A denied student-loan discharge does not necessarily mean your entire bankruptcy discharge was denied. First obtain the signed order and docket, determine exactly what the judge decided, and speak promptly with a bankruptcy lawyer who handles student-loan adversary proceedings in that district. The order’s date, finality, stated findings, and local rules control what—if anything—you can do next.
Start with the signed order, not a notice or phone call
Student-loan discharge litigation is usually a separate adversary proceeding inside the bankruptcy case. A ruling that your loans are not dischargeable is different from a ruling denying your general bankruptcy discharge. The first task is to identify the document that actually controls your case.

- Download the signed order and judgment. Use the bankruptcy court’s docket and save the PDF, not just a docket summary. Check whether it is titled an order, memorandum decision, or final judgment.
- Record the docket-entry date. Deadlines can run from entry on the docket, and the applicable period depends on the type of ruling and the rules governing that court.
- Read the ruling’s scope. Confirm which loans, borrowers, and claims it covers. A decision may address all loans, only certain obligations, or only the undue-hardship issue.
- Preserve the case file. Keep the adversary complaint, answer, discovery, exhibits, declarations, hearing transcripts or recordings, briefs, the bankruptcy schedules, payment history, and communications with loan holders and government lawyers.
- Contact qualified counsel immediately. Ask for a lawyer who regularly handles bankruptcy appeals and student-loan dischargeability proceedings in your federal district. Do not assume a familiar deadline from another case applies to yours.
This is a U.S.-focused explanation, not a case-specific legal opinion. Have counsel check the current Federal Rules of Bankruptcy Procedure, appellate rules, circuit precedent, and local procedures against your order.
What a denial usually means under bankruptcy law
Section 523(a)(8) of the Bankruptcy Code generally excepts specified student-loan obligations from discharge unless repaying them would impose an undue hardship on the debtor and the debtor’s dependents. The hardship determination is made in a formal adversary proceeding, normally started by filing a complaint and serving the required papers.

The judge’s decision concerns dischargeability of the covered education debt. It does not automatically decide whether you received, or were denied, a discharge of other consumer debts in the main bankruptcy case. Read the judgment for the exact relief granted and denied.
The loan’s legal category matters. Section 523(a)(8) covers several types of educational obligations, but the court must apply the statute to the debt proved in your record. Your lawyer should verify the promissory notes, account history, guaranty or servicing documents, and any allegation that the debt is a qualified education loan or another obligation within the statute.
Identify the hardship test used by your court
Courts do not use one nationwide factual formula. The governing circuit may apply the Brunner test, a totality-of-the-circumstances test, or a related formulation. Your response should track the test the judge actually used and the findings in your order.

- Minimal standard of living: Would requiring payment prevent you and your dependents from maintaining a minimal standard of living?
- Persistence: Are your financial circumstances likely to continue for a significant part of the repayment period?
- Good-faith efforts: Have you made good-faith efforts to repay or manage the debt?
A judge may find against a borrower on one element even when the other two appear favorable. The order should explain which facts controlled each finding.
Totality of the circumstances
Some courts weigh the entire financial picture instead of applying Brunner’s three-prong structure. The factors described by DOJ include:
- Past, present, and reasonably reliable future financial resources;
- Reasonably necessary living expenses for you and your dependents; and
- Other relevant facts in the case.
The label matters less than the court’s reasoning. Have counsel map every finding in the order to the controlling circuit’s test and identify whether the judge applied the correct legal standard.

Income and necessary expenses
- Compare the income figures in the order with pay stubs, tax returns, benefit statements, business records, and updated household income.
- Check whether the judge treated an expense as discretionary when it is necessary for housing, food, utilities, transportation, medical care, insurance, childcare, or a dependent’s needs.
- Identify changes after the hearing, but distinguish new facts from evidence that was already available and omitted.
Dependents and other obligations
Review how the decision counted dependents, support obligations, family-care duties, and other secured or priority debts. A mathematical or factual error can be significant, but it must be tied to evidence in the record or to a procedurally permissible way to present new information.
Health, age, disability, and future earning capacity
Where relevant, examine medical records, disability determinations, treatment costs, work restrictions, age-related limits, and realistic employment prospects. The issue is not whether a diagnosis exists by itself; it is how reliably the condition affects income, expenses, or the expected repayment period under the applicable test.
Payment history and good faith
Collect account statements, payment records, deferment or forbearance requests, income-driven repayment applications, consolidation documents, and correspondence showing attempts to manage the debt. A period of nonpayment may be interpreted differently depending on income, servicing errors, available programs, and the explanations proved at trial.

