If your tenant in India stops paying rent, first document the exact arrears, check the lease and the law governing the property, then send the required written demand and tenancy-termination notice through the legally valid channel. If the tenant does not pay or leave, use the rent-control authority or court with jurisdiction. Do not change locks, remove belongings, or cut essential services: possession must be recovered through the applicable legal process.
Why there is no single India-wide answer
Unpaid rent is not handled by one uniform eviction timetable for every Indian property. The result can change with the state or union territory, whether the premises are residential, commercial or agricultural, whether a rent-control or tenancy statute applies, the wording and expiry date of the lease, and the notices already served.

Section 106 of the Transfer of Property Act, 1882 (TPA) supplies a default framework, but it expressly yields to a contrary contract, local law or usage. A state rent statute may impose a different demand period, cure opportunity, forum or filing procedure. Before sending a notice, identify the property’s jurisdiction and have the proposed notice checked against the currently operative local law and any amendments.

Step 1: Check the lease and calculate the arrears
Read the clauses that control default
Locate the rent amount, due date, payment method, grace period, late-payment interest, notice clause, cure period, security-deposit terms, renewal language and expiry date. Check whether the lease requires disputes to be raised in writing or permits a set-off for repairs or other expenses. A tenant may dispute the amount because of a credit, a payment already made, an agreed reduction or an unresolved repair obligation. Do not describe a contested balance as undisputed rent until the contract and governing law have been reviewed.
Create a contemporaneous ledger
Prepare a month-by-month statement showing the contractual rent, due date, payments received, dates of receipt, credits, interest (if legally and contractually permitted), and the running balance. Preserve bank statements, cancelled cheques, receipts, invoices, the signed lease, renewal documents, inspection records, emails, text messages and messaging-app exports. Keep the original files and note when each record was created. A clean ledger helps a court or authority distinguish arrears from penalties or unrelated charges.
Send a factual reconciliation first when appropriate
If the amount is unclear, ask the tenant in writing to confirm which entries are disputed and invite payment of any admitted sum. This communication is not a substitute for a statutory notice. It can, however, reduce an avoidable accounting dispute and show that you attempted to identify the real default.

Step 2: Identify the legal regime before choosing a notice
- Location: record the state or union territory and the city or local authority where the premises sit.
- Use: classify the tenancy as residential, commercial, agricultural or manufacturing. The classification can affect both notice periods and the forum.
- Coverage: determine whether a state rent-control or tenancy statute covers the building, rent level, landlord, tenant or type of property.
- Contract: check whether the lease sets a notice period or procedure that differs from the statutory default and whether it has expired.
- Procedural history: gather prior demands, waivers, payment plans, partial payments and any pending case or settlement.
Local legislation may contain special definitions, protected-tenancy rules, deposit requirements, designated controllers or tribunals, and mandatory forms. A landlord should verify the current text and the competent forum rather than rely on a general internet template.

What Section 106 of the Transfer of Property Act actually says
In the absence of a contract, local law or usage to the contrary, Section 106(1) sets default periods. As reproduced in the eCourts India section page, the statutory sentence is:
“In the absence of a contract or local law or usage to the contrary, a lease of immovable property for agricultural or manufacturing purposes shall be deemed to be a lease from year to year, terminable, on the part of either lessor or lessee, by six months’ notice; and a lease of immovable property for any other purpose shall be deemed to be a lease from month to month, terminable, on the part of either lessor or lessee, by fifteen days’ notice.”
The opening qualification is decisive. The six-month and fifteen-day periods are not a universal answer for every Indian tenant. A written lease or a state statute may displace them, and a rent-control law may require a separate arrears demand and cure period before possession can be sought.

“Every notice under sub-section (1) must be in writing, signed by or on behalf of the person giving it, and either be sent by post to the party who is intended to be bound by it or be tendered or delivered personally to such party, or to one of his family or servants at his residence, or (if such tender or delivery is not practicable) affixed to a conspicuous part of the property.”
Those methods should not be treated as the only rules where a local rent statute prescribes a different method. Follow the applicable statute and keep proof of the method, address, date and result of service.
Step 3: Decide whether you need a demand notice, a termination notice, or both
Demand for arrears
A demand notice identifies the rent claimed, the period covered, any legally recoverable interest or charges, the payment deadline and the consequences of non-payment. It should attach or clearly explain the ledger and provide payment instructions. State laws may prescribe a minimum demand period, a particular wording or a requirement to state the tenant’s right to cure.

Notice terminating the tenancy
A termination notice tells the tenant that the tenancy will end on a specified date under the lease or governing law and requests delivery of vacant possession. It must use the correct notice period and end-date calculation. A notice that combines demands and termination can be defective if it fails to satisfy either requirement, so obtain local advice on whether separate notices are safer.

Do not assume service equals eviction
Service starts a contractual or statutory period; it does not authorize a private lockout. If the tenant remains after the effective date, the landlord generally must file in the forum designated by the applicable rent-control or tenancy law, or bring a civil possession action where no protective statute governs. The pleading may seek arrears, possession, interest and permitted costs, but the available relief depends on the statute and facts.
Step 4: Give the tenant any required opportunity to cure
Many regimes give a tenant a chance to pay or deposit arrears before an eviction order can be made on non-payment grounds. The period and conditions are state-specific.
Uttarakhand example
The Uttarakhand Tenancy Act provision identified in the source material prevents an eviction order on the specified non-payment ground when the tenant pays or deposits the arrears and other payable charges, including interest, within one month of service of the demand notice. This is an example of a statutory cure rule for Uttarakhand, not a national one-month deadline. Confirm the exact section, calculations and current text before relying on it.
Maharashtra example
A provision of the Maharashtra Rent Control Act described in a Supreme Court judgment uses a different demand and waiting structure. Its timing cannot be transplanted to another state, property type or tenancy. Read the operative statute and the relevant judgment together, especially where the tenant has made partial payments or disputes the account.

