What to do if your Medicare Advantage doctor leaves the network

By TheFinanceBase Team 9 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Call both your Medicare Advantage plan and the doctor’s office to confirm the doctor’s final in-network date. Then ask the plan, in writing, how it will protect ongoing treatment, which replacement doctors are available, what referrals or prior authorization are required, and what you would pay for any visit after the termination date. Do not assume that the old in-network rate continues automatically.

First, verify exactly what is changing

A doctor may stop participating in one Medicare Advantage plan while remaining available through another plan, or the office may have an administrative issue that can be corrected. Before changing appointments or agreeing to an out-of-network visit, confirm the facts from two sources.

As an Amazon Associate I earn from qualifying purchases.

  1. Call the number on your plan member card. Ask whether the doctor is leaving your exact plan, the effective date and time of the termination, and whether the plan sent a written notice.
  2. Call the doctor’s billing or referral office. Ask whether the departure applies to your plan and whether the office will continue seeing plan members during a transition period.
  3. Save the evidence. Keep the letter, portal message or email. Record the date and time of each call, the representative’s name or identification number, and any call-reference number.

Medicare says a Medicare Advantage plan can add or remove providers during the year. Check network status again when scheduling an appointment, because an old directory entry is not a guarantee of current participation.

What notice and assistance should you receive?

Plans should make a good-faith effort to give people who regularly see a departing provider at least 30 days’ notice. The notice should explain the change and help you locate alternatives. Medicare guidance also says plans must protect access to medically necessary benefits and help members continue care already in progress.

If you did not receive notice, or received it too late to arrange safe care, tell the plan. Ask for the written termination notice, the current provider directory and a list of suitable in-network alternatives. A late notice does not automatically mean the doctor remains in network, so obtain the plan’s written position before a non-emergency appointment.

Protect treatment that is already underway

Do not describe the issue merely as “I want to keep my doctor.” Explain the treatment, the next scheduled service and the harm a gap could cause. Ask the plan to document a continuity-of-care request.

When transitional in-network care may apply

CMS patient-rights guidance says a qualifying “continuing care patient” can receive care from the departing provider at in-network rates for up to 90 days. The guidance identifies situations such as:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • treatment for a serious or complex illness;
  • inpatient or institutional care;
  • a scheduled, non-elective surgery;
  • pregnancy-related treatment; and
  • terminal illness.

The 90-day period is a maximum described in the guidance, not an automatic entitlement for every patient. Ask whether you meet the plan’s definition, when the transition would begin, which services are included, and what forms or physician certification are required. Confirm whether the current doctor must agree to the plan’s terms.

Information to give the plan

  • Your diagnosis and the specialty involved.
  • The treatment or procedure in progress.
  • The date of the next appointment, infusion, surgery or other service.
  • Why changing clinicians immediately could affect your health or recovery.
  • Any practical requirements, such as language, accessibility, transportation or a particular hospital.

Request the answer in writing through the plan’s secure portal, letter or email. If the representative gives only a telephone answer, ask for a reference number and the department that made the decision.

Understand the cost risk before seeing the doctor again

Out-of-network rules depend on the plan contract. A visit that was covered at an in-network copayment before the termination can become substantially more expensive afterward.

Plan situation What may happen after the doctor leaves What to ask before care
HMO Non-emergency care generally must come from network providers. Out-of-network care may not be covered, leaving you responsible for the full charge. Whether a continuity-of-care exception applies; whether the plan will authorize the doctor temporarily; and the exact member cost.
HMO-POS The plan may permit some out-of-network care, usually with higher cost sharing and possible limits. Whether this service is eligible, whether prior authorization or a referral is required, and the dollar amount you would owe.
Other Medicare Advantage designs Rules vary by contract, service and network. A directory listing or office statement alone does not establish coverage. Written confirmation of network status, authorization, coverage and cost sharing for the specific service and date.

Ask the plan to answer these questions in one communication:

What’s actually slowing this PC down?

Pick the symptom - the matching free tool is one click away.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Is the doctor in network on the date of my next appointment?
  • Will the plan pay this doctor at the in-network rate while a continuity request is reviewed?
  • Is a referral, prior authorization or treatment-plan approval required?
  • If the service is out of network, what portion will the plan pay and what is my estimated responsibility?
  • Who will issue the organization determination if coverage is disputed?

Do not rely on a provider’s promise that “insurance should cover it.” The plan controls the benefit decision, and the written response is useful if you later appeal a bill or denial.

Find a replacement doctor without losing essential care

Ask the plan for a current directory and several named alternatives, not just a generic website search. The plan’s termination-notice model calls for alternate provider contacts and directory information. Confirm each candidate with both the plan and the doctor’s office before transferring records or booking.

Compare candidates on the factors that affect your care

  • Clinical fit: specialty, diagnosis experience and the services the doctor can provide.
  • Location and transportation: travel time, parking, public transit and whether frequent visits are realistic.
  • Accessibility: exam-room access, equipment, mobility accommodations and communication support.
  • Appointment availability: the earliest new-patient appointment and follow-up capacity.
  • Referral rules: whether your primary-care doctor must issue a referral.
  • Hospital affiliation: relevant if treatment, surgery or emergency follow-up occurs at a particular hospital.
  • Language and communication: interpreter availability, accessible portals and preferred communication methods.
  • Expected cost: specialist copayment, deductible exposure, facility charges and any authorization requirement.

