Then obtain the plan documents, verify what is vested, compare the choices the plan actually offers, and use a direct rollover when moving eligible 401(k) money if you want to avoid mandatory withholding. A vested pension usually remains with the former employer until you claim it, while a 401(k) may be left in place, moved to another plan or IRA, or withdrawn.
Start by identifying the benefit you have
The words “retirement plan” can describe two very different arrangements. Your options, deadlines and risks depend on which one you have. This guide covers U.S. federal rules; your plan document, state law and tax situation can change the result.

401(k): an account balance
A 401(k) is a defined-contribution plan. You and, often, your employer make contributions to an individual account. Its value changes with contributions, investment gains or losses and fees. The balance is not a promised monthly amount. The plan’s rules determine when you can take a distribution and which rollover destinations it accepts.

A traditional pension is usually a defined-benefit plan. The plan formula—often based on pay and years of service—determines a benefit, commonly paid as monthly income beginning at a stated age. You do not generally “transfer” a pension the way you transfer a 401(k). If you are vested, the benefit normally stays in the former plan until you reach the plan’s claim age, unless the plan offers an earlier start or a lump-sum election.

Collect the documents before making an election
Contact the plan administrator or former employer and request the latest Summary Plan Description (SPD) and your individual benefit statement. The SPD explains eligibility, vesting, payment timing, rollover rules and available forms. The statement can show your account value, contribution sources and vesting information.
- Ask for the most recent SPD and individual account or pension statement.
- Request the distribution notice, tax notice and all election forms.
- Ask for the exact deadline for choosing a distribution, rollover or pension commencement date.
- Confirm the administrator’s mailing address, telephone number and secure online portal.
- Give the plan your current mailing address and retain copies of every form and confirmation.
Do not assume that a choice available in one employer’s plan is available in another. The SPD and the administrator’s written explanation control the practical choices.
Check vesting and when the benefit can be paid
Vesting is your nonforfeitable right to keep a benefit. Your own salary-deferral contributions to a 401(k) are generally yours, but employer contributions may vest gradually. Separate the employee contributions, vested employer contributions and any unvested employer amount on your statement.

Ask how the plan counts service, whether breaks in service affect the calculation and which contribution sources are subject to the schedule. An unvested employer amount can be forfeited when you leave.
Vested does not mean immediately payable
A vested pension can remain in the former employer’s plan until its normal retirement age or another claim date. A 401(k) may become distributable after separation from service, but the plan can impose administrative procedures, minimum-balance rules or other conditions. Confirm the earliest payment date in writing.
Your 401(k) choices after leaving
Most plans present four broad paths. Compare total fees, investment choices, convenience, creditor or legal protections that matter to you, and tax treatment before selecting one.
| Choice | What it can provide | Questions to ask |
|---|---|---|
| Leave money in the former plan | Continued access to that plan’s investment menu and recordkeeping | What are the ongoing investment and administrative fees? Is there a minimum balance or a forced-distribution rule? How will you access statements and beneficiaries? |
| Roll to the new employer plan | One workplace account and a single payroll system for future contributions | Does the new plan accept rollovers? Which sources and investments are accepted? Are fees and investment options better or worse? |
| Roll to a traditional IRA | Potentially broader investment selection and consolidation outside an employer plan | What are account, fund and advisory costs? Would leaving the employer plan change protections or access that matter in your circumstances? |
| Take a withdrawal | Immediate access to cash | How much is taxable? Will the additional tax for an early distribution apply? What retirement assets will be lost? |
Leaving the balance in the former plan
This can be sensible when the plan has low-cost investments, useful institutional funds or features you value. Check whether former employees pay different fees, whether a small balance triggers an automatic distribution, and how to update beneficiaries. Keep the administrator’s contact information and monitor statements.

