Act immediately, but do not assume that a foreclosure notice means the sale can legally proceed. Your next steps are to identify the exact stage of the foreclosure, confirm in writing whether your loss-mitigation application is complete, calculate the days remaining before any scheduled sale, and get local legal help if a case is filed or a sale is close.

Federal Regulation X creates important timing protections, but they depend on when the servicer received a complete application, whether the foreclosure had already started, the type of loan and investor rules, and state procedure. A pending application is not a promise that you will receive a modification or that every foreclosure step will stop.

What to do in the next 24 hours

  1. Read every page of every notice. Determine whether the document is a default notice, a summons and complaint, a judgment, a notice of sale, or something else. Write down the date you received it, every response deadline, the court and case number if shown, and the scheduled sale date. Do not guess what a notice means; its legal effect depends on your state and the procedural stage.
  2. Call the servicer using the number on your mortgage statement. Ask for the loss-mitigation department and your assigned point of contact. Request written confirmation of the date your application was received, the date it was deemed complete, any document still missing, the current foreclosure status, the sale date, and whether foreclosure counsel has been instructed to pause actions required by federal or state rules.
  3. Send missing documents at once. Use a delivery method that produces a timestamp and confirmation. Keep the exact files or paper copies you send, the transmittal page, and proof of delivery. Ask the servicer to acknowledge receipt and state whether the application is now complete.
  4. Create a single case file. Keep notices, payment records, bank statements, income documents, tax returns, emails, portal screenshots, call logs, names of representatives, and confirmation numbers in date order. Record the time and substance of every call while it is fresh.
  5. Get independent help. Contact a HUD-approved housing counseling agency for free expert assistance, as the Consumer Financial Protection Bureau (CFPB) recommends. If a lawsuit is pending, a sale is scheduled, or a deadline is near, contact local legal aid, a foreclosure-defense lawyer, or a state bar referral service immediately.

Do not ignore court papers while waiting for the servicer to review your application. A loss-mitigation review does not replace an answer, appearance, motion, or other filing required by your state court.

How the federal foreclosure clock works

Regulation X, 12 C.F.R. § 1024.41, establishes procedures for loss-mitigation applications. It does not guarantee a modification, reduce the balance automatically, or require the servicer to accept a proposal that is not available under the loan owner’s rules.

The 120-day threshold before the first foreclosure notice or filing

As a general rule, a servicer may not make the first notice or filing required for a judicial or nonjudicial foreclosure until the borrower is more than 120 days delinquent. The regulation states: “A servicer shall not make the first notice or filing required by applicable law for any judicial or non-judicial foreclosure process unless” one of the conditions in the rule applies. Exceptions include circumstances such as a due-on-sale situation or joining another lienholder’s foreclosure action. Because the exceptions and the definition of delinquency matter, do not treat 120 days as a universal promise that no notice can appear.

A complete application received before the first notice or filing

If the servicer receives a complete loss-mitigation application before making the first foreclosure notice or filing, Regulation X generally restricts that referral until the servicer has followed the required evaluation and notice procedures and one of the rule’s resolution conditions has occurred. The protection turns on a complete application, not merely an online inquiry, a partial packet, or a promise to send documents later.

A complete application received more than 37 days before a scheduled sale

When foreclosure has already begun, the most important cutoff is more than 37 days before the scheduled sale. If the servicer receives a complete application by that point, it generally may not move for a foreclosure judgment or order of sale, and may not conduct the sale, until it has evaluated the application, notified you of the decision, and one of the rule’s specified events occurs. Those events include a denial after any applicable appeal period has ended, your rejection or non-acceptance of an offered option, or your failure to perform under an agreement.

The servicer also must direct foreclosure counsel to comply with the restriction. CFPB consumer guidance says that, when a complete application arrives more than 37 days before sale, the borrower should receive a written response within 30 days. That is a response expectation for a qualifying complete application, not a guarantee of approval.

An application submitted 37 days or less before sale

The procedures in § 1024.41(c), (d), and (g) do not apply in the same way when the complete application arrives 37 days or less before the scheduled sale. Other servicing duties and investor requirements may still require an evaluation, but federal law does not automatically provide the same pause. A late application can therefore be important without stopping the sale by itself. Treat this as an emergency and seek local legal assistance rather than relying on a portal submission or a telephone promise.

