If your home would sell for less than the amount needed to pay off your mortgage, contact your mortgage servicer promptly. This “underwater” or “negative equity” position is a financial condition, not a command to sell, stop paying, or abandon the property. Ask the servicer to review every loss-mitigation option for your loan and situation, and contact a HUD-approved housing counseling agency for free help. If you have been served legal papers or foreclosure appears imminent, consult a qualified lawyer in your state.
What “underwater” means
A home is underwater when its current market value is below the balance required to satisfy the mortgage and any other loans secured by the property. For example, if a realistic sale price is $280,000 and the mortgage payoff is $310,000, the property has approximately $30,000 of negative equity before selling costs, commissions, taxes, or junior liens.

Negative equity alone does not make you delinquent, trigger foreclosure, or require an immediate sale. You can often remain in the home while making payments. The urgent issue is whether the payment is affordable now and likely to remain affordable, and what happens if you cannot pay.

1. Call the mortgage servicer before the problem becomes a foreclosure case
Use the phone number on your mortgage statement and ask for the loss-mitigation or home-retention department. Explain whether your income reduction or expense increase is temporary or permanent, when it began, and whether you are current, late, or already in a workout plan. Ask which options are available for your specific loan, who owns or guarantees it, and what documents are required for a complete application.

Keep a dated record of every call, the representative’s name or identification number, promised follow-ups, and documents sent. Continue making the payments you can afford unless your servicer gives you different written instructions. A telephone conversation is not approval; request proposed terms in writing and review them before signing.
2. Assemble a complete financial packet
Preparation helps the servicer evaluate the application without avoidable delays. Gather:
- Recent pay stubs, benefit statements, tax returns, or other income records for everyone responsible for the loan.
- A monthly list of essential expenses, debts, insurance, property taxes, and household costs.
- Bank, retirement, and other asset statements.
- The mortgage statement, loan number, current payoff information, and details of any home-equity loan, second mortgage, judgment, or tax lien.
- A short hardship explanation, including dates, whether the hardship is temporary or permanent, and documents such as medical, employment, or disaster records when relevant.
- Military permanent-change-of-station orders if a service-related move affects the request.
The Consumer Financial Protection Bureau (CFPB) lists these categories in its “If I can’t pay my mortgage loan, what are my options?” guidance, last reviewed August 28, 2026. Your servicer may request additional forms or a specific income-and-expense worksheet.

4. Get legal help when the stakes are immediate
If you receive a summons, complaint, notice of sale, or other legal paper, or if a foreclosure sale may be scheduled soon, contact a foreclosure or mortgage lawyer licensed in your state. Foreclosure procedures, deadlines, and defenses vary by location. A counselor can help with the workout process, but is not a substitute for legal advice.
Compare the main paths
The right choice depends on affordability, loan type, lien structure, timing, and the written terms offered. No option is automatically best for every underwater borrower.
| Path | Can you remain in the home? | Approval and lien issues | Questions to resolve |
|---|---|---|---|
| Refinance | Usually yes | New-lender and program eligibility; negative equity can make qualification difficult | New payment, rate, closing costs, total interest, and whether any subordinate liens consent |
| Loan modification | Usually yes | Servicer or investor approval; complete application normally required | New payment, term length, fees, capitalization of missed amounts, and total amount owed |
| Repayment plan | Yes if affordable | Servicer agreement | How the arrears are added, payment duration, and consequences of a missed plan payment |
| Forbearance | Usually temporarily | Servicer agreement; a pause or reduction is not forgiveness | End date, repayment method, interest treatment, and payment after the pause |
| Short sale | No after closing | Mortgage servicer approval; every other mortgage secured by the home may also need approval | Deficiency balance, taxes, sale costs, move-out terms, and written releases |
| Deed-in-lieu | No after transfer | Mortgage company acceptance; junior liens and other title problems must be addressed | Debt cancellation, deficiency, lien releases, move-out date, and property condition requirements |
| Foreclosure | Only until legal process ends | Process and timing depend on state law and loan documents | Deadlines, possible defenses, remaining debt, tax effects, and housing after sale |
If keeping the home is realistic
Refinance
A refinance replaces the existing mortgage with a new loan. Ask whether your loan type and equity position qualify, what appraisal or documentation is required, and whether closing costs would erase any payment savings. A lower payment can still cost more over time if the new term is longer. A refinance is not a guaranteed solution for an underwater property, and a second lien may need separate consent or payoff.
Loan modification
A modification changes the existing loan terms rather than replacing the loan. CFPB’s “Mortgage answers: key terms” explains that a modification may extend repayment, reduce the interest rate, or forbear or reduce some principal under the terms offered. Ask for a written estimate of the new payment, escrow amount, interest rate, maturity date, fees, and total amount owed. A lower near-term payment can increase the total paid or leave a balance due later.

