If a Medicare late enrollment penalty looks wrong, first identify whether it is for Part B or Part D. The programs use different rules, evidence and appeal routes. Read the penalty notice, reconstruct your coverage month by month, then follow the deadline and instructions on the notice. Part D enrollees generally use the CMS reconsideration process; for Part B, the responsible office and applicable deadline must be confirmed from the notice, Medicare or Social Security.
Start by identifying which Medicare part was penalized
“Medicare late enrollment penalty” is not one universal charge. A Part D penalty is assessed through a Medicare prescription drug plan and has a specific reconsideration form. Part B penalties involve delayed enrollment in outpatient medical insurance and have different exceptions. Sending a Part D form about a Part B charge can delay the correction of your record.

| Question | Part D | Part B |
|---|---|---|
| Typical issue to verify | Months without Part D or creditable prescription coverage after the initial enrollment period | Delayed Part B enrollment and whether a Special Enrollment Period or another exception applied |
| First records to gather | Drug-plan history, creditable-coverage notices, Extra Help dates and enrollment dates | Medicare enrollment dates, employer or group-health-plan records and enrollment paperwork |
| Official next step | Use the plan’s penalty notice and the CMS Part D LEP Reconsideration Request Form | Follow the notice and confirm the correction or appeal office with the issuer, Medicare or Social Security |
| Deadline established in the applicable material | The form says to submit within 60 days from the date of the penalty letter | No matching Part B penalty-specific deadline is established in the reviewed official material; verify it directly |
Read every line of the penalty notice
Before arguing that the charge is wrong, determine exactly what the agency counted. Note the Medicare part, the plan or office that issued the letter, the months or years treated as uncovered, the amount and the response deadline. The notice should also explain where to send documents and whether the charge will continue while a review is pending.

Build a month-by-month coverage timeline
A timeline is the most useful way to expose an incorrect gap. Create one row for every month from the end of your initial enrollment period through the month Medicare says coverage began. Put the effective date—not just the application date—on each row.
For a Part D charge
List every period in which you had Part D, another prescription plan, or a qualifying exception. Ask each former employer, union, insurer or government program for dated proof of the exact coverage dates. A card showing that you once had insurance is usually less persuasive than a letter stating the start and end dates and whether the plan was creditable.
For a Part B charge
Record when you first became eligible, when you actually enrolled, and the dates of employer or union group-health coverage. Include employment-status changes, a spouse’s employer coverage, termination notices and any Medicare enrollment forms. These records help establish whether a Special Enrollment Period or another exception applied.
Documents to preserve
- Creditable-coverage notices and certificates from an employer, union or insurer
- Drug-plan enrollment and disenrollment confirmations
- Medicare cards and effective-date letters
- Employer group-health-plan verification and proof of active employment
- VA, TRICARE or state-program coverage records, when applicable
- Extra Help approval or termination notices
- Hospital or emergency records when a serious medical event is relevant
- Proof of overseas residence when that is the reason you could not enroll
Send copies, not originals, unless the instructions specifically require otherwise. Keep the originals and proof of delivery.

Check whether a Part D penalty rule actually fits
The 63-day test
Medicare generally assesses a Part D late enrollment penalty when, after the initial enrollment period, a person goes at least 63 continuous days without Part D or creditable prescription-drug coverage. The relevant question is whether the gap was continuous and whether another plan qualified—not simply whether you lacked a Medicare drug plan.
What “creditable coverage” means
Creditable prescription coverage is expected to pay, on average, at least as much as standard Medicare prescription coverage. Depending on the circumstances, it can include some employer or union plans, Veterans Affairs coverage, TRICARE and certain state programs. The coverage provider should be able to confirm whether its plan was creditable for the months in question.
Exceptions that can remove the charge
Medicare says Part D penalties generally do not apply when you had creditable coverage or qualified for Extra Help. The dates matter: an approval or coverage period that began after the alleged gap will not automatically erase earlier months. Compare the effective dates on your notices with the months listed in the penalty letter.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteWhen the form’s listed circumstances may help
The CMS Part D LEP Reconsideration Request Form lists specific grounds. Examples include proof that you were not eligible to enroll during the stated period, such as overseas residence; records of a serious medical emergency, including an unexpected hospitalization; and dates when Extra Help applied. Select the circumstance that matches your facts and provide documents supporting that particular ground.

