.

  • The current creditor’s full legal name and mailing address.
  • The collector’s role and, if ownership changed, the date and chain of transfers.
  • The account number or other identifier, with sensitive digits redacted where appropriate.
  • The total amount claimed, itemized into principal, interest, fees, credits, and payments.
  • The charge-off date, last-payment date, and date of the most recent transaction.
  • The contract, note, or other basis for the obligation and the interest or fee terms being used.
  • The name of the original creditor if it is different from the current creditor.
  • Instructions for disputing the debt and the deadline shown on any validation notice.

Keep the original notice, your letter, attachments, and proof of delivery. CFPB advises consumers to retain collection letters and communications. A dated log should record calls, names, phone numbers, promises, threats, and what documents were requested. If you speak by phone, follow up with a short letter confirming what was said.

Compare the claim with your own records

Build a simple timeline before deciding what to do. Gather the signed loan agreement, monthly statements, payment confirmations, bank or payroll records, account notices, insurance or escrow records for a mortgage, settlement offers, forgiveness correspondence, and any bankruptcy or court papers. Compare the lender’s dates and amounts with your records line by line.

  1. Match the account. Confirm that the account number, borrower name, co-borrower, property, and original creditor correspond to your loan.
  2. Reconstruct payments. Mark the date and amount of every payment, returned payment, deferment, forbearance, modification, or credit.
  3. Check the balance math. Look for duplicate charges, fees not authorized by the contract, interest calculated after a payoff or discharge, and credits that were omitted.
  4. Look for a separate resolution. Identify any document promising settlement, forgiveness, cancellation, release, or bankruptcy discharge, and check whether its conditions were met.
  5. Record transfers. Note when servicing or ownership changed and whether statements explain how the balance moved.

Make copies rather than sending your only original. Redact full bank-account numbers, Social Security numbers, and unrelated personal information unless a legitimate process requires them.

If a covered debt collector’s claim is wrong, dispute it promptly

CFPB says, “You should dispute a debt if you believe you don’t owe it or the information and amount is incorrect.” For a third-party debt collector covered by the applicable federal rules, send the dispute in writing within the validation period shown on the notice. State whether you dispute the entire debt or a specific amount, explain the error briefly, and attach copies of supporting documents.

A timely written dispute generally requires the collector to stop collecting the disputed debt or amount until it sends verification or a copy of a judgment. This is a conditional pause, not a universal injunction: it does not automatically cover an original lender or every servicer communication, and it does not erase a valid obligation. Continue preserving notices and follow the instructions in the response you receive.

A concise dispute can use this structure:

Date

Collector name and address

Re: account ending in [last four digits]

I dispute [the entire debt / the amount of $___]. Please provide verification, including the current creditor, the amount claimed and its itemization, the original creditor, the account history, and documents showing the basis for the balance. My records show [brief factual discrepancy]. Please communicate with me in writing at the address above.

Sincerely,
Your name

Check and correct your credit reports separately

Collection correspondence and credit reporting are related but separate systems. Pull your reports from the major nationwide credit-reporting companies and examine the creditor name, account status, balance, charge-off date, payment history, and any “sold” or “transferred” notation. An account can be reported inaccurately even if a collector’s letter is otherwise valid.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If an entry is wrong, dispute it with the credit-reporting company and separately with the company that furnished the information. Identify each inaccurate field, explain why it is wrong, and include relevant statements, payment records, settlement documents, or discharge papers. Keep proof of submission and the investigation results. If the investigation does not resolve the issue, you can ask that a statement of your dispute be added to the file, subject to the reporting company’s procedures.

CFPB describes most negative payment information as generally reportable for up to seven years, based on the applicable reporting rules. That is a credit-reporting period, not a universal deadline for filing a lawsuit or collecting a debt. The charge-off date and the date used for reporting should be checked against the records; do not assume that paying or disputing an account automatically resets every legal clock.

