What to Do If Your Mortgage Broker’s Recommendation Doesn’t Suit Your Needs

If a mortgage recommendation does not fit your priorities, do not accept it simply because the broker presented it as the best available deal. Pause before exchanging contracts or completing, identify the precise mismatch, check the facts recorded about you, and ask the broker to explain the recommendation in writing. If the explanation does not resolve the issue, complain to the firm, preserve your records and use the Financial Ombudsman Service route where eligible. UK rules require regulated mortgage advice to be suitable for the customer’s needs and circumstances, but whether a recommendation was unsuitable depends on your facts, the mortgage, the broker’s service scope and the firm’s permissions.

1. Pause the application and identify what does not fit

If you have not completed the purchase or accepted the mortgage, avoid rushing because a valuation, offer expiry or sales deadline is approaching. Tell the broker exactly which priority or circumstance the recommendation appears to miss. For example, you may have said that payment certainty matters more than the lowest initial rate, that you expect to move within a few years, that you need the ability to overpay, or that an interest-only structure is unacceptable.

Ask the broker to explain the recommendation against the information recorded about you and the service they agreed to provide. Request the explanation, product rationale and any revised recommendation in writing. A different mortgage being cheaper, or disliking a particular lender, does not by itself prove that advice was unsuitable. Focus on the conflict between your stated needs and the recommended contract, including any trade-off the broker says you accepted.

Do not cancel blindly

Withdrawing an application can trigger valuation, application or broker charges, delay a purchase and affect your ability to meet a deadline. Before cancelling, ask what alternatives remain, whether a product can be changed without a new full application, and what fees or early-repayment consequences would apply. If the transaction is at risk, obtain independent legal or regulated mortgage advice promptly rather than relying on an assumption that the original recommendation was wrong.

2. Check the information on which the advice was based

A recommendation can look unsuitable because the broker’s fact-find contains an error or an important change was never recorded. Read the documents and correspondence carefully, then send corrections with the date and supporting evidence.

Documents to review

  • The fact-find or affordability questionnaire, including income, expenditure, employment status, dependants and existing debts.
  • The mortgage illustration and any European Standardised Information Sheet or equivalent illustration supplied for the product.
  • The recommendation, suitability or advice letter and the stated reasons for choosing the mortgage.
  • Fee disclosures, including broker fees, lender fees, valuation charges and any commission disclosure.
  • Emails, messages and notes of calls that record your priorities, planned term, repayment preference or anticipated changes.

Check the loan amount, term, repayment type, interest-rate basis, assumed future income, property use and any special eligibility assumptions. Correct information about a planned parental leave, retirement, job change, relocation, variable income or expected lump-sum repayment can materially change suitability. Keep dated copies of every document and write a short note after each call recording who said what and when.

3. Understand what “suitable” means under UK mortgage rules

For advised sales of a regulated mortgage contract, the Financial Conduct Authority’s Handbook states in MCOB 4.7A.2: “If a firm gives advice to a particular customer to enter into a regulated mortgage contract, or to vary an existing regulated mortgage contract, it must take reasonable steps to ensure that the regulated mortgage contract is, or after the variation will be, suitable for that customer.” Read the rule in context at the FCA Handbook, MCOB 4.7A.

Suitability is assessed against your needs and circumstances, using facts you disclosed and other relevant facts the firm is, or should reasonably be, aware of. The Handbook identifies considerations such as eligibility, repayment versus interest-only borrowing, the term, payment stability if rates change, the wish to minimise initial payments, early-repayment charges and other product features. The firm must retain your information and a record explaining why its advice meets the suitability requirement.

If several suitable products exist within the firm’s range and the recommended one is not the cheapest, the firm must explain why it selected that product. That does not mean a broker must recommend the cheapest mortgage in the entire market, or search every lender, because the firm may offer whole-of-market advice or a restricted service. It does mean the recommendation should have a reasoned link to your circumstances and the scope of the service you paid for.

