What to Do if Your Income-Tax Penalty Waiver Application Is Rejected

A rejected penalty-waiver request is not necessarily the end of the matter. Start with the denial notice: identify the tax authority, penalty and tax period, exact review or appeal right, destination, and deadline. Then use the procedure that applies to that authority, explain precisely what the first decision missed or misunderstood, and attach evidence that connects your circumstances to the filing or payment failure.

Deadlines and remedies are jurisdiction-specific. The examples below cover the United States, Canada, and a limited United Kingdom overview; your current notice controls if it differs.

Start with the denial notice, not a generic appeal form

Read every page of the decision and save the complete notice, envelope, or electronic notification record. The document usually tells you more than a general web search: which penalty was considered, the tax period, why relief was refused, where a response must go, whether a formal review is available, and the last day to act.

  • Record the controlling date. Write down the date printed on the decision, the date you received it, and the stated deadline. Use the authority’s definition of “received” or “date of notice” if the letter explains one.
  • Identify the exact liability. Separate an income-tax penalty from interest, a payroll or sales-tax penalty, and the underlying tax assessment. Different units and appeal routes can apply.
  • Preserve proof. Keep the original notice, all pages and enclosures, your first waiver request, delivery confirmations, account transcripts, and a copy of anything you submit next.
  • Calendar a safety date. Set an earlier internal deadline so a missing document or postage problem does not consume the authority’s filing window.

If the notice gives no clear route, contact the authority using the number or address printed on that notice and ask what procedure applies. Do not assume that a request for discretionary penalty relief extends the deadline to challenge the tax assessment itself.

Determine what was denied

Penalty relief

A waiver or abatement request asks an authority to cancel or reduce an assessed penalty under its relief rules. The authority may consider reasonable cause, an administrative waiver, a statutory exception, compliance history, or circumstances beyond your control. Approval is discretionary or conditional in many cases; satisfying one listed factor does not guarantee relief.

The underlying assessment

If you believe the tax, income, deduction, or filing position itself is wrong, that is usually a separate objection or appeal. A penalty-relief request may leave those deadlines untouched. Review the assessment notice and its objection instructions at the same time, and file the appropriate challenge separately when required.

Jurisdiction determines the next step

Authority After a penalty-relief denial Timing and important limits
United States — Internal Revenue Service An eligible taxpayer may request an Independent Office of Appeals conference or hearing when the written denial grants appeal rights. The IRS describes a general 30-day period from the rejection letter; the specific letter’s deadline controls.
Canada — Canada Revenue Agency Ask for a second administrative review with a focused explanation and relevant new facts, documents, or correspondence. Judicial review in Federal Court is a separate option. Federal Court judicial review generally must be brought within 30 calendar days after receiving the decision. The CRA recommends seeking a second review first.
United Kingdom — HM Revenue and Customs For direct-tax decisions and penalties, appeal to HMRC first before a review. For indirect-tax decisions and penalties, HMRC can offer a review with the decision. The tax type and decision notice determine the current route and deadline; follow that notice.

These are examples, not a universal timetable. A different country, state, province, tax, or penalty can use a different form, deadline, or tribunal.

United States: appealing an IRS penalty-relief denial

Check whether the IRS appeal conditions fit

IRS penalty-appeal guidance describes a pathway for an assessed individual or business failure-to-file and/or failure-to-pay penalty. The taxpayer must have made a written request to remove the penalty, received a denial, and received a denial letter that gives appeal rights. If those conditions are present, the IRS says, “You generally have 30 days from the date of the rejection letter to file your request for an appeal.” Treat the letter’s own date and instructions as controlling if they differ from the general statement.

Build the written request around the denial reason

Request the Independent Office of Appeals conference or hearing using the method and address in the denial. Identify the tax, tax period, notice number, penalty type, and date of the decision. State that you are requesting Appeals consideration of the penalty-relief denial, then address each reason the IRS gave.

Reasonable-cause arguments are strongest when they show ordinary business care and prudence, the specific event that prevented timely filing or payment, the dates involved, and the actions taken once compliance became possible. IRS examples include death or serious illness, fire or another disaster, inability to obtain necessary records, mistakes, and reliance on erroneous advice. An example alone is not enough: connect the event to the missed act and explain why a reasonable taxpayer could not meet the deadline.

  • Medical records, hospital or death records, and a dated explanation can support illness or death claims.
  • Insurance, government, employer, or emergency records can document a disaster or loss of access.
  • Requests for records, third-party correspondence, and a chronology can show why documents were unavailable.
  • Written professional advice, engagement records, and your actions after discovering the error can support an erroneous-advice explanation, although reliance does not automatically qualify.

If no standard example fits, provide detailed facts and circumstances for Appeals to consider. Include evidence of subsequent compliance, such as a corrected filing or payment arrangement, only as context; it does not replace proof of the original cause.

Know where Form 843 fits

IRS penalty-relief options include first-time abatement, an administrative waiver, reasonable cause, and statutory exceptions. Some requests can be handled by telephone. If the IRS cannot approve relief by phone, its guidance says a written request may be made using Form 843, Claim for Refund and Request for Abatement. That form is a relief-request mechanism; an appeal after a denial must follow the appeal instructions in the denial letter rather than assuming that filing Form 843 alone creates an Appeals case.

