If your Social Security spousal payment looks wrong, start with the determination notice and your payment history, then ask the Social Security Administration (SSA) to explain the calculation. If the amount, recomputation, underpayment, or an alleged overpayment is still wrong, use the remedy that matches the problem: reconsideration for the determination itself, an overpayment appeal to dispute the debt, or a waiver request when recovery would be unfair or unaffordable.

First, identify what SSA says is wrong

A payment that is lower than expected does not necessarily mean SSA made a mistake. A spousal benefit is generally calculated from the worker’s primary insurance amount (PIA), and SSA says it can be as much as 50% of that PIA. “As much as” is important: the actual amount can be lower because of the claiming spouse’s age, dual entitlement to a retirement benefit on their own record, or another adjustment shown in the notice.

Before calling or filing an appeal, gather the determination notice, recent benefit statements, and a month-by-month payment history. Mark the decision date, the first month affected, the amount SSA says it should pay, the worker’s record used, and the reason given for the change. If the notice concerns an overpayment, it should also explain why SSA says the overpayment occurred, the total amount, repayment options, and appeal and waiver rights.

How a spousal benefit is supposed to be calculated

The worker’s primary insurance amount is the starting point

The worker’s PIA is the amount payable at the worker’s full retirement age before adjustments such as early claiming, delayed retirement credits, or other case-specific factors. SSA’s spouse-benefits guidance describes a maximum spousal amount of one-half of the worker’s PIA when the spouse claims at full retirement age. That ceiling is not a guaranteed payment for every spouse.

Claiming before full retirement age can reduce the spouse amount

If the spouse starts benefits before their full retirement age, the spousal portion is generally reduced. SSA’s illustration uses a worker PIA of $1,600. One-half is $800. A spouse who claims 36 months before normal retirement age receives a 25% reduction in the example, producing a $600 base spousal amount. This is an SSA example, not a prediction for an individual; your full retirement age, filing month, and eligibility facts control.

SSA notes different treatment when a spouse is caring for a qualifying child. Do not apply the age-reduction example automatically if a qualifying child is in the spouse’s care. Ask SSA to identify which rule and starting date it used.

Dual entitlement changes the way the payment appears

Someone who qualifies for both a retirement benefit on their own earnings record and a spouse’s benefit does not normally receive two full checks. SSA pays the person’s own retirement benefit first. It then adds only the spouse-based amount needed to bring the total up to the higher spouse-entitled amount. For example, if the unreduced spouse-entitled total is $900 and the person’s own retirement benefit is $650, the spouse portion may appear as a $250 supplement rather than a separate $900 benefit.

This “own benefit first” rule is a common reason a payment is lower than one-half of the worker’s PIA. Compare the total monthly amount with the components listed in the notice, not just the line labeled “spousal.”

Check the calculation with SSA before appealing

Contact SSA and request a plain-language explanation of the computation. Ask the representative to identify:

  • the worker’s PIA and the earnings record used;
  • the spouse’s entitlement date and age when benefits began;
  • the full-retirement-age reduction, if any;
  • the amount paid on the spouse’s own retirement record;
  • the resulting spousal supplement and total monthly payment;
  • any recomputation, underpayment, offset, or other adjustment listed in the notice; and
  • the months for which SSA says a different amount applies.

Ask for the explanation in writing when possible. Record the date, the office or representative you spoke with, and the specific answer. An explanation may resolve a misunderstanding, such as comparing the gross entitlement with the net payment or overlooking the person’s own retirement benefit. If the explanation conflicts with the notice or payment history, preserve both records and move to reconsideration rather than relying on a phone conversation alone.

Use reconsideration when the initial amount or recomputation is wrong

What reconsideration covers

SSA’s Request for Reconsideration form, SSA-561, lists the amount of benefit, a recomputation, and an underpayment among Title II initial determinations that can be challenged. It also covers an overpayment determination when the disagreement is whether an overpayment occurred or how much it is.

The form states: “I do not agree with the Social Security Administration’s (SSA) determination and request reconsideration.” Use the space for reasons to identify the exact error rather than writing only that the payment is too low.

What to include in the request

  1. Identify the decision date, the benefit type, the worker’s record, and every month affected.
  2. State the amount SSA used and the amount you believe is correct, if you can calculate it.
  3. Explain the specific issue: for example, an incorrect PIA, wrong entitlement date, missing own-record payment, incorrect age reduction, or a missed underpayment.
  4. Attach copies of the notice, benefit statements, payment history, earnings or entitlement records, and correspondence that support the explanation. Keep originals.
  5. Submit the request using the method and deadline in your notice. Keep a dated copy and proof of mailing, upload confirmation, fax receipt, or other delivery record.

Do not wait for a perfect calculation before protecting your appeal rights. File a clear, timely request and add supporting documents as SSA instructs. Deadlines and filing methods can vary by determination, so the notice controls.

Overpayment: appeal the debt or request a waiver

Appeal when you dispute the overpayment itself

An overpayment appeal asks SSA to decide whether you were overpaid or whether the stated amount is wrong. Use this route if, for example, SSA counted months in which the correct spousal amount was already paid, used the wrong worker’s record, or made an arithmetic error.