During a cure period, accept or reject payments carefully. Record what the payment covers and whether accepting it could waive a notice, revive a tenancy or alter the claimed balance under local law. Have a lawyer document any payment plan or reservation of rights.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Step 5: Serve the notice in a provable way
- Use the tenant’s address and contact details stated in the lease, plus any legally recognized service address.
- Sign the notice as the landlord or authorized representative. Keep a dated, identical copy and the calculation sheet.
- Use the service method required by the lease or local statute. Where the default TPA framework applies, Section 106(4) describes post, personal delivery, delivery to a family member or servant at the residence, or affixing the notice conspicuously when delivery is impracticable.
- Retain postal receipts, tracking history, delivery reports, photographs of affixation, witness details and returned envelopes. A returned letter is not automatically proof of valid or invalid service; the governing rule and facts matter.
- Record the date on which the statutory or contractual period begins. Do not count days until local rules on receipt, refusal, holidays and month-to-month tenancy have been checked.
Step 6: Choose the correct forum if the tenant does not pay or leave
Where rent-control legislation applies, it may name a rent controller, tribunal or other authority and specify the grounds, evidence and appeal route. Where the tenancy is outside such protection, a civil court may hear a possession claim after effective termination. A court that can award arrears is not necessarily the court that can order possession, so confirm jurisdiction before filing.
Prepare the file that the forum will expect:
- the signed lease and renewals;
- the rent ledger and supporting bank records;
- copies of demands and termination notices;
- proof of service;
- communications about repairs, set-offs, payment plans or admissions;
- ownership or authority documents; and
- a calculation separating rent, interest, permitted charges and costs.
Ask local counsel whether to claim arrears and possession together, whether later rent must be deposited during the case, and whether accepting use-and-occupation payments affects termination. Filing the wrong proceeding or using the wrong notice can add delay and expense.
Remedies compared
| Question | If a state rent-control or tenancy statute applies | If no protective statute governs |
|---|---|---|
| Notice | Follow the statute and lease; a demand and a termination notice may be separate. | Check the lease first; TPA Section 106 may supply a default if its conditions apply. |
| Cure opportunity | Use the statutory payment or deposit period and conditions. | Use any contractual cure term and any applicable statutory rule. |
| Forum | File before the authority or court named by the local law. | Usually a competent civil court after effective termination, subject to local jurisdiction rules. |
| Potential claims | Arrears, possession and other relief allowed by the statute. | Arrears and possession, with interest and costs only as legally recoverable. |
| Timing | Depends on local demand, cure, filing and hearing rules; not stated nationally. | Depends on contract, default notice rules and court procedure; not stated nationally. |
What a landlord must not do
Do not change the locks, block access, remove or sell the tenant’s belongings, disconnect electricity or water, obstruct essential services, threaten occupants, or enter unlawfully to force departure. Such self-help can create separate civil or criminal exposure and may undermine the possession case. Preserve the premises, communicate in writing and use the authorized process for recovery.
If there is an immediate safety emergency, a risk of damage or an abandoned property issue, document the condition and obtain urgent local legal advice rather than treating the emergency as permission for a lockout. Handling belongings, deposits and access after abandonment is governed by local rules and the lease.
A practical decision checklist
- Freeze the facts: photograph the current condition, export communications and secure the lease and payment records.
- Reconcile the account: identify the precise unpaid months and remove credits or disputed items that cannot be proved.
- Classify the tenancy: location, use, rent-control coverage, lease status and any special statutory category.
- Map the notices: determine whether the law requires a demand, termination notice, both, prescribed wording or a specific signatory.
- Calculate the deadline: apply the correct receipt and cure rules; never substitute the fifteen-day or six-month TPA defaults without checking the qualification.
- Serve and preserve proof: use the required channel and retain every delivery record.
- Reassess after cure: record payment or deposit, confirm the remaining balance and obtain advice before accepting terms that could waive rights.
- File in the proper forum: claim only the relief and amounts the governing law permits.
- Protect the property lawfully: maintain essential services and avoid any act intended to force an informal surrender.
Questions to resolve with an Indian property lawyer
- Which state or union-territory statute applies to this address and use?
- Is the tenant protected by rent control, and does the lease’s expiry change the ground for possession?
- What exact arrears, interest and charges are legally recoverable?
- Must the landlord serve one notice or separate demand and termination notices?
- What cure or deposit period applies, and how is it calculated?
- Which authority or court has jurisdiction, and can arrears and possession be claimed together?
- Could a past payment, renewal, waiver or settlement affect termination?
These questions are especially important where the tenant alleges defective premises, claims a repair set-off, has paid into court, or has already received an earlier notice.
Bottom line
For a non-paying tenant in India, the safest sequence is: establish the real arrears, identify the governing state and tenancy regime, serve the legally correct written demand and/or termination notice, allow the applicable cure period, and file before the proper authority or court if the default continues. Section 106 of the Transfer of Property Act can provide a default notice framework, but its six-month and fifteen-day periods apply only when contract, local law and usage do not say otherwise. No landlord should treat unpaid rent as permission for a private eviction.