Possible next routes your lawyer may evaluate
The available remedy depends on the order, the date it was entered, whether it is final, the existing record, and the rules in your district and circuit. The following comparison describes issues counsel should investigate; it does not establish that every route is available in every case.
| Route to evaluate | What it asks | Questions that control the analysis | Record focus |
|---|---|---|---|
| Request for the bankruptcy court to revisit its ruling | Asks the same court to correct a qualifying legal or factual problem or consider a procedurally proper basis for relief. | What rule applies? Is the order final? Was the issue raised in time? Is the asserted error apparent from the existing record? | Findings, exhibits, transcripts, and any properly supported change in circumstances. |
| Appeal | Seeks review by the designated appellate court or bankruptcy appellate panel, as permitted by governing rules. | When was the judgment entered? Is appellate jurisdiction present? What notice and briefing requirements apply in this district and circuit? | Preserved legal arguments and factual findings reviewed under the standards applicable to each issue. |
| Other litigation or debt-management options | Addresses repayment or a later, legally permissible proceeding rather than asking an appellate court to reverse this judgment. | Does the proposed action concern the same debt and issue? Has claim or issue preclusion become relevant? What changed, and what relief can the court legally grant? | Current account information, changed circumstances, and the limits imposed by the existing judgment. |
Cost, collection activity, credit consequences, and the risk of losing rights through an untimely filing should be part of the advice. Do not file a motion or notice based on a deadline copied from an internet article or another state.

For federal loans, the U.S. Attorney’s Office for the district where the bankruptcy is pending handles the government’s student-loan dischargeability adversary case. DOJ and the Department of Education use a borrower attestation and related information to evaluate the hardship claim and may recommend a partial or full discharge when appropriate.

That administrative process informs the government’s position; it does not replace the bankruptcy judge’s decision. The judge makes the judicial determination under the Bankruptcy Code and the controlling case law. An attestation is not an automatic application and does not guarantee a favorable outcome.
DOJ announced the guidance in November 2022. Associate Attorney General Vanita Gupta described it as “a better, fairer, more transparent process for student loan borrowers in bankruptcy proceedings.” Education Under Secretary James Kvaal said the departments sought “clearer, fairer, and more practical standards” for recommendations. Those policy statements explain the agencies’ approach, not the result in an individual case.
The federal guidance index was updated March 17, 2026, and links the 2022 guidance, a May 2025 attestation form, and related materials. Ask counsel whether the version used in your case, the government’s position, or a later update affects any procedural step.

Bankruptcy procedure is federal, but districts add local rules, forms, filing conventions, and service instructions. An official example from the Central District of California directs a plaintiff to file an adversary complaint, download and serve the summons under the applicable rules, and file proof of service. That example describes starting a case; it is not a nationwide instruction for challenging a judgment that has already been entered.
For your case, obtain the district’s current local rules and clerk’s guidance, then confirm every requirement with counsel. A missing service document, incorrect docket event, or misidentified appellate path can affect jurisdiction or timing.
Protect yourself while the denial is reviewed
- Keep every servicer notice. Save statements, collection letters, payment histories, and notices of transfer. Send important communications through a method that creates a delivery record.
- Ask about collection status. Counsel can determine whether the judgment permits collection, whether a stay exists, and whether any administrative relief is available while a timely motion or appeal is considered.
- Do not stop filing required bankruptcy documents. A dischargeability judgment does not erase duties in the main bankruptcy case or any separate order.
- Update your budget. Document income, necessary expenses, dependents, medical costs, and changes in employment so your lawyer can assess both litigation and repayment consequences.
- Avoid unsupported promises. No lawyer or agency can guarantee that a denial will be reversed or that a particular repayment program will produce a discharge.
Common mistakes after a denial
- Treating the ruling as a denial of the entire bankruptcy discharge without reading the judgment.
- Counting from the hearing date, mailing date, or phone call instead of the docket-entry date that controls the applicable rule.
- Assuming every court uses Brunner, or assuming a totality test applies because another court used it.
- Submitting new financial information without determining whether the chosen procedure allows new evidence.
- Calling an attestation an automatic discharge application or assuming the government’s recommendation binds the judge.
- Relying on a generic appeal deadline without checking the order, finality, circuit, and local rules.
- Ignoring collection notices while debating litigation strategy.
Questions to take to your lawyer
- What exactly did the signed order deny, and which loans and periods does it cover?
- Is the judgment final, and what date starts any applicable filing period?
- Which hardship test and circuit precedents did the judge apply?
- Which finding was decisive: living standard, persistence of circumstances, good faith, resources, expenses, or another fact?
- Is there a procedurally available request for relief in the bankruptcy court, an appeal, or neither?
- What evidence is already preserved, and what evidence can legally be added?
- How would each option affect collection, costs, timing, and repayment planning?
- For federal loans, what role did the DOJ-Education process and borrower attestation play in the government’s position?
The practical objective is not to pursue every conceivable filing. It is to match the signed judgment and the proven record to the remedy the governing rules actually permit, while protecting your rights and household finances.
