What to Do If You’re Behind on Credit Card Payments

By TheFinanceBase Team 8 min read

If you have missed a credit-card payment—or expect to miss the minimum—contact the card issuer now, work out the amount your household can actually afford, and ask for a written explanation of any assistance offered. The Consumer Financial Protection Bureau (CFPB) says you do not have to wait until you are behind to ask for help. Call the number on your card or statement, explain the hardship, and propose a specific temporary payment. Then monitor deadlines, get independent counseling if useful, and respond to any collector rather than ignoring the account.

This guide is U.S.-focused. Issuer programs, fees, credit reporting and legal procedures vary by account and state.

Start with an action plan today

  1. Pause and calculate. Total take-home income and essential household expenses. The amount left after those expenses is the starting point for an affordable card payment; do not promise more than you can sustain.
  2. Call the issuer promptly. Use the telephone number on the back of the card or on a statement. You can ask for help before a missed payment, not only afterward. The CFPB’s current guidance is available at “What should I do if I can’t pay my credit card bills?” (reviewed September 2, 2026).
  3. Make a concrete request. Explain why the minimum is unaffordable, what you can pay now, when normal payments may resume, and the temporary amount and duration you are requesting.
  4. Confirm the terms. Ask what happens to interest, fees, card use, reporting and the due date. Write down the representative’s name, the date, the agreed terms and any confirmation number.
  5. Escalate carefully. If the issuer cannot offer a workable arrangement, compare a reputable credit counselor’s plan with the issuer’s proposal. Treat promises of guaranteed debt elimination or instructions to stop paying as warning signs.
  6. Respond to collection contacts. Review validation information, dispute inaccuracies in writing within 30 days when applicable, and keep copies of everything.

A hardship conversation does not automatically change your due date or stop interest. Continue making any payment you can until the issuer confirms a different arrangement in writing.

Build a realistic payment number before you call

List cash coming in

Use reliable, after-tax income for the period covered by your next statement: wages, benefits, support payments and regular self-employment draws. If income varies, use a conservative month rather than an unusually strong one. Note the date each source arrives, because a payment that is affordable in total can still fail if cash arrives after the due date.

List expenses in full

Record housing, utilities, food, transportation, insurance, medicine, taxes, child care and other necessary costs, plus minimums on other debts. Include annual or irregular bills by converting them to a monthly amount. A simple notebook or expense tracker can help you total the figures, but it is only a budgeting aid—not a debt solution.

Set the amount you can maintain

Subtract expenses from income and leave a small cushion for unavoidable variation. If the result cannot cover the card’s minimum, write down the amount you can pay and the date it will be available. The CFPB does not prescribe one universal order for paying bills; your calculation should make clear what is genuinely available without sacrificing basic needs.

What to say to the card issuer

Prepare four facts

  • Why the minimum is not affordable (for example, a job interruption, medical cost or other financial emergency).
  • How much you can pay now and on which date.
  • When you reasonably expect regular payments to resume, if known.
  • The temporary payment and duration you want the issuer to consider.

Keep the explanation factual and brief. The issuer decides whether it can provide a hardship arrangement; a request is not a guarantee of approval.

Questions that reveal the real cost

  • Is the arrangement a reduced payment, a deferred payment, a fee waiver, an interest-rate change, or another type of program?
  • What monthly payment, start date and end date apply?
  • Will interest, late fees or other charges continue, and can any be removed?
  • Can you use the account, or will charging privileges be restricted or the account closed?
  • How will payments and the arrangement be reported to credit bureaus?
  • What happens if one payment is late or you need an extension?
  • Will the regular minimum and due date return automatically after the program?

Ask for the terms in writing before relying on them. Record the call, but do not assume a phone conversation itself changes the contract or reporting.

When is a credit-card payment considered late?

Under CFPB guidance reviewed December 9, 2024, a payment generally must be received by 5 p.m. on the due date in the time zone shown on the statement to be considered timely. If the due date falls on a Sunday or a legal holiday on which the issuer does not accept payments, the next business day generally applies. An issuer may set reasonable cutoffs for particular payment methods, so check the statement and the issuer’s instructions at the CFPB payment-timing explanation.

Allow extra time for mailed checks or payment systems that post later. Save confirmation screens, bank records and timestamps. If a payment was made on time but posted incorrectly, contact the issuer promptly and ask how to use its billing-error process. Do not assume that a hardship call, a promise to pay or a pending application changes the due date.

What can happen after a missed payment?

Consequences depend on the issuer, the account history and how long the payment remains unpaid. Possible outcomes include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Restricted or suspended card use.
  • A late fee or continued interest under the account terms.
  • Delinquency reporting to credit bureaus.
  • Referral or sale of the balance to a collection agency.
  • A lawsuit to collect the debt.

