What to Do if Your GST Appeal Is Dismissed for a Pre-Deposit Shortfall

Do not assume a dismissed GST appeal is the end of the case. First obtain the complete dismissal order, record the date it was communicated, and identify whether the case was a first appeal under section 107 or a later appeal. Then reconcile the required pre-deposit with the disputed-tax figure in the original order and your challans, electronic ledgers and appeal acknowledgement. If the authority dismissed the appeal without telling you about an alleged shortfall or giving a reasonable chance to correct it, request correction or restoration immediately and obtain advice on a jurisdiction-specific challenge. The Bombay High Court’s decision in G Khanna and Company v Union of India (23 September 2025) supports an opportunity to cure on the facts before that court, but it does not guarantee restoration in every state or case.

Start with the dismissal order, not the portal status

A portal message such as “appeal rejected” does not tell you why the matter was closed or which remedy remains available. Download the signed order and every annexure. Note:

  • the authority that passed it and the statutory provision cited;
  • whether it concerns a first appeal to the Appellate Authority under section 107, a Tribunal matter under section 112, or another stage;
  • the date on which the order was communicated to you, including the electronic communication record;
  • the tax period, demand order and appeal number involved; and
  • the stated reason: no payment, an insufficient amount, payment in the wrong head or mode, an unposted payment, or missing evidence.

The communication date is critical. Limitation normally runs from communication, not from the date printed on an order that reached you later. Preserve the email, portal download receipt, acknowledgement and system logs that establish when you actually received it.

Separate a dismissal from an order on the tax merits

A pre-deposit dismissal is usually a threshold or procedural decision. It may leave the original assessment or demand in force without deciding whether the tax was correctly imposed. Your next filing therefore needs to address the deposit defect and the route of appeal, while preserving the substantive grounds against the demand.

Recalculate the amount that was actually required

For a first appeal under section 107(6) of the Central Goods and Services Tax Act, 2017, the appellant must pay the full amount of tax admitted as payable and an amount equal to 10% of the remaining amount of tax in dispute arising from the order. The percentage is not applied to an assumed total demand. Rebuild the calculation from the order and your grounds of appeal.

Use the order’s disputed-tax numbers

  1. Identify the tax amount you expressly admit, if any, and calculate that amount in full.
  2. Identify the tax portion you contest. Apply the statutory percentage to that remaining disputed tax.
  3. Keep tax separate from interest, penalty and fees unless the applicable statutory text or order expressly treats an item differently.
  4. Check whether an amendment, special provision or transitional rule applies to the relevant period and appeal stage.
  5. Compare your calculation with the amount shown in the appeal application, payment challans and the dismissal order.

Section 107(7) provides that recovery proceedings for the balance are deemed stayed once the appellant has paid as required by subsection (6). That protection depends on a completed payment meeting the statutory condition; it is not created by an intention to pay or by an unposted challan.

Common calculation errors

  • Using the entire demand, including amounts not in dispute, as the percentage base.
  • Applying 10% to a figure that includes interest or penalty when the disputed-tax calculation is lower.
  • Forgetting the admitted tax component.
  • Relying on a departmental worksheet that uses a different tax period, order or appeal number.
  • Assuming a later payment automatically cures a limitation or pre-deposit defect without an order accepting it.

Prove what happened to every payment

Assemble a payment trail that a reviewing authority can follow without guessing. Include the challan identification number, date, amount, tax head, bank confirmation, electronic cash or credit ledger extract, debit entry, appeal acknowledgement and any correspondence with the department. Match each amount to the demand and to the appeal number.

A challan alone does not establish that the required pre-deposit was completed. The amount may have been paid under the wrong head, remained uncredited, been debited after the relevant date, or been used for a different liability. Obtain the ledger entry showing that the payment was posted in the legally accepted manner. If the payment was made through an electronic liability register, preserve the before-and-after balance and transaction reference.

Classify the defect before choosing a remedy

What the records show What it may mean Immediate response
No payment A genuine statutory shortfall Calculate the exact amount, pay if legally and practically possible, and seek acceptance or restoration while protecting the next limitation deadline.
Payment made, but amount is lower Calculation or admitted-tax error File a reconciliation explaining the correct base and attach the order, working and ledger proof.
Payment made but not posted Payment-mode or accounting problem Obtain bank and portal evidence, ask for posting or correction, and do not assume the appeal is protected until the authority accepts the payment.
Payment appears complete Possible departmental mistake or missing evidence Request correction or recall and attach a document-by-document payment trail.
No prior notice of shortfall Procedural-fairness issue Raise the absence of notice and opportunity to cure immediately; assess restoration and judicial options in the relevant jurisdiction.

Ask the original appellate authority to correct or restore the matter

Where the alleged shortfall is demonstrably wrong, or where you were never told what was deficient, send a prompt written request to the authority that issued the dismissal. Identify the order, date of communication, appeal number and precise relief sought: correction of the record, acceptance of the completed deposit, recall of the dismissal, or restoration of the appeal for decision on merits.

Attach a short calculation and indexed evidence rather than a bundle that forces the officer to search for the answer. Explain whether the defect is a missing payment, a numerical discrepancy, a posting delay or lack of notice. Request a written decision and retain proof of filing. A restoration request does not necessarily stop limitation for a Tribunal or High Court proceeding, so prepare the next statutory filing in parallel when time is running.

