What to Do if Your Mortgage Escrow Account Has a Surplus After a Property Tax Decrease

By TheFinanceBase Team 8 min read

A lower property-tax bill can reduce the amount your mortgage servicer needs to collect, but it does not automatically create a refund. The servicer must compare your escrow account’s current balance with its required target balance in an escrow analysis. If your federally related mortgage is current and that analysis shows a surplus of at least $50, the servicer generally must refund it within 30 days of the analysis. A surplus under $50 may be refunded or credited toward the next year’s escrow payments.

Start by finding your latest annual escrow statement, checking the tax figure against your local bill, and asking the servicer to correct or explain any mismatch. The analysis also determines whether the escrow portion of your monthly payment changes.

A property-tax decrease is not automatically an escrow surplus

An escrow (sometimes called an impound) account holds part of each mortgage payment so the servicer can pay property taxes, homeowners insurance and other permitted charges when they come due. Your payment is based on projected disbursements, not simply on the last tax bill. The servicer periodically performs an escrow analysis that compares the account’s balance with a target balance needed to cover projected bills and any permitted cushion. The amount above that target is the surplus.

Consequently, a tax reduction may lower future escrow collections without leaving excess cash in the account. For example, the servicer may have already paid a large tax installment, may be holding a permitted cushion, or may have used the lower estimate only in a later projection. Conversely, a surplus can exist even when the tax bill itself has not fallen. The controlling calculation is the escrow analysis, not the tax change by itself. See the Consumer Financial Protection Bureau’s explanation of escrow analysis at CFPB Mortgage Servicing FAQs.

What the federal surplus rule requires

Regulation X, 12 CFR § 1024.17(f), sets the general rule for covered federally related mortgage loans. It applies when the borrower is current at the time of the analysis. Under the regulation, a payment is treated as current when it is received within 30 days of its due date. A borrower who is more than 30 days late may not receive the same mandatory refund treatment; the servicer may retain the surplus as allowed by the loan documents and applicable law.

Escrow result at the analysis Borrower status What the servicer generally must or may do Timing
Surplus of $50 or more Current when the analysis is performed Refund the surplus Within 30 days after the analysis date
Surplus below $50 Current when the analysis is performed Refund it or credit it against the next year’s escrow payments Handled in accordance with the analysis and statement
Any surplus More than 30 days delinquent under the regulation The servicer may be able to retain it under the loan documents; the mandatory current-borrower refund rule does not apply in the same way Check the loan documents and ask the servicer for its written basis

The regulation states: “If an escrow account analysis discloses a surplus, the servicer shall, within 30 days from the date of the analysis, refund the surplus to the borrower if the surplus is greater than or equal to 50 dollars ($50).” Read the current text at 12 CFR § 1024.17. The $50 threshold is measured against the analyzed surplus, not against the amount by which your tax bill decreased.

Find and read the annual escrow statement

Your servicer generally sends an annual escrow statement within 30 days after the end of the escrow computation year. The statement is the best starting point because it shows both what happened and what the servicer expects next. The required information includes:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the account’s beginning balance and transaction history;
  • escrow deposits collected from you;
  • payments made to the taxing authority, insurer or other payees;
  • the ending balance and the lowest projected balance;
  • next year’s projected disbursements and monthly deposits;
  • the target balance, including any permitted cushion; and
  • an explanation of how a surplus or shortage will be handled.

Locate the analysis date, the tax disbursement date and the line that identifies a surplus, refund or credit. A statement may reflect a tax decrease in the next year’s projection even when no refund is due immediately. The annual-statement requirements are described in Regulation X § 1024.17.

Step-by-step: check the surplus and request a correction

  1. Download the latest statement and analysis

    Use your online mortgage portal or request a copy from the servicer. Gather the statement, recent mortgage bills, the latest property-tax bill or assessment notice, and proof of any payment that appears missing. Record the analysis date because the 30-day refund clock runs from that date, not necessarily from the day you opened the statement.

  2. Verify the tax amount and due date

    Compare the tax amount and installment date in the analysis with the bill issued by your city, county or other taxing authority. Check whether the statement uses a new assessed value, an exemption, a supplemental bill or an estimated amount. A lower current bill may not apply until the next tax cycle, and some jurisdictions bill in installments. If the servicer used an outdated figure, ask it to perform a corrected analysis.

  3. Reconcile the account history

    Match each escrow deposit with your mortgage statements and each tax or insurance disbursement with the payee’s receipt. Look for duplicate withdrawals, an omitted tax payment, an insurance premium posted to the wrong period, or a deposit that was credited late. The ending balance should be explainable from the opening balance plus deposits minus disbursements.

    Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  4. Confirm the target balance and stated surplus

    Ask how the servicer calculated the target balance and any cushion. The target is not simply the next tax bill; it reflects projected bills and the amount the rules permit the servicer to maintain. Compare the stated surplus with the difference between the actual ending balance and that target.

