What to Do When a Bank Rejects Your Compensation Claim for a Delayed Request

A bank’s refusal is not the end of the matter, but your next step depends on what was delayed, which party owed the compensation, and the country governing the account. Identify the original request or payment, the compensation scheme or contract, the bank’s role, the date and wording of its rejection, and the applicable jurisdiction before relying on any deadline or remedy. The process below uses current UK financial-services complaint rules as a worked example; other countries use different bodies and time limits.

Start by identifying the claim you are actually pursuing

“Compensation for a delayed request” can describe several different disputes. A bank may have delayed a transfer, failed to process a refund, rejected a card claim, or merely handled a request made under a scheme operated by another company. Those situations do not automatically create the same legal right or complaint route.

As an Amazon Associate I earn from qualifying purchases.

  • Bank service problem: the bank may have delayed or mishandled a payment, refund investigation, fraud report, or complaint.
  • Card purchase problem: the underlying issue may be goods or services that were not supplied, were defective, or were not refunded. Chargeback or, in qualifying UK credit-card cases, Section 75 may be relevant.
  • Another provider’s compensation scheme: an airline, payment platform, employer, insurer, or other service provider may owe the compensation. The bank may only be processing a payment or reviewing a card dispute.
  • Account or transfer delay: a bank-transfer delay may be governed by payment-services rules, the account contract, or a scheme’s specific terms rather than a general compensation entitlement.

Write down which party made the decision you are challenging. A complaint that the bank rejected your request or handled it unfairly is different from a claim that the original provider caused the loss. You may need to pursue both issues separately, but do not assume one route substitutes for the other.

Preserve the rejection and ask for the reasoning

Get the bank’s decision in writing before arguing about it. If the refusal was made by telephone or secure message without a full explanation, ask for a formal written decision and the bank’s final response letter if it considers the matter closed.

Keep the original compensation request, the bank’s reply, every reference number, and the dates and times of calls, messages and uploads. Ask the bank to identify the rule, account term, card-dispute condition, or evidence on which it relied. If it says information was missing, request a precise list of what it needed and the date by which it should have been supplied.

Do not edit screenshots or overwrite messages. Export statements and online-chat transcripts where possible, and keep a simple chronology showing when you made the request, when documents were sent, when the bank asked questions, and when it rejected the claim. This record can show whether the issue was the underlying entitlement, the bank’s investigation, or an avoidable delay in handling.

Make a formal complaint to the bank

Use the bank’s published complaint channel, not only the team that first rejected the claim. GOV.UK advises asking the company for a copy of its complaint procedure if you cannot find it. Mark the communication “formal complaint” and state the outcome you want.

  1. Describe the request: give the payment, purchase, refund, or scheme reference and the date it was submitted.
  2. Set out the timeline: list the bank’s actions, questions, delays, and rejection date in chronological order.
  3. Explain what you say was wrong: identify a factual error, an overlooked document, an incorrect application of terms, or an unreasonable delay in investigating.
  4. Attach targeted evidence: include the rejection, transaction proof, relevant terms, correspondence, and proof of loss or impact. Label each attachment and refer to it in the complaint.
  5. State the remedy: ask the bank to reconsider the decision, complete a proper investigation, correct an error, pay any compensation it is required to pay, or explain why the claimed amount is not due. Ask for interest or out-of-pocket costs only where you can substantiate them.
  6. Request a final response: ask the bank to confirm the date by which it will respond and to explain any external dispute-resolution route if it does not uphold the complaint.

The Financial Conduct Authority says its rules require firms to deal with complaints “fairly, consistently and promptly.” That standard concerns the bank’s handling and decision; it is not a promise that every compensation claim will be paid.

Build one evidence file

Incomplete information can prevent a bank or ombudsman from testing what happened. Keep originals and submit copies or secure uploads.

