If an Indian income-tax reassessment notice appears to name the wrong Assessing Officer (AO), do not ignore it and do not assume it is automatically void. First identify the relevant assessment year or tax year and the law that governs it. Then compare the officer and jurisdiction printed on the notice with the Income Tax Department’s Know Your JAO result for your PAN. If the records do not match, submit a documented jurisdiction objection promptly through the official channel stated in the notice or portal, while continuing to observe the notice’s response deadline unless the Department or a competent authority directs otherwise.
For proceedings under the Income-tax Act, 1961, section 124 contains the jurisdiction-objection mechanism and timing rules. A mismatch is a reason to investigate and object; it is not, by itself, proof that every reassessment notice is invalid.

Identify which income-tax law applies before you object
The first question is not whether the officer’s name looks unfamiliar. It is which Act governs the proceeding. The Department’s transition guidance says the Income-tax Act, 2025 applies to tax year 2026–27 and later. For a tax year beginning before 1 April 2026, reassessment remains under the Income-tax Act, 1961. Proceedings already pending under the 1961 Act continue under that Act after the new law begins. See the Department’s Reassessment Proceedings FAQs and Objective and scope of the New Act FAQs.

| Period or status | Likely governing framework | What to check |
|---|---|---|
| Tax year beginning before 1 April 2026 | Income-tax Act, 1961 | Section 124 and the procedural dates connected with the notice, return and earlier proceedings |
| Tax year 2026–27 or later | Income Tax Act, 2025 | The section and objection procedure stated in the notice and the Department’s current guidance |
| Proceeding already pending under the 1961 Act when the new Act starts | Income-tax Act, 1961 continues to govern that proceeding | The original notice, pending-stage records and any orders or directions already issued |
Do not substitute “assessment year” and “tax year” casually. Record the exact label and period printed on the notice. The period determines which statutory section you should cite and prevents an objection built on the wrong Act.

What a wrong-officer concern actually means
A reassessment notice normally identifies an officer, unit or jurisdiction responsible for the proceeding. A jurisdiction concern can arise when that identity appears inconsistent with the Department’s PAN-linked AO record, the taxpayer’s address or business location, an earlier jurisdiction order, or a transfer or delegation shown in the case file.
The comparison is factual, not merely cosmetic. An officer’s name, designation or office address may change while the underlying jurisdiction remains valid. Conversely, a different area code, AO type, range, number or jurisdiction description can justify a formal check. The notice itself may also identify a special unit or arrangement that is not obvious from a basic PAN lookup. Treat the mismatch as a prompt to verify the complete record, not as a final legal conclusion.
How to check your jurisdictional AO
1. Make a complete notice record
Before contacting anyone, save the notice in its original electronic form and make a dated working copy. Record:

- the statutory section printed on the notice;
- the issue date and the date and method of service;
- the named officer, designation, office, unit and address;
- the response date or period stated in the notice;
- any document identification number, reference number or proceeding identifier; and
- the return-filing history and earlier notices or orders for the same period.
Keep service evidence, such as the portal download record or email, because the time limit for a jurisdiction objection can depend on what was served and when.
2. Use the Department’s Know Your JAO service
Open the Income Tax Department’s Know Your AO User Manual and follow the current portal instructions for looking up the jurisdiction associated with your PAN. Enter the requested taxpayer details exactly as the service requires, then save or print the result with the date of retrieval.

The manual says the result displays the area code, AO type, range code, AO number, jurisdiction, address and email ID. Compare every field with the notice rather than checking only the officer’s name. Preserve a PDF or screenshot of the result and retain the original notice so the two records can be reviewed together.
3. Check for an explanation before alleging an error
Ask whether the difference could be explained by a recent address change, a transfer of jurisdiction, a centralised or special unit, a pending proceeding under an earlier Act, or an order assigning the case to another officer. Review prior correspondence and any jurisdiction or transfer order available to you. If you cannot locate the explanation, state that fact in the objection and ask the Department to identify the authority and order on which the officer relies.

Section 124 of the Income-tax Act, 1961 deals with an Assessing Officer’s jurisdiction. It contains area-based rules, identifies the senior tax authority or authorities who determine jurisdiction questions, and imposes time limits on challenges. The deadline is not a universal number that can safely be given without examining the taxpayer’s procedural history, the notices served and the return position.
Section 124(4) states:
“Subject to the provisions of sub-section (3), where an assessee calls in question the jurisdiction of an Assessing Officer, then the Assessing Officer shall, if not satisfied with the correctness of the claim, refer the matter for determination under sub-section (2) before the assessment is made.”
The practical consequence is important. If you raise the question and the AO does not accept your position, the provision contemplates a referral for determination before the assessment is made. That does not mean the objection will automatically succeed, nor does it convert every administrative mismatch into a jurisdictional defect. Read the full statutory text, including the timing provisions in section 124(3), at the Department’s section 124 page.

