If your hourly rate is below the legally required minimum for the hours you worked, first verify the rule and effective date for the place where you work, then preserve your records and ask payroll to correct the shortfall in writing. If the employer does not fix it, use the labor agency, tribunal, or wage-claim process that has authority over your job. The controlling rate is not automatically the U.S. federal rate: state, local, national, or sector rules and coverage exceptions can change the answer.

1. Confirm which minimum-wage rule applies

An announced increase does not by itself tell you which paycheck should show it. The legal question is the rate that applied to the hours you worked, in the location where you performed the work, under the coverage rules for your job and employer.

Identify the work location and coverage

Check the official labor authority for the country, state or province, and city where the work occurred. Look for a special youth, trainee, tipped, agricultural, residential-care, or other sector rate, and check whether your employer or job is covered by that law. Remote workers should verify which jurisdiction governs the work location rather than assuming the employer’s headquarters controls.

Use the effective date, not the announcement date

Write down the date the new rate legally took effect. Compare it with each pay period’s work dates and your employer’s pay-cycle cutoff. A pay period can contain hours before and after the change, so the correct calculation may require two rates on one statement. Ask the agency’s guidance how it treats a change that begins partway through a pay period.

Examples from official guidance

Jurisdiction or example What the cited guidance establishes What you still must verify
United States, federal Fair Labor Standards Act (FLSA) The federal minimum wage is $7.25 per hour, effective July 24, 2009. Whether your job is covered and whether a state or local rate is higher. Where both apply, an employer must comply with both, so the more protective rate generally controls.
United Kingdom GOV.UK directs workers who believe they are below the correct National Minimum Wage or National Living Wage rate to raise the issue with the employer first. The age band, apprentice status, work dates, and rate that applied to those dates.
California The Division of Labor Standards Enforcement (DLSE) explains state minimum-wage rights and provides separate routes for an individual wage claim and a labor-law-violation report. The state, local, industry, and effective-date rules that cover your particular hours.

The U.S. federal figure is an official example, not a universal rate. A state or city can require more, and the federal FLSA does not automatically collect every promised wage above the federal minimum.

2. Recalculate the paycheck before accusing anyone

Start with the hours that should have been paid at the new rate. For each pay period, record the work date, start and finish times, unpaid or paid breaks as shown in your records, the applicable legal rate, and the gross wages actually paid. Multiply covered hours by the applicable rate, then compare that result with the straight-time wages on the statement. Keep overtime, tips, commissions, bonuses, and deductions in separate lines so you do not mistake a payroll-format difference for an underpayment.

Check the statement and time record together

  • Confirm that the statement lists the correct number of regular and overtime hours.
  • Check whether a payroll system continued to display an old hourly rate after the legal change.
  • Compare scheduled shifts with clock-in and clock-out records; a schedule alone may not show all hours worked.
  • Note any missing break, training, opening, closing, or required meeting time that you actually worked, and ask the agency whether it is compensable.
  • Separate a statutory minimum-wage shortfall from a contractual raise or promised wage. The federal DOL says the FLSA generally does not provide a wage-collection procedure for usual or promised wages above the federal minimum; state law may provide a remedy.

Make a simple difference calculation

For every affected pay period, use: (legal rate × covered hours) − wages paid for those hours = apparent shortfall. If two rates applied, calculate each date range separately. Label the result “apparent” until the agency or employer confirms how coverage, tips, deductions, and overtime rules affect it. Do not erase the original figures when payroll later issues an adjustment.

3. Build a contemporaneous evidence file

A clear paper trail makes an arithmetic correction easier and an agency review more effective. Create one folder, digital or paper, and keep copies in a place you can access outside work.

  • Pay statements for every affected period.
  • Personal time records showing each date, start and finish time, breaks, and total hours.
  • Employer time-clock exports, schedules, shift-swap messages, and training or meeting notices.
  • Your offer letter, handbook, wage notice, or classification information.
  • Announcements about the rate change and any employer message promising an adjustment.
  • Emails, texts, or portal tickets in which you asked about the discrepancy and the responses you received.
  • A running log of the date, person, and substance of each conversation.

The U.S. Department of Labor specifically recommends keeping a personal record of hours, breaks, and each payment when employer records are missing. Record facts promptly and do not alter a time sheet to match a manager’s estimate.

4. Ask payroll or your employer in writing

GOV.UK says, “Workers who think their pay is below the correct minimum wage rate should talk to their employer first.” A written, factual request gives payroll a chance to fix a setup error and creates a dated record if the matter continues.

What to include

  1. Name the legal rate and the effective date you found, and identify the official authority that published it.
  2. List the pay period and dates worked that appear affected.
  3. State the rate and hours shown on your statement and the difference you calculate.
  4. Attach or reference the relevant statement and time records.
  5. Ask payroll or HR to review the calculation, provide the underlying payment and time records, and state when any arrears will be paid.
  6. Request a written explanation if the employer believes an exception, different coverage rule, or other rate applies.

Sample message

Subject: Request to review minimum-wage rate for [pay period]
Hello [Payroll/HR name],

My records show that I worked [dates and hours] in [work location]. The official [labor authority] lists a minimum rate of [rate] effective [date]. My [pay-date] statement shows [rate paid] for those hours. I calculate an apparent difference of [amount], before any agency review of coverage or other adjustments.