  • Proof of the original payment or request, such as a statement, transfer confirmation, receipt, order record, or claim reference.
  • The contract, account terms, card terms, refund policy, or compensation-scheme rules that you say apply.
  • A dated timeline of the event, your request, document submissions, bank contacts, and rejection.
  • Emails, letters, secure messages, call notes, chat transcripts, and names or reference numbers for staff you contacted.
  • Messages with the business or service provider responsible for the delay, including its admission, refusal, or proposed remedy.
  • Evidence of the amount claimed: invoices, receipts, replacement costs, fee statements, or a clear calculation.
  • Evidence of practical impact where relevant, such as cancelled arrangements or additional costs. Avoid claiming losses you cannot connect to the delay.
  • For card disputes, the Financial Ombudsman Service says payment proof, contracts, correspondence, and relevant photographs or videos may help it assess the case.

Use a short index at the front of the file. A reviewer should be able to match each important fact to a document without searching through an unlabelled bundle.

Track the bank’s response deadline

Deadlines depend on the complaint category and jurisdiction. In the UK, the ordinary financial-complaint timetable is generally up to eight weeks for the firm’s response. Certain complaints involving payment services, fraud or scams, and electronic money generally have a 15-day response period under the applicable rules, although exceptions can affect the timetable. Do not assume that a delayed transfer and a card-purchase complaint use the same clock.

UK situation Process point Qualification
Most financial-services complaints The firm may have up to eight weeks to issue its response. GOV.UK and Financial Ombudsman Service guidance; the exact category must be checked.
Specified payment-service, fraud/scam, or electronic-money complaints A 15-day response period generally applies. Financial Ombudsman Service guidance; some cases can be subject to permitted exceptions.
Referral after an unsatisfactory final response Usually six months from the date of the final response. General UK Financial Ombudsman Service deadline; check the letter and eligibility rules.
Chargeback for many card disputes Often around 120 days. Financial Ombudsman Service guidance says timing varies with the circumstances and card-network rules.

Record the date the bank receives your formal complaint, not just the date you drafted it. If the bank misses the applicable deadline, send a short written reminder and preserve proof of delivery. A late response does not automatically prove that you are entitled to compensation, but it can support a complaint about handling and may allow escalation.

Escalate an eligible UK complaint to the Financial Ombudsman Service

If the bank’s final response is unsatisfactory, or the response period has expired, check whether you can refer the complaint to the Financial Ombudsman Service. You normally must first give the bank an opportunity to resolve the matter. The service is free to consumers and independent of the bank.

  1. Read the final response carefully. Note the issue it decided, any proposed remedy, and the stated external-complaint deadline.
  2. Check that the bank and the type of activity fall within the Ombudsman’s jurisdiction and that you are an eligible complainant.
  3. Refer the case within the stated period. The general deadline is six months from the date of the final response, but the letter may specify a different rule for the complaint category.
  4. Send the final response, your original complaint, the evidence index, and a concise explanation of why the bank’s decision or handling was wrong.
  5. Answer requests for information by the stated date and tell the Ombudsman if a document cannot be obtained.

The Ombudsman examines what happened, the relevant rules and terms, and what would be fair and reasonable. It may not uphold the complaint, and it cannot turn every disappointing outcome into a compensation award. The bank’s duty to investigate fairly is distinct from whether the original provider owed money.

Use chargeback or Section 75 only when the transaction fits

For a card payment for goods or services, ask the bank whether chargeback is available and whether Section 75 of the UK Consumer Credit Act could apply. These are card-specific mechanisms, not general compensation procedures for any delayed request.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Chargeback

Chargeback is a card-network process in which the issuer may seek to reverse a transaction under network rules. The Financial Ombudsman Service says many cases have a timing window of around 120 days, but the starting point and permitted period can vary with the transaction and reason for the dispute. Contact the issuer promptly, provide the purchase evidence and correspondence with the merchant, and ask it to explain the applicable deadline. A chargeback is not guaranteed and can be challenged by the merchant.

Section 75

Section 75 can create a direct claim against a qualifying UK credit-card provider for certain breaches or misrepresentations by the supplier. Eligibility depends on matters such as the credit agreement, the transaction structure, and the goods or services involved. It is not a remedy for a bank transfer, a debit-card payment, or every delayed service. Ask the card issuer to assess Section 75 separately from any chargeback request and obtain its decision in writing.

