If Social Security denies your Medicare Income-Related Monthly Adjustment Amount (IRMAA) reconsideration, you can request the next level of review: a hearing before an administrative law judge (ALJ) in the U.S. Department of Health and Human Services (HHS) Office of Medicare Hearings and Appeals (OMHA). Use Form HA-501-U5, Request for Hearing by Administrative Law Judge, and follow the deadline, delivery method, and address printed on your reconsideration notice. If the ALJ decision is unfavorable, the remaining levels are review by the HHS Medicare Appeals Council (MAC) and, when available and appropriate, an action in federal court.
Before filing, confirm that your notice concerns an IRMAA premium determination—not a denied medical service, prescription, or Medicare plan-coverage request. Those coverage disputes use a different Medicare appeals system.

What an IRMAA denial means
IRMAA is the income-related surcharge added to Medicare Part B and Part D premiums for beneficiaries whose income exceeds the applicable thresholds. Social Security Administration (SSA) generally makes the initial premium determination using federal tax information, and SSA handles reconsideration of that determination.

A denied reconsideration means SSA has upheld the existing premium decision at the reconsideration level. It does not end every possible remedy. The next formal appeal is an HHS ALJ hearing conducted through OMHA. After the ALJ level, the case may proceed to the Medicare Appeals Council and then, subject to the governing rules, federal court.

SSA summarizes the right this way: “If you disagree with the decision we made about your income-related monthly adjustment amounts, you have the right to appeal.” The exact instructions in your notice control what you must do next.
First, verify that you are using the right appeal process
Read the heading and explanation on the notice you received. An IRMAA case is about the amount of your Medicare premiums, not whether Medicare will pay for a particular treatment or prescription.
- IRMAA issue: The notice identifies an income-related Part B or Part D premium adjustment, a premium year, the income information used, and appeal rights.
- Coverage issue: A denial of a service, drug, item, claim, or Medicare Advantage or Part D plan decision follows the Medicare claims or plan-appeal procedures instead.
If the document is not an SSA IRMAA determination or reconsideration notice, do not send Form HA-501-U5 based solely on the word “denied.” Use the appeal instructions for the type of decision you actually received.
Read the reconsideration notice before doing anything else
The notice is the case-specific roadmap. Mark these items before preparing a filing:
- the premium year involved;
- the determination and reconsideration notice dates;
- SSA’s stated reason for upholding the IRMAA;
- the appeal-rights section;
- the deadline for requesting an ALJ hearing;
- the address, online route, fax number, or other delivery method specified; and
- any case number or identifying information the notice requires.
Keep the original notice and make a complete copy or scan. If you mail or fax anything, retain proof of transmission and the date sent. If you submit online, save the confirmation page or receipt. These records can matter if SSA or OMHA later questions whether you filed on time.
Request the ALJ hearing with Form HA-501-U5
After an unfavorable reconsideration, the formal next level is an HHS ALJ hearing in OMHA. The form used for that step is HA-501-U5, Request for Hearing by Administrative Law Judge.

- Obtain the current form. Use the version identified by the instructions accompanying your notice or by the responsible federal agency. Do not substitute Form SSA-561-U2; that form is for a reconsideration request, not the ALJ level.
- Identify the decision precisely. Enter the beneficiary’s identifying information, the premium year, and the IRMAA reconsideration decision you are challenging. Copy case or reference numbers exactly as shown on the notice.
- State why the decision is wrong. Tie each reason to the evidence you are submitting. For example, explain that SSA used an incorrect tax figure, that the IRS record was corrected, or that a qualifying life-changing event reduced income.
- Attach organized evidence. Include the determination and reconsideration notices, relevant tax documents, and proof supporting each factual assertion. Label attachments so an ALJ can match them to the issue described on the form.
- Submit it exactly as directed. Follow the reconsideration notice for the filing deadline, destination, and permitted submission method. The available material establishes the form and hearing level, but it does not establish one universal hearing deadline or filing address for every case.
- Preserve proof. Keep the signed form, every attachment, delivery confirmation, and a copy of the complete submission together in one file.
Do not assume that the 60-day period often associated with IRMAA appeals is the deadline for this hearing. SSA policy states that a reconsideration of an initial IRMAA determination may be requested within 60 days after receipt. That is a different stage from an ALJ request after reconsideration. For the hearing, use the deadline and instructions in your own reconsideration notice.
Build evidence around the reason for the surcharge
An ALJ review is stronger when the documents directly answer why SSA upheld the premium. Assemble the notices first, then add only records that prove the disputed fact.
If the income figure came from an incorrect IRS record
SSA says that a beneficiary who believes the modified adjusted gross income (MAGI) supplied by the IRS is wrong must correct the information with the IRS and give SSA proof of the correction. A disagreement with the tax data, without evidence that the IRS record changed, may not establish that SSA’s determination was erroneous.
- Obtain documentation from the IRS showing the corrected record or accepted correction.
- Provide SSA with proof of that correction and identify the premium year it affects.
- Explain how the corrected income changes the IRMAA calculation.
If you filed an amended tax return
An amended return can support a new initial determination in an appropriate case. Submit the amended return and the IRS acknowledgment or other proof that the IRS received or processed it. Keep the original return as well, because SSA may need to see what changed.
If your income fell after a qualifying life-changing event
A qualifying event that reduced household income may justify asking SSA for a new initial determination. SSA examples include a spouse’s death and retirement or a reduction in work. The evidence must establish both parts of the claim:

- The event: such as a death certificate, employer letter documenting retirement or reduced work, or other event-specific documentation.
- The resulting income reduction: such as pension information, updated earnings records, or other documentation SSA requests to show the lower income.
The exact qualifying events and acceptable proof depend on the circumstances. Submit the documents SSA identifies for your event rather than relying on a general statement that your income is now lower.