What the Bombay High Court decision adds

In G Khanna and Company v Union of India, decided on 23 September 2025, the Bombay High Court considered an appeal dismissed for an alleged short payment. The court held, on the facts before it, that dismissal without first giving the taxpayer notice and a reasonable opportunity to produce proof or make good the shortfall was unjustified. The reasoning can support a request for an opportunity to cure where the authority acted without warning.

The decision is not a nationwide rule that every shortfall is curable. Its force depends on the territorial court, the wording of the dismissal, the evidence of payment, whether any notice was issued and whether the taxpayer responded. Check the official judgment and subsequent treatment before relying on it, and do not present it as a promise that a court will restore your appeal.

Protect the next appeal deadline

Section 112 provides an ordinary appeal to the Appellate Tribunal from an order under section 107 or 108, generally within three months after communication. The exact maintainability of a Tribunal appeal against your particular dismissal must be checked against the order and current statutory text. Do not wait for a restoration request to be decided if the three-month period is approaching.

Tribunal deposit and stay

For the section 112 appeal, the statutory deposit includes the amount admitted and 20% of the remaining disputed tax, in addition to the amount already paid under section 107(6). Section 112(8) provides a deemed stay of recovery of the balance after the required payment. Confirm the current enacted provisions, any amendments and the amount already credited before paying.

Prescribed forms

The CGST Rules identify Form GST APL-01 for an appeal before the Appellate Authority, Form GST APL-05 for a Tribunal appeal and Form GST APL-08 for a High Court appeal. Portal labels and filing workflows can change, so use the current form and instructions displayed for your case. Supporting documents and acknowledgements should be retained with the filed form.

Compare the available routes

Route Forum and stage Timing Additional deposit Best fit Main caution
Correction or restoration request Authority that dismissed the appeal File promptly; no assumption that it extends another limitation period Pay any genuine shortfall, subject to legal advice Wrong calculation, payment evidence or no notice An administrative request may not suspend the Tribunal deadline.
Statutory further appeal Appellate Tribunal under section 112, where maintainable Generally three months from communication Admitted amount plus 20% of remaining disputed tax, in addition to the section 107(6) payment Need to preserve appellate rights while the first appeal is closed Confirm the order is appealable and calculate the deposit from the correct order.
High Court challenge Jurisdictional High Court, often through a writ or the applicable statutory appeal Depends on the remedy and facts; act without delay Not a universal substitute for the statutory deposit No notice, denial of a hearing, jurisdictional error or an exceptional procedural failure Territorial precedent and alternative-remedy rules matter; outcome is fact-specific.

The sources establish the statutory framework and one directly relevant High Court example, not a universal ranking of these routes. A lawyer should assess the order, limitation, recovery risk, payment evidence and the law of the state in which the authority sits.

Use a practical filing sequence

  1. Day one: download the order, record communication, and calculate the last possible date for each available remedy.
  2. Within the first few days: obtain the original demand order, appeal form, challans, bank confirmations and ledger extracts.
  3. Reconcile: prepare a one-page table showing admitted tax, disputed tax, statutory percentage, amount paid, date paid and posting reference.
  4. Write to the authority: request correction, restoration or an opportunity to cure, and identify the missing notice or proof if applicable.
  5. Prepare the next appeal: draft the grounds on both the procedural dismissal and the underlying tax dispute.
  6. Pay only after verification: use the correct tax head and reference, then confirm the debit and posting.
  7. File before limitation: submit the maintainable Tribunal or High Court proceeding even if the restoration request remains pending, where counsel advises that parallel protection is necessary.
  8. Monitor recovery: respond to any demand or recovery communication and provide evidence of the statutory deposit and deemed-stay condition.

When dismissal without notice is more vulnerable

A procedural challenge is stronger when the authority had the payment records, the alleged deficiency was capable of simple correction, no show-cause or deficiency communication identified the amount, and the taxpayer was denied any reasonable opportunity to respond. A court may view the case differently where a clear notice was issued, the taxpayer ignored it, the statutory amount was never paid, or the appeal was filed after limitation.

Keep the arguments distinct. “I paid the correct amount” is an evidentiary and calculation argument. “The authority never told me what was wrong” is a natural-justice argument. “The order is from the wrong forum or lacks jurisdiction” is a jurisdictional argument. Combining them without documents can obscure the strongest point.

Professional review and risk controls

GST appeal deadlines and deposits are technical, and a restoration application does not guarantee that recovery will stop. Obtain advice from a qualified GST litigation professional who can verify the current CGST Act, applicable state provisions, amendments, portal procedure and local High Court precedent. Give that adviser the complete order and communication proof, not only a screenshot of the rejection message.

  • Do not advertise a 10% or 20% figure without identifying the appeal stage and disputed-tax base.
  • Do not treat an unposted challan as a completed pre-deposit.
  • Do not assume a Bombay High Court ruling binds authorities in another state.
  • Do not let a pending correction request consume the statutory appeal period.
  • Do not promise that a writ, delayed appeal or restoration application will be accepted.

What to take to your adviser

  • the original adjudication order and complete demand calculation;
  • the dismissal order and proof of its communication date;
  • the filed appeal and acknowledgement;
  • challans, bank confirmations and electronic cash or credit ledger statements;
  • all deficiency notices, emails, portal messages and replies;
  • a chronology of payments, communications and attempted filings; and
  • your proposed calculation of admitted and disputed tax.

With those records, the adviser can determine whether the problem is curable, whether the first appeal can be restored, whether a Tribunal filing is maintainable, and whether urgent protection against recovery is needed.