Please review the rate, time records, and calculation, provide the records used, and confirm in writing how and when any arrears will be paid. If a different rate or exception applies, please identify the rule and the dates it covers.

Thank you,
[Your name]

Send it through a channel that preserves the date, such as email or a payroll portal, and save the sent copy. Keep the tone neutral; the goal is to establish the facts without surrendering any rights.

5. Choose the escalation route if the employer does not fix it

There is no single worldwide complaint process. Compare the available routes by the result you want, the agency with jurisdiction, confidentiality and retaliation rules, the deadline, and whether the process is an individual claim or a public enforcement investigation.

Route Typical purpose Key distinction
Internal payroll or HR review Informal correction and payment of an obvious calculation error Fastest first step, but it is not an independent investigation.
Labor-agency inquiry or complaint Ask a public authority to assess compliance or investigate Authority, confidentiality, remedies, and filing rules depend on the jurisdiction.
Individual wage claim Seek recovery of your own unpaid wages Often requires your records and a filing identifying the employer and amounts.
Tribunal, arbitration, or court action Pursue a formal legal remedy when administrative routes are unavailable or unsuitable Deadlines and procedural risks vary; obtain local advice before filing.

United Kingdom

After raising the issue with the employer, GOV.UK points workers to Acas for help with a payment dispute and to HM Revenue & Customs for a minimum-wage complaint. The guidance also says a worker may go directly to an employment tribunal. Any arrears owed must be paid back. Decide whether you primarily need help negotiating, an HMRC enforcement complaint, or an individual tribunal remedy, and check the applicable deadline before choosing.

United States: federal and state options

For a covered FLSA minimum-wage matter, the Department of Labor’s Wage and Hour Division (WHD) accepts inquiries and complaints. The Department states, “There are no charges to file a complaint or for the Wage and Hour Division to conduct an investigation.” State labor departments often enforce state minimum-wage laws, and a state or local rate may be more protective than the federal rate. Contact the agency whose law covers the work rather than assuming a federal filing will address every state-law issue.

California illustration

California’s DLSE describes an individual wage claim through the Labor Commissioner’s Office for workers seeking their own unpaid wages. It also describes reporting a labor-law violation, which can lead to an investigation and citation. Those routes have different purposes and procedures: a claim focuses on your recovery, while a report can support public enforcement. The California FAQ identifies retaliation protections; preserve evidence of any adverse action after you raise the issue.

6. Observe deadlines and protect yourself from retaliation

Do not wait for an indefinite payroll promise. The U.S. Department of Labor describes a two-year limitations period for non-willful FLSA violations and three years for willful violations, and advises workers to file as soon as possible. Those periods apply to the federal FLSA context described by the agency; state, local, UK, and other claims can have different deadlines or mandatory pre-filing steps.

Save dated evidence if your hours are cut, shifts disappear, discipline begins, threats are made, or another adverse action follows your wage inquiry. The cited U.S. federal and California materials describe protections against retaliation, but protections are not identical everywhere. Tell the agency about the timing and keep the underlying messages, schedules, and notices. If you belong to a union, follow any grievance deadline as well as the public-agency deadline.

7. Understand what “back pay” can mean

If the applicable law confirms that you were paid below the required rate, the remedy may include the difference for covered hours and any additional amounts authorized by that jurisdiction. The amount is not established by multiplying every paycheck by the newest rate: only hours governed by that rate count, and overtime, tips, deductions, classification, and coverage can change the calculation. An employer’s voluntary correction may appear as a separate adjustment on a later statement; keep both statements and verify that the adjustment covers every affected period.

A contractual promise to raise your pay can be enforceable under a state or other law even when it is not a federal minimum-wage violation. Describe the promise separately from the statutory shortfall when you contact an agency so the claim is directed to the rule that can address it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. Common mistakes that weaken a claim

  • Using a national or federal rate without checking the work city, state, country, or sector.
  • Treating the date an employer announced an increase as the legal effective date.
  • Relying only on a verbal conversation and keeping no dated follow-up.
  • Submitting an estimate without preserving the original statements and time records.
  • Assuming a public enforcement report automatically produces an individual payment.
  • Waiting until the longest possible deadline, even though records and memories become harder to verify.
  • Calling every promised raise a minimum-wage violation when the governing law may treat it as a contract or wage-payment claim.
  • Confronting a manager publicly or altering workplace records instead of using a documented process.

9. A practical decision checklist

  1. Locate the official minimum-wage rule for the place and dates you worked.
  2. Confirm coverage, exceptions, and whether a state, local, or sector rate is higher.
  3. Recalculate each affected pay period and label uncertain items.
  4. Collect statements, schedules, time records, notices, and communications.
  5. Send a written payroll request with the rate, effective date, dates, hours, and apparent difference.
  6. Set a reasonable follow-up date and keep the response.
  7. If unresolved, select the agency, wage claim, tribunal, arbitration, or court route with jurisdiction over your work.
  8. Check that route’s filing deadline and any retaliation-protection procedure; file promptly rather than waiting for an open-ended promise.

Because the governing rate and remedy depend on location, coverage, dates, and job classification, an official labor agency is the right place to confirm the rule before you sign a settlement or withdraw a complaint.