Canada: request a CRA second review

Explain what the first decision missed

The CRA treats taxpayer relief separately from an objection or court appeal of an assessment. If you disagree with a taxpayer-relief decision, ask for a second administrative review. Explain specifically why the decision should be reconsidered: relevant information may not have been considered, facts may have been misunderstood, or documents may have been taken out of context. Include new facts, records, or correspondence that directly answer the reasons for refusal.

A different official conducts the second review. Organize the submission so that reviewer can verify each point without reconstructing your file:

  1. Identify the decision, tax years, penalties, and date you received it.
  2. Quote or accurately summarize each material reason for refusal.
  3. Under a separate heading for each reason, state the correction and cite the attached evidence by page or document name.
  4. Explain the relief requested and the amount or periods affected.
  5. Describe any steps taken to prevent a recurrence, such as filing missing returns or arranging payment.

Address the CRA’s stated factors

CRA guidance says it may consider your filing and payment history, the care used in managing tax affairs, whether you knowingly allowed a balance to remain, and how quickly you corrected a delay or omission. Possible circumstances include events beyond your control, CRA actions, specified financial hardship or inability-to-pay situations, and other relevant circumstances. Present facts and dates; the existence of a listed circumstance does not guarantee relief.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Plan for interest and a long review

CRA guidance states that interest continues to accrue on an amount owing while a relief request is being reviewed. Paying all or part of the balance reduces the interest charged; related interest may be cancelled if relief is granted. Consider your cash position and obtain current payment instructions rather than allowing avoidable interest to accumulate.

The CRA’s taxpayer-relief page has reported an average processing time of approximately 16 months. That is an estimate, not a promise: complexity, tax years, programs, completeness, and request volume can make the actual period shorter or longer. Check the current processing-time information when you submit and retain proof of delivery.

Consider Federal Court judicial review carefully

If you consider the decision unfair or unreasonable, CRA guidance says you may apply to the Federal Court for judicial review within 30 calendar days after receiving the decision. The CRA recommends requesting a second administrative review first. Judicial review examines whether the decision was made lawfully and reasonably; it is not a general promise that the court will replace the CRA’s decision with the outcome you prefer. Court procedure and filing requirements are technical, so obtain legal advice promptly if this route is under consideration.

United Kingdom: confirm whether the matter is direct or indirect tax

GOV.UK distinguishes between tax types. For direct-tax decisions and penalties, you must appeal to HMRC first before obtaining a review. For indirect-tax decisions and penalties, HMRC offers a review when it sends the decision. Because the route and time limit depend on the tax and the wording of the decision, use the notice’s instructions and current HMRC contact details. Do not transplant the IRS 30-day or CRA 30-calendar-day rule into an HMRC case.

Assemble a convincing review package

A reviewer needs a short, verifiable account, not a long personal narrative. Use this order:

  1. One-page chronology. List the filing or payment due date, the event that interfered, when you learned of the problem, every contact with the authority, and when you corrected it.
  2. Decision analysis. For each refusal reason, state whether the fact was missing, misunderstood, or unsupported in the original submission.
  3. Evidence index. Number attachments and identify the exact date, issuer, and fact each document proves.
  4. Relief rule. Name the applicable reasonable-cause, waiver, exception, or taxpayer-relief basis without claiming that eligibility is automatic.
  5. Specific request. Ask for cancellation, reduction, or reconsideration of the named penalty and periods. If partial relief is appropriate, say so.

Write plainly, avoid blaming language, and disclose unfavorable facts that the reviewer will see in the account. Acknowledging the error while explaining why it occurred is more useful than asserting that the penalty is unfair without evidence.

Submission and follow-up checklist

  • Use only the address, portal, fax, or other method stated in the decision or current official instructions.
  • Submit before the deadline; do not wait for a missing document if the authority permits a timely response followed by supplements.
  • Keep the complete signed or uploaded copy, attachment index, transmission receipt, and confirmation number.
  • Monitor the account and postal or electronic messages for requests for information.
  • Respond by the stated date and keep a log of every call, including the representative’s name or identification number when provided.
  • If the authority rejects the request as late, ask whether a late-filing explanation or extension process exists; do not assume one is available.

Common mistakes that weaken a second request

  • Sending the same waiver letter again without answering the denial’s reasoning.
  • Arguing only that the penalty is large or causes hardship when the applicable rule requires a qualifying cause.
  • Confusing interest with the penalty or asking a relief unit to correct an assessment that must be challenged elsewhere.
  • Missing the deadline because you are waiting for professional advice or additional records.
  • Providing undated screenshots or summaries that cannot establish what happened during the relevant period.
  • Assuming a pending request stops collection, interest, or another appeal clock without written confirmation from the authority.

When professional help is worthwhile

Consider a qualified tax professional when the balance is substantial, several years or tax types are involved, the facts are disputed, or a court review may be needed. Ask the adviser to review the denial notice and deadline first, not merely prepare a generic abatement letter. In the United States, IRS materials identify Low Income Taxpayer Clinics as a possible public-help resource for eligible taxpayers. A clinic or adviser can also help preserve a separate assessment objection while the penalty-relief issue is reviewed.

Bottom line

Use the denial notice as your roadmap. Preserve the deadline, separate penalty relief from an assessment challenge, and submit a focused response that fixes the first request’s factual or evidentiary weaknesses. IRS cases may lead to an Appeals conference when the letter grants that right, CRA cases can proceed to a second review and potentially Federal Court judicial review, and HMRC routes depend on direct versus indirect tax. Follow the authority and tax type named on your own notice rather than borrowing another jurisdiction’s procedure.