4. Compare the recommendation on more than the headline rate

Ask for a side-by-side explanation of the recommended mortgage and realistic alternatives. A useful comparison covers the following dimensions.

Issue Questions to ask Why it matters
Total cost What are the rate, arrangement fee, valuation cost, broker fee, incentives and estimated interest over the relevant period? A lower initial rate can cost more once fees, a higher follow-on rate or refinancing costs are included.
Payment amount and stability What is the initial payment, when can it change, and how would payments respond to future rate movements? A payment that is affordable today may become unaffordable after a variable-rate or fixed-rate period ends.
Repayment structure and term Is the loan repayment or interest-only? What balance remains at the end, and how does the term affect monthly payments and total interest? Interest-only borrowing requires a credible repayment plan; a longer term can reduce monthly cost while increasing total interest.
Flexibility Can you overpay, port the mortgage, make lump-sum payments or redeem early? What charges and limits apply? Restrictions can conflict with plans to move, repay a bonus or refinance before the deal ends.
Eligibility and access Which lender criteria were applied, and was the broker’s service whole-market or restricted? A product may be unsuitable if you cannot satisfy its underwriting conditions or if relevant alternatives were outside the broker’s stated panel.

Ask the broker to identify the trade-off rather than merely repeat that the product is “best.” For example, a fee-paying five-year fix might be preferred for payment certainty even though a fee-free two-year deal has a lower initial cost. The explanation should show why that trade-off fits your stated plans and risk tolerance.

  • What needs and circumstances did you record, and which of them drove the recommendation?
  • What products or lenders did you consider within your service scope?
  • Is your service whole-market, limited to a panel, or limited to particular lenders or products?
  • Why is this mortgage preferable to each materially different suitable option?
  • How did you assess payment affordability after a fixed or introductory rate ends?
  • What are the total fees, early-repayment charges, overpayment limits and remaining balance at the end of the term?
  • Which information would change the recommendation, and what documents do you need from me?

Ask the broker to correct any inaccurate fact-find entry and issue an updated suitability explanation. Keep the original version as well as the correction; changing a document without a dated record can make the timeline harder to establish.

6. Make a formal complaint to the responsible firm

If clarification does not resolve the problem, complain to the firm that gave the advice. The FCA’s complaint guidance says to explain what happened and when, ask the firm to put things right, and keep a record of how and when you made contact.

  1. Address the correct business. Use the firm’s complaints procedure or the compliance address in its terms of business. If an appointed representative arranged the mortgage, identify both the representative and the principal firm where the documents do so.
  2. Set out the chronology. Give dates for the fact-find, recommendation, application, conversations and any financial consequence, such as a fee, delay or decision to proceed.
  3. Describe the mismatch. State the priority or circumstance you disclosed, what was recommended, and why the product’s cost, payment risk, term, repayment type, flexibility or eligibility does not meet it.
  4. Attach evidence. Include the illustration, suitability letter, fact-find corrections, relevant messages and a call log. Keep the originals and send copies.
  5. State the remedy sought. Depending on the facts, you might ask for a reassessment, correction of records, reimbursement of a fee, compensation for a proven loss or another specific remedy. Do not demand a particular redress amount without evidence of loss.
  6. Keep proof of submission. Save the email, web-form confirmation, postal proof and every response.

A complaint is about the firm’s service or advice, not simply a request to renegotiate a lender’s commercial pricing. The firm may ask for further information, offer to resolve the matter or issue a final response explaining its position.

7. Track the regulatory time limits

These periods serve different purposes. They are process limits, not a guarantee that a complaint will succeed or that it is in time in your particular circumstances.

