If GST authorities detain your consignment or vehicle, first secure every order and notice, record the service dates, and preserve the invoice, e-way bill and transport evidence exactly as issued. Then match each allegation to those records, file a specific objection and request the statutory hearing. If release cannot wait, compare payment with equivalent security under Section 129(1), record any protest, and obtain both the release order and the later formal demand order. The applicable state procedure and the facts of the movement can change the result, so involve a qualified GST practitioner or tax lawyer where the calculation, jurisdiction or challenge is disputed.
What to do in the first hour
- Collect the complete file. Ask the person in charge of the vehicle for the detention or seizure order, inspection record, notice, photographs or statements, and every form delivered by the officer. Record the date, exact time, place, officer’s name and designation, vehicle number, goods description and the method used to serve each document.
- Freeze the evidence. Preserve the original invoice, e-way bill and its validity or status, delivery challan where applicable, lorry receipt or other transport record, purchase and sale documents, packing details, permits and any correspondence about the movement. Do not alter, recreate or backdate a document after detention.
- Identify the parties. Establish who owns the goods, who is the consignor and recipient, who is the transporter, who is named in each notice and whether the owner has formally come forward. That last fact changes the statutory penalty alternative.
- Diary every deadline. Calculate from the dates shown on the served documents, not from an informal phone call or the date someone first heard about the interception. Perishable, hazardous or rapidly depreciating goods require immediate escalation because the normal period for disposal can be shortened.
Keep one shared, dated record for the owner, driver, transporter and tax representative. Conflicting instructions or different versions of the documents can make a factual discrepancy harder to resolve.

What Section 129 covers
Section 129 applies when goods are transported or stored while in transit in contravention of the GST Act or rules. The goods, the conveyance carrying them and related documents can be detained or seized. The provision also requires the detention or seizure order to be served on the person transporting the goods. A detention is therefore a statutory process, not permission to discard the transport trail or substitute a new invoice.

The current wording, effective from 1 January 2022, distinguishes the penalty according to whether the owner comes forward. The figures below are statutory bases, not a calculation of your particular demand. Confirm the tax payable, value, exemption status, ownership and the wording of the actual order before paying or offering security.

| Situation | Penalty basis for taxable goods | Penalty basis for exempt goods |
|---|---|---|
| Owner comes forward | 200% of the tax payable | 2% of the value of the goods or ₹25,000, whichever is less |
| Owner does not come forward | 50% of the value of the goods or 200% of the tax payable, whichever is higher | 5% of the value of the goods or ₹25,000, whichever is less |
| Alternative release method | Security equivalent to the applicable amount, in the prescribed form and manner | |
“Owner comes forward” is a factual and procedural question. Make the owner’s identity and willingness to assume the statutory route clear in writing instead of leaving the officer to infer it from a driver’s statement or an invoice alone.
Notice, hearing and order: the statutory clock
Section 129(3) requires the proper officer to issue a notice specifying the penalty within seven days of detention or seizure. The officer must pass the order within seven days after the notice is served. The person concerned must receive an opportunity to be heard before the penalty is determined.
Use the notice as a checklist. It should identify the movement, the alleged contravention and the proposed amount. If a date, quantity, vehicle number, tax rate, value or document reference is wrong, say exactly what is wrong and attach the record that proves it. A general statement that the detention is “illegal” is less useful than a numbered response addressing every allegation.
Write down the date and method of service for both notice and order. If the seven-day period appears to have expired, preserve proof of the dates and raise the point in the written record; do not assume that an expired period automatically releases the goods without a formal request or further legal step.

How to prepare a point-by-point objection
Match each allegation to primary documents
Create a simple schedule with one row for each alleged discrepancy: the officer’s wording, the document relied on, the factual answer, and the supporting page or electronic record. Check the description, quantity, value, tax classification, consignor and recipient details, vehicle number, e-way-bill number, validity window and the actual route.
Explain movement-specific facts
Where the issue concerns a delivery challan, trans-shipment, job work, return, branch transfer or partial load, explain the commercial reason and identify every document that supports it. If the e-way bill was updated, cancelled or extended, retain the system history and the reason for the change.
Ask for the hearing expressly
End the objection with a clear request for the opportunity of hearing before any penalty is determined under Section 129(3). Ask that your written documents and explanations be considered and that the decision address each material contention. Keep the acknowledgment, portal receipt or other proof of submission.
Choosing payment or security for release
Section 129(1) permits release against payment of the applicable penalty or against security for that amount in the prescribed form and manner. The decision is usually a business-risk judgment rather than a simple admission or denial.