  5. Check whether you were current

    Review payment records around the analysis date. For the federal rule, payments received within 30 days of their due dates are treated as current. If a payment was misapplied or your account was transferred between servicers, collect confirmation of the receipt date before disputing the refund decision.

  6. Ask focused questions in writing

    Send a secure message or letter that identifies the account and asks: Which tax bill and disbursement date did you use? What were the beginning balance, projected deposits, disbursements and target balance? What surplus did the analysis produce? Is the amount being refunded or credited, and on what date? When will the escrow portion of my payment change? Request a corrected analysis if any input is wrong.

  7. Save the response and monitor the deadline

    Keep the statement, your tax documents, screenshots, correspondence and the servicer’s response. If a qualifying surplus of at least $50 is shown and no refund arrives within 30 days of the analysis, follow up with the servicer and ask for the reason in writing. Continue making the required mortgage payment until the servicer confirms a new amount; do not subtract an expected refund or payment reduction yourself.

How a tax decrease can change your monthly mortgage payment

The escrow part of your payment is generally recalculated by taking projected annual escrow costs, adjusting for the target balance and permitted cushion, and spreading the needed deposits over the payment schedule. A lower tax projection can reduce the escrow portion. The total payment can still rise or stay the same if insurance premiums increased, another escrowed charge was added, a prior shortage is being collected, or the loan’s principal-and-interest amount changed.

Your statement should show the old and new payment components or otherwise explain the revised amount. The servicer may implement a lower payment at the start of the next computation period, after a midyear analysis, or on another date stated in the notice. The exact timing depends on the account’s analysis and other escrowed expenses; the tax decrease alone does not establish a particular dollar reduction. Illustrative examples of the calculation

These examples show the mechanics only; your servicer’s figures control.

Situation Current balance Target balance Analyzed surplus Likely federal treatment if current
Tax estimate falls before the next annual analysis $4,200 $4,100 $100 Refund within 30 days after the analysis
Small excess after revised projection $3,025 $3,000 $25 Refund or credit toward next year’s escrow payments
Lower tax bill but a larger insurance premium $3,900 $4,000 None No surplus refund; the payment may increase to fund the higher target

In the first example, the $100 is the balance above the target, not the amount of the tax reduction. In the third, a lower tax bill does not produce a surplus because another projected expense raises the target.

If the servicer’s figures do not match your documents

Begin with the servicer’s customer-service or escrow department and provide the specific discrepancy. Ask for a revised analysis rather than only a verbal explanation. If the issue concerns a payment posting, tax disbursement or account transfer, identify the transaction date and attach the relevant receipt. Ask when the correction will appear and whether it changes the refund or the monthly payment.

Keep paying the amount currently required while the dispute is reviewed. A tax authority’s corrected bill does not itself change your contractual mortgage payment until the servicer processes an analysis or other permitted adjustment. If the servicer will not explain its calculation, consult the complaint and dispute options available through your loan documents and the CFPB; the federal rules do not determine every state-law remedy, loan-term variation or coverage question.

Situations that follow different rules

When the mortgage is paid off

A payoff is different from an annual surplus. When the mortgage is paid in full, Regulation X § 1024.34 generally requires the servicer to return remaining escrow funds within 20 days, excluding legal public holidays, Saturdays and Sundays. The payoff rule is described at 12 CFR § 1024.34. Do not use the annual $50 threshold to calculate a payoff refund.

When the loan is not covered by the federal rule

Not every mortgage has the same federal coverage, and state law or the loan contract can provide additional requirements. Ask the servicer which rule and loan provision it is applying. The sources cited here do not establish state-specific rights or guarantee coverage for an individual loan.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When the account is delinquent

If payments were more than 30 days late when the analysis was performed, the current-borrower refund requirement may not apply. Ask the servicer to identify the payment date it used and the contractual authority for retaining or applying the surplus. Correcting a misapplied payment can change that determination.

Questions to send your servicer

  • What was the exact date of my escrow analysis?
  • Which property-tax bill, assessment and installment dates were used?
  • What are my current balance, projected disbursements, target balance and permitted cushion?
  • What surplus amount did the analysis calculate?
  • Am I considered current under the 30-day payment standard on the analysis date?
  • Will the surplus be refunded or credited, and on what date?
  • What will my new escrow and total monthly payment be, and when does it begin?
  • Can you send a corrected analysis if the tax figure or transaction history is wrong?

Bottom line

Use the escrow statement—not the tax decrease alone—to determine whether money is owed. Verify the tax estimate and account history, confirm your payment status, and obtain the servicer’s calculation in writing. For a covered loan with a current borrower, a surplus of $50 or more generally must be refunded within 30 days of the analysis; a smaller surplus may be refunded or credited. The same analysis determines any change to your monthly payment.