Period What it means Source and qualification
Three business days If the firm has not resolved the complaint within three business days, it will generally need to acknowledge it in writing. FCA consumer complaint guidance, current page accessed in 2026.
Eight weeks The firm generally has eight weeks to send its written outcome, unless it resolves the complaint within the short early-resolution process. FCA consumer complaint guidance; some cases can have specific rules or exceptions.
Six months You should normally refer the complaint to the Financial Ombudsman Service within six months of the firm’s final response. The FCA describes the service as free and independent; check the Ombudsman’s current eligibility and complaint checker.
Six years or three years from awareness General complaint time limits are usually six years from the event, or three years from when you knew, or ought reasonably to have known, there was cause to complain. The FCA’s Mortgage Rule Review (PS25/11, 2025) explains these limits; exceptions and the application to your facts require checking.

Do not confuse the firm’s eight-week response period with your separate six-month Ombudsman referral deadline. If the firm misses its response deadline, check the Ombudsman’s rules rather than waiting indefinitely.

8. Escalate to the Financial Ombudsman Service when appropriate

If the final response is unsatisfactory, or the firm has not responded within the applicable period, use the Financial Ombudsman Service complaint checker and eligibility information promptly. Provide the final response, your original complaint, the key documents and a concise timeline. The Ombudsman decides whether it can investigate and, if so, assesses the facts and applicable rules independently; referral does not guarantee compensation.

Keep pursuing practical arrangements for the mortgage while the complaint is considered. An Ombudsman case does not automatically pause completion, payments, arrears action or a product expiry. Ask the firm and the Ombudsman what information is needed if a deadline is close.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

9. Check the broker’s authorisation and permissions

Use the FCA’s Firm Checker and Financial Services Register guidance to confirm the business name, trading names, permissions and whether the relevant mortgage activity is authorised. Save a dated screenshot or printout showing what you checked.

If the firm is unauthorised, ordinary protections may differ. Do not assume that the Financial Ombudsman Service or compensation arrangements will be available; consult the FCA’s consumer guidance and obtain case-specific advice. A trading name can differ from the legal entity, so match the details on your mortgage documents with the register.

10. If you have already completed or remortgaged

Completion does not automatically remove the possibility of complaining about earlier advice. The FCA’s PS25/11 review says a later remortgage with a new lender does not, by itself, prevent a complaint about the original recommendation. The ordinary time limits still apply, and the outcome depends on the advice, your disclosures, the firm’s status and any loss that can be established.

Gather the original illustration, offer, suitability letter, payment history, redemption statement, later remortgage documents and evidence of costs. Separate dissatisfaction with the lender’s later rate or service from an allegation that the broker’s earlier advice was unsuitable; they may involve different firms and different complaint routes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

11. Common mistakes to avoid

  • Relying on the cheapest-rate test alone: fees, payment stability, term, flexibility and eligibility can make a higher-rate product suitable.
  • Assuming “whole market” without checking: read the broker’s disclosure to see whether the service is whole-market or restricted.
  • Leaving corrections verbal: send the corrected income, expenditure or plans in writing and retain the prior record.
  • Waiting for a perfect file: submit a complaint with the evidence available, then add documents; delay can create deadline problems.
  • Missing the six-month referral window: diarise the date of the final response and check Ombudsman rules immediately.
  • Seeking a replacement mortgage from an unauthorised source: verify permissions before sharing documents or paying fees.

12. When to obtain independent help

Consider independent regulated advice or legal guidance if the recommendation involves interest-only borrowing, complex income, a future retirement date, a potentially unaffordable payment, significant early-repayment charges, alleged financial loss or an imminent possession or completion deadline. A solicitor can address contract and deadline issues; a regulated mortgage adviser can assess replacement options. Neither role guarantees that a complaint will be upheld, so provide them with the complete dated record.

Practical outcome

The strongest response is evidence-led: pause, state the mismatch, correct the facts, obtain a written explanation, and compare the mortgage on total cost, payment risk, structure, flexibility and eligibility. If the explanation remains inadequate, complain to the responsible firm and monitor the three-business-day, eight-week and six-month process points. Check authorisation and, where appropriate, refer the matter to the Financial Ombudsman Service without assuming that a later remortgage or an old complaint is automatically barred.
