What to do if your home equity loan application is delayed or denied

By TheFinanceBase Team 9 min read

First, ask the lender to state whether your file is complete, list every outstanding item or third-party step, and give you the date of its next update. Send documents only through the lender’s secure channel and keep proof of delivery. If the application is denied, read the adverse-action notice, obtain the specific principal reasons, check any credit information used, and ask whether corrected information can be reconsidered or whether you must submit a new application.

This guidance applies to applications in the United States. Federal rules set notice requirements, but they do not guarantee approval, a particular processing time, or a reconsideration. State laws may add protections.

Start by establishing exactly where the application stands

A “delay” can mean the lender is still collecting information, waiting for a valuation or title work, reviewing a lien issue, or deciding the file. Do not rely on a general promise that the loan is “under review.” Ask for a status that you can document.

Questions to send the lender

  • Is my application complete under your process?
  • What exact documents, signatures, or actions are still outstanding?
  • When did you receive each item I already sent?
  • Is a valuation, title search, lien review, or another third-party step pending?
  • What is the expected date of the next update?
  • Does any deadline or quoted term depend on my response?

Request the answers in writing through the lender’s portal, secure message system, or another channel it specifies. Send requested income, asset, identity, property, or insurance records in the format requested, retain copies, and ask the lender to confirm receipt. This process advice helps prevent a document from sitting in an unread mailbox; it is not a promise that the lender must approve or close the loan by a particular date.

Keep a timeline

Record the application date, every document submission, the name of the employee or department contacted, promised follow-up dates, valuation appointments, and any changes to the requested amount or terms. Save notices and portal screenshots. A clear timeline helps you identify whether the file is waiting for you, waiting for a vendor, or past a required notice period.

Know when the federal 30-day notice rule applies

Under Regulation B, the creditor’s general 30-day period to notify you of the action taken begins after it has received all information it normally considers in making the credit decision. The Consumer Financial Protection Bureau’s official interpretation states: “Once a creditor has obtained all the information it normally considers in making a credit decision, the application is complete and the creditor has 30 days in which to notify the applicant of the credit decision.”

That is a decision-notice rule, not a guarantee that the loan will be funded, that underwriting will finish within 30 days of your first contact, or that an approval will have a particular rate. If the lender is still waiting for information that you can provide, the application may not yet be complete for this purpose.

If the lender says the application is incomplete

When information you can provide is missing and the creditor does not have enough information to decide, Regulation B generally allows two paths within 30 days after receiving the application: it may deny the application for incompleteness, or it may send a written notice identifying the missing information, giving you a reasonable period to supply it, and warning that the application may receive no further consideration if you do not respond.

The notice’s response period is not a universal 30-day borrower deadline. Ask the lender to identify each missing item in writing and state the actual response date. If the creditor had enough information to decide for another reason, it cannot simply describe that decision as an “incomplete application.” If the lender says the file is denied, request the principal reasons rather than assuming the missing-document explanation is the whole decision.

What to do when the application is denied

Read the adverse-action notice immediately

Note the date you received the notice, the stated reasons, whether a credit-reporting company is named, and any instructions or deadlines. A usable notice should state the specific principal reasons for the denial. If it gives only a right to request the reasons, make that request promptly and no later than 60 days after the notice. Keep the request and proof that you sent it.

The CFPB’s interpretation explains that when credit is denied, “missing information or ‘incomplete application’ cannot be given as the reason for the denial” if the creditor had enough information to make a decision. The purpose of requesting specific reasons is to learn what actually drove the outcome, not to force the lender to change its underwriting standards.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Follow the credit-report instructions

If the notice says credit information contributed to the decision, it should identify the reporting company, provide the score used and the key factors affecting that score, and explain how to obtain the free report associated with the notice. Obtain that report from the named company within the period stated in the notice.

Compare each account, balance, limit, payment status, date, and public-record entry with your own records. Dispute specific inaccuracies with both the reporting company and the business that supplied the information. Include documents that support the correction and keep copies of the disputes and delivery confirmations. A corrected report can improve the accuracy of the file, but it does not automatically entitle you to approval.

Ask about reconsideration or a new application

After correcting an error or supplying an overlooked document, ask the lender in writing:

  • Will underwriting review the corrected information on the existing file?
  • What documentation does it require?
  • Will the lender issue a revised decision, or must you submit a new application?
  • Could a new application affect the timing, fees, credit inquiry, or offered terms?

Do not assume that filing a credit dispute pauses the lender’s decision or preserves an offer. Get the lender’s answer before allowing a quoted term or commitment period to expire.

Separate a home equity loan from a HELOC

A closed-end home equity loan usually provides a lump sum with scheduled repayment. A home equity line of credit (HELOC) is revolving credit: you may draw during a draw period and then repay under the line’s terms. Both are secured by your home, but their disclosures and payment behavior differ.

The CFPB states that HELOC applicants do not receive a Loan Estimate or Closing Disclosure. Instead, they receive Truth-in-Lending disclosures. For covered mortgage applications, a Loan Estimate is generally due within three business days, unless the lender denies the application before that third business day. Confirm which product you applied for and which disclosure rules apply before concluding that a document is missing.