The 90-day and 14-day loan-modification appeal deadlines

If the servicer received your complete application at least 90 days before the scheduled sale, Regulation X gives you a right to appeal a denial of a trial or permanent loan modification. You generally have 14 days after the denial notice to submit the appeal. The appeal must be reviewed by personnel who were not responsible for the original decision. This right is narrower than a general appeal of every loss-mitigation option: it applies to qualifying trial or permanent modification denials and depends on the 90-day timing condition.

Timing or event What the rule generally does What you should do
Before the first foreclosure notice or filing Generally bars the first action until the loan is more than 120 days delinquent, subject to exceptions. Confirm delinquency calculations, submit a complete application, and ask for written status.
Complete application received more than 37 days before sale Generally restricts judgment, order-of-sale activity, and the sale until evaluation, notice, and a listed resolution event. Preserve proof of completeness and monitor the 30-day written response period.
Complete application received 37 days or less before sale The same § 1024.41(c), (d), and (g) procedures do not apply in the same way; other duties may remain. Contact counsel and a HUD-approved counselor immediately; do not assume the sale is paused.
Modification denial; complete application received at least 90 days before sale Provides a 14-day appeal opportunity for a trial or permanent modification, with a different reviewer. Follow the denial notice exactly and submit a documented appeal before the deadline.

How to prove that your application is complete

Servicers can request additional information or documents. A package is not safely treated as complete simply because you uploaded something or a representative said it was “under review.” Ask the servicer to identify, in writing, the date it determined the application complete and every item it believes is outstanding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Compare the servicer’s list with your records. Check that names, account numbers, dates, signatures, income periods, and tax years are consistent. If a document is unavailable, explain why in writing and ask what substitute is acceptable. Send replacements promptly when a document expires or the servicer says a page is unreadable.

Keep the original version of each submission. A later upload can overwrite a portal record, and a phone call may not establish what was actually transmitted. Save confirmation screens, fax confirmations, overnight-tracking records, and emails showing the servicer received the material. If the servicer says the file is incomplete, ask it to identify the missing item and the rule or investor requirement it is applying.

What to ask the servicer—and how to document the answers

Use a short, specific script so the representative addresses both loss mitigation and foreclosure:

  • “What date did you receive my complete loss-mitigation application?”
  • “Is the application complete today? If not, list every missing document and the deadline.”
  • “Has a foreclosure lawsuit been filed? If yes, what is the court, case number, and current stage?”
  • “Is a sale scheduled? What is the exact date and location or online-sale information?”
  • “Has foreclosure counsel been told about my complete application and the applicable pause requirements?”
  • “What option is being evaluated, and when will I receive a written decision?”

Ask the representative to send the answers through the portal or by letter. Write down the representative’s name or identification number, the date and time, and any confirmation number. If a representative says the sale is “on hold,” ask what action was taken, by whom, and whether you will receive written confirmation. Continue checking the court docket or trustee’s notices where state procedure permits; do not rely on an informal statement alone.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a foreclosure lawsuit has already been filed

A filed case creates obligations that exist separately from the loss-mitigation review. Read the summons and complaint for the deadline to answer or appear. Missing that deadline can lead to a default judgment even if the servicer later reviews your application.

Send the complaint, all notices, and your application records to a local attorney or legal-aid office. Ask counsel to assess defenses, available motions, mediation programs, and whether state law provides a way to postpone or challenge the sale. State timelines differ substantially between judicial and nonjudicial systems, so a national estimate is not reliable.

Tell both your lawyer and the servicer about the complete-application date, the 37-day calculation, and any scheduled sale. If the application qualified for federal protections, counsel can ask the servicer and foreclosure attorney to correct steps taken contrary to the rule. Do not assume that filing a complaint with the CFPB will stop a court case or sale; use it, if appropriate, as an additional record of the dispute while pursuing time-sensitive legal remedies.

If the servicer denies, offers, or requests more information

A written decision should tell you whether the servicer is offering an option, denying the request, or asking for more information. Read the entire letter, including the reason, acceptance deadline, payment amount, effective date, and appeal instructions. Availability depends on the loan owner’s or investor’s rules and your financial facts.