If SSA used an older tax year
IRMAA determinations may rely on tax information from an earlier year. Ask SSA whether the rules permitting consideration of more recent tax information apply to your specific premium year and situation. Do not assume that any newer tax return automatically replaces the year used in the notice; eligibility depends on the applicable SSA rules.
Appeal or request a new initial determination?
These are different routes and can address different problems. SSA policy allows a person to pursue an appeal and a new initial determination at the same time.

Continuing the appeal preserves review of the existing decision. A new initial determination can be more direct when the central problem is a changed income picture or corrected tax data rather than an error in the reconsideration analysis. Because the two routes can coexist, follow the notice for the ALJ filing while separately asking SSA whether it will accept a new initial-determination request.

SSA also lists online filing and contact with a local Social Security office for reconsideration requests. Those options do not change the need to follow the specific instructions for the later ALJ level.
What happens after the ALJ?
Medicare Appeals Council review
If the ALJ decision is unfavorable, the next review body is the HHS Medicare Appeals Council. Read the ALJ decision’s appeal-rights section carefully for the filing period, destination, and required format. The council review is not the same as starting over with a new SSA reconsideration.
Federal court
After the Medicare Appeals Council level, federal court action may be available under the governing requirements. The council decision will state the conditions and deadline that apply. Court filing is a separate legal proceeding, so obtain qualified legal advice if you are considering it, particularly when the amount at issue is substantial or the record is complex.

Deadlines: do not copy the 60-day rule to the wrong stage
SSA policy describes a 60-day period for requesting reconsideration of an initial IRMAA determination. Receipt is generally presumed to occur five days after the notice date unless the beneficiary can show it arrived later. That rule applies to the initial reconsideration stage.
The available policy description does not establish a single hearing deadline for every post-reconsideration case. Use the deadline printed in your reconsideration notice and ask SSA or OMHA promptly if the notice is unclear. Missing a deadline can jeopardize the next level even when the underlying income evidence is persuasive.
Contact SSA and get neutral Medicare help
SSA’s IRMAA service options include an online SSA-44 route for life-changing-event requests, fax or mail submission with evidence, appointments at a local office, and telephone support at 1-800-772-1213. TTY users can call 1-800-325-0778. If you are outside the United States, SSA directs callers to a Federal Benefits Unit for an appointment.
For Medicare questions and terminology, a State Health Insurance Assistance Program (SHIP) can provide free counseling. SHIP can help you understand the process, but the formal IRMAA determination, reconsideration, and hearing filings remain with SSA and HHS.
Common mistakes and how to correct them
Sending SSA-561-U2 after reconsideration
Problem: You submit another reconsideration request when the next level is an ALJ hearing.
Fix: Use HA-501-U5 and the filing route in the reconsideration notice. If you have new qualifying evidence, ask separately about an SSA-44 new initial determination.

Using the 60-day period without checking the notice
Problem: You treat the initial reconsideration deadline as the hearing deadline.
Fix: Locate the post-reconsideration appeal-rights section and follow its date and delivery instructions. If the date is missing or confusing, contact SSA immediately and document the inquiry.
Arguing with IRS data but not correcting it
Problem: You tell SSA the MAGI is wrong but provide no proof that the IRS record changed.
Fix: Work with the IRS to correct the record, retain the acknowledgment or correction evidence, and send that proof to SSA with an explanation of the premium-year impact.
Proving a life event but not the income reduction
Problem: A death certificate or retirement letter is included, but nothing shows the resulting lower income.
Fix: Submit both event documentation and records showing the reduced income, such as pension or updated earnings documentation.
Confusing a premium appeal with a coverage appeal
Problem: You use IRMAA forms for a denied service, drug, or plan decision.

A practical filing checklist
- Confirm that the notice is an SSA IRMAA reconsideration decision.
- Record the premium year, notice dates, reason, case number, deadline, and filing address.
- Complete HA-501-U5 for the ALJ hearing.
- Explain the error or changed circumstance in plain language tied to each attachment.
- Include both IRMAA notices and the evidence matching your reason.
- Use IRS correction proof for an IRS-data dispute.
- Use an amended return and IRS acknowledgment for an amended-filing request.
- Use SSA-44 and evidence of both the qualifying event and income reduction when seeking a new initial determination.
- Keep copies and proof of delivery.
- Ask SSA or OMHA promptly about any unclear deadline or filing route.
SSA, HHS, tax-year inputs, forms, and premium procedures can change. The current notice and current agency instructions govern your case, even when a general explanation describes the usual sequence.