Rolling into a new employer’s plan
Get confirmation from the new plan before sending money. Some plans accept only particular contribution types or require specific paperwork. Compare the two plans’ expense ratios, recordkeeping charges, investment lineup, withdrawal rules and loan provisions. A rollover is not complete merely because a check was requested; verify that the receiving plan posted the funds.
Rolling to an IRA
A traditional IRA rollover can consolidate old accounts and may offer a wider investment menu. Costs vary by investment and provider, so compare all account, fund and advisory fees. Moving out of an employer plan can affect protections or access relevant to you; obtain individualized advice if those issues are important. A rollover to a Roth IRA is different: untaxed amounts generally become taxable income in the rollover year.
Withdrawing the money
The taxable portion not rolled over is generally included in income for the year you receive it. A 10% additional tax can apply to taxable distributions before age 59½ unless an exception fits. The age test and exceptions are not identical for every account type, so check the applicable IRS rules. Cashing out also removes money from tax-deferred retirement savings and can increase your current tax bracket.
How to move a 401(k) without avoidable withholding
The cleanest method is a direct rollover. The IRS states: “You can choose to have your 401(k) plan transfer a distribution directly to another eligible plan or to an IRA. Under this option, no taxes are withheld.” The plan sends the eligible amount directly to the receiving plan or IRA, so the mandatory 20% withholding that generally applies when an eligible taxable distribution is paid to you does not apply to the directly transferred amount.

Direct-rollover procedure
- Open or identify the receiving traditional IRA or confirm the new employer plan’s rollover instructions.
- Ask the former plan for a trustee-to-trustee or direct rollover, payable to the receiving trustee or custodian rather than to you.
- Provide the receiving institution’s exact name, address and account number on the former plan’s form.
- Keep the distribution confirmation and verify that the receiving account posts the full eligible amount.
If the check is paid to you
When an eligible taxable distribution is paid to the participant, the payer generally withholds 20%. You generally have 60 days to deposit the distribution into an eligible plan or IRA. To roll over the entire taxable amount, you may need to replace the withheld money from another source; otherwise the withheld portion can remain taxable and may also face the additional early-distribution tax. The IRS provides exceptions to the 60-day rule in limited circumstances, including a different deadline for certain qualified-plan loan offsets.
Read the tax notice before endorsing or depositing a check. A check payable to you is not treated the same as a direct rollover, even if you intend to redeposit it.

Ask the pension administrator for a written estimate of your vested monthly benefit at normal retirement age and at every available early-start date. If a lump sum is offered, request its amount and the date through which it is valid. Also request the payment forms and the rules for changing an election.

1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteQuestions for the administrator
- What is the monthly amount at normal retirement age and at each early commencement date?
- Is a lump sum available, and is it eligible for a rollover?
- What single-life and joint-and-survivor annuity forms are offered?
- How much does the worker’s payment decrease for survivor coverage, and what would the spouse receive?
- Is there an inflation adjustment or other cost-of-living feature?
- What spousal consent or waiver is required?
- What is the election deadline and can an election be revoked?
Single-life versus survivor income
A single-life annuity generally pays more each month while you are alive but may stop at death. A joint-and-survivor annuity generally pays less to the worker while alive and continues a stated percentage to the surviving spouse. A qualified joint-and-survivor annuity may be required unless it is properly waived with spousal consent. The exact percentages, reductions and consent procedures are plan-specific.

Lump sum versus lifetime payments
Compare the lump sum with the annuity actually offered, not with an assumed amount. A lump sum transfers investment and longevity risk to you: you must invest it, manage withdrawals and ensure it lasts. An annuity supplies a schedule of payments but may provide less flexibility and may have different survivor or inflation features. Consider start date, household health and longevity expectations, other income, tax treatment, fees and your ability to manage investments. Public guidance does not determine which choice is best for an individual.
Understand pension security and PBGC limits
The Pension Benefit Guaranty Corporation (PBGC) protects certain benefits in covered private defined-benefit plans that terminate without enough assets, subject to legal limits. PBGC does not insure 401(k) account balances. Coverage is not a promise that every elected benefit, early-retirement subsidy or future employer plan will perform exactly as illustrated. Ask whether your pension is in a PBGC-covered plan and review the applicable limits before treating the benefit as guaranteed.
Keep the benefit reachable after you leave
Update your address with the former employer or administrator whenever you move. Save the SPD, benefit statements, rollover confirmations, pension estimates and beneficiary records in a secure location. If the plan changes administrators, record the new contact details. Missing mail can mean missing an election deadline or a payment notice.