Request Part D reconsideration within the stated deadline
- Obtain the current packet. Your Part D plan’s penalty letter should include an explanation of review rights and the Part D LEP Reconsideration Request Form. Use the form supplied with the current notice or the current CMS form identified by the plan.
- Check the date. The form says to submit the completed request within 60 days from the date of the penalty letter. If circumstances prevented a timely filing, explain that in the space provided and include supporting evidence; do not assume an extension is automatic.
- Complete only applicable sections. State the months at issue and choose the listed reason that describes your case. Attach copies of dated records that prove the coverage, exception or eligibility facts.
- Sign the form. The form states: “IMPORTANT: A signature by the enrollee is required on this form in order to process an appeal.” An unsigned submission can be rejected without a decision on the underlying evidence.
- Send it exactly as instructed. Use the mailing address, fax number or other delivery method in the notice or form. Keep a complete copy and delivery confirmation.
- Respond to follow-up requests. The independent review entity may ask for clarification or additional documents. Meet every date in its correspondence and retain proof of what you sent.
CMS says the independent review entity generally notifies the enrollee of its final Part D LEP reconsideration decision within 90 calendar days after receiving a reconsideration request. That is a general timeframe, not a guarantee that every case will finish within 90 days.
Understand how a Part D penalty is calculated
The dollar amount changes with the national base beneficiary premium. For 2026, Medicare lists a national base beneficiary premium of $38.99. The usual calculation is 1% of that base for each full uncovered month, multiplied by the number of full months in the qualifying gap, then rounded to the nearest ten cents. The resulting amount is generally added to your monthly Part D premium and can change when the national base changes.
| Illustrative element | 2026 value or rule |
|---|---|
| National base beneficiary premium | $38.99 (Medicare’s 2026 figure) |
| Rate per full uncovered month | 1% of the national base beneficiary premium |
| Rounding | Rounded to the nearest $0.10 |
| Months counted | Only full months in the qualifying uncovered period |
For example, the arithmetic uses 0.01 × $38.99 for each full uncovered month, multiplied by the months Medicare determines are chargeable. Do not substitute the premium of your particular drug plan for the national base beneficiary premium.

Handle a Part B penalty through the notice and responsible office
Part B has a separate penalty formula and separate exceptions. Medicare generally adds 10% of the standard Part B premium for each full 12-month period you could have enrolled but did not. Certain Special Enrollment Period situations and enrollment in a Medicare Savings Program can affect whether the penalty applies.

For 2026, the standard monthly Part B premium is $202.90. Medicare’s example shows that a 20% penalty after two full years would add $40.58, producing an unrounded total of $243.48 and a displayed premium of $243.50 after rounding. The premium and any penalty percentages should be checked against the current year’s official figures.
The official material does not identify one Part B penalty-specific appeal form or a universal deadline for an already-assessed charge. Therefore:
- Follow the correction or appeal instructions printed on your Part B notice.
- Contact the issuer named in the letter and ask which office can correct the enrollment record.
- Contact Medicare or Social Security to confirm the applicable reconsideration route and filing date.
- Submit employer coverage, enrollment and Special Enrollment Period evidence in the format requested by that office.
Do not use the Part D 60-day form for a Part B assessment unless the responsible office expressly tells you to do so.
Common reasons a penalty appears to be wrong
The coverage was creditable but never reported
An employer or union may have provided creditable drug coverage without Medicare receiving the dates. Request a written statement from the plan administrator and submit it with the Part D reconsideration form.

The gap was shorter than 63 continuous days
Check the effective and termination dates, including whether a month was counted differently because coverage began or ended mid-month. A timeline can reveal that the alleged period was not a continuous 63-day gap.
Extra Help dates were omitted
Compare your Extra Help approval, renewal or termination notice with the months on the penalty letter. Provide the date-specific notice rather than relying on a general statement that you once received assistance.
You were outside the United States or medically unable to enroll
Use dated residency documents or medical records that correspond to the period selected on the CMS form. Explain how the event relates to the missed enrollment opportunity.
Part B employment coverage was misunderstood
Part B eligibility can depend on active employer coverage and the size or type of the group plan. Ask the employer’s benefits administrator for a written statement of coverage and active-employment dates, then provide it to the office named in the notice.
Protect yourself while the review is pending
- Continue paying premiums when instructed so coverage is not terminated for nonpayment.
- Keep a single file containing the notice, form, evidence, delivery confirmation and every response.
- Use the same spelling of your name, Medicare number and dates on every document.
- Redact unrelated financial or medical information that the instructions do not request, while leaving dates and identifying details needed to verify the claim.
- Watch for a revised premium bill or decision letter and compare its months and amount with your original notice.
If the decision still appears incorrect, read the next-level rights included with that decision. Appeals can have different deadlines and destinations from the initial reconsideration request.
When to seek one-on-one assistance
A licensed Medicare counselor or benefits counselor can help organize records and explain options, especially when coverage changed several times, an employer closed, or records conflict. Ask what the service costs and what it can do; counseling does not replace filing the official form by its deadline. Never give a counselor authority to discard original records or submit an unsigned form.