Issue Closed-end home equity loan HELOC
How funds are accessed Usually a lump sum at closing Revolving line with draws during an available period
Disclosure path described by CFPB guidance Covered mortgage applications generally use a Loan Estimate and Closing Disclosure No Loan Estimate or Closing Disclosure; Truth-in-Lending disclosures apply
Rate and payment structure to examine Review whether the rate is fixed or otherwise specified, the scheduled payment, fees, and repayment period Review draw-period rules, variable-rate changes, minimum payments, and the repayment period after draws end

These are product characteristics, not promises about a particular lender’s terms. Obtain current written disclosures before choosing between them.

If you suspect the property valuation is the problem

A lender may use an appraisal, an automated valuation, or another valuation method. Ask which method was used, whether you can review or discuss the material, whether the lender accepts a reconsideration request, and what evidence it wants. Factual corrections, photographs, records of improvements, and relevant comparable sales may be useful if the lender accepts them.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Be precise about lien position. The Regulation B appraisal-copy rule cited by the CFPB covers applications for credit secured by a first lien on a dwelling. A typical home equity loan is subordinate to an existing mortgage, so that rule does not automatically guarantee a copy for every home equity loan. Ask the lender which valuation-disclosure and review rules apply to your transaction rather than treating the absence of a copy as proof of a violation.

Decide whether to try another lender or product

A denial does not mean another creditor will reach the same result, because underwriting standards, valuation methods, allowable debt-to-income ratios, and product structures differ. It also does not mean another application is automatically wise. Compare the complete obligation, not just the advertised interest rate.

Comparison point Why it matters
Total fees and closing costs Origination, appraisal, title, recording, annual, or early-termination charges can change the effective cost.
Fixed or variable rate A variable rate can raise the payment; test the budget at a less favorable rate.
Payment and repayment period A lower initial payment may result from a longer term, interest-only period, or later payment increase.
Lump sum versus revolving credit Borrow only what is needed with a lump sum; a line offers flexibility but can encourage additional borrowing.
Lien priority and foreclosure consequences Both products put the home at risk if required payments are not made; understand how the new lien ranks with the existing mortgage.
HELOC draw and repayment terms Confirm the draw-period end date, repayment rules, rate adjustments, and any minimum or balloon payment features.
Ability to repay under stress Test the payment against reduced income, higher rates, repairs, taxes, insurance, and existing debts.

Ask each lender for written terms and compare the same borrowing amount and assumed term. Approval and pricing remain subject to that lender’s underwriting.

Use housing counseling and escalation channels carefully

HUD-approved housing counseling

If the denied amount would have been needed for a major expense or you are unsure whether the payment is affordable, a HUD-approved housing counselor can help review income, debts, repayment capacity, and alternatives. Counseling does not guarantee a loan or override a lender’s decision; its value is an independent review of the financial choice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Complaints and possible discrimination

The Equal Credit Opportunity Act covers home equity loan applications. If the facts suggest discrimination or another legal violation, preserve the application, notices, dates, valuation materials, credit reports, and communications. You can consider a complaint through the CFPB and review protections available under your state’s law. A regulator or counselor can help you evaluate a specific situation, but a delayed or denied application alone does not establish unlawful conduct.

When to stop pursuing the loan

Pause before reapplying if the requested payment would strain your budget, the purpose of borrowing is uncertain, or the home’s value and existing debt leave little equity. A second application can add fees or credit inquiries without solving the underlying affordability problem. Reassess the amount, purpose, and repayment plan before submitting another file.

A practical response sequence

  1. Write to the lender for a complete/incomplete status, every outstanding item, receipt dates, pending third-party work, and the next-update date.
  2. Submit only the requested documents through the specified secure channel and retain delivery evidence.
  3. If denied, save the adverse-action notice and identify the reasons, credit-reporting company, and deadlines.
  4. Request specific principal reasons when the notice requires a request, and do so within the notice’s stated period.
  5. Obtain the named credit report, dispute documented inaccuracies with both the reporting company and the information furnisher, and keep the dispute record.
  6. Ask whether corrected information will be reconsidered on the existing file or requires a new application.
  7. Review affordability and compare the total structure of another lender or a HELOC before applying again.
  8. Preserve records and consider CFPB or state channels if the process suggests discrimination or another legal violation.

Deadlines and notices at a glance

Item What the rule or guidance says What it does not mean
Decision notice Generally within 30 days after the creditor has all information it normally considers and the application is complete It is not a promise of approval, closing, or funding within 30 days of first contact
Incomplete application notice Within 30 days after receiving certain incomplete applications, the creditor generally must deny for incompleteness or identify missing information and provide a reasonable response period The borrower’s response period is not universally 30 days
Request for denial reasons When the notice offers a right to request reasons, request them within 60 days Requesting reasons does not require the lender to reverse its decision
Free report after credit-based denial Use the period stated in the notice, described in CFPB guidance as 60 days, to obtain the identified report Correcting a report does not guarantee approval
Loan Estimate Generally due within three business days for covered mortgage applications unless denied before that third business day HELOC applications follow a different disclosure path and do not receive a Loan Estimate or Closing Disclosure