Check time limits before acting on an old debt

The time limit for a lawsuit is usually called a statute of limitations, and it varies by state, debt type, contract language, and the relevant dates. It is different from the period for negative credit reporting. A debt can be too old to sue on and still appear on a credit report within the reporting period, or it can be reportable inaccurately even when a lawsuit would be timely.

Before making a payment, signing a new agreement, or acknowledging an old debt in writing, learn the law of the state that governs the account. CFPB recommends finding out the applicable limitation period before paying or agreeing to a plan on old debt because some actions can affect the legal analysis in certain jurisdictions. Do not rely on a generic national number.

If you receive a summons, complaint, garnishment notice, or other court paper, follow the response deadline printed on it. A collector’s letter is not the same as a court judgment, and ignoring actual court papers can forfeit defenses.

Mortgage loans require an additional legal check

With a mortgage, collecting a personal balance and enforcing a lien are not always the same issue. State law may address foreclosure timing, reinstatement, acceleration, deficiency claims, and whether a lien remains after a charge-off or other account event. A written-off mortgage can therefore raise property and title questions even when the billing history is disputed.

Collect your note, mortgage or deed of trust, modification agreements, payment history, escrow statements, foreclosure notices, payoff or settlement letters, and any bankruptcy discharge. If the demand mentions foreclosure, a lien, sale of the property, or a deficiency, contact a lawyer or qualified housing counselor promptly. CFPB specifically notes that a lawyer may be needed to assess mortgage limitation periods, collection, foreclosure, and lien consequences. The answer depends on your state and the exact documents.

Choose the response that fits the facts

Your situation Practical next move Avoid assuming
You recognize the loan, but the balance is unclear Request an itemized history, compare statements and payments, and ask the lender or collector to correct specific errors. That the charge-off date proves the balance is accurate.
You do not recognize the account Send a written validation request and preserve identity-theft or fraud evidence if relevant. That a familiar company name proves the claim is yours.
A covered third-party collector sent a validation notice Use the notice’s deadline and send a written dispute with copies of supporting records. That the same pause automatically binds the original lender or servicer.
The debt is old Check your state’s limitation law and obtain advice before payment, a new promise, or a settlement agreement. That seven years on a credit report equals the lawsuit deadline.
The account involves a mortgage or court paper Get state-specific legal help immediately and calendar every response date. That a charge-off automatically removes a lien or ends foreclosure rights.

Common problems and how to handle them

The collector refuses to explain ownership

Repeat the request in writing, ask for the current creditor and transfer history, and keep proof of delivery. If the sender will not provide a usable address or validation information, preserve the communications and seek help from a consumer-law attorney or your state consumer-protection agency.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The amount changes between letters

Do not rely on a phone estimate. Request an itemization identifying principal, interest, fees, payments, and credits as of a stated date. Compare each version and dispute the specific discrepancy.

The credit report says “paid” or “sold,” but collection continues

“Sold” may identify a transfer rather than forgiveness, while a paid or settled notation should be checked against the agreement that produced it. Obtain the account history and dispute any reporting that conflicts with the documents.

You already paid after the charge-off

Gather receipts, canceled checks, bank statements, and confirmation letters. Ask for the payment to be applied correctly and for a written balance statement. Do not send duplicate payment merely to end a confusing phone call.

You cannot resolve the issue yourself

Free or low-cost assistance may be available through a state bar referral service, legal-aid organization, housing counselor, or consumer-protection office. Bring your timeline and copies of every notice so an adviser can evaluate the actual documents and deadlines.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to keep in your file

  • Every statement, letter, email, text, and envelope showing dates or postmarks.
  • Copies of validation requests, credit-report disputes, attachments, and delivery receipts.
  • A payment spreadsheet tied to bank or payroll records.
  • Settlement, forgiveness, modification, bankruptcy, and court documents.
  • A contact log with dates, names, numbers, and promised follow-up.
  • Credit-report copies and investigation results.

The practical rule is simple: treat “written off” as a status that needs verification, not as proof of forgiveness. Establish who is asking, what amount is claimed, and which documents support it; then use the procedure that matches the sender, the loan, and the age of the debt.
