If your co-borrower refuses to refinance or sell, separate the ownership problem from the mortgage problem. The deed determines who owns the home; the promissory note determines who owes the lender. A deed transfer, buyout agreement, divorce decree or court order generally does not remove a borrower from the mortgage contract. Until the lender changes or pays off that loan, every named borrower can remain responsible for the payments.
Start with a written proposal for a sale or buyout, then ask the mortgage servicer in writing whether the loan permits an assumption with a release of liability and, if not, whether a refinance is feasible. If you are a co-owner and agreement remains impossible, a local attorney can evaluate whether partition or a family-court remedy is available in the state and under the form of ownership shown on the deed.

First, identify the two separate problems
Who owns the house?
Ownership comes from the recorded deed and its vesting language. It may show joint tenancy, tenancy in common, tenancy by the entirety for some married couples, or another form recognized by the state. The deed may also show unequal ownership shares. Those details affect who can consent to a sale, who may seek partition and how sale proceeds could be divided.

The promissory note and related mortgage or deed of trust identify the borrowers and secure the lender’s rights in the property. If your name remains on the note, the lender can generally seek payment from you even if you moved out, transferred your ownership interest or received a divorce order assigning payments to the other person. The Consumer Financial Protection Bureau states that a divorce decree or property settlement can allocate a debt between spouses but does not change a creditor’s ability to collect from anyone named as a borrower.

That distinction explains why removing someone from the deed is not the same as removing them from the loan. A title change may alter ownership while leaving both borrowers exposed to missed payments, collection activity and credit damage.
Protect yourself while the loan is still joint
Do not wait for negotiations to fail before monitoring the account. A late payment can affect the credit of every borrower who remains on the mortgage. A former spouse may also have difficulty qualifying for another mortgage while the existing joint debt appears on credit reports, even when a separation agreement says the other person will pay.
- Keep copies of monthly statements, payment confirmations, escrow notices and all messages with the co-borrower and servicer.
- Confirm who is making each payment and how taxes, insurance, utilities and urgent repairs will be handled.
- Check the mortgage account and your credit reports for missed or misapplied payments.
- If a payment may be late, contact the servicer promptly and document the call, the representative’s name and any promised action.
- Get prompt legal advice if a court order or written agreement is being violated, or if foreclosure risk is developing.
Do not stop paying solely because a divorce decree or private agreement assigns the debt to someone else. That agreement may be enforceable between the two of you, but it does not rewrite the lender’s contract.

Route 1: Make a documented agreement to sell
A negotiated sale is often the cleanest way to resolve both the ownership and loan issues. At closing, the mortgage is ordinarily paid from the sale proceeds, which can end the borrowers’ liability on that loan. The sale must actually close and pay the debt; listing the property or signing a contract does not release anyone in the meantime.

- Whether the home will be listed, the proposed asking price and how a real-estate professional will be selected.
- Access for appraisal, inspections, repairs, photography and showings.
- Who will occupy the property and who will pay the mortgage, taxes, insurance, utilities and maintenance until closing.
- How repair costs, commissions, closing costs and other sale expenses will be approved and paid.
- How net proceeds will be divided according to the deed, a valid agreement or applicable law.
- What happens if the sale produces less than the mortgage payoff and closing costs.
These are negotiation points, not a universal legal checklist. Have a local real-estate or family-law attorney review any agreement before signing. Ownership shares, marital-property rules, tax consequences and enforcement procedures vary by state.
When the home is worth less than the debt
Negative equity can prevent a straightforward voluntary sale. If the expected sale price is below the payoff and selling costs, the parties may need to contribute cash, obtain the lender’s approval for a loss-mitigation arrangement or pursue another legally available option. Neither co-owner should assume the other will cover a shortfall without a written agreement, and a sale proposal should identify who bears that risk.

Route 2: Buy out the departing owner and solve the loan separately
If one person wants to keep the home, that person can negotiate compensation for the other’s ownership share. The amount may depend on market value, the mortgage payoff, ownership percentages, documented contributions and any state marital-property rules. A deed transfer alone, however, leaves the departing person on the mortgage unless the lender changes the loan or it is paid off.
Ask for an assumption with a release of liability
Contact the servicer in writing and ask four separate questions:
- Does the loan permit an assumption by the person who will keep the home?
- Can the departing borrower receive a written release of liability at the same time?
- What underwriting standards, income documents, credit requirements and property documents apply?
- What forms, fees and review steps are required, and how will the servicer communicate the decision?
An assumption transfers responsibility for an existing loan under the investor’s and servicer’s rules. It is not automatic, and eligibility differs by loan type and governing documents. A servicer may approve an assumption yet decline to release the departing borrower, so request the release explicitly and obtain it in writing before transferring title.