Possible path Effect on the home and payments Questions to resolve in writing
Loan modification Usually keeps the home and changes payment terms, interest, maturity, principal treatment, or a combination. Is it a trial or permanent modification? What payment starts when, and what happens after a trial?
Forbearance Temporarily reduces or pauses payments, but the missed amount is not necessarily forgiven. When and how is the deferred amount repaid? Is a lump sum required?
Repayment plan Adds a portion of past-due amounts to regular payments for a defined period. What is the total payment, duration, and consequence of a missed installment?
Non-retention option, such as a short sale May allow a sale or transfer instead of retaining the home; approval and timing depend on the investor and state process. Who approves the sale, what happens to any deficiency, and can foreclosure continue while it is reviewed?

Do not stop making payments, assume an application cures the delinquency, or accept a new payment without understanding the written terms. Ask the servicer and a qualified local adviser how payments should be handled while the review or trial period is pending.

How to appeal a qualifying loan-modification denial

  1. Check eligibility. Confirm that the servicer received a complete application at least 90 days before the scheduled sale and that the denial concerns a trial or permanent loan modification.
  2. Calendar the 14-day deadline. Use the date and delivery method specified in the denial notice. If the notice is unclear, ask in writing immediately; do not wait for a phone explanation.
  3. Identify the stated reason. The denial may cite income, documentation, debt-to-income calculations, property information, investor criteria, or another factor. Gather evidence that directly addresses that reason.
  4. Submit a focused appeal. Include the appeal form or letter, corrected documents, a concise explanation, and proof of delivery. Keep a complete copy.
  5. Confirm independent review. Request written confirmation that a person who did not make the original decision is reviewing the appeal, and ask when the decision is due.
  6. Keep preparing for the sale. An appeal does not eliminate court deadlines. Give the denial and appeal package to local counsel and your HUD-approved counselor.

When the sale is within 37 days—or already scheduled

Use a same-day escalation plan:

  • Call the servicer’s escalation or executive-response contact and ask for written confirmation of the sale status.
  • Contact a local foreclosure attorney or legal-aid provider and provide the sale notice, court papers, application, completeness proof, and call log.
  • Contact a HUD-approved housing counselor for help organizing the file and communicating with the servicer.
  • Check whether your state offers foreclosure mediation, emergency court review, reinstatement, bankruptcy consultation, or other remedies. Only a local professional can explain eligibility and consequences.
  • Continue complying with every court or trustee deadline unless a court formally changes it.

Do not assume that uploading documents on the eve of a sale, submitting a complaint, or receiving a verbal promise automatically postpones the auction. Obtain written confirmation and legal advice.

Common mistakes that make a crisis worse

  • Confusing an inquiry with a complete application: asking for options or submitting one document does not establish the protected date.
  • Ignoring a “missing items” letter: an incomplete file can prevent the timing protections from applying.
  • Counting from the wrong date: calculate 37 and 90 days from the scheduled sale and use the servicer’s documented receipt date, not the date you started an online form.
  • Relying on a generic national timeline: state law controls much of the period between filing and sale.
  • Missing court deadlines while negotiating: loss mitigation and litigation proceed on parallel tracks.
  • Sending originals without copies: retain the exact version and delivery proof for every document.
  • Assuming every denial can be appealed: the federal right described here is limited to qualifying trial or permanent modification denials.
  • Paying an unverified “foreclosure rescue” service: seek free HUD-approved counseling and licensed local legal assistance first.

What state law and loan type can change

Federal servicing rules apply within their stated scope, but state law determines whether foreclosure is judicial or nonjudicial, which notices are required, how quickly a sale can follow a judgment or notice, and what remedies are available. The loan’s owner or investor may impose additional evaluation requirements. Government-backed, private-label, portfolio, and subordinate-lien loans can follow different rules.

That is why a servicer’s statement that “the file is under review” is not enough to determine whether a sale is lawful. You need the exact application-completion date, the sale date, the foreclosure posture, the loan type, and the applicable state procedure. A HUD-approved counselor can help organize those facts; a local lawyer can advise on deadlines and legal remedies.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Bottom line

Find out today whether your application is complete, when the servicer received it, whether a foreclosure case and sale date exist, and which deadlines apply. More than 37 days before sale, a qualifying complete application generally triggers evaluation and notice protections; at 37 days or less, those protections narrow. A qualifying modification denial may be appealable within 14 days when the complete application arrived at least 90 days before sale. Preserve proof, respond to court papers, and obtain local legal and HUD-approved counseling help immediately.