Request a waiver when recovery should not be required

A waiver is different. It accepts that SSA may have calculated an overpayment but asks the agency not to recover it because you were not at fault or recovery would be unfair or unaffordable under the applicable rules. You can dispute the amount, request a waiver, or pursue both when the facts support both positions; state clearly which outcome you seek.

Observe the overpayment timing rules

SSA’s overpayment guidance says that an appeal or waiver request made within 30 days prevents collection while SSA decides the request. Its Title II overpayment reconsideration procedure generally allows 60 days from the initial overpayment notice to request reconsideration. A request after 60 days may require a good-cause determination. These are overpayment-specific rules, not a universal deadline for every spousal-benefit dispute. Follow the date and instructions printed on your own notice, and act immediately if the deadline is close.

In a written overpayment request, identify whether you are challenging occurrence, amount, or recovery; list the affected months; explain the facts; and include evidence. If asking for a waiver, provide the information SSA requests about income, expenses, assets, fault, and hardship. Keep sending any payment or withholding notices to the person handling the case so the record remains current.

What happens after reconsideration

If reconsideration does not resolve the issue, SSA describes additional appeal opportunities for covered decisions. The exact filing deadline and instructions appear in the decision notice at each stage.

Stage What you are asking for What to do
Reconsideration A new review of the initial determination, such as the benefit amount, recomputation, underpayment, or overpayment Explain the factual or calculation error and provide records.
Administrative law judge hearing Review after an unfavorable reconsideration decision Read the reconsideration decision for the filing method and deadline; organize your documents and testimony.
Appeals Council review Review of the administrative law judge’s decision Follow the instructions and deadline in the hearing decision.
Federal district court action Judicial review after the administrative process Use the deadline and filing directions stated in the Appeals Council decision; court procedures apply.

Missing a deadline can limit your options. If circumstances prevented a timely filing, explain them and ask whether SSA’s good-cause rules apply; do not assume a late request will be accepted.

Build an evidence file that makes the error easy to see

  • Decision documents: every determination, reconsideration decision, overpayment notice, and appeal form.
  • Payment proof: benefit statements, bank records showing deposits, and a month-by-month spreadsheet of expected versus received amounts.
  • Entitlement facts: the worker’s name and record information, marriage or qualifying-child information when relevant, filing dates, and the spouse’s own retirement entitlement.
  • Communications: letters, secure messages, call notes, confirmation numbers, and the names or offices of SSA personnel contacted.
  • Waiver material: current income, regular expenses, assets, debts, and facts showing why you were not at fault or why recovery would cause hardship.

Send copies, not irreplaceable originals. Use a consistent file name or paper index so you can identify the notice date, affected months, and document purpose quickly. A simple folder or binder is optional organization—not a substitute for filing the correct SSA request.

When professional help is useful

SSA says a claimant may choose an attorney or another qualified person to help with an appeal. Representation is not required, and choosing a representative does not guarantee a particular result. Help can be useful when several records conflict, the worker’s earnings history is complicated, an underpayment spans many months, or an overpayment and waiver request involve different facts.

If you seek help, give the representative the complete notice and payment history, ask what issue they are addressing, and confirm who is responsible for meeting the next deadline. You remain responsible for reading SSA notices and promptly forwarding them unless your representative has formally agreed to receive them.

A practical decision guide

Your situation Primary request Key information to state
The initial spousal amount is calculated incorrectly Reconsideration Correct worker PIA, age and entitlement date, own-record benefit, and months affected.
SSA changed the amount after a recomputation Reconsideration What changed, when it changed, and why the new computation is unsupported.
SSA owes benefits that were not paid Reconsideration of underpayment Each unpaid month and proof of the amount due.
SSA says you were overpaid, but the debt or amount is wrong Overpayment appeal or reconsideration Why no overpayment occurred or the month-by-month amount is incorrect.
You agree an overpayment may exist but cannot fairly repay it Waiver request Why you were not at fault and why recovery would be unfair or unaffordable.

Common mistakes to avoid

  • Assuming half the worker’s PIA is automatic: age reductions and dual entitlement can produce a lower spousal supplement.
  • Appealing only by telephone: a call can clarify an issue, but use the written process and preserve proof of filing.
  • Confusing an appeal with a waiver: an appeal challenges whether the debt exists or its amount; a waiver addresses whether SSA should collect it.
  • Using the wrong deadline: the 30-day collection-protection rule and the generally 60-day overpayment reconsideration period apply to overpayment procedures, not every benefit determination.
  • Sending an unexplained objection: identify the record, month, calculation step, and evidence that SSA should correct.
  • Ignoring later notices: each appeal stage can have its own deadline and filing instructions.

Bottom line: match the remedy to the error

Start by reconciling the worker’s PIA, your claiming age, and any benefit payable on your own record with SSA’s notice and payment history. Ask SSA to explain discrepancies. If the initial amount, recomputation, or underpayment is wrong, request reconsideration through the method and deadline in the notice. If SSA alleges an overpayment, appeal the existence or amount of the debt, request a waiver when recovery would be unfair or unaffordable, or pursue both when appropriate. If reconsideration fails, the next possible stages are an administrative law judge hearing, Appeals Council review, and federal district court action, with the notice controlling each deadline.