Federal law includes a due-on-sale exception for certain divorce-related transfers. That exception can protect a qualifying transfer from an immediate demand for full repayment; it does not itself release a borrower from the note or guarantee that an assumption will be approved. The exact exception and its application depend on the facts and loan documents.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesIf assumption is unavailable, ask about refinancing
A refinance replaces the existing mortgage with a new loan in the keeping owner’s name, subject to that borrower’s income, credit, equity and lender underwriting. Ask the servicer whether there is an internal refinance path, but also compare other lenders through legitimate channels. Do not sign over the deed until you know whether the new loan will close and pay off the old one. If neither assumption nor refinance works, return to a sale negotiation or obtain jurisdiction-specific legal advice.
Route 3: Use a divorce or separation order carefully
A divorce decree or separation agreement can require one spouse to make the payments, sell the home or refinance by a deadline. It can also create a right to reimbursement if that spouse fails to comply. Those remedies operate between the former spouses. The mortgage lender still has the rights granted by the original note and security instrument against every named borrower.
Before signing a settlement, make sure it states who controls listing and sale decisions, who pays carrying costs, what happens if refinancing is denied, how an appraisal will be obtained, and what enforcement or indemnity applies if payments are missed. Ask your attorney whether the order should require an assumption request, a release of liability, a sale, or a return to court if the deadline cannot be met.
If the other spouse stops paying, preserve statements and proof that you paid or attempted to pay. Notify your lawyer promptly about any violation. Do not rely on an informal promise that the lender will remove your name.

Route 4: Ask whether partition is available
Partition is a court process that can allow a co-owner to separate their interest from another co-owner’s interest. The right depends on state law, the deed’s ownership form and any agreements or court orders. A court may divide property physically when that is equitable. If physical division is impractical, the court may order a sale and distribute the proceeds according to the applicable rules.
Why partition is not a guaranteed quick sale
- Tenancy by the entirety and some other ownership forms can restrict or alter the remedy.
- Family-court jurisdiction, a pending divorce, a settlement agreement or a prior order may change where and how the dispute must be handled.
- Courts must address liens, sale expenses, credits for payments or improvements and competing claims to proceeds.
- Litigation can take time and create attorney, appraisal, filing and sale costs; no universal timeline or price outcome applies.
A local real-estate or family-law attorney should review the recorded deed, mortgage, any co-ownership contract and every existing court order before you file. Do not represent partition as an automatic right to force an immediate sale.

When a servicer gives conflicting answers or does not process an assumption or release request, create a paper trail. Send a written request through the address or portal the servicer designates for borrower correspondence. Ask it to identify the loan’s investor, the applicable assumption policy, eligibility criteria, required documents and the status of any pending release request.
Keep the request, delivery confirmation, uploaded files and every response. The CFPB has reported consumer complaints involving delays, inaccurate information and pressure to refinance when an assumption may be available. If the servicer does not resolve a mortgage problem, CFPB guidance identifies filing a complaint as an option. A complaint does not guarantee approval, but it creates a formal record for the agency and the servicer.

Compare the available paths
| Path | Consent or authority | Mortgage result | Equity and cash issue | Main exposure while pending |
|---|---|---|---|---|
| Negotiated sale | Usually requires both owners’ cooperation unless a court orders otherwise | Sale proceeds ordinarily pay the mortgage at closing | Negative equity may require cash, lender approval or another agreement | All named borrowers remain liable until payoff |
| Buyout plus assumption | Parties agree on the ownership transfer; servicer and investor must approve the assumption and any release | Existing loan may continue, but release is not automatic | Keeping owner needs funds for the buyout and must meet underwriting rules | Departing borrower remains exposed unless a written release takes effect |
| Buyout plus refinance | Parties agree; a new lender must approve and close | New loan pays off the old one if the refinance closes | Rates, fees, appraisal, credit, income and available equity affect feasibility | Old loan liability continues until the payoff posts |
| Divorce or separation order | Family court or a valid settlement can assign duties between spouses | Does not by itself change the lender’s contract | Order should address value, deadlines, costs and shortfall | Creditor can still pursue every named borrower |
| Partition | May be available to a co-owner under state law; court involvement is required | Court-ordered sale may pay the mortgage, but timing and outcome are not stated universally | Costs, liens, credits and sale proceeds are determined in the case | Payments and credit exposure continue until the debt is paid or otherwise changed |
Gather these documents before choosing a path
Collect a complete file so an attorney, servicer or lender can evaluate the actual transaction rather than assumptions:
- Recorded deed and vesting language.
- Promissory note and mortgage or deed of trust.
- Current payoff statement and recent payment history.
- Approximate market value, appraisal or credible comparative sales.
- Divorce decree, separation agreement or co-ownership contract.
- Tax, insurance, repair and contribution records.
- Every servicer letter, assumption form, denial and payment confirmation.
Write down the property’s state and county, whether the loan is current, whether the person seeking to keep the home is already on title, and whether the dispute is divorce-related or a non-marital co-ownership matter.
Questions to ask before signing anything
- What exactly does the deed say about ownership shares and survivorship?
- Who is named on the note, and what does the servicer say is required for a release?
- Is an assumption available for this loan and investor, and does it include underwriting?
- If refinancing is required, what happens if the keeping owner is denied?
- Who pays the mortgage and property expenses during the transition?
- How will an appraisal, buyout amount, sale price or negative-equity shortfall be determined?
- What deadline applies, and what remedy follows if the other person refuses to cooperate?
- Which state and county’s law governs the deed, contract and court process?
The direct answer is practical but fact-dependent: document a sale or buyout proposal, ask the servicer about assumption and release in writing, and obtain local legal advice about partition or divorce remedies if cooperation fails. Keep the loan current as far as possible and preserve evidence until your name is formally released or the mortgage is paid in full.