How to submit a jurisdiction objection
1. Draft a focused written objection
Identify the notice by date, section, reference number and tax period. State the jurisdictional AO shown by the Know Your JAO result and the officer named in the notice. Then describe the precise inconsistency: for example, a different area, AO type, range, number or address. Explain why the difference matters on the facts available to you and attach the documents that support the comparison.
Recommended Free Tools
For a 1961 Act proceeding, cite section 124 and say that the objection is being raised within the applicable statutory period, if you have verified that this is so. If the timing is uncertain, do not make an unsupported assurance; state the relevant service and procedural dates and ask the authority to consider the objection under the applicable provision.
2. Use the channel specified for the proceeding
Submit the objection through the official response facility, e-filing workflow, email address or physical submission route identified in the notice or current Department instructions. Do not send sensitive tax records to an unverified address found through a general web search. If more than one official route is available, use the route that produces a submission acknowledgement and retain the acknowledgement, timestamp, uploaded files and any delivery proof.
3. Continue with the substantive response
A jurisdiction objection is not a safe reason to miss the notice’s stated response deadline. The official material available for this issue does not establish a universal rule that an objection pauses every reassessment deadline. Unless the Department or a competent authority tells you otherwise, submit the required response and documents on time while expressly reserving the jurisdiction objection.
4. Follow up without changing the record
Keep one chronological file containing the notice, JAO result, objection, attachments, acknowledgements, replies and call or meeting notes. If the Department asks for clarification, answer the request in writing and refer back to the original objection. Avoid filing contradictory versions through different channels; if a correction is necessary, label it as a supplementary submission.

What evidence should accompany the objection?
- the complete reassessment notice and proof of service;
- the dated Know Your JAO result showing the PAN-linked details;
- the relevant income-tax return acknowledgement and address information;
- earlier assessment orders, notices or correspondence showing a different AO;
- any order recording transfer, change of jurisdiction, delegation or assignment;
- documents establishing the address, place of business or other fact on which the jurisdiction rule may turn; and
- the acknowledgement proving when and how the objection was submitted.
Send only material relevant to the jurisdiction question and the underlying response requirement. A clear index helps the receiving officer identify the alleged mismatch without searching through unrelated records.
Does a wrong jurisdictional officer automatically void the notice?
No categorical conclusion is established by the official materials cited here. A difference between the notice and the JAO lookup is a reason to verify the record and raise the issue promptly, but it does not prove that the notice is automatically invalid. The legal result can depend on the type of jurisdictional defect, the applicable Act, the taxpayer’s procedural history, the timing of the objection and any orders or delegations in the file.
That distinction matters because taxpayers sometimes treat a portal mismatch as a complete defence and stop responding. That approach can create a separate procedural problem if the notice remains operative while the jurisdiction question is being considered. Conversely, silently complying without preserving the objection can make it harder to establish that the issue was raised within the statutory period. A written, timely reservation protects both positions more effectively than either assumption.

- the notice concerns several years or more than one PAN or entity;
- the officer has changed since an earlier order or the case has been transferred;
- the notice refers to a special unit, centralised function or delegation that is not explained in the JAO result;
- the objection deadline may already have passed;
- the tax period falls near the 1 April 2026 transition between Acts;
- you have already filed a response, attended a hearing or received an adverse order; or
- the issue could affect a pending assessment, penalty or recovery action.
Give the adviser the full chronology, not just a screenshot of the officer’s name. The relevant question is whether the officer had lawful jurisdiction for this proceeding at the relevant time and whether the objection was raised in the manner and period required by the governing law.

Common mistakes to avoid
Ignoring the notice
Not responding does not establish that the officer lacked jurisdiction. It can leave the taxpayer exposed to the consequences of missing the stated deadline.
Relying on the name alone
Names and designations can change. Compare the full jurisdiction fields and investigate transfers or assignments.
Using the wrong Act or section
A proceeding governed by the 2025 Act should not automatically be described using the 1961 Act’s section 124 procedure. Confirm the period and the notice language first.
Assuming an objection extends time
The available official guidance does not establish that filing a jurisdiction objection suspends every other deadline. Continue responding unless an authorised instruction says otherwise.
Making an unsupported invalidity claim
State the mismatch and request determination. Whether the defect invalidates the notice is fact-specific and may require review of jurisdiction orders and procedural history.