| Question | Why it matters |
|---|---|
| How urgent is release? | Production stoppage, a missed delivery or spoilage can make delay more expensive than arranging immediate security or payment. |
| How strong is the documentary case? | A clear invoice, valid e-way bill and supported explanation may justify vigorous objection and a hearing; an unexplained mismatch may require a different risk assessment. |
| Can the owner come forward? | The owner’s status changes the statutory penalty formula, especially for taxable goods. |
| Can acceptable security be arranged quickly? | Security must match the applicable amount and comply with the prescribed form and process; an informal promise is not equivalent security. |
| Are the goods perishable, hazardous or depreciating? | The officer may shorten the period before disposal, so delay can create an immediate commercial loss. |
If paying to obtain release while disputing the allegation, state the objection or protest in the submission and payment record, retain the acknowledgment and obtain case-specific advice on the remedy and limitation period. Do not describe payment as an automatic waiver or as an automatic guarantee that every challenge will succeed.
Forms and records you should obtain
CBIC procedural material and the Supreme Court’s discussion of that procedure identify a sequence of electronic forms. Keep the original portal records, acknowledgments and downloads, not only screenshots or informal messages.
| Form | Practical function |
|---|---|
| MOV-06 | Detention order described in the CBIC procedure. |
| MOV-07 | Notice under Section 129(3), specifying the proposed penalty. |
| MOV-09 | Order determining or quantifying the demand. |
| MOV-05 | Release order issued after payment or accepted security. |
| DRC-07 | Electronic summary associated with the demand order in the procedure discussed by the Supreme Court. |
A release order and a reasoned order determining the demand do different jobs. Before the vehicle leaves, verify that the release order identifies the correct vehicle and goods and states the basis on which release is granted. Separately check that the formal order and electronic summary have been issued and uploaded.
Kerala SGST Department Circular 10/2022, dated 10 November 2022, illustrates why this follow-up matters: it directs online MOV-09 orders even where voluntary payment has been made through DRC-03 and links portal-based appeal processing to the order. That circular is Kerala-specific administrative guidance, so confirm the procedure in the State or Union Territory handling your case.

What happens if the penalty remains unpaid
Section 129(6) permits sale or other disposal of the detained goods or conveyance to recover the penalty if it remains unpaid within fifteen days from receipt of the order. The officer may reduce that period for perishable or hazardous goods or goods likely to depreciate.
The conveyance has a separate release rule: it must be released when the transporter pays the penalty or ₹1 lakh, whichever is less. This does not erase the goods-related dispute or determine who ultimately bears the amount between owner, transporter and other parties. Obtain proof of any transporter payment and clarify how it is recorded in the order.

In ASP Traders v. State of Uttar Pradesh, judgment dated 24 July 2025, the Supreme Court considered a case in which payment was made to secure release after objections had been filed and under protest. On those facts, the Court held that the deemed-conclusion language in Section 129(5) did not mean the taxpayer had waived the right to challenge the levy. It also held that the proper officer remained duty-bound to issue the formal order and upload its summary so the statutory appeal remedy could be used.

Transit-State jurisdiction: an issue to check, not assume
A Government of India PIB FAQ posted on 9 October 2026 describes the post-amendment position it addresses. It says inspection, detention or seizure under Section 129 may ordinarily be performed only by an officer of the State or Union Territory where the supplier or recipient is located. A State through which the goods merely pass, where neither supplier nor recipient is located, is generally expected to let the conveyance and goods proceed and send information to the jurisdictional officer.
The same FAQ states an exception where consignment information has not been furnished electronically, such as when there is no e-way bill, or where the person in charge lacks prescribed documents. In that situation an authorised officer may inspect and detain outside the supplier’s or recipient’s State. It also states that transit goods are dealt with under Section 129 read with Section 68, rather than Section 130.

After release: preserve the procedural record
- Download MOV-05 and the payment or security acknowledgment.
- Check the released vehicle number, goods description, quantity and any conditions against the physical consignment.
- Obtain MOV-09 and the electronic summary when issued; a manual release document is not a substitute for the formal demand order.
- Diary the order-receipt date, any appeal limitation date and every follow-up communication.
- Preserve the complete file, including the original objection, hearing request, officer replies, portal acknowledgments, payment records and proof of protest.
Release ends the immediate detention; it does not by itself answer whether the penalty was correctly imposed or whether a challenge remains available. The order, the dates and the record of what was paid or secured determine the next procedural step.
Common mistakes that make a detention harder to resolve
- Relying on a phone call. Ask for written orders and submit written responses with proof of delivery.
- Sending only a replacement invoice. Preserve the original records and explain any correction transparently.
- Ignoring ownership status. The owner-coming-forward distinction directly affects the statutory formula.
- Treating MOV-05 as the final demand order. Keep pursuing MOV-09 and the portal summary.
- Missing the hearing request. State it expressly before the penalty is determined.
- Waiting because goods are already released. Release does not remove the need to track the formal order and appeal dates.
- Assuming a transit State always lacks power to detain. Check the e-way-bill and document exceptions and the law effective on the interception date.
When to obtain professional help
Get a qualified GST practitioner or tax lawyer promptly if the notice uses a value or tax amount you cannot reconcile, the goods are exempt or multi-rate, ownership is disputed, the vehicle is held in a different jurisdiction, the seven-day timetable is contested, security terms are unclear, or you paid under protest and need to preserve an appeal. Give the adviser the complete served record rather than a summary from the driver or transporter.