The CFPB says delinquency generally can remain on a credit report for up to seven years. “Up to” is not a prediction of the reporting date for your account; the applicable reporting rules and account history matter.

The 60-day rate-and-fee rule

Regulation Z contains a limited exception that can permit certain increases in an annual percentage rate, fee or charge when the required minimum payment remains unpaid for more than 60 days after the due date, subject to statutory and regulatory conditions. Read the current text of Regulation Z § 1026.55. Reaching 60 days does not make every increase automatic, and it does not describe every issuer’s policy.

An older CFPB discussion, “Need help with your credit card debt? Start with your credit card company!” (April 3, 2019), describes possible collection and litigation consequences. Use it as general context, not as a prediction of what your issuer will do today.

Compare an issuer arrangement with credit counseling

There is no standard hardship program shared by all issuers. Compare an offer you receive with an independent debt-management plan (DMP) using the same questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Question Ask the card issuer Ask a credit counselor
Payment What amount is required, on what date, and for how long? What single payment will the administrator collect, and how is it allocated?
Interest and fees What APR, late fees and other charges continue? What APR reductions or fees are available, and for how long?
Total cost and duration What total amount will be paid before the account is current? What is the estimated duration and total paid, including enrollment and monthly fees?
Account use Will charging privileges be restricted or the account closed? Must enrolled accounts be closed or left unused?
Credit reporting How will the issuer report the arrangement and payments? What will each participating creditor report, in writing?
Participation Which of your accounts are covered? Which creditors have accepted the proposed plan?
Failure What happens after a missed arrangement payment? What happens if you miss an administrator payment or a creditor rejects the plan?

These are questions to ask, not guaranteed terms. Do not send money to a DMP administrator until you have confirmation that the relevant creditors accepted the plan.

How reputable credit counseling works

A counselor can review your budget, discuss debt options and, when appropriate, arrange a DMP that bundles payments to enrolled creditors. Counseling is different from a company promising to erase debt. The CFPB’s explanation, “What is credit counseling?” (reviewed August 2, 2023), suggests starting points such as the National Foundation for Credit Counseling, the Financial Counseling Association of America and U.S. Department of Justice-approved counselors.

Screen a provider before signing

  • Request a written fee quote and a precise list of included services.
  • Ask about counselor qualifications, supervision and staff incentives.
  • Obtain the entire agreement, including cancellation and missed-payment terms.
  • Confirm which creditors and account types can participate.
  • Verify creditor acceptance of the proposed plan before making the first administrator payment.

A counselor cannot force an issuer to accept a plan. If the proposed payment still exceeds your budget, say so before enrolling.

Debt-relief pitches that deserve caution

Be skeptical of anyone who guarantees that all debt will disappear, tells you to stop communicating with your issuer, or instructs you to stop making minimum payments without explaining the consequences. Stopping payments can lead to additional fees, credit damage, collection activity or a lawsuit while negotiations are pending.

The CFPB states that a debt-settlement company may not collect fees before it settles or resolves a debt. Ask exactly when fees become due, what happens if no settlement is reached, whether you must set aside money yourself, and how creditors will be contacted. Read the written terms and do not rely on a verbal promise. These warnings do not mean every settlement option is unavailable; they mean the risks and costs must be understood first.

If a debt collector contacts you

Review the validation information

A collector should provide information identifying the creditor and amount claimed. Compare it with statements, payment confirmations and your own records. Do not provide sensitive bank details merely because someone calls; independently verify the collector’s identity using contact information you can confirm.

Dispute an inaccurate or unfamiliar debt

If you do not owe the debt, already paid it, or believe the amount is wrong, send a written dispute or request for more information. Under the CFPB guidance at “What can I do if a debt collector contacts me about a debt I already paid or don’t think I owe?” (reviewed August 2, 2023), a written request sent within 30 days can require the collector to stop collection until it provides verification. Keep a dated copy and proof of delivery.

Never ignore court papers

If a lawsuit is filed, deadlines and response procedures depend on the court and state. Do not assume the 30-day validation period is the deadline for answering a lawsuit. Contact a legal-aid organization or attorney promptly, bring the summons and complaint, and ask about local options. The consequences of missing a court deadline can be different from those of ignoring an ordinary collection letter.

Keep a written record and reassess monthly

Maintain one folder—paper or digital—with statements, call notes, agreements, confirmation numbers, payment receipts and collector correspondence. After each payment, check that it posted to the intended account. Review the budget monthly: if income improves, ask whether the issuer’s arrangement requires a return to the regular payment; if income falls, call before missing the next payment. Update contact information with the issuer so notices reach you.

Your objective is a payment arrangement you can keep, with terms you understand and records that prove what was agreed. Prompt contact gives the issuer the earliest opportunity to explain available options; careful verification protects you when the account moves to counseling or collections.
