What to Do if Your Old-Age Pension Application Is Rejected or Delayed

By TheFinanceBase Team 8 min read

First, identify whether your application is still pending or has been formally refused. A delay calls for a status and missing-information check; a refusal usually starts a time-limited review or appeal. Deadlines, review bodies and complaint procedures depend on the pension scheme and country, so use the decision letter and the issuing agency’s current instructions. The Canada and United Kingdom examples below illustrate the process; they are not universal rules.

Start with the letter and the scheme

Find the latest acknowledgement, decision or request-for-information notice. Confirm the agency that issued it, the pension or benefit name, the date the notice arrived, the reference number and the exact action requested. Write down the reason given in the agency’s own words. A missing document, an eligibility finding and an administrative delay require different responses.

Do not assume that an unanswered application is a rejection. Conversely, do not treat a formal refusal as an ordinary customer-service query if a review deadline is running. The notice normally states whether you can ask for reconsideration, mandatory reconsideration or an appeal, how to file and when the time limit starts.

Pending is different from refused

Situation First action What you are trying to establish
Application pending Check the official account or contact the agency Whether the application was received, which evidence is outstanding and when an update is expected
Written refusal Read the reason and follow the formal review instructions Whether the agency made a factual or legal error, or whether you can provide evidence the scheme allows it to consider
Problem with handling Use the agency’s complaint route Whether documents were lost, staff gave incorrect information, updates were missing or the delay was unreasonable

If your application is delayed

A delay can result from incomplete information, verification of residence or contributions, a request for more evidence, or a backlog. Contacting the agency is useful, but a status call does not replace a formal review request when a decision has already been issued.

Verify receipt and outstanding items

  1. Log in to the agency’s official portal, if one exists, and check that the application is recorded.
  2. Read every message for a request for identity, residence, employment, contribution or other supporting evidence.
  3. Ask the agency to identify any missing item, the date it was requested and the accepted submission method.
  4. Send copies rather than irreplaceable originals unless the agency specifically requires an original. Keep proof of delivery or an electronic confirmation.
  5. Record the contact date, representative’s name or reference, what you supplied and the next expected update.

Use published processing estimates carefully

For Canadian Old Age Security (OAS), Employment and Social Development Canada currently publishes estimates of 14 days for an online application and 120 days for one sent by mail. These are agency estimates, not guarantees or universal benchmarks. The same guidance says missing required documents or a request for more information can make processing take longer. A different country or pension scheme may have entirely different targets.

If the estimate has passed, ask for a specific status explanation rather than repeatedly submitting a new application. Confirm whether the file is awaiting evidence, a decision, a payment calculation or an internal transfer. If the agency cannot explain the delay, use its complaint procedure while continuing to protect any appeal deadline.

Canada: checking an OAS application

Service Canada says applicants can view OAS status in My Service Canada Account. Someone who cannot use that account can contact Service Canada. Many people do not need to apply because the agency already has enough information; it generally sends an enrolment letter around age 64. If no letter has arrived one month after the 64th birthday, contact Service Canada to ask whether an application is needed. A person outside Canada must use a paper OAS application under the current application instructions, and online filing is limited to specified conditions.

If the application was rejected

Read the refusal line by line before deciding what to send. Separate facts you believe are wrong (such as a date, address, contribution record or marital status) from disagreements about how the rules were applied. Gather evidence that directly addresses each reason. A review request should explain the error or provide the permitted new information; a general statement that the decision is unfair is less useful.

Build a focused response

  • Quote or paraphrase each refusal reason and answer it separately.
  • Identify the document or record that proves your version of the facts.
  • Explain any gap, inconsistency or late document instead of leaving the reviewer to infer it.
  • Ask for confirmation that the review request and attachments were received.
  • Keep the original notice and a complete copy of everything submitted.

Canada: OAS reconsideration

Service Canada says an OAS applicant must request reconsideration within 90 days of receiving the decision letter. The request can be made online, on form ISP-3134, in writing by mail to the return address on the decision letter, or at a Service Canada office. A written request should include your name, address, telephone number, Social Insurance Number or client identification number, a detailed explanation of why you disagree, relevant new information, your signature and the date.

The agency states: “Reconsiderations can take several months to complete, depending on the case.” That estimate is not a promise of a particular completion date. If the reconsideration decision still goes against you, the next level is an appeal to the Social Security Tribunal of Canada, which is independent of Service Canada. Follow the new decision’s instructions and deadline rather than relying on the date of your original refusal.

United Kingdom: mandatory reconsideration and tribunal appeal

For most covered Department for Work and Pensions (DWP) benefit decisions in England and Wales, including Retirement Pension and Pension Credit decisions, GOV.UK says you normally request a mandatory reconsideration first. The ordinary deadline is one month from the date on the decision letter. The letter will explain how to request it and may state that a direct appeal is allowed in a particular case.