Question Chargeback Section 75
Underlying transaction Card payment dispute governed by card-network rules. Qualifying UK credit-card transaction involving supplier breach or misrepresentation.
Typical timing Often around 120 days, but variable. No single deadline stated here; act promptly and check the applicable legal and card terms.
What to provide Payment proof, merchant correspondence, contract or order details, and evidence of non-delivery or breach. The credit-card statement, contract, supplier breach or misrepresentation evidence, and loss calculation.
Outcome certainty Not guaranteed; the merchant may challenge the reversal. Eligibility and liability depend on the statutory conditions.

If you are outside the UK

Do not transplant the UK eight-week, 15-day, or six-month figures into another country. The account’s governing jurisdiction, the bank’s licence, and the underlying transaction determine the complaint body and deadlines.

European Banking Authority guidance tells consumers to make an official complaint to the institution, provide relevant documents, and consult its country-by-country complaint contacts. Start with the bank’s formal complaints process, then identify the national ombudsman, supervisory authority, or alternative-dispute-resolution body that handles the relevant service. Confirm whether the body covers the bank, the type of claim, and cross-border transactions.

The Bank of England does not investigate personal banking-account problems at individual firms. Contacting a central bank or general regulator therefore may not substitute for the bank’s complaint process or the designated dispute-resolution service.

Choose the route by decision-maker and evidence

What you are challenging Likely first route Key evidence Deadline issue
The bank rejected or mishandled your request Formal complaint to the bank, followed by the applicable financial ombudsman. Rejection, final response, timeline, terms, and proof of the bank’s error or delay. Use the jurisdiction’s firm-response and referral deadlines.
A merchant or service provider failed to deliver or refund Complain to that provider; ask the card issuer about chargeback or Section 75 if the payment qualifies. Contract, payment proof, correspondence, delivery or refund evidence, and loss calculation. Card-network and statutory windows can differ; act promptly.
A transfer or payment-service delay Bank complaint under the relevant payment-services rules and account terms. Payment confirmation, timestamps, recipient details, messages, and resulting loss. Check whether the complaint falls into a category with a shorter response period.
A compensation scheme operated by another body Claim under that scheme’s terms, while separately complaining about any bank handling failure. Scheme rules, eligibility proof, original request, bank decision, and correspondence with the scheme operator. The scheme may impose its own filing limit; it is not established by the bank’s complaint timetable.

Common mistakes that weaken a claim

  • Arguing only by phone: without a written record, it is harder to prove what the bank decided and why.
  • Claiming against the wrong party: a bank may not be responsible for a service provider’s original delay.
  • Sending an unstructured document bundle: missing dates and unexplained attachments slow review.
  • Waiting for the bank indefinitely: an investigation does not necessarily pause an ombudsman or card-dispute deadline.
  • Assuming every card transaction qualifies: chargeback and Section 75 have different conditions and are not universal compensation routes.
  • Using a UK deadline abroad: complaint bodies and statutory periods are jurisdiction-specific.
  • Demanding an unsupported amount: separate the principal loss, recoverable costs, interest, and any non-financial impact, and show how each figure was calculated.

A practical decision sequence

  1. Identify the delayed request, the country, and the party that owed the underlying compensation.
  2. Obtain the bank’s written rejection and preserve all related records.
  3. Check the account, card, payment-service, or compensation-scheme terms that govern the request.
  4. Submit a formal complaint to the bank focused on its decision or handling, with a dated evidence index and a specific remedy.
  5. Mark the applicable response and referral deadlines on a calendar while the bank investigates.
  6. If the matter is a qualifying card purchase, ask separately about chargeback and Section 75 without assuming either applies.
  7. Escalate to the correct ombudsman or national complaint body when the bank’s response is final, overdue, or plainly inadequate.
  8. Continue pursuing the original service provider or scheme operator if that party, rather than the bank, is responsible for the underlying compensation.

This approach keeps two questions separate: whether compensation was owed in the first place, and whether the bank dealt with your request fairly, consistently, and promptly. That distinction determines what evidence to submit and which decision-maker can provide a remedy.