Ask the replacement office to verify the exact plan name and network tier, not merely whether it accepts “Medicare.” Original Medicare participation and Medicare Advantage network participation are different questions.

Use a written transition request

A short, specific request is easier for the plan to route than a general complaint. You can adapt this wording:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“My doctor, [doctor’s name], is reported to leave my Medicare Advantage network on [date]. I am receiving treatment for [condition], with [service] scheduled on [date]. A gap or immediate transfer could affect my care because [reason]. Please tell me whether I qualify as a continuing-care patient, whether the doctor may continue temporarily at in-network cost sharing, what documents you need, and how you will cover the next service. Please send the decision and my appeal rights in writing.”

Keep a copy and attach the termination notice, appointment confirmation and relevant clinical information. Do not send more medical information than the plan requests, but provide enough to show why a gap matters.

Know when to file an appeal or a grievance

These processes address different problems.

Appeal: a coverage or payment decision

Use an appeal when the plan refuses to cover medically necessary care, denies a continuity arrangement, refuses authorization, or says it will not pay a claim. First request an organization determination if the plan has not yet made one. If you receive a denial, follow the appeal instructions and deadline printed on that notice.

For a Medicare Advantage level-one reconsideration, the general deadline is 65 days from the date of the initial denial notice. The notice controls if it gives a different instruction or explains an extension. A doctor or authorized representative may help request the appeal.

Expedited appeal: when delay could cause serious harm

Request an expedited appeal when waiting through the standard process could seriously jeopardize your life, health or ability to regain maximum function. When the criteria apply, the plan’s decision is generally due within 72 hours. State clearly what service is scheduled and what harm a delay could cause; ask the treating clinician to support the urgency.

Grievance: a service or access problem

File a grievance for problems such as failure to send notice, inaccurate directory information, repeated inability to reach the plan, rude or misleading service, or failure to help you find an accessible replacement. A grievance does not replace an appeal when the immediate issue is a denied benefit or payment.

Can you change Medicare Advantage plans mid-year?

A doctor’s departure by itself usually does not create a special enrollment period. Do not disenroll based on a sales call or an assumption that a network change automatically gives you a mid-year right to switch.

Ask Medicare or a State Health Insurance Assistance Program (SHIP) counselor to review your circumstances and the enrollment period for the relevant year. Medicare’s model notice identifies these general windows:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Enrollment window General use Important qualification
October 15–December 7 Annual period to make changes for the following year. Verify the dates and the plan change that will take effect for the applicable year.
January 1–March 31 Medicare Advantage Open Enrollment Period for eligible people who are already enrolled in Medicare Advantage. Eligibility and permitted changes depend on your status; confirm before acting.

Other exceptions can exist for particular life events or circumstances. Medicare and SHIP can explain whether one applies. SHIP counseling is free and personalized; use the Medicare SHIP locator to find your state program.

A practical call-and-record checklist

  1. Write down the doctor’s name, specialty, plan name and reported termination date.
  2. Call the plan and ask for written confirmation of network status and the termination notice.
  3. Ask for continuity-of-care review and provide the next treatment date and clinical reason for urgency.
  4. Request in-network alternatives that match specialty, location, accessibility and hospital needs.
  5. Confirm each alternative’s participation directly with the plan and office.
  6. Obtain written answers about referral, prior authorization, coverage and cost sharing before non-emergency care.
  7. If the plan denies medically necessary coverage, request an organization determination and follow the denial notice’s appeal steps.
  8. If the problem is access or service handling, file a grievance and keep the confirmation.
  9. Ask Medicare or SHIP whether a valid enrollment exception applies before changing plans.

Common situations and the safest response

The office says the doctor is still taking my plan

Ask the plan to verify the status in writing. If the plan and office disagree, postpone non-emergency care until you know who will pay, or obtain a written authorization for the specific visit.

My surgery or treatment is scheduled soon

Tell the plan the exact date and explain why a transfer could be unsafe. Request expedited handling if delay could seriously affect your health, and ask the surgeon’s office to submit supporting documentation.

The only replacement has a long wait

Report the access problem as well as the clinical need. Ask the plan for additional providers, a temporary arrangement with the departing doctor, or another medically appropriate option. Document every unavailable appointment and proposed date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

I already received a bill from the doctor

Ask the plan whether the claim was processed under in-network, out-of-network or denied status and request the explanation of benefits. If the plan made a coverage or payment decision you dispute, use the appeal process rather than relying only on a billing-office conversation.

Keep a file until the issue is resolved

Maintain the termination notice, directory pages, appointment confirmations, authorization letters, claim forms, explanations of benefits and call log together. Note the service date, provider, amount billed, amount paid and every reference number. This record helps the plan, your doctor and an appeal reviewer see exactly what happened.

The governing documents remain your plan contract, current directory and written determinations. Medicare’s consumer and patient-rights guidance explains the general protections, but your plan, location, treatment and notice determine the outcome in an individual case.