After the mandatory reconsideration notice, the ordinary tribunal appeal deadline is one month. A late request or appeal needs an explanation and may not be accepted, so do not wait for a reply to an informal enquiry if the clock is running. The Social Security and Child Support Tribunal is described by GOV.UK as impartial and independent of government. Northern Ireland and Social Security Scotland use different routes, so residents there should follow the instructions for their own administration.

Appeal versus complaint: choose the route that matches the problem

An appeal or reconsideration challenges entitlement or the outcome: you say the agency applied the rules incorrectly, misunderstood your facts or failed to consider relevant evidence. A complaint challenges administration: you say the agency lost documents, gave poor treatment, failed to update you or took an unreasonable time. You may need both, but one does not substitute for the other.

What a complaint can and cannot do

A complaint can seek an explanation, correction of handling, an apology or action to resolve a service failure. It normally does not overturn a benefit refusal. File the required reconsideration or appeal even if you also complain about the delay or treatment.

United Kingdom: DWP service complaints

DWP complaint guidance asks you to describe what happened, when it happened, how it affected you and what would put matters right. Its escalation path is the DWP complaints team, then the Independent Case Examiner after a final DWP response, and potentially the Parliamentary and Health Service Ombudsman through an MP after the Independent Case Examiner’s response.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The DWP says its complaints team aims to resolve escalated complaints within 15 working days, but it is currently receiving a high volume and may not meet its usual timescale. Treat 15 working days as an aim, not a guaranteed response date. A complaint about delay should run alongside, not instead of, mandatory reconsideration where you dispute the decision itself.

Prepare evidence and protect your deadline

Make one chronological file, digital or paper, with an index. Requirements differ by scheme, so this is a practical recordkeeping list rather than a universal document requirement.

  • The decision, acknowledgement or request-for-information letter, including the envelope or electronic receipt showing when it arrived.
  • A copy of the application and every form or statement sent later.
  • Documents relevant to the disputed issue, such as residence history, contribution or employment records, identity evidence and medical or caring evidence where the scheme requires it.
  • Proof and date of submission: upload confirmation, postal tracking, a stamped receipt or the agency’s reference number.
  • A short timeline of calls, messages, promised callbacks and documents supplied.
  • Authorization details if another person is acting for you, using the scheme’s required form.

Use the agency’s form and submission channel exactly. If you post a review request, use tracked delivery where practical and retain a copy. If you submit online, save the confirmation page or message. When a deadline is close, send the minimum valid request immediately and state that supporting evidence will follow only if the rules permit it; do not miss the deadline while perfecting the file.

When and how to get help

Ask for assistance if the reason is unclear, you have difficulty reading or communicating, the decision involves several years of records, or the deadline is near. A benefits adviser can help identify the correct route and evidence. A legal professional may be appropriate for a complex eligibility dispute or a tribunal case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For the UK process, GOV.UK identifies Citizens Advice, Advicenow, local advisers and legal advisers or solicitors as possible sources of help. Check eligibility, cost and availability directly; inclusion on an official information page is not a guarantee of representation. Tell any adviser the scheme, the date the notice arrived and the deadline before discussing the merits.

Common mistakes that make delays or refusals harder to fix

  • Waiting for a phone update while a deadline runs: submit the formal review or appeal required by the notice.
  • Sending a complaint instead of a reconsideration: a service complaint may not change an entitlement decision.
  • Reapplying without addressing the refusal: a new application can create confusion and does not necessarily replace the review route.
  • Missing one requested item: ask the agency to list all outstanding evidence and confirm acceptable formats.
  • Assuming another country’s deadline applies: use the issuing scheme’s notice, not an internet generalization.
  • Discarding submission proof: without a receipt or reference, it is harder to show that you acted on time.
  • Expecting an automatic payment or back pay: entitlement to arrears depends on the scheme and decision; confirm it with the agency.

A practical decision path

  1. Classify the notice. Mark it as acknowledgement, information request, pending-status message, refusal, reconsideration decision or appeal notice.
  2. Write down the controlling date. Use the date the scheme says starts the period, and calculate the deadline immediately.
  3. Check the official account and contact record. Confirm receipt, missing evidence and the current status.
  4. Choose the correct action. Supply documents for a pending file; request reconsideration or mandatory reconsideration for a refusal; file a complaint for handling failures.
  5. Submit and preserve proof. Save the full package, confirmation and reference number.
  6. Escalate only through the scheme’s next level. Follow the reconsideration outcome to the specified tribunal or appeal body.

The issuing agency’s current notice controls the procedure. Country, region, pension type and edition can change the deadline, filing method, review body and payment rules, so verify those details before relying on any example in this guide.