Repayment plan
If the hardship has ended and you can afford the regular payment plus an additional amount, the servicer may let you catch up over a defined period. Confirm the exact arrears included, the duration, and whether a failed plan returns the loan to delinquency or foreclosure review. Do not accept a payment that leaves no room for ordinary expenses.
Forbearance
Forbearance temporarily pauses or reduces payments. It does not by itself erase the missed amount. Before agreeing, obtain the end date, interest and escrow treatment, and the required repayment method, such as a lump sum, higher payments, a modification, or another approved arrangement. Ask what happens if your income is still reduced when forbearance ends.
If selling or leaving is necessary
Short sale
In a short sale, the home is sold for less than the mortgage payoff and the servicer agrees to accept the sale proceeds under specified conditions. CFPB guidance says the servicer must approve the transaction and that other mortgage servicers must also approve it when additional mortgages are secured by the property. A complete loss-mitigation application and an acceptable purchase contract may be required.

Deed-in-lieu of foreclosure
A deed-in-lieu transfers title voluntarily to the mortgage company in exchange for an agreement to avoid foreclosure. It can be simpler than marketing a property, but acceptance is discretionary and title must be transferable. Obtain exact written terms covering whether the debt is fully canceled, whether a deficiency can be pursued, how junior liens or judgments are treated, the move-out date, property condition, and any relocation assistance. A deed-in-lieu does not automatically eliminate another lien or guarantee a particular credit or tax result.
Foreclosure
Foreclosure is the legal process used to enforce the mortgage after default. Walking away without communicating does not eliminate the loan, lien, legal deadlines, or possible tax and deficiency issues. If you cannot reach an affordable arrangement, ask the servicer in writing what alternatives remain and seek state-specific legal advice. Keep every notice, even if you believe the balance exceeds the property value.

Junior liens and other claims
A home-equity line, second mortgage, judgment, unpaid property tax, condominium assessment, or contractor lien can block a sale or transfer. List every claim on title before choosing a short sale or deed-in-lieu. Each lienholder may require separate consent, payment, or release. A first-mortgage agreement cannot automatically bind a different creditor.
Credit, taxes, and transaction costs
Any delinquency, modification, short sale, deed-in-lieu, or foreclosure may be reported and may affect future borrowing, but the precise effect depends on reporting and your circumstances. Selling also involves commissions, transfer taxes, repairs, insurance, and moving costs. Cancellation of debt can create tax questions, with exceptions that depend on federal and state law. Have a tax professional review the written settlement terms rather than relying on a general internet statement.

Recognize foreclosure-rescue scams
CFPB warns about companies that demand an upfront fee, promise guaranteed modified terms or guarantee that you will not lose the home, pressure you to sign over title, present documents you do not understand, tell you to redirect payments away from the mortgage servicer, sell a “forensic audit,” or instruct you to stop paying. These are warning signs, not legitimate requirements for a loss-mitigation review.
- Work directly with your servicer and a HUD-approved counselor before paying anyone.
- Never transfer title or sign a power of attorney without independent legal advice.
- Send payments only through verified servicer channels and keep confirmation numbers.
- Read every agreement for fees, deficiency language, deadlines, and cancellation rights.
- Report suspected fraud to the appropriate consumer-protection authorities and notify your servicer.
Loan type and location matter
Eligibility is not determined by negative equity alone. Ask whether the loan is FHA, VA, USDA, conventional, or another product; who owns or guarantees it; whether mortgage insurance applies; and what state’s foreclosure and deficiency rules govern. HUD’s “FHA’s Loss Mitigation Program” describes FHA-specific retention and disposition tools, including an eligible pre-foreclosure sale when the value does not repay the loan. Do not assume an FHA option applies to a conventional, VA, USDA, or other mortgage.
Tell the counselor and servicer whether foreclosure has started, whether there are junior liens, and whether the property is your primary residence, rental, or vacant. Those facts can affect available programs, documents, timelines, and tax analysis.
A practical decision sequence
- Stabilize the facts: estimate a realistic current value, obtain a mortgage payoff, and list every lien and monthly housing cost.
- Measure affordability: calculate what you can pay now and after a temporary hardship, leaving room for taxes, insurance, repairs, and basic living expenses.
- Submit a complete request: provide the servicer’s forms and supporting records, then ask for a written acknowledgment and a list of anything missing.
- Compare written offers: evaluate payment, total debt, term, fees, approval conditions, lien treatment, deficiency, taxes, credit implications, and deadlines.
- Use independent review: have a HUD-approved counselor check the numbers; obtain legal or tax advice when papers, title, deficiency, or cancellation of debt is involved.
- Meet every deadline: keep copies, respond promptly, and escalate through the servicer’s designated complaint process if documents are lost or no decision arrives.
Special case: an underwater reverse mortgage
Do not apply ordinary forward-mortgage rules to a reverse mortgage. CFPB’s page “What happens if my reverse mortgage loan balance grows larger than the value of my home?” addresses Home Equity Conversion Mortgages (HECMs), the common reverse-mortgage type, and was last reviewed July 11, 2022. In the circumstances described there, mortgage insurance can cover a balance above the appraised value when the home is sold for its appraised fair market value. In the stated inheritance situation, heirs may have a 95%-of-appraised-value cap. Those protections are HECM-specific and conditional; review the loan documents and contact the servicer before assuming they apply.
This article is U.S.-focused general information, not individualized legal, tax, or financial advice. The safest first move is prompt, documented contact with the servicer, followed by free HUD-approved counseling and state-specific professional advice when legal papers, title issues, or a potential deficiency are involved.
